Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. PERMIT FOR A 35' X 16' GARAGE AREA ONLY!!!!!!HHH! 1.All proposed development and associated construction must be done in accordance with the permitted work plat drawing(s) submitted on 4-19-04. 2. No impermeable surfaces shall be allowed over any functional; part of the septic tank system. 3. All construction must conform to the International Building Code requirements and all other local, State and Federal regulations. 4. Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. 5. Walls built around the storage area must be constructed with non -supporting breakaway wall, or open lattice work. 6. Pursuant to 15 NCAC, Subchapter 71 0406(B), this permit may not be assigned, transferred, or otherwise disposed of to athird party. Town Ordinance 157.027: On lots containing marsh or wetlands the piles supporting the structure shall not be located closer than seven (7) feet form an existing bulkhead, the COE line , or CAMA line, whichever is closer. S. Town Ordinance 157.027: Fill material placed landward of the marsh line is not allowed to slip or wash into the marsh. 9. No fill material is to be placed in federal or coastal wetlands. Temporary storage of materials or soil in wetlands is strictly prohibited. 10. The proposed construction shall meet all requirements of section 158.00 and 157.060 located in the Code of Ordinances. 11. The innovative stormwater system authorized with this permit must be maintained for the life of the structure addressed. 12. It is noted that coastal marsh exists on the property, and that the proposed development addressed on the submitted plat dated is not located within this marsh. 13. It is noted that there are federal wetlands on this property, as delineated on the plat dated, and that the proposed development addressed on the submitted plat dated April 20, 2004 is not located within these wetlands. 14. No excavation or filling of any wetlands or waters is authorized under this permit. 15. A copy of this permit shall be available onsite for regulatory inspection. 16. Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two (2) years of the time when it becomes imminently threatened, and in any case, upon its collapse or subsidence. However, if natural shoreline recovery or beach renourishment takes place within two (2) years of the time the structure becomes imminently threatened, so that the structure in no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary protective measures allowed by CRC Rules. 17.Such enclosed space is to be used solely for storage and by signing this permit you - as the owner understand that this area shall not be used for human habitation. This permit action may be appealed by the pernittee or other qualified persons within twenty (20) days of the issuing date. Preferred construction materials are open wood latticework or insect screening. However, solid breakaway wall panels are allowed. If non -supporting breakaway walls are used, they are to have a design safe -loading resistance of not less than ten nor more than twenty pounds per square foot. If breakaway walls exceed the twenty -pound criteria, they must be designed or certified by a registered professional engineer or architect, using the V- Zone Certification form. 20.Pursuant to 15 A NCAC 07J.0406(b), this permit may not be assigned, transferred, sold, or otherwise disposed of to a third party by the applicant, agent, or any entity other than the NC the NC Division of Coastal Management. 21.FLOOD RESISANT MATERIALS ARE REQUIRED FOR THE STORAGE AREA THAT WILL BE LOCATED BELOW THE BASE FLOOD ELEVATION. 22. The International Building Code states that the separation required is the garage shall be separated from the residence and its attic area by not less than Y2 inch gypsum board applied to the garage side. 23. Openings that are allowed by the International Building Code adopted by N.C. to be between the garage and residence shall be equipped with solid wood doors not less than 1 3/8 inch in thickness, solid or honeycomb core steel doors not less than 1 3/8 thick, or 20 minute fire -rated doors. 24. The rules of the Coastal Resources Commission require that you receive an AEC Hazard Notice and acknowledge that notice in writing before a permit for development can be issued. The Commission's rules onbuildingstandards, oceanfront setbacks and dune alteration are designed to minimize, but not eliminate, property loss from hazards. By granting permits, the Coastal Resources Commission does not guarantee the safety of the development and assumes no liability for future damage to the development. The best available information, as accepted by the Coastal Resources Commission, indicates that the annual ocean ero ion rate for the area where your property is located is feet per year. The rate was established by careful analysis of aerial photographs of the coastline taken over the past 50 years. Studies al o indicate that the shoreline could move as much asfeet landward in a major storm. The flood waters in a majorstorm arepredicted to be about `�30feet deep in this area. Preferred oceanfront protection measures are beach nourishment and relocation of threatened structures. Hard erosion control structures such as bulkheads, seawalls, revetments, groins, jetties and breakwaters are prohibited. Temporary devices, including sand bags, may be allowed under certain conditions. This structure shall be relocated or dismantled within two years of becoming imminently threatened. The applicant must acknowledge this information and requirements by signing this notice in the below space. Natural forces of water and wind collide with tons of force, even on calm days. Man-made structures cannot be guaranteed to survive the force of a hurricane. Long-term erosion (or barrier island migration) may take from two to ten feet of the beach each year and, sooner or later, will threaten oceanfront struc- tures. These are the facts of life for oceanfront property owners. The Coastal Resources Commission (CRC) has adopted rules for building along the oceanfront. The rules are in- tended to avoid an unreasonable risk to life and property and to limit public and private losses from storms and long-term erosion. These rules lessen but do not eliminate the element of risk in oceanfront development. As you consider building along the oceanfront, the CRC wants you to understand the rules and the risks. With this knowledge you can make a more informed decision about where and how to build in the coastal area. The Rules When you build along the oceanfront, coastal manage- ment rules require that the structure be sited to fit safely into the beach environment. Structures along the oceanfront must be behind the frontal dune, landward of the crest of the primary dune and set back from the first line of natural stable vegetation a dis- tance equal to 30 times the annual erosion rate (a minimum of 60 feet). If the erosion rate is greater than 3.5 feet/year, the setback is 30 times the erosion rate plus 105 feet. The Reasons The beachfront is an ever -changing landform. The beach and the dunes are natural "shock absorbers", taking the beatings of the winds and waves and protecting the inland areas. By setting back 30 or 60 times the annual long-term erosion rate; you have a good chance of enjoying the full life of the structure. At first, it seems very inviting to build your dream house as close to the beach as possible, but in five years you could find the dream has become a nightmare as high tides and storm tides threaten your investment. The Exception The Coastal Resources Commission recognized that these rules, initially passed in June of 1979, might prove a hardship for some property owners. Therefore, they estab- lished an exception for lots which cannot meet the setback requirement. The exception allows buildings in front of the setback line if the following conditions apply: (1) the lot must have been platted as of June 1,1979, and not capable of being enlarged by combining with adjoining land under the same ownership, (2) development must be as far back on the property as possible and in no case less than 60 feet landward of the vegetation line, (3) no development can take place on the frontal dune (4) special construction standards on piling depth and square footage must be met and (5) all other CAMA, state and local regulations must be met. The exception is not available in the Inlet Hazard Area.
