in an area of environment concern pursuant to Section 113A-118 of the

Permit Number
Issued to Mr. Thomas Smith, authorizing the construction of a single family residence, in the ORW shoreline AEC at 279
Shannon Drive, as requested in the permittee's application dated June 18, 2003. This permit, issued on September 17,
2003, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable
regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine,
imprisonment or civil action; or may cause the permit to be null and void.
♦ Per Revised Site Plan dated August 7, 2003 and received in this office on September 15,
2003.
♦ NO encroachment into the "404" wetlands allowed. NO sediment or building materials can
be allowed to enter the marsh grasses or waters. Silt fence or other protective barriers(s)
must be placed and maintained between the disturbed area and any 404 wetlands or coastal
wetlands, to keep sediment from entering those areas.
♦ A copy of this permit shall be available onsite for regulatory inspection.
♦ An undisturbed buffer zone of a least thirty feet from the mean high water (normal water line)
must be maintained at all times.
♦ All proposed development and associated construction must be done in accordance with the
permitted workplat drawings as submitted and amended.
♦ All construction must conform to the N.C. Building Code requirements and all other local, State
and Federal regulations.
♦ Any change or changes in the plans for development, construction or land use activities will
require a re-evaluation and modification of this permit.
♦ The amount of built -upon area shall be limited to no more than 25% of the 575' Area of
Environmental Concern area of the land to be developed; in this case, 1,988 square feet built
upon.
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date. From
the date of an appeal, any work conducted under this permit must
cease until the appeal is resolved.
This permit must be on the project she and accessible to
the permit officer when the project is inspected for compliance.
Any maintenance work or project modification not
covered under this permit, require further written permit approval.
All work must cease when this permit expires on
December 31, 20D6.
In issuing this permit it is agreed that this project is
consistent with the local Land Use Plan and all applicable
ordinances.
This permit may not be transferred to another party
without the written approval of the Division of Coastal Management.

2003, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable
regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine,

I acknowledge that the land owner is aware that the proposed development is planned for an area which may
be susceptible to erosion and/or flooding. I acknowledge that the local permit officer has explained to me the

After reviewing your application in conjunction with the development standards required by the
Coastal Area Management Act (CAMA) and our locally adopted Land Use Plan and Ordinances, it is
my determination that this permit be placed on hold until the following activities are conducted:
1. Need well permit from New Hanover County Environmental Health Department.
2. The proposed dwelling does not meet New Hanover County R-15 zoning setbacks
of 25 feet from the front property line. This must also include the steps.
3. Revised site plan must be resubmitted to adjacent property owners.
