Health, and Natural Resources and the Coastal Resources Commission for development In an area of environment concern pursuant to Section 113A-118 of the General Statues, "Coastal Area Management Issued to Mr. Ken Miller, authorizing the construction of a 138 lin. ft. retaining wall and prox. 200sq.ft. sun deck, in the ORW shoreline AEC at 2535 Middle Sound Loop Rd, Wilmington, NC s requested in the permittee's application dated August 1, 2003. This permit, issued on ril 25, 2003 is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject ".'permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. ♦ A copy of this permit shall be available onsite for regulatory inspection. ♦ An undisturbed buffer zone of a least thirty feet from the mean high water (normal water line) must be maintained at all times. ♦ All proposed development and associated construction must be done in accordance with the permitted workplat drawings as submitted and amended. ♦ All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations. ♦ Any change or changes in the plans for development, construction or land use activities will require a re-evaluation and modification of this permit. ♦ The amount of built -upon area shall be limited to no more than 25% of the 575' Area of Environmental Concern area of the land to be developed. ♦ No filling or development within any Federally regulated 404 wetlands is authorized. ♦ No sediment or building materials can be allowed to enter the marsh grasses or waterilt fence or other protective barriers(s) must be placed and maintained between the distur d area and any 404 wetlands or coastal wetlands, to keep sediment from entering those areas. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing dale. From the date of an appeal, any work conducted under this permit must cease unfit the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All work must cease when this permit expires on December 31. 2006. In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances.
