This permit, issued on September 28, 2015 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may De subject to tines, imprisonment or civil action; or may cause the permit to be. tun ana votes Docking Facility 1) This permit authorizes only the dock, boatlift, and other structures and uses located in or over the water that are expresslyand specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non=water dependent uses of structures shall be conducted on, in'or'over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the. docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee I Larry Francis Permit No. 101A5 Page 2 of 3 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 1 formalized boat slip and temporary access adjacent to the floating dock. 6) In order to satisfy concerns regarding impacts to shallow bottom Primary Nursery Area (PNA) habitat, physical stops shall be placed on the boatlift at a minimum height of 18" above the bottom substrate to prevent the boat lift from disturbing the bottom substrate. Additionally, physical stops shall be placed on the floating dock at a minimum height of 24" above the bottom substrate to prevent the floating dock from disturbing the bottom substrate. The stops shall remain in place for the life of the docking facility. 7) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 8) No portion of the authorized docking facility, including tie piles, shall extend more than one quarter of the width of the water body. Measurements to determine width of the water body shall be made from the waterward edge of any coastal wetland vegetation which borders the water body. 9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 10) Any portion of the permitted access pier and docking facilities built over coastal wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 11) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 12) The roof of the covered platform shall not be designed for second story use. 13) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Larry Francis Permit No. 101-15 Page 3 of 3 General 14) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. The permittee and/or his or her contractor shall meet with a representative of the Division prior to projectinitiation. No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: NOTE: NOTE: NOTE: NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2015-01264), which was issued on 7/7/15. The N.C. Division of Water Resources assigned the proposed project DWQ Project No. 15-0580. Future development of the permittee's property. may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. It is the staffs recommendation that the proposal to construct a private docking facility with a gazebo, floating dock, and boatlift is CONSISTENT with the Rules of 15 NCAC 7H.0205 (d) Use Standards for Coastal Wetlands, Rules of 15 NCAC 7H.0206 (d) Use Standards for Estuarine Waters, Rules of 15 NCAC 7H.0207 (d) Use Standards for Public Trust Areas. The construction of the pier with gazebo, floating dock, and boatlift would provide docking space for two (2) vessels. It is staffs recommendation that the proposal to construct a private docking facility with a gazebo, floating dock and boatlift is CONSISTENT with the Rule in 15 NCAC 7H.0208 (b) (6) (G) (iii) which states "Pier and docking facility length shall be limited by: not extending more than one-fourth the width of a natural water body, or human -made canal or basin. Measurements to determine widths of the water body, canals or basins shall be made from the water ward edge of any coastal wetland vegetation that borders the water body. The one-fourth length limitation shall not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier head line. The one- fourth length limitation shall not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall -not be longer than the pier head line established by the adjacent piers or docking facilities, nor longer than one- third the width of the water body." The proposed pier does conform to the quarter width limitation, would be located approximately 80 feet from the edge of the 80 foot federal channel setback and would not exceed the established pier head line. Due to the limited amount of water, approximately -0.70 to -1.30 feet at MLW located adjacent to the proposed docking facility as shown in the attached drawings, there could be potential for bottom disturbance and displacement of the substrate "kicking" by vessel propellers to access the docking facility at periods of low water. This office supports the recommendations of the resource agencies, particularly the NC Division of Marine Fisheries, regarding potential impacts to shallow bottom within primary nursery areas. Should concerns be expressed over potential impacts from any of the resource agencies, the project could then be found to be inconsistent with NCAC 07H .0208(a)(2), which requires that the location, design and need be consistent with the management objective of the Estuarine System AEC and the project be sited and designed so as to avoid significant adverse impacts upon the productivity and biological integrity of spawning and nursery areas. Recommendations for State Permit — Larry Francis 06/09/15 page 2 The project is CONSISTENT with the Rules of NCAC 07H .0208(b)(6) Use Standards for Piers and Docking Facilities. As proposed, it is the opinion of this office, in the absence of any concerns from the commenting resources agencies, that it is recommended any permit issued should include the following conditions: This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of the structure without permit modification. No non -water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 3. The authorized structure and associated activity must not cause an unacceptable interference with navigation and shall not exceed the established pier head line. 4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. 