as requested in the permittee's application, dated December 2, 2003. This permit, issued on3-1 i-bq , is
subject to compliance with the application and site drawing (where consistent with the permit), all applicable
regulations and special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
Permit to construct a retaining wall and then add fill material to the lot.
All proposed development and associated construction must be done in accordance with the
permitted work tat drawing. This approved Plan shows the final elevations to exist on the lot will
be 8.0 and 8.4 feet above mean sea level.
1. Any change or changes in the plans for development, construction, or land use activities will require a re-
evaluation and modification of this permit.
2. Pursuant to 15 NCAC, Subchapter 71 .0406 (b), this permit may not be assigned, transferred, sold or
otherwise disposed of to a third -party
3. No impermeable surface shall be allowed over any functional part of septic tank system. Septic system
must be installed according to Brunswick County Health Department Permit. All pilings shall be located a

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date. From
the date of an appeal, any work conducted under this permit must

this permit, require further written permit approval.

4. Neither the principal structure nor uncovered steps may extend closer than six feet from the
bulkhead and no piles shall be placed closer than six feet from any bulkhead. Holden Beach Town
Code 157.025 (a).

titled Stormwater Management located in the Holden Beach Code of Ordinances. The stormwater
flow shall be routinely contained within property lines in question, and not be directed onto adjacent
real estate. Within property lines, sheet flow drainage of stormwater over grassy or adequately
vegetated surfaces will be managed in such a manner so as not to create soil erosion, sedimentation
buildup, or channeling water in any way onto adjacent property.
6. Within the Coastal Shorelines category (estuarine and public trust shoreline AECs), new
development shall be located a distance of 30 feet landward of the normal water leel or normal high
water level, with the exception of the following:

individual parcels of land, and areas in between, so as not to adversely affect the quantity and quality
of surface water flows as a result of natural rainfall, and to control runoff onto adjacent property, or
water induced soil erosion in any form.

11. PRIOR TO INITIATING LAND -DISTURBING ACTIVITIES, ADEQUATE
SEDIMENTATION/EROSION CONTROL MEASURES MUST BE EMPLOYED TO PREVENT
THE MOVEMENT OF UNCONSOLIDATED MATERIALS INTO THE MARSH OR WATER.
THIS MEASURE MUST REMAIN IN PLACE UNTIL SUCH TIME AS THE AREA IS
PROPERLY STABILIZED WITH VEGETATED COVER.
12. The innovative stormwater system authorized with this permit must be maintained for the life of
the structure addressed.

owners.

RE: CAMA application for 596 O.B.W.
Gentlemen:
The Minor CAMA Permit applicati to construct a retaining wall
and add fill material has bee laced on hold. We still need a copy of the
survey showing the 404 Cor me, Coastal Wetland line and
stormwater plan. The survey shall also include all required information
in order to apply for a stormwater permit. The Corp of Engineers will
also need to sign off on the survey verifying that the location of there line
is correct.
Also the design that was turned in for the construction of the wall shows
five foot of material out above the ground and three foot below ground.
We will require a detailed drawing that shows the same amount of wood
that is being installed above ground to also be installed below ground.

Dear Sea Castle Construction:
After reviewing your application in conjunction with the development standards
required by the Coastal Area Management Act (CAMA), it is my determination that no
permit may be granted for the project you have proposed.
This decision is based on my finding that your request violated 113A-120(g) which
requires that all applications be denied which are inconsistent with CAMA guidelines.
You have applied to construct a single family residence within 30 feet of the normal
water level. This proposal is inconsistent with section 15 NCAC 7H .0209(10) of the
Coastal Area Management Act which states that: Within the estuarine AEC's, new
development, with the exception of water dependent uses, shall be located a distance
of 30 feet landward of the normal high water level. The proposed construction does
not meet the criteria for either exception to the 30 foot buffer regulation. These
exceptions have been discussed with the property owner.
Enclosed you will find the requested forms that you will need to apply for a variance
to the Coastal Resource Commission. Please feel free to contact me if you have any
