HomeMy WebLinkAboutHB_04-053_CreechV' TOWN OF HOLDEN BEACH Local Government CAMA MINOR DEVELOPMENT PERMIT as authorized by the State of North Carolina, Department of Environment, and Natural Resources and the Coastal Resources Commission for development in an area of environment concern pursuant to Section 113A-118 of the General Statues,"Coastal Area ManagemenC HB 2004-053 Permit Number Issued to Linwood Creech authorizing development _In Estuarine Shoreline at 105 South Shore as requested in the permittee's application, submitted April 8, 2004. This permit, issued on April23, 2004, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. PERMIT TO A INSTALL SEPTIC SYSTEM, CONSTRUCT SINGLE FAMUYRESIDENCE, GRAVEL DRIVEWAY, AND RE=IONAREAS. A COASTAL WETLANDS LINE WAS PREVIOUSLYMARKED BYLOCAL PERMIT OFFICER IN ORDER TO INSTALL A BULKHEAD ON THE LOT. 1. Prior to initiating any land -disturbing activities adequate sedimentation/erosion control measures must be employed to prevent the movement of unconsolidated materials into the marsh or water. These measures must remain in place until such time as the area is properly stabilized with vegetated cover. 2. Any change or changes in the plans for development, construction or land use activities will . equire a re-evaluation and modification of this permit. 3. All construction must conform to the International Building Code requirements and all oth cal, State and Federal regulations. 4. All proposed development and associated construction must'be done in accordance with the permitted workplat drawine (s) that were submitted on 3-11-04. - This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All work must cease when this permit expires on December 31, 2007 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. Pursuant to 15 NCAC, Subchapter A .0406 (b), this permit may not be assigned, transferred, sold or otherwise disposed of to a third party. 6. Marsh and wetlands shall be those areas so designated by CAMA and the U.S. Army Corps of Engineers and shown on plat used for the project. Also plat must include the certification which states the plat accurately depicts the boundary of the 404 line and must be signed by the Corps of Engineer representative. 7. Town Ordinance 157.027: On lots containing marsh or wetlands the piles supporting the structure shall not be located closer than seven (7) feet form an existing bulkhead, the COE line, or CAMA line, whichever is closer. & Town Ordinance 157.027: Fill material placed landward of the marsh line is not allowed to slip or wash into the marsh. 9. No fill material is to be placed in federal or coastal wetlands. Temporary storage of materials or soil in wetlands is strictly prohibited. 10. The proposed construction shall meet all requirements of section 158.00 and 157.060 located in the Code of Ordinances. 11. The innovative stormwater system authorized with this permit must be maintained for the life of the structure addressed. 12. It is noted that coastal marsh exists on the property, and that the proposed development addressed on the submitted plat dated is not located within this marsh. 13. It is noted that there are federal wetlands on this property, as delineated by /shown on the plat dated March 1, 2002, and that the proposed development addressed on the submitted plat dated March 11, 2004 is not located within these wetlands. 14. No excavation or filling of any wetlands or waters is authorized under this permit. 15. A copy of this permit shall be available onsite for regulatory inspection. 16. The front overhangs into the front yard setback is being permitted in accordance with chapter 157.029. This permit action may be appealed by the permi8ee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Pursuant to 15A NCAC 07J .0406(b), this permit may not be assigned, transferred, sold or otherwise disposed of to a third party by the applicant, agent, or any entity other than the NC Division of Coastal Management. 18. ALL CONSTRUCTION AND FILL MUST BE INSTALLED IN ACCORDANCE WITH SECTION 158.00 OF THE TOWN OF HOLDEN BEACH CODE OF ORDINANCE. 20. The concrete slab will be a finished elevation of 11.65'. 21. Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two (2) years of the time when it becomes imminently threatened, and in any case, upon its collapse or subsidence. However, if natural shoreline recovery or beach renourishment takes place within two (2) years of the time the structure becomes imminently threatened, so that the structure in no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary protective measures allowed by CRC Rules. 22. Such enclosed space is to be used solely for storage and by signing this permit you as the owner understand that this area shall not be used for human habitation. 23. FLOOD RESISANT MATERIALS ARE REQUIRED FOR THE STORAGE AREA THAT WILL BE LOCATED BELOW THE BASE FLOOD ELEVATION. PLEASE CONTACT TOWN HALL FOR A COPY OF THE FEMA APPROVED MATERIALS IF YOU HAVE ANY QUESTIONS ABOUT THIS REQUIREMENT. 24. This house will be located within a BASE FLOOD AE with a elevation of 14 feet. 25. Please be advised that flood vents shall be installed in accordance with FEMA requirements. 26.