5. The pier/boathouse and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 6. This permit does not authorize the interference with any existing or proposed Federal project, and, the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 7. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without having the permit transferred to a third -party. 8. This permit authorizes a maximum of two (2) boat slips. At no time shall more than two (2) vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. The applicant proposes to construct a pier with gazebo and a4loating dock with 2 available slips. The adjacent waters are classified as Coastal Wetlands (CW), Primary Nursery Area (PNA), supports shellfish harvest (SA) and are 'open to shellfishing by the NC Division of Marine Fisheries Shellfish Sanitation Section. In addition a site visit noted extensive shell hash within the coastal wetlands extending out into deeper water. PNA's are estuarine waters where initial post -larval development occurs. Species within this area are early post -larval and juvenile and include finfish, crabs, and shrimp. ,Specie's inhabit PNA's because,they afford food and protection during vulnerable per of their life history. Shell bottom is an extremely productive self -building three dimensional habitat that can be impacted long term through dredging and filling, pollution and other contaminants. This vital estuarine habitat is very limited in North Carolina. Depths at the floating dock are approximately 0:70ft. to 1.30ft, at mean low water (MLW). The end of the pier has approximately 25ft. of shallow water to traverse before reaching the Atlantic Intercoastal Waterway (AIW W). The project, as proposed, would likely cause significant adverse effects to the surrounding habitat. The second "floating" boat slip, as described, would allow a vessel to impact the PNA substrate directly and consistently during low tide. To reduce potential direct impacts to PNA habitat associated with this application, the following recommendations are provided. The second boat slip should have a boat lift installed to reduce the potential forvessel impact with the substrate. The floating dock and both boat lifts should be conditioned with 24" stops to reduce the potential for.PNA substrate impact.. Finally, wording should be added to any permit issued addressing the importance of reducing the potential for prop "kicking" from occurring within the vicinity of the boat lifts. The project site is located at 516 Twisted Oak Lane adjacent the AI W W in Sunset Beach, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-I00 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proses to construct a private pier with gazebo, floating dock, and boat lift to provide mooring for two vessels. The 6' wide access pier and dock would shade approximately 1,974 ft' of coastal marsh. Water depths in the proposed slip area range between -0.7' to -1.3' at MLW. Adjacent properties have similar structures. The AIWW in this location is classified SA by the Environmental Management Commission, is designated a primary nursery area (PNA) by the NC Division of Marine Fisheries, and is open to shellfish harvesting. The NCWRC has reviewed the permit application and is concerned with the impact to shallow water habitats due to low water depths and the disturbance of bottom sediments during vessel ingress and egress. We do not generally support slips in water depths less than -2' NLW when located within PNA and open shellfish waters and would prefer the structure to be only an observation platform. PROJECT DESCRIPTION: The project site is located at 516 Twisted Oak Lane, adjacent to the Atlantic Intracoastal Waterway (AIWW), in Sunset Beach, Brunswick County. To locate the property from US 17 S near Shallotte, travel south to NC Highway 904 turn left and travel approximately 3.5 miles to the intersection of Beach Drive SW(HWY 179). Turn right onto Beach Drive SW and travel approximately 0.25 miles to Park Road and turn left. Travel approximately 0.4 miles to Shoreline Drive East and turn right. Follow Shoreline Drive East approximately 0.35 miles to Twisted Oak Lane. The property is located on the left side of the road. The property consists of a 1.72 acre platted lot, with an approximate 20,000 square feet of high ground property. According to the Brunswick County GIS website the property appears to be platted beyond Mean High Water and depicts and area of private ownership over the intertidal marsh and extending for a distance of approximately 515 feet towards the waterway. The property is bordered by Twisted Oak Drive to the north, residential properties to the east and west and the AIWW to the south. The property has approximately 111 feet of shoreline frontage along the rear of property and is stabilized with natural vegetation. The high ground portion of the property ranges from approximately 2 feet to 12 feet above mean high water (MHW) and is primarily vegetated with native trees, shrubs and grasses. The high ground of the property transitions to an area of mixed coastal