This permit, issued on November 13, 2015 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Docking Facility
1) This permit authorizes only the dock, pier, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the pennittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2018
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes one formalized boat slip.
6) To protect sensitive shallow bottom habitat the authorized boat lift shall have mechanical stops installed
to maintain a minimum of twenty four (24) inches between the authorized boat lift and the substrate.
These stops shall remain in place for the life of the permitted structure.
7) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and
shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are
permitted. Lattice is specifically excluded from being used under this authorization.
8) The roof of the covered gazebo shall not be designed for second story use.
9) The docking facility and associated structures shall have a minimum setback distance of 15 feet between
any parts of the structure and the adjacent property owner's riparian access corridor to the west, which is
determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel
line that intersects with the shore at the point where the upland property line meets the water's edge.
NOTE: Should the adjacent property to the east be sold prior to the initiation of construction, the
permittee shall be required to obtain a signed riparian corridor waiver from the new property
owner prior to the placement of any structures within the 15 foot riparian corridor.
10) No portion of the docking facility shall exceed one quarter of the width of the water body as depicted on
the attached workplan drawings.
11) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
12) Any portion of the permitted access pier and docking facilities built over coastal wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.
13) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation
within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is
not authorized. This prohibition shall be applied and enforced throughout the entire existence of the
permitted structure.

General
14) To reduce direct impacts to oyster resources, the permittee shall, in consultation with DCM, relocate all
oysters falling within the footprint of pilings to an area immediately adjacent to the project area.
15) The permittee and/or his'or her contractor shall meet with a representative of the Division prior to
project initiation.
16) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
17) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit
197800056 (Action ID No. SAW-2015-02182).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 3883 and assigned the project DWR Project No. 20071367 V5.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or
113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, [phone] within twenty (20) days of
this decision on your permit. You should also be aware that another qualified party may submit an objection to the issuance
of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried
out in accordance with your application. Modifications, time extensions, and future maintenance requires additional
approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are
having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance.

9. Narrative Description:
The lot 53 project is located at 1404 Mainsail Road of Oglesby Rd which is part of the existing
Mariners Point subdivision. Mariners Point was permitted through major permit # 167-07 for
infrastructure,149 lots and a docking facility. Oglesby Rd. is found by turning right off of N.
20'b St. in Morehead City in the area locally known as Crab Point. Dill Creek borders this site
to the east and north.
Lot 53 is .287 acres (12,520sf) in its entirety and is an average of 3.5' above NHW. A fringe
(Approximately 16,500 sf) of Coastal Wetlands is present along the shore adjacent to Dill
Creek. This fringe contains Smooth Coordgrass (Spartina alterniflora), and Salt Meadow
Grass (Spartina patens). There are also are expanses of oyster beds within the waters of Dill
Creek adjacent to the proposed dock. The water depths in Dill Creek, according to the
applicant, reach -2.2' NLW at the waterward end of the proposed structure. Field work
confirms the soundings. The substrate in this area is thick organic mud.
This section of Dill Creek is a Primary Nursery Area as designated by the Division of Marine
Fisheries and the Division of Water Quality classifies it as SA/HQW waters. The area in
which the proposed project would take place is closed to the taking of shellfish. Morehead
City's Land Use Plan dated 2007 classifies this area as Low Density Residential and
Conservation within the AECs.
10. Project Description: RECEIVED

The applicant is proposing a 6' x 325.2' pier, 12' x 14' covered platform, a 5' x 20' floating
finger pier and an 11' x I I' boatlift. They are not proposing any upland devel t t

The pier would cross high ground for approximately 10' of coastal wetlands and oyster beds.
for approximately 315'with a total length of 325.2'. It would then intersect a 14' x 12'
covered platform. A 3'x 10' gangway would extend off the northwest side of the covered
platform and connect to a 5' x 20' floating finger pier (located on the northwest side). There
would be an 11' x I V boatlift installed on the east side of the floating finger pier. A total of 1
slip (with boatlift) is proposed. The water depths along the platform area are -2.2' nlw. The
most water ward portion of the structure would be located approximately 10' landward (sw) of
the edge of the existing channel.
The Division has determined that the configuration of marsh and oyster beds along the
shoreline of this property establishes the point from which to measure the water body for the
immediate area, creating a width of 152.9'. In consideration of this, the projection into the
water body by the structure consequently would be approximately 38' into the 152.9' body of
water. The pier and platform would be located 15' from the west riparian corridor, 19' from
the east riparian corridor and approximately 400' from the community pier to the east.

