X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 Excavation and/or filling pursuant to NCGS 113-229 Issued to Brian K. Fowler, 712 Arendell Street Apartment 211, Morehead City NC 28557 Authorizing development in Carteret County at adjacent to Dill Creek, 1404 Mainsail Drive in Morehead City , as requested in the permittee's application dated 09/17/15 including attached worknlan drawinas (1-2 of 2) both dated 06/22/15. This permit, issued on November 13, 2015 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Docking Facility 1) This permit authorizes only the dock, pier, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the pennittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Fowler Permit No.129-15 ' Page 2 of 3 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes one formalized boat slip. 6) To protect sensitive shallow bottom habitat the authorized boat lift shall have mechanical stops installed to maintain a minimum of twenty four (24) inches between the authorized boat lift and the substrate. These stops shall remain in place for the life of the permitted structure. 7) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 8) The roof of the covered gazebo shall not be designed for second story use. 9) The docking facility and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor to the west, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. NOTE: Should the adjacent property to the east be sold prior to the initiation of construction, the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15 foot riparian corridor. 10) No portion of the docking facility shall exceed one quarter of the width of the water body as depicted on the attached workplan drawings. 11) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 12) Any portion of the permitted access pier and docking facilities built over coastal wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 13) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Fowler Permit No. 129-15 Page 3 of 3 ADDITIONAL CONDITIONS General 14) To reduce direct impacts to oyster resources, the permittee shall, in consultation with DCM, relocate all oysters falling within the footprint of pilings to an area immediately adjacent to the project area. 15) The permittee and/or his'or her contractor shall meet with a representative of the Division prior to project initiation. 16) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 17) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2015-02182). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 3883 and assigned the project DWR Project No. 20071367 V5. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: An application processing fee of $250 was received by DCM for this project. Narrative Description: The lot 53 project is located at 1404 Mainsail Road of Oglesby Rd which is part of the existing Mariners Point subdivision. Mariners Point was permitted through major permit # 167-07 for infrastructure,149 lots and a docking facility. Oglesby Rd. is found by turning right off of N. 20'b St. in Morehead City in the area locally known as Crab Point. Dill Creek borders this site to the east and north. Lot 53 is .287 acres (12,520sf) in its entirety and is an average of 3.5' above NHW. A fringe (Approximately 16,500 sf) of Coastal Wetlands is present along the shore adjacent to Dill Creek. This fringe contains Smooth Coordgrass (Spartina alterniflora), and Salt Meadow Grass (Spartina patens). There are also are expanses of oyster beds within the waters of Dill Creek adjacent to the proposed dock. The water depths in Dill Creek, according to the applicant, reach -2.2' NLW at the waterward end of the proposed structure. Field work confirms the soundings. The substrate in this area is thick organic mud. This section of Dill Creek is a Primary Nursery Area as designated by the Division of Marine Fisheries and the Division of Water Quality classifies it as SA/HQW waters. The area in which the proposed project would take place is closed to the taking of shellfish. Morehead City's Land Use Plan dated 2007 classifies this area as Low Density Residential and Conservation within the AECs. 10. Project Description: RECEIVED OCT 202015 The applicant is proposing a 6' x 325.2' pier, 12' x 14' covered platform, a 5' x 20' floating finger pier and an 11' x I I' boatlift. They are not proposing any upland devel t t time. D C Is`Y The pier would cross high ground for approximately 10' of coastal wetlands and oyster beds. for approximately 315'with a total length of 325.2'. It would then intersect a 14' x 12' covered platform. A 3'x 10' gangway would extend off the northwest side of the covered platform and connect to a 5' x 20' floating finger pier (located on the northwest side). There would be an 11' x I V boatlift installed on the east side of the floating finger pier. A total of 1 slip (with boatlift) is proposed. The water depths along the platform area are -2.2' nlw. The most water ward portion of the structure would be located approximately 10' landward (sw) of the edge of the existing channel. The Division has determined that the configuration of marsh and oyster beds along the shoreline of this property establishes the point from which to measure the water body for the immediate area, creating a width of 152.9'. In consideration of this, the projection into the water body by the structure consequently would be approximately 38' into the 152.9' body of water. The pier and platform would be located 15' from the west riparian corridor, 19' from the east riparian corridor and approximately 400' from the community pier to the east. Riparian corridors where determined on the original major permit submittal for the Field Investigation Report: Fowler Lot 53 Mariners Point Page 03 subdivision as well as through field visits and aerial photography and are drawn relative to the channel location. All water depths as well as the outermost limit of the oyster rock, channel location and water body width have been field verified. 11. Anticipated Impacts: The proposed pier as would incorporate 60 ftz of high ground while shading and incorporating 1,837ft2of coastal wetlands and oyster beds. A total 419 ft2 of open water of would be shaded and incorporated by the pier. Oyster beds containing healthy populations existing along the shoreline would be disturbed during the construction process as well as temporary turbidity during piling placement. The Division of Land Resources approved the Sedimentation and Erosion control plan (CARTE-2006-440) on 6/19/06 with the DWQ Stormwater permit #SW8060625 issued on 7/12/06 for the existing s/d. Based on the determination of the water body widths by the Division and the District, the structure should not cause a hindrance to navigation due to the location of the existing oyster beds. The oyster beds/coastal wetland area terminates approximately 340' waterward of NHW. The channel edge is located 50' from the edge of the oyster beds. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 1404 Mainsail Drive, lot #53 in the Mariner's Point subdivision in Morehead City, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G. S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to construct a 6' by 325.2'pier, a 12' by 14' covered platform, a 5' by 20' floating forger pier, and a I I' by I F boatlift. The pier would cross coastal wetlands and oyster beds for 315'to intersect with the platform Water depths at the platform are from -2.2' NLW. Due to resource concerns during the original subdivision development, each lot must apply for a major permit for individual docks. Dill Creek is classified SA HQW by the Environmental Management Commission and is designated a primary nursery area (PNA) by the NC Division of Marine Fisheries. The NCWRC has reviewed the permit application and supports recommendations presented by the NC Division of Coastal Management's fisheries specialist and / NC Division of Marine Fisheries. However, we would like to state our concerns with the project. The structure terminates with a floating forger pier and boadift. To minimize impacts to the shallow water habitat of a PNA, stops should be incorporated into the floating finger pier design so the structure rests at a minimum 18" above the bottom substrate. PNAs are defined as those areas inhabited by the embryonic, larval or juvenile life stages of marine or estuarine fish or crustacean species due to favorable physical, chemical or biological factors. As a designated PNA, the creek provides an important rearing area for this variety of estuarine fishes and invertebrates that need relatively undisturbed habitats.