and 404-type wetlands, which ranges from approximately 15 feet to 50 feet in width to the Mean High Water (MHW) boundary. Wetland vegetation consists of: Salt Meadow Hay (Spartina patens), Spike Grass (Distichlis spicata), Sea Lavender (Limonium spp.), Sea Oxeye (Borrichia frutescens), Groundsel-bush (Bacchorus halimifolia) and Wax Myrtle (Myrica cerfera). The property then transitions, from the MHW boundary water ward, to an area of low marsh consisting of Smooth Cord Grass (Spartina alterniflora). The Spartina extends approximately 300 feet and the Mean Low Water (MLW) contour is located approximately 50 feet water ward of the edge of vegetation (see sheet 2 of 2). The Town of Sunset Beach Land Use Plan classifies the upland areas of the project site as undeveloped. The waters of the AIWW are classified SA by the Division of Water Quality. The project area is designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and is OPEN to the harvest of shellfish. 10. PROPOSED PROJECT: The applicant proposes to construct a private pier with a gazebo, floating dock and boat lift. As proposed, the access pier would measure approximately 479 feet in length, of which 460 feet would extend beyond the MHW boundary. The proposed access pier would measure 6 feet in width and would extend to the south from the high ground of the property towards the AIWW. The access pier would then begin to span the wetlands located above MHW for a distance of approximately 20 feet to the MHW boundary. The proposed 6 feet wide pier would then extend approximately 300 feet to the water ward edge of vegetation. The proposed access pier would continue over open water toward the AIWW channel for a distance of approximately 139 feet. The pier would then terminate at a covered T-head platform measuring approximately 16 feet in width by 20 feet in length, as measured from the roof drip line. The proposed gazebo would be connected by an access ramp to a proposed 8 feet wide by 16 feet long floating dock that would extend to the east and would be oriented perpendicular to the AIWW channel. A boatlift, measuring approximately 17 feet in length by 10 feet in width, would be installed between the proposed floating dock and gazebo. The applicant states that the existing water depths in the location of the proposed floating dock and boatlift range from approximately -0.70 feet to -1.30 feet at Mean Low Water (see sheet 2 of 2). As proposed, the structure would provide docking space for two (2) vessels; one lift slip and one slip on the outboard edge of the proposed floating dock. The applicant states the width of water body in this location of the AIWW is approximately 585 feet. As proposed, the docking facility would extend approximately 460 feet water ward of Mean High Water and approximately 140 feet water ward of the edge of marsh. As proposed, the docking facility would be aligned to meet the quarter width of the water body distance and as proposed, would not exceed the established pier head line and would be approximately 85 feet from the federal channel setback in this location. The proposed pier system construction would incorporate approximately 1,338 sq. ft. of Estuarine Waters and Pubic Trust Area and would shade approximately 1,974 sq. ft. of Coastal Wetlands, consisting primarily of Smooth Cord Grass. The proposed access pier would result in the disturbance of approximately 120 feet of high marsh. Water depths in the vicinity of the proposed floating dock and boatlift range from -0.70 to -1.30 feet at MLW. As proposed, there could be potential for bottom disturbance and displacement of the substrate "kicking" by vessel propellers to access the docking facility at periods of low water. Minor increases in turbidity should be expected during construction. The proposed docking facility would extend a total distance of approximately 460 feet into the water body as measured from the mean high water boundary of which approximately 140 feet would extend into open water within a water body which measures approximately 585 feet in width. This distance would conform to the 1/4 width rule and would not exceed the established pier head line. The structure, as proposed, would not encroach into either of the adjacent 15' riparian corridor setbacks or the 80 foot federal channel setback. The pier and dock will be constructed using treated southern yellow pine. Materials needed for construction across marsh will be brought to applicants lot. Pilings (6 X 6 ) will be put in place using 2 man motorized auger. Joist, cross bracing, decking will be put in by hand labor using galvanized bolts and nails. Once a 16' section of pier is put in place, materials will be carried over that section and each succeeding section until the end of the marsh is reached. Pilings at water will be transported and put in place by work barge. When pilings are in place, the remainder of framing materials will be carried on previously constructed portion of pier and manually framed to new pilings until the full length of the pier is reached. Picket rails will enclose pier and stationary dock. Aluminum ramp will connect stationary dock to fixed dock. Boat lift will be installed for 17' boat between floating dock and stationary dock. An 8' X 8' covered dock will be built on right side of the fixed dock closest to land with shingle roof. Electrical service per code will be installed to operate boat lift and lights. Water line will be installed for boat, general, and maybe some fish cleaning.