subdivision as well as through field visits and aerial photography and are drawn relative to the
channel location. All water depths as well as the outermost limit of the oyster rock, channel
location and water body width have been field verified.
11. Anticipated Impacts:
The proposed pier as would incorporate 60 ftz of high ground while shading and
incorporating 1,837ft2of coastal wetlands and oyster beds. A total 419 ft2 of open water of
would be shaded and incorporated by the pier. Oyster beds containing healthy populations
existing along the shoreline would be disturbed during the construction process as well as
temporary turbidity during piling placement. The Division of Land Resources approved the
Sedimentation and Erosion control plan (CARTE-2006-440) on 6/19/06 with the DWQ
Stormwater permit #SW8060625 issued on 7/12/06 for the existing s/d. Based on the
determination of the water body widths by the Division and the District, the structure
should not cause a hindrance to navigation due to the location of the existing oyster beds.
The oyster beds/coastal wetland area terminates approximately 340' waterward of NHW.
The channel edge is located 50' from the edge of the oyster beds.

The following are my comments and recommendations regarding the aforementioned proposal. The
proposal is for the construction of a fixed pier with a covered platform, floating finger pier and a boat lift (1
slip). The water depths within this area are an average of -2.2' nlw.
The proposed development is consistent with 15A NCAC 7H.0208. The Morehead City District office
recommends the project be authorized as proposed on plats dated received 9/17/15 contingent upon all
applicable general conditions and the following standard conditions:
The pier, platform, finger and boatlift should not exceed a maximum distance of 350' waterward of
NHW and should not exceed a maximum of 38' from the oyster bed/coastal wetland edge due to
the 152.9' wide water body width as well as the channel location.
No more than one slip (with lift) is authorized.

Consistency Determination:
This project is consistent with the Carteret County Comprehensive Land Use Plan Update.
The applicant proposes to construct a pier, platform with a covered area, floating finger
pier and boatlift for lot 53 of the Mariners Point subdivision. The project is located at
1404 Mainsail Drive in Morehead City adjacent to Dill Circle.
I have reviewed this proposal for consistency with the Carteret County Land Use Plan
and offer the following comments.
The general area of the project is classified as Low Density Residential/Conservation.
Waters at the project site are classified as SA/HQW and are not open to the harvesting of
shellfish. The area is a Primary Nursery area. Areas of Environmental Concern are CW,
EW and PTA.
Carteret County allows development in Conservation classified AECs, which is
consistent with the State's minimum use standards. The Carteret County Comprehensive
Land Use Plan contains some policies, which exceed the State's minimum use standards.
However, none of these policies appear to be applicable to this project.
This project appears to be consistent with the Carteret County Comprehensive
Land Use Plan Update.

You have our approval; in accordance with the attached conditions and those listed below to construct a
pier; platform with a covered area, floating finger pier and boatliftas described in your CAMA
application dated October 1, 2015 and received by the Division of Water Resources (DWR) on October 5;
2015. After reviewing your application, we have decided that the,impacts are covered by General Water
Quality.Certification Number 3883 (GC 3883). This Certification allows you to use the General Permit
198700056when issued by the US Army Corps of Engineers and the CAMA.Major Permit when issued by
the Division of Coastal Management. Inaddition, you should obtain or otherwise comply with any other
required federal, state or local permits before you go ahead with your project including (but not limited
to) Erosion and Sediment Control, Non -discharge, and stormwater regulations. Also, this approval to
proceed with your proposed impacts or to conduct impacts to waters as depicted in your application
shall expire upon expiration of the General Permits or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is
sold, the. new owner must be given a copy of this General Certification and approval letter and is
thereby responsible for complying with all conditions. If total fills for this project (now or in the future)
exceed one acre of wetland or 150 linear feet of stream,.compensatorymitigation may be required as
described in 15A NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the
attached certification and any additional conditions listed on the following pages.
The Additional Conditions of the Certification are:
1. This approval is for the purpose and design described in your application. The plans and specifications for
this project are incorporated by reference as part of the Certification. If you change your project, you must
notify the Division and you may be required to submit a new application package with the appropriate fee.
Ifthe property is sold, the new owner must begiven a copy of this approval letter and General Certification
and is responsible for complying with all conditions. Any new owner must notify the Division and request
the Certification be issued in their name {15A NCAC 02H .0501 and .0502).

