PERMIT TO CONSTRUCT A RETAINING WALL, INSTALL SEPTIC SYSTEM, CONSTRUCT SINGLE FAMILY RESIDENCE, GRAVEL DRIVEWAY, AND ADD FILL MATERIAL! A COASTAL WETLANDS LINE MUST BE STAKED BY LOCAL PERMIT OFFICER AND THE U.S. ARMY CORPS OF ENGINEERS MUST DETERMINE THE 404 JURISDICTION PRIOR TO ALL CONSTRUCTION OR PERMITS BEING ISSUED. I. Prior to initiating any land -disturbing activities adequate sedimentation/erosion control measures must be employed to prevent the movement of unconsolidated materials into the marsh or water. These measures must remain m place until such time as the area is properly stabilized with vegetated cover. 2. Any change or changes in the plans for development, construction or land use activities will require a re-evaluation and modification of this permit. 3. All construction must conform to the International Building Code requirements and all other Local, State and Federal regulations. This pennit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further wrihen permit approval. All work must cease when this permit expires on December 31, 2007 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. All proposed development and associated construction must be done in accordance with the permitted workplat drawing (s) that were revised and submitted on 5. Pursuant to 15 NCAC, Subchapter 7J .0406 (b), this permit may not be assigned, transferred, sold or otherwise disposed of to a third party. 6. Marsh and wetlands shall be those areas so designated by CAMA and the U.S. Army Corps of Engineers and shown on plat used for the project. Also plat must include the certification which states the plat accurately depicts the boundary of the 404 line and must be signed by the Corps of Engineer representative. 7. Town Ordinance 157.027: On lots containing marsh or wetlands the piles supporting the structure shall not be located closer than seven (7) feet form an existing bulkhead, the COE line, or CAMA line, whichever is closer. 8. Town Ordinance 157.027: Fill material placed landward of the marsh line is not allowed to slip or wash into the marsh. 9. No fill material is to be placed in federal or coastal wetlands. Temporary storage of - materials or soil in wetlands is strictly prohibited. 10. The proposed construction shall meet all requirements of section 158.00 and 157.060 located in the Code of Ordinances. 11. The innovative stormwater system authorized with this permit must be maintained for the life of the structure addressed. 12. It is noted that coastal marsh exists on the property, and that the proposed development addressed on the submitted plat dated is not located within this marsh. 13. It is noted that there are federal wetlands on this property, as delineated by /shown on the plat dated 2/09/04, and that the proposed development addressed on the submitted plat dated 02/20/04 is not located within these wetlands. 14. No excavation or filling of any wetlands or waters is authorized under this permit. 15. A copy of this permit shall be available onsite for regulatory inspection. 16. The structure shall be set back a minimum of 60 feet from the f of stable natural vegetation, as determined by the DCM or the LPO. 17. Please be advised that nothing including gutters, overhangs, rooflines, steps, shall be cantilevered over the coastal wetland line or constructed over the coastal wetland line. 21. The concrete slab will be a finished elevation of 10.0. 22. Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two (2) years of the time when it becomes imminently threatened, and in any case, upon its collapse or subsidence. However, if natural shoreline recovery or beach renourishment takes place within two (2) years of the time the structure becomes imminently threatened, so that the structure in no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary protective measures allowed by CRC Rules. 23. Such enclosed space is to be used solely for storage and by signing this permit you as the owner understand that this area shall not be used for human habitation. 24. The space below the lowest floor that is located in V Zones must either be free of obstruction or constructed with non -supporting breakaway materials. Preferred construction materials are open wood latticework or insect screening. However, solid breakaway wall panels are allowed. (ANY QUESTIONS ABOUT THE BREAKAWAY WALLS PLEASE CALL THE BUILING INSPECTOR AT TOWN HALL (910) 842- 6488). 25. Any construction below the lowest floor should collapse under wind and water loads without causing collapse, displacement, or other structural damage to the elevated portion of the building or the supporting foundation system. If non -supporting breakaway walls are used, they are to have a design safe -loading resistance of not less than ten nor more than twenty pounds per square foot. If breakaway walls exceed the twenty -pound criteria, they must be designed or certified by a registered professional engineer or architect, using the V-Zone Certification form. 26.FLOOD RESISANT MATERIALS ARE REQUIRED FOR THE STORAGE AREA THAT WILL BE LOCATED BELOW THE BASE FLOOD ELEVATION. I Project Is In An: — Date Lot Was Platted: AEC HAZARD NOTICE Ocean Erodible Areavdigh Hazard Flood Area This notice is intended to make you, the applicant, aware of the special risks and conditions associated with development in this area, which is subject to natural hazards such as storms, erosion and currents. The rules of the Coastal Resources Commission require that you receive an AEC Hazard Notice and acknowledge that notice in writing before a permit for development can be issued. The Commission's rules on building standards, oceanfront setbacks and dune alteration are designed to minimize, but not eliminate, property loss from hazards. By granting permits, the Coastal Resources Commission does not guarantee the safety of the development and assumes no liability for future damage to the development. The best available information, as accepted by the Coastal Resources Commission, indicates that the annual ocean erosion rate for the area where your property is located is feet per year. — The rate was established by careful analysis of aerial photographs of the coastline taken over the past 50 years. Studies also indicate that the shoreline could move as much as 3Wfeet landward in a major storm. ,C Tflood waters in a major storm are predicted to be about feet deep in this area. Preferred oceanfront protection measures are beach nourishment and relocation of threatened structures. Hard erosion control structures such as bulkheads, seawalls, revetments, groins, jetties and breakwaters are prohibited. Temporary devices, including sandbags, may be allowed under certain conditions. This structure shall be relocated or dismantled within two years of becoming imminently threatened. The applicant must acknowledge this information and requirements by signing this notice in the below space. Without the proper signature, the application will not be complete. Inlet Hazard Area SPECIAL NOTE: Thhs hazard notice is required for development in areas subject to sudden and massive storms and erosion. Permits issued for development in this area expire on December 31 of the third year following the year in which the permit was issued. Shortly before work begins on the project site, the Local Permit Officer will determine the vegetation line and setback distance at your site. if theproperty has seen little change and theproposed development can still meet the setback requirement, the LPO will inform you that you may begin work. It is impor- tant that you check with the LPO before the permit expires for official approval to continue the work after the permit has expired. Generally, if foundation pilings have been placed and substantial progress is continuing, permit renewal may not be necessary. If substantial progress has not been made, the permit must be renewed and a new - setback line established. It is unlawful to continue work after permit expiration without this approval.
