Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to ne nun ana voia. Docking Facility 1) Unless specifically altered herein, this permit authorizes the additional boathouse, boatlift and finger piers, as well as the associated uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Day Permit # 04-15 Page 2 off 3 ADDITIONAL CONDITIONS 2) The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. 3) The authorized boathouse shall be single story, and shall not be designed to allow for second story use. 4) The authorized structure shall not extend more than '/< of the width of the waterbody, as measured from the waterward edge of the marsh on both sides of the water body immediately in front of the project site. 5) The associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridors. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 8) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 9) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 10) This permit authorizes one additional boatlip for a maximum of three formalized boat slips at the authorized facility. General 11) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 12) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation in order to discuss the conditions set forth in this permit. 13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. Field Investigation Report: Allan Day property is on a cove in an unnamed tributary (UT) off of the Trent River. The immediate offshore water depths in this area are —3.0' to 9.0' normal water level (nwl). The subaqueous substrate is firm and without shell. There is not a cultural resource in the nearby vicinity of the project area. This waterbody is approximately 975' across. These waters of the Trent River are not classified as a Primary Nursery Area. There is no submerged aquatic vegetation present in the nearby vicinity of the project area. This area is closed to shellfish harvest and is classified as SB, Sw; NSW. There is not a defined Federal Channel in this area. The Trent River is a part of the Neuse River basin. 10. Proposed Development: The applicant proposes to expand an existing private residential docking facility from a 2-slip facility in order to support a total of three boat slips within the Trent River, adjacent to 2409 Tram Road, in New Bern, Craven County. The applicant proposes to construct a new roof over an existing boat lift, construct a third boatlift, and construct an additional finger pier for accessing the proposed boat lift. It will be for private use at a single family residence. The adjacent properties on either side are single family residences with dock structures. The closest adjacent docking facility to the south is 27' from the existing boathouse. The existing adjacent docking facility to the east would be 70' from the proposed boatlift. The proposed roof will be constructed over the existing 13' by 13' boatlift located next to the existing 23' by 32' boat house. This proposed boat house roof overhang will be 14' wide and 28' long. The proposed 3' by 31' finger pier will provide access to the other side of the existing boat lift, for boat access and maintenance. The proposed (third) 12' by 13' boat lift will be installed on the north side of the proposed boat house containing the existing (second) boat lift. The proposed finger pier will also provide access for this proposed third boat lift. 10. Anticipated Impacts: The incorporated footprint of the existing docking facility is 820 square feet. This proposed expansion would result in the additional usurpation of 240 square feet of Public Trust Waters. The proposed boathouse, including the finger pier, will shade an additional 476 square feet of open water, making the total shading impact to be 1,127 square feet of platform and roof area along 115' of shoreline. The proposal will increase the number of slips at this facility from two up to a total of three. There is not a cultural resource in the nearby vicinity of the project area. Water depths where the expansion is proposed will approximately be in the -3' to -9' nwl depth contour. These waters of the Trent River are not classified as a Primary Nursery Area. The total proposed square footage for shading impacts (existing and proposed combined) is equal to 1,127 square feet, which is greater than 8 square feet per linear foot of shoreline, as Mr. Day has 115' of shoreline along the Trent River. 15A NCAC 07H .0208(b)(6)(B) states that: "The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. " Therefore, the shading impacts allowable under this rule with 115' of shoreline would be limited to 920 square feet, unless the greater dimensions proposed can be demonstrated to meet the latter part of the rule. Narrative Description: The project is located adjacent to the Trent River, at 2409 Tram Road, off of Country Club Road, in Trent Woods, Craven County. This property is developed with a single family residence, a dock, and shoreline stabilization. There is approximately 115' of estuarine shoreline on the 1 acre lot. This Field Investigation Report: Allan Day Page 2 property is on a cove in an unnamed tributary (UT) off of the Trent River. The immediate offshore water depths in this area are —3.0' to 9.0' normal water level (nwl). The subaqueous substrate is firm and without shell. There is not a cultural resource in the nearby vicinity of the project area. This waterbody is approximately 975' across. These waters of the Trent River are not classified as a Primary Nursery Area. There is no submerged aquatic vegetation present in the nearby vicinity of the project area. This area is closed to shellfish harvest and is classified as SB, Sw; NSW. There is not a defined Federal Channel in this area. The Trent River is a part of the Neuse River basin. 10. Proposed Development: The applicant proposes to expand an existing private residential docking facility from a 2-slip facility in order to support a total of three boat slips within the Trent River, adjacent to 2409 Tram Road, in New Bem, Craven County. The applicant proposes to construct a new roof over an existing boat lift, construct a third boatlift, and construct an additional finger pier for accessing the proposed boat lift. It will be for private use at a single family residence. The adjacent properties on either side are single family residences with dock structures. The closest adjacent docking facility to the south is 27' from the existing boathouse. The existing adjacent docking facility to the east would be 70' from the proposed boatlift. The proposed roof will be constructed over the existing 13' by 13' boatlift located next to the existing 23' by 32' boat house. This proposed boat house roof overhang will be 14' wide and 28' long. The proposed 3' by 31' finger pier will provide access to the other side of the existing boat lift, for boat access and maintenance. The proposed (third)12' by 13' boat lift will be installed on the north side of the proposed boat house containing the existing (second) boat lift. The proposed finger pier will also provide access for this proposed third boat lift. 10. Anticipated Impacts: The incorporated footprint of the existing docking facility is 820 square feet. This proposed expansion would result in the additional usurpation of 240 square feet of Public Trust Waters. The proposed boathouse, including the finger pier, will shade an additional 476 square feet of open water,. making the total shading impact to be 1,127 square feet of platform and roof area along 115' of shoreline.
