This permit, issued on May 27, 2015 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
oe subject io nnes, imprisonment or civil action; or may cause the permit to be null and void.
Water Access Facility
1) Unless specifically altered herein, this permit authorizes the construction of the piers, kayak launch and
handicap ramp, and other structures and uses located in or over the water that are expressly and
specifically set forth in the permit application. No other structure, whether floating or stationary, shall
become a permanent part of this reconfigured docking facility without permit modification. No non -
water dependent uses of structures shall be conducted on, in or over public trust waters without permit
modification.
2) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
water at or adjacent to authorized work.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2018
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structures in order to make them more visible during hours of darkness
or inclement weather.
6) This permit does not authorize and formalized boat slips.

7) In order to protect anadromous fish, no in -Water work shall be permitted between February 15 and
October 31 of any year without prior approval from the Division of Coastal Management.
8) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or -alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
10) The permittee and/or his contractor shall meet with a representative of the Division prior to project
initiation.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. No.
SAW-2015-00593.
NOTE: An application processing fee of $400 was received by DCM for this project.

Natural cypress along a section of the northwest shoreline between the existing boardwalk and creek. 3.4 acres of mowed
grass and 1.3 acres of natural plants and phragmites reed. A few loblolly pines. A few shade trees were recently planted on
the east side of the park close to the boardwalk

The park is acessed by a gravel entrance off Queen Street. The park consists of 3.44 acres of mowed grass and
approximately 1.2 acres of natural plants and phragmites reed. There is 1,033 ft x 8 ft of wooden boardwalk along the
waterfront. The boardwalk on the west side of the park is accessed by a concrete and wooden walkway from a 16 ft x 20 ft
handicap parking pad. There is a 16 ft x 11ft platform near a cypress stand on the northwest side of the park There is a 30
ft x 6 ft wooden platform on the east end of the boardwalk for launching canoes and kayaks. The platform is about a foot
below the level of the boardwalk and about a foot above normal water level. There is a gravel parking area for four cars and
a 16' x 20' concrete handicap parking space on the east side of the park. A concrete and timber walkway provides access to
the boardwalk from the handicap pad and parking area.

Bayside Marina is to the west of Pembroke Creek Park. It is a private marina with two boat ramps.West Queen St borders
the south side of the park and Pembroke Creek the east, north and part of the west side. The State Department of
Transportation owns a right-of-way between Queen St and the park.

Pembroke Creek Park is an important resource for public access to Pembroke Creek and surrounding waters. The park
serves local residents and visitors for fishing, canoeing, kayaking and nature tourism. It is a true neighborhood park, which
many local residents may access by walking or biking. The park also provides safe access to Pembroke Creek and
surrounding waters, which include 13 miles of marked paddle trails and five camping platforms on John's Island in Edenton
Bay, The Edenton-Chowan Recreation Department will use Pembroke Creek Park for summer water -based recreation
programs. The department's canoes, kayaks and equipment will be stored on site for easy access. The proposed project will
improve water access to all segments of the community including persons with disabilities.

Round piles for the piers will driven by a small excavator on a barge. The two timber piers and wooden ramp connecting one
of the new piers to the existing timber platform will be constructed from a small barge.

