This permit issued on July 21, 2016 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Reconfigured Docking Facility 1) This permit authorizes only the floating dock, pier, elevated walkway, fish cleaning station, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this reconfigured docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the reconfigured docking facility. Any sewage discharge at the reconfigured docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) permit action may be appealed by the permittee or other ;d persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee JOhn Clark & Mary Denison Permit No. 72-15 Page 2 of 3 ADDITIONAL CONDITIONS The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) The authorized structures shall not exceed one quarter of the width of the water body. 5)•,. This permit does not authorize any tie piles in association with the authorized facility. 6j The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is _ not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Boat Ramp ,-.7).- Unless specifically altered herein, this permit authorizes one clean/washed stone boat ramp, as indicated on the attached workplan drawings. 8) _ Excavation and ground disturbing activities, associated with the placement of the boat ramp, above and below the normal water line shall be limited to that absolutely necessary to establish adequate ramp ' slope and provide a ramp no greater in size that specified in the attached permit application and workplan drawings. Upland Development Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, p p p rty, including the elevated walkway, firepit, and other associated infrastructure, all as expressly and specifically set forth in the attached permit application and workplan drawings. 10)'' All portions of the boardwalk within 30' of the normal high water line shall be 6' feet wide, elevated, and slatted. Sedimentation and Erosion Control l,l) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. l2) - A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. !I Jolin Clark & Mary Denison ADDITIONAL. CONDITIONS General Permit No. 72-15 Page 3 of 3 13) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 14) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. . 15) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 16) The permittee and/or his or her contractor shall meet with a representative of the Division prior to initiation of any phase of this project. 17) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 18) This Major Modification shall be attached to the original of Permit No. 72-15, which was issued on 7/2/15, and copies of both documents shall be readily available on site when a Division representative inspects the project for compliance. 19) Unless specifically altered herein, all conditions and stipulations of the active permit remain in force under this Major Modification. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized assigned Action ID No. SAW-2016-01278. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 3900 and assigned the project DWR Project No. 15-0358 V2. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: An application processing fee of $250 was received by DCM for this project. im CAROLINA MARINE CONSTRUCTION, Inc. 6400-8 Carolina Beach Rd #212 Wilmington, NC 28412 910-793-4143 April 27, 2016 Robb, As per our previous conversation and meeting, I would like to modify Major Permit #72-15 for #8 Cedar Island. We are proposing to relocate the permitted floating dock and associated access pier (as per plans). The new location will not encroach into the established channel based on permit #9-03, also shown on the plans. There will be no increase in the number of slips. We are also proposing to modify the permit to include 419' of 6' wide access walkway between the water dependent structures on site along with a 198 sq ft fish cleaning station/deck along with a 452.4 sq ft crushed shell fire pit. There are no impervious or built upon areas proposed. Construction of the walkways and fish cleaning station will match that of the stationary pier. I have attached a cross section drawing showing the details. The access walkways area necessity to utilize the water dependent structures. The walkway adjacent to the boathouse will allow both elderly and special needs individuals access to the lift/boat without having to negotiate the slope of the ramp or any instability there may be in the floating dock. We are proposing to cantilever this section of access walkway by 2' in order to make boarding and unboarding easier. I have also attached a cross section drawing showing the locations of this portion of access walkway in relation to the boathouse and lift for clarity. To locate the property heading south on Oleander Drive (NC Highway17), turn left onto Greenville Loop Road and travel approximately 0.8 miles. Turn left onto Old Military Road and travel approximately 0.5 miles east. Once you cross the bridge to Cedar Island Subdivision turn right at the bend and continue to travel south until the road terminates into the property of interest. The property consists of approximately 2.65 acres and the applicants currently maintain a private residence at this site. The average elevation of the property is approximately 3'-12' above normal high water (NHW). The highground area is landscaped with ornamental shrubs and