No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond
the footprint of the impacts depicted in the application. All construction activities,_ including the
design, Installation, operation, and maintenance of sediment and erosion control Best Management,
Practices, shall be performed so that,no violations of state water quality standards, statutes, or rules
occur .Approved plans and specifications for this project are incorporated by reference and are
enforceable parts of this permit f15A NCAC.02H .0501 and .0502).
3. Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded as
described in 15 A NCAC 2B. M21. Appropriate.sediment and erosion control practices must be used
to meet this standard. Turbidity curtains hall be used as appropriate. Please notify this Office if'
any turbidity. issues arise at 916.796.7215
4. Primar4 Nursery'Area (PNAI
Please understand that the waters around your project area have been identified by the Division of
Marine Fisheries as Primary Nursery Area (PNA). Should the need for dredging within the proposed
project area. arise in the future, please be aware that new dredging within a PNA is, not allowed
under lSA NCAC 028.0221 and is a degradation of water quality standards and therefore
considered a water quality violation. [15A NCAC,02B .0221]
5. Any final construction plans: for this project must include or reference the application and plans
approved by the DWR under the authorization letter and certification. The applicant will also be
required'to evaluate all acquired permits to assure that'they are consistent and all relative
Impacts are accounted for and shown on the construction plans .[35A NCAC 02H .0502 (b) and i5A
NCAC',02H .0506(4)j
6. The permitee shall require -its contractors and/or agents to comply with'the terms of this permit in
the construction and maintenance of this project, and shall provide each of its contractors and/or
agents associated with the construction or maintenance of this project a copy of this certification. A
copy of this certification including all conditions shall be available at the project site during the

All mechanized equipment will be regularly inspected and maintained to prevent contamination of
waters and wetlands from hydrocarbons or'other potential toxic chemicals. In the event of a
hydrocarbon or chemical spill, the permitee/contractor shall immediately contact the Division of
Water Quality, between the hours of 8 am to 5 pm at the Wilmington Regional Office at.
910.796.7215 or Steve Lewis at 919SO7.63' and after hours and on weekends call the USCG
National Response Centerat 1.800.424.8802, management of such spills shall comply with
provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act. [15A NCAC 02H

8. Fueling, lubricationand general equipment maintenance should not take place within 50 feet of a
waterbody or Wetlands to prevent contamination by fuel and oils. [15A NCAC 02H .0506 (b)(3) and
(c)(3) and 15A NCACr02B .0200 (3)(f)]
9. This General Certification shall expire on the same day as the expiration date of the corresponding
General. Permit. The conditions in effect on the date of.issuance of the Certification fora specific
project shall remain In effect for the life of the project, regardless of the expiration of this
Certification.
Continuing Compliance:
10. The applicant/permitee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from compliance
with 303(d) of the Clean Water Act), and any other appropriate requirements of State and Federal
law. Ifthe-Division determines that such standards or laws are not.being met, including failure to
sustain a designated or achieved use, or that State or Federal law is being' violated, or that further
conditions are necessary to assure compliance, than the Division may reevaluate and modify this
General Water Quality Certification. [15A NCAC 02H .0507(d)]
11. Certificate of Completion
The applicant and/or authorized agent shall provide'a completed Certificate of Completion form to
the Division within 30 (thirty) days of project completion. Mail to: NCDEQ DWR 401 and Buffers Unit

12. This certification grants permission to the director, an authorized representative of the Director, or
DEQ staff, upon the presentation of proper credentials, to enter the property during normal
business hours (15A NCAC 02H .0502 (e)).
Violations of any condition herein set forth may result In revocation of this Certification and may
result In criminal and/or civil penalties. The authorization to proceed with your proposed.impacts.or to
conduct' impacts to waters as depicted in your application and as authorized by this Certification shall
expire upon expiration of the 404 or CAMA Permit.
If you wish to contest any conditions in the enclosed certification (associated with the approved wetland
or waters impacts) you must file a petition for an administrative hearing. You may obtain the petition