6. Additional Information
a. Project Narrative
Pembroke Creek Park is an important resource for public access to Pembroke Creek and
surrounding waters. The park serves local residents and visitors for fishing, canoeing, kayaking
and nature tourism. It is a true neighborhood park, which many local residents may access by
walking or biking. The park also provides safe access to Pembroke Creek and surrounding
waters, which include 13 miles of marked paddle trails and five camping platforms on John's
Island in Edenton Bay (paddle trail map attached). There are two canoe/kayak access sites on
the Edenton waterfront one mile from Pembroke Creek Park, but these sites are exposed to the
rougher waters of Edenton Bay. Pembroke Creek Park and Pembroke Creek provide recreational
opportunities even on windy days when waters are rough in Edenton Bay and the Albemarle
Sound.
Pembroke Creek Park is also used for regional fishing tournaments. Bayside Marina, on the west
side of Pembroke Creek Park, organizes bass fishing tournaments three times a month, April
through October. These tournaments bring in approximately 500 fisherman and family members
from across the region. Local bass clubs also host four large tournaments a year that average
approximately 130 boats per tournament. These four tournaments bring in an additional 1,200
fisherman and family members from across the region. The fisherman and their families use
Pembroke Creek Park for parking and tournament events. The Marina and local bass clubs also
use Pembroke Creek Park for an annual fishing tournament for local youth.
The Edenton-Chowan Recreation Department will use Pembroke Creek Park for summer water -
based recreation programs. The department's canoes, kayaks and equipment will be stored on
site for easy access. The project will improve water access to all segments of the community
including persons with disabilities. Access improvements include:
Construct two, 50 ft x 6 ft piers with 20 ft x 5 ft T's off the existing boardwalk to allow
fishing in deeper waters.
Construct 14 ft x 4 ft wooden handicap accessible ramp from one of the new piers to the
existing timber platform (6 ft x30 ft).
Attach pre -fabricated floating canoe/kayak launch platform (8 ft x12 ft) to existing timber
platform (6 ft x 30 ft).
The existing 8 ft wide timber boardwalk parallel to the park's shoreline has approximately 6,260
sq ft of platform over water.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -
colored form) is retained by you and it must be available on site when the project is inspected for
compliance. Please sign both the original and the copy and return the copy to this office in the enclosed
envelope. Signing the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B
with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-
2698 within twenty (20) days of this decision on your permit. You should also be aware that another
qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your. application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and review
all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to
be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact
Department personnel at any time for assistance. By working in accordance with the permit, you will be
helping to protect our vitally important coastal resources.

Project Setting
The applicant's property is Pembroke Creek Park, located at 716 Queen Street (SR 1204), adjacent to the
Pembroke Creek Bridge, within the Town of Edenton, in Chowan County, North Carolina. The property consists of
5.435 acres of conservation easement, with approximately 1,250' of shoreline; 408' along a man-made canal and
the remaining 842' along Pembroke Creek. The average elevation of the tract in question is 2' above mean sea
level.
Primary land use at Pembroke Park is recreational, including use for regional fishing tournaments, and as a canoe
and kayak launch for accessing 13 miles of marked paddle trails and camping platforms on John's Island in Edenton
Bay.
Structures on the property consist of a 285' vinyl bulkhead along Pembroke Creek authorized by General Permit
#64834A, an 8'Wx 1,0331 boardwalk paralleling the shoreline, two platforms, two ramp accesses to the boardwalk,
and associated parking outside of the Division Area Environmental Concern (AEC). Approximately 6,260sf of the
existing 8' wide boardwalk is located over water and meets the definition of a platform.
Adjacent property uses consist of SR 1204 on the south side of the property; Pembroke Creek to the north and east,
a man-made canal shared with a commercial boat ramp, docking facility and restaurant to the west. Across SR
1204 is a mix of retail commercial and residential uses.
Vegetation along the shoreline escarpment includes, but is not limited to, loblolly pine (Pins taeda), tulip poplar
(Liriodendron tulipifera), bald cypress (Taxodium distichum), groundsel tree (Baccharis halimifolia), Carolina
jasmine (Gelsemium sempervirens), cat brier (Smilax rotundifolia), common reed (Phragmites australis), soft rush
(Juncus effuses), cattails (Typha latifolia), witch cane (Arundinana tecta), poison ivy (Toxicodendron radicans), and
a variety of domestic grasses. No submerged aquatic vegetation has been known to inhabit the water bottom within
the project limits. Non coastal wetlands are located along the northwest quadrant of the property.
The water bottom along the applicant's property consists of a fine silt substrate with a gentle slope. Water depths
average between 4' and 5' approximately 50' waterward of existing boardwalk. The nearest pier is a 115' private
residential marina with 20 slips located 200' south of the property and the Pembroke Creek Bridge. Pembroke
Creek is approximately 500' wide along north side of the property and between 350' and 400' on the east side,
adjacent to the bridge. Pembroke Creek is classified as "Inland" beginning at the bridge, and are Public Trust
Waters. While the water is classified as "B" for primary recreational is includes aquatic life propagation and survival,
fishing, and wildlife. The waters within the creek are also considered nutrient sensitive, requiring limitations on
nutrient inputs. There are no known archaeological sites or geologic formations associated with this property.
Development Proposal
The applicant proposes to construct two 6'W x 451 piers with a 5'W x 2017" head platforms extending a total of
50' waterward of an existing 8' wide platform/boardwalk paralleling shoreline along Pembroke Creek. The project
will include an 8'W x 121 floating kayak launch adjacent to an existing platform with a 4'W x 121 handicap ramp
extending from the right (east) pier to the existing platform and floating kayak launch. There are no existing or
proposed mooring facilities associated with Pembroke Park. RECEIVED

