Conley, 8325 Stryker St, Raleigh, NC 27615 Authorizing development in New Hanover County at adi. to Banks Channel, 530 Wavnick St., Wrightsville Beach , as requested in the permittee's application dated 5/15/15, Incl. attached workplan drawings (2), 1-2 of 2, both dated 5/2/15. This permit, issued on September 30, 2015 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may ec suuJccr w imes, imprisonment or civil action; or may cause the permit to oe null ana voia. Docking Facility 1) This permit authorizes only the floating dock and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this expanded docking facility without permit modification. No non -water dependent uses of structures shall be conducted on,, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Conley Permit No. 9�45 Page 2 of 3 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition, and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent .. reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes the addition of 1 boat slip to the existing docking facility. NOTE: The permittee is cautioned that this permit does not authorize the installation of tie pilings in association with the authorized docking facility. 6) The floating dock and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor to the north, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore. at the point where the upland property line meets the water's edge. 7) Should the adjacent property to the south be sold prior to the initiation of construction, the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15 foot riparian corridor. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 9) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 10) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 11) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2015-01640), which was issued on 8/20/15. NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. 1AR- 15-0722. Tom G. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. It appears that the project is consistent with the use standards set forth in NCAC 07H .0208(b)(6), including the % width rule, the eight square foot rule and the pierwidth rule. The proposed floating dock would be located entirely overopen water. This office has no objection to the proposed work, provided it is consistent with all other state and federal permitting requirements. If the project is determined to be consistent with NCAC 07H .0208(b)(6), it is recommended that any permit issued should include standard docking facility conditions to include: 1. This permit authorizes a maximum of four (4) boat slips. At no time shall more than four (4) vessels be moored or docked at the facility. The applicant proposes to install a Eft. wide by 30ft. long floating dock as an addition to an existing share boating facility. The addition will allow for a total of 4 slips, but the orientation does provide the potential for another slip. Waters are classified as saltwater for primary recreation (SB#), is closed to shellfish harvest by the Division of Marine Fisheries Shellfish Sanitation Section, and though the site is not designated Primary Nursery Area (PNA), it is directly across the channel. The proposed 2 slips are within a closed shellfish harvest area. If the NC DMF Shellfish Sanitation Section determines that the addition of these slips increases the shellfish closure, then I object to any number of slips that would result in the additional closure of shellfish harvest grounds. The orientation of the proposed floating dock does allow enough access to the side of the floating dock nearest the existing pier to be utilized as a slip. The water depth along the proposed floating dock is -6.5ft. to -2ft. at Normal Low Water (NLW). Therefore it is recommended that a handrail be installed on the side of the proposed floating dock nearest to the existing pier to remove the potential for the additional unpermitted slip and to reduce the potential for shallow bottom impact. PROJECT DESCRIPTION: The project site is located at 530 Waynick Blvd., adjacent to Banks Channel, between the Atlantic Ocean and Greenville Sound within the Town of Wrightsville Beach, in New Hanover County. To locate the property from the Wilmington Regional Office (WiRO) travel east from Eastwood Road approximately 3 miles towards Wrightsville Beach. From the drawbridge, confinue heading east on Causeway Drive (U.S. Highway 76) approximately 1 mile and proceed to cross the bridge over Banks Channel. Take the immediate right onto Waynick Boulevard (U.S. Highway 76) and travel south approximately 0.8 mile until you reach the property of interest will be located on the right. The lot averages approximately 3'-6' above normal high water (NHW). Highground vegetation consists of maintained lawn grass and ornamental landscaping. The lot is approximately 0.09 acres with approximately 88' of shoreline irregular frontage currently stabilized with a timber bulkhead, which was authorized to a previous owner (Whitford) under CAMA General Permit No. 42801-D in August 2005. There are currently no Coastal Wetlands adjacent to the property. The applicant currently maintains half of an existing shared docking facility on the property, which consists of a concrete access pier (30' x 75), gazebo (16' x 13'), access ramp, floating docks (16' x 6.5' and 22' x 6') and a boat lift (13' x 13'). The shared docking facility was authorized to the adjacent riparian property owner to the south (R. Whitford) and a previous property owner (K. Shardera). The applicant's portion of the shared docking facility currently accommodates up to two (2) vessels within water depths ranging from approximately -6' to -11' @ normal low water (NLW) (See Sheet 1 of 2 and Project Narrative). The Wrightsville Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of Banks Channel, which are included in the Wrightsville Recreational Area, are classified SB# by the Division of Water Resources. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish PROPOSED PROJECT: The applicant proposes to re -configure an existing docking facility within Banks Channel. A floating dock, measuring approximately 30' in length by 6' in width would extend from the existing floating docks towards the east from the most landward end of the floating dock, creating a "T-shaped" docking configuration oriented towards the north. The application states the proposed structures would be constructed to provide additional docking space for up to two (2) vessels for a total of four (4) vessels at the applicant's side of the shared docking facility and would be located in approximately -2' to -6.5' @ NLW (See Sheet 1 and 2 of 2 and Project Narrative). 10. ANTICIPATED IMPACTS: The proposed new floating dock would incorporate approximately 180 sq. ft. of Estuarine Waters and Pubic Trust Area. The structure would extend approximately 45' into a waterbody, which measures approximately 700' across. This distance would conform with the 1/4 width rule and the established pier lengths. As proposed, the applicant's proposal would not extend beyond the Town of Wrightsville Beach Pier head Line; however, the structure would encroach into the adjacent 15 foot Riparian Corridor Setback Area requirement to the south. The application states that applicant has obtained a waiver for the encroachment from the adjacent riparian property owner to the south. The proposed docking facility would be located within water depths of approximately -2' to -6.5' @ NLW. Minor increases in turbidity should be expected during construction.
