Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. Permit to pour concrete under existing roofed area!! All Proposed development and associated construction must be done in accordance with the permitted workPtatdrawing. All construction must conform with the International Building Code requirements and all other local State and Federal regulations This construction shall meet all requirements of Section 157.060 located in the Town Code of Ordinances. 1. No exratation or filling of any wetlands or waters is authorized under this permit. 2. Any change or changes in the plans for development, construction, or land use activities will require a re- evaluation and modification of this permit. 3. Pursuant to 15 NCAC, Subchapter 7J .0406 (b), this permit may not be assigned, transferred, sold or otherwise disposed of to a third -party by the applicant, agent, or any entity other thaw the NC Division of Coastal Management. 4. No impermeable surface shall be allowed over any functional part of septic tank system. Septic system must be installed according to Brunswick County Health Department Permit. All pilings shall be located a minimum of five feet from all portions of the septic system. All water lines shall be located a minimum of ten feet from al I portions of the septic system. This permit action may be appealed by the permitlee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project wdificalion not covered under this permit, requre further written permit approval. All work must cease when this permit expires on December 31, 2007 In issuing this peirril it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. This permit may not he transferred to another party without the written approval of the Division of Coastal Management. Neither the principal structure nor uncovered steps may extend closer than six feet from the bulkhead and no piles shall be placed closer than six feet from any bulkhead. Holden Beach Town Code 157.025 (a). 6. All proposed development must be done in accordance with the requirements of Chapter 158. titled Stormwater Management located in the Holden Beach Code of Ordinances. The stormwater flow shall be routinely contained within property lines in question, and not be directed onto adjacent real estate. Within property lines, sheet flow drainage of stormwater over grassy or adequately vegetated surfaces will be managed in such a manner so as not to create soil erosion, sedimentation buildup, or channeling water in any way onto adjacent property. 7. THIS PERMIT WILL BE APPROVED USING 15A NCAC 7H.0209(d)(I0) (H) 8. Please be advised that the current stormwater ordinance states in part that stormwater on individual parcels of land, and areas in between, so as not to adversely affect the quantity and quality of surface water flows as a result of natural rainfall, and to control runoff onto adjacent property, or water induced soil erosion in any form. 9. No excavation or filling of any wetlands or waters is authorized under this permit. 10. It is noted that coastal marsh exists on the property, and that the proposed development addressed on the submitted plat dated 2/06104 is not located within the marsh. 11. A copy of this permit shall be available onsite for regulatory inspection. 12. PRIOR TO INITIATING LAND -DISTURBING ACTIVITIES, ADEQUATE SEDIMENTATIONIEROSION CONTROL MEASURES MUST BE EMPLOYED TO PREVENT THE MOVEMENT OF UNCONSOLIDATED MATERIALS INTO THE MARSH OR WATER. THIS MEASURE MUST REMAIN IN PLACE UNTIL SUCH TIME AS T1 AREA IS PROPERLY STABILIZED WITH VEGETATED COVER. 13. The rules of the Coastal resources Commission require that you receive an AEC Hazard Notice and acknowiedge that notice in writing before a permit for development can be issued. The Commission's rules onbuildingstandards,oceanfront setbacks and dune alteration aredesigned to minimize,but not eliminate, property loss from hazards. By granting permits, the Coastal resources Commission does not guarantee the safety of the development and assumes no liability for future damage to the development. Thebest available information, as accepted by the Coastal resources Commission, indicates that the annual ocean erosion rate for the area where your property- is located is feet per year. The rate was established by careful analysis of aerial photographs of the coastline taken over the past 50 years. Studies also indicate that the shoreline could move as much as3� feet landward in a major storm. The flood waters in a major storm arepredi cted to beabout feet deep in this area. Preferred oceanfront protection measures are beach nourishment and relocation of threatened structures. Hard erosion control structures such as bulkheads, seawalls, revetments, groins, jetties and breakwaters are prohibited. Temporary devices, including sand bags, may be allowed under certain conditions. This structure shall be relocated or dismantled within two years of becoming imminently threatened.