Anticipated Impacts
1) If approved there will be an additional shading of shading 884sf of open water for a total of 7,144sf of
shading.
2) If approved the total area of platform dedicated to the property for public benefit will be 6,604sf.
3) Installation of pilings for the proposed piers will result in a temporally increase in turbidity of the water in and
around the construction site.
4) A secondary impact of the proposed development if approved will be an increase in debris on land and in
the adjacent waterbodies.

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the
subject permit application for proposed actions that impact fish and fish habitats. The applicant
proposes to construct two 6' by 45' piers with 5' by 20' t-head platforms into Pembroke Creek, the piling,
will be driven by excavator. The applicant also proposes an 8' by 12' floating platform/kayak launch to
be installed along the existing boardwalk and an accompanying 4' by 12' handicap access ramp.
This portion of Pembroke Creek is classified as an Anadromous Fish, Spawning Area (AFSA). Water bodies
with the AFSA designation are considered critical to the lifecycle of anadromous fish such as Alewife,
blueback herring, striped bass, hickory and American Shad. Driving pilings can'cause fall back behavior in
fishes that disrupts their movements. In order to reduce disturbances to these fish on their spawning
migration a moratorium on in -water work from February 15—October 31 should be observed.

I have reviewed the rules as they pertain to Piers and Docking Facilities and would like to offer the
following:
15A NCAC 07H .0207 PUBLIC TRUST AREAS
(a) Description. Public trust areas are all waters of the Atlantic Ocean and the lands thereunder from the
mean high water mark to the seaward limit of state jurisdiction; all natural bodies of water subject to
measurable lunar tides and lands thereunder to the normal high water or normal water level; all
navigable natural bodies of water and lands thereunder to the normal high water or normal water level
as the case may be, except privately -owned lakes to which the public has no right of access; all water
in artificially created bodies of water containing public fishing resources or other public resources which
are accessible to the public by navigation from bodies of water in which the public has rights of
navigation; and all waters in artificially created bodies of water in which the public has acquired rights
by prescription, custom, usage, dedication, or any other means. In determining whether the public has
acquired rights in artificially created bodies of water, the following factors shall be considered:
(1) the use of the body of water by the public;
(2) the length of time the public has used the area;
(3) the value of public resources in the body of water;
(4) whether the public resources in the body of water are mobile to the extent that they can move
into natural bodies of water;
(5) whether the creation of the artificial body of water required permission from the state; and
(6) the value of the body of water to the public for navigation from one public area to another public
area.
(b) Significance. The public has rights in these areas, including navigation and recreation. In addition,
these areas support commercial and sports fisheries, have aesthetic value, and are important
resources for economic development.
(c) Management Objective. To protect public rights for navigation and recreation and to conserve and
manage the public trust areas so as to safeguard and perpetuate their biological, economic and
aesthetic value.
(d) Use Standards. Acceptable uses shall be those consistent with the management objectives in
Paragraph (c) of this Rule. In the absence of overriding public benefit, any use which jeopardizes the
capability of the waters to be used by the public for navigation or other public trust rights which the
public may be found to have in these areas shall not be allowed. The development of navigational
channels or drainage ditches, the use of bulkheads to prevent erosion, and the building of piers,
wharfs, or marinas are examples of uses that may be acceptable within public trust areas, provided thatCEIVED

such uses shall not be detrimental to the public trust rights and the biological and physical functions of
the estuary. Projects which would directly or indirectly block or impair existing navigation channels,
increase shoreline erosion, deposit spoils below normal high water, cause adverse water circulation
patterns, violate water quality standards, or cause degradation of shellfish waters are considered
incompatible with the management policies of public trust areas. In every instance, the particular
location, use, and design characteristics shall be in accord with the general use standards for coastal
wetlands, estuarine waters, and public trust areas.
Consistent: Water dependent development to provide the general public with access to
recreational fishing piers and navigable waters.