SUBJECT: CAMA Dredge/Fill Permit Application for Brian Fowler, Carteret County
North Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the
permit application with regard to impacts on fish and wildlife resources. The project site is located at
1404 Mainsail Drive, lot #53 in the Mariner's Point subdivision in Morehead City, NC. Our comments
are provided in accordance with provisions of the Coastal Area Management Act (G. S. 113A-100 through
113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to construct a 6' by 325.2'pier, a 12' by 14' covered platform, a 5' by 20'
floating forger pier, and a I I' by I F boatlift. The pier would cross coastal wetlands and oyster beds for
315'to intersect with the platform Water depths at the platform are from -2.2' NLW. Due to resource
concerns during the original subdivision development, each lot must apply for a major permit for
individual docks. Dill Creek is classified SA HQW by the Environmental Management Commission and
is designated a primary nursery area (PNA) by the NC Division of Marine Fisheries.
The NCWRC has reviewed the permit application and supports recommendations presented by
the NC Division of Coastal Management's fisheries specialist and / NC Division of Marine Fisheries.
However, we would like to state our concerns with the project. The structure terminates with a floating
forger pier and boadift. To minimize impacts to the shallow water habitat of a PNA, stops should be
incorporated into the floating finger pier design so the structure rests at a minimum 18" above the bottom
substrate. PNAs are defined as those areas inhabited by the embryonic, larval or juvenile life stages of
marine or estuarine fish or crustacean species due to favorable physical, chemical or biological factors. As
a designated PNA, the creek provides an important rearing area for this variety of estuarine fishes and
invertebrates that need relatively undisturbed habitats.

floating dock with an 11' x 11' boatlift. The project located in Dill Creek, a small tidal creek, will span
coastal wetlands, soft mud bottom, and oyster bars. The waters are classified as PNA (Primary Nursery
Area) by the DMF (Division of Marine Fisheries); a PNA habitat is an area that has been deemed critical
to the larval and juvenile life -stages of fish and shellfish. A site visit by DCM staff on 10/14/15 to the
area revealed an extensive oyster resource throughout the waterbody as well as an abundance of
shrimp and finfish. The edge of the marsh, mudflat, and oysters are dry at low tide and drop off rapidly
to approximately.2' NLW at the channels edge in the proposed dock location.
The site conditions appear sufficient to support the requested boat facilities but to protect sensitive
habitat in the project area precaution should be taken to avoid and minimize impacts to the resource
where possible during construction. Additionally to protect the oyster and soft bottom habitat present
in Dill Creek the floating pier and boat lift should be conditioned to have stops installed 24" above
substrate to prevent the floating dock from resting on bottom during low tide and to the help limit use
of the boat lift during low tides when bottom disturbance from prop kicking could occur.

During project construction care should be taken to minimize disturbance to the oyster resources
present by leaving oyster beds in place and not smothering oysters with equipment or sediment.
However where impacts are unavoidable due to piling placement or the need to get equipment to the
project site the oysters should be moved to an area of open bottom adjacent to the project area.

Bogue Banks Marine Construction, acting as agent for Brian Fowler, is requesting a CAMA Major
permit in accordance with the Mariners Pointe Subdivision's CAMA Major Permit conditions. The project
consists of a 6' x 325.2' dock, 12' x 14' platform with roof, a 5' x 20' floating finger pier and an 11' x 11'

The NC Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development of your property located on Dills Creek in Carteret County. The site is at
404 M'sail Road in Morehead City, Carteret County. The application was received as complete on
and appears to be adequate for processing at this time. The projected deadline for making a
decision is 12/l/15. An additional 75-day review period is provided by law when such time is necessary
to complete the review. If you have not been notified of a final action by the initial deadline stated
above, you should consider the review period extended. Under those circumstances, this letter will
serve as your notice of an extended review. However, an additional letter will be provided on or about
the 75th day.
If this agency does not render a permit decision within 70 days from 9/17/15, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status
of your project Such a meeting will be held within five working days from the receipt of your written
request and shall include the property owner, developer, and project designer/consultant
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development You should post this notice at a conspicuous point along
your property where it can be observed from a public road. Some examples would be: Nailing the
notice card to a telephone pole or tree along the road right-of-way fronting your property, or at a point
along the road right-of-way where a private road would lead one into your property. Failure to post
this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by
the appropriate State or Federal agency. Please contact me if you have any questions and notify me in
writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.