maintained lawn grass. In addition, there are some woody species, which includes Pine, Oak and Magnolia trees which are primarily along the western portion of the property. There is a border of coastal wetlands approximately 16-20' in width along the eastern side and southern side of the property, which faces the access channel from Cedar Island Basin to the AIWW. These coastal wetlands are vegetated primarily with Smooth Cordgrass (Spartina alterniflora) and Salt Meadow Grass (Spartina patens). Other wetland vegetation landward of the bulkhead includes Sea Oxeye (Borrichia frutescens). Permit History: The applicants obtained State Permit No. 72-15 on July 2, 2015, which is due to expire on December 31, 2018. State Permit No. 72-15 authorized replacement of a timber bulkhead with new shoreline stabilization and reconfigure an existing boat basin within the Cedar Island Basin, which incorporated living shoreline structures along the property. A new marsh enhancing sill consisting of granite and limestone was constructed on the western side and most northern end of the property, which borders Cedar Island Basin access channel to the AIWW. The existing upland boat basin located on the western end of the property, which abuts the upper end of the Cedar Island Basin was re -developed with a new bulkhead, maintenance excavation, floating dock and boatlift within an existing boat -house. An existing composite elevated boat ramp located on the eastern end of the property within the channel to the AIWW was relocated to the northern end of the property within the Cedar Island Basin, just north of the existing boat basin. State Permit No. 72-15 authorized the construction of a new docking facility, which would extend from the shoreline towards the access channel to the AIWW, directly east of the applicant's residence. The pier, measuring approximately 24' in length by 6' in width would lead from an access ramp onto a floating dock, measuring approximately 40' in length by 8' in width, would run parallel to the shoreline and channel. The authorized docking facility is located in water depths of approximately -2.5' @ normal low water (NLW), which accommodates up to two (2) vessels. Outside this docking facility, all work authorized under State Permit No. 72-15 has been completed in accordance with the permit conditions (See sheet 2 of 4 and Project Narrative). The New Hanover County/City of Wilmington Land Use Plan 2006 Update classifies the adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. In the project area, the waters of Cedar Creek are classified as SA, by the NC Division of Water Resources, and they are CLOSED to the harvest of shellfish. These waters are designated as Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. The authorized docking facility, which was authorized to be located on the eastern end of the property adjacent to the access channel to the AIWW would be relocated approximately 170' to the south, within the authorized dimensions, aforementioned. The application states that this proposed docking facility would be located in water depths of approximately -3.0' @ NLW, which would accommodate up to two (2) vessels. The applicants also propose to construct a new approximately 420' in length by 6' in width elevated timber walkway, which would be located on highground and run parallel to the shoreline. The walkway would connect the new docking facility and the existing boat basin facility. The application states that the portion of the walkway adjacent to the boat house would be cantilevered approximately 2' waterward of the bulkhead to allow safe access to the existing boat lift. The walkway would lead to a new fire pit made of crushed stone and metal edging would be located approximately 50' landward of the shoreline. The application also proposes approximately 198 sq. ft. of new uncovered decking along the shoreline of the boat basin, which the application states would be utilized as a fish cleaning station. Finally, the application states that a new highground boat ramp approximately 25' in length by 14' in width, which would be constructed of clean/washed stone would be on the landward side of the existing elevated ramp located on the most northern end of the property (See sheets 1 through 4 of 4 and Project Narrative). 10. ANTICIPATED IMPACTS The proposed docking facility along the southern portion of the property would impact approximately 464 sq. ft. of Public Trust Area and Estuarine Waters. The proposed structures would be located within the applicant's riparian access area and would not encroach into the adjacent 15' riparian corridor setback requirements. The proposed docking facility on the southern portion of the property would extend approximately 20' into a waterbody within the access channel to the AIWW, which measures approximately 120' in width across, which would not exceed the '% width limitation. The proposed relocation of the docking facility would continue to accommodate two (2) vessels within water depth of approximately -3.0' @ NLW. Based on the provided survey, permit history (State Permit No. 9-03) and on -site meetings, the proposed new location of the docking facility appears to not encroach into the established channel. The proposed elevated walkway, fire pit and uncovered decking and stone boat ramp would impact approximately 3,521 sq. ft. of Estuarine Shoreline.