(b)Special Use Standards
(6) Piers and Docking Facilities.
(A) Piers shall not exceed six feet in width. Piers greater than six feet in width shall be permitted
only if the greater width is necessary for safe use, to improve public access, or to support a
water dependent use that cannot otherwise occur;
Consistent: Proposed piers are 6' in width.
(B) The total square footage of shaded impact for docks and mooring facilities (excluding the pier)
allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square
feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the
total. Projects requiring dimensions greater than those stated in this Rule shall be permitted
only if the greater dimensions are necessary for safe use, to improve public access, or to
support a water dependent use that cannot otherwise occur. Size restrictions shall not apply to
marinas;

than 75 linear feet of shoreline. Size restrictions do not apply to marinas;

(H) Piers or docking facilities longer than 400 feet shall be permitted only if the proposed length
gives access to deeper water at a rate of at least 1 foot each 100 foot increment of length
longer than 400 feet, or, if the additional length is necessary to span some obstruction to
navigation.
Consistent: The maximum length proposed is 50'.
(1) Piers and docking facilities shall not interfere with the access to any riparian property and shall
have a minimum setback of 15 feet between any part of the pier or docking facility and the
adjacent property owner's areas of riparian access.
Consistent: The pier adjacent to the Bundy property is the closest and will maintain a
minimum of 15' from the riparian line.
(J) Applicants for authorization to construct a pier or docking facility shall provide notice of the
permit application to the owner of any part of a shellfish franchise or lease over which the
proposed dock or pier would extend. The applicant shall allow the lease holder the opportunity
to mark a navigation route from the pier to the edge of the lease.
Consistent: The piers do not involve any shellfishing franchise.
Based on the above review I would like to recommend that the request be approved
subject to the standard conditions.

Consistency Determination: The request is consistent with/not in conflict with the Chowan
County/Town of Edenton 2008 Core Land Use Plan certified by
the CRC on July 24, 2008.
Overview: The subject property is a 5.44 acre site with 408 linear feet of shoreline along
Pembroke Creek to the north and east and 842 linear feet of shoreline along a manmade canal
to the west. Water depths average between 4 and 5 feet approximately 50 feet from the
shoreline. The majority of the site is cleared, with Section 404 wetlands and shoreline trees to
the northwest. The property is located within the AE Floodzone. The property is a public
recreation site known as Pembroke Creek Park and is under a conservation easement held by
the Clean Water Management Trust Fund (CWMTF) and the State of North Carolina.
Existing site improvements consist of a gravel access drive and unmarked grass parking.
Existing shoreline improvements consist of 285 linear feet of vinyl bulkhead and an 8 foot wide
by 1,033 foot long boardwalk with two (2) overwater platforms and two (2) shore side access
ramps. The bulkhead is located along Pembroke Creek. The boardwalk parallels the shoreline
and in some areas extends over the water.
Construction of two (2) 6 foot wide by 45 foot long piers with 5 foot wide by 20 foot long "T" head
terminus platforms and installation of an 8 foot wide by 12 foot long floating kayak launch and a
4 foot wide by 12 foot long handicapped ramp/wooden gangway are proposed. A handicapped
accessible kayak facility will be created by connecting the floating launch to an existing platform
along the boardwalk and connecting the platform to the pier with the handicapped ramp/wooden
gangway.

Proposed improvements are included in a public access grant contract (Contract 5822) between
the County and NCDENR. Prior to approval of a grant award, public access improvements for
the site were approved by the CWMTF.
There are no existing or proposed mooring facilities.
The waters of Pembroke Creek are classified as "B" in this area and are considered nutrient
sensitive. No Submerged Aquatic Vegetation has been observed in the project area. There are
no known archaeological sites or geological formations associated with the property.
Anticipated impacts resulting from this project are expected to include: the shading of 884 sq. ft.
of Public Trust Waters Area of Environmental Concern (AEC).
Basis for Determination:
The Edenton/Chowan County Future Land Use Map identifies the project site as adjacent to
"Medium/High Density Residential". As indicated on Page 146, estuarine waters, estuarine
shoreline, and public trust areas are considered to be part of the "Conservation/Open Space"
designation.
Definitions of key words are provided on page 115 of 233. These words include "Support:
Supply the needed staff support, policies, and financial assistance at all levels to achieve the
desired goal".

Dear Mr. Powell:
The NC Division of Coastal Management hereby acknowledges receipt of the application
submitted on behalf of Chowan County for State approval for development of their
property located at Pembroke Creek Park in Edenton, Chowan County. It was received
complete on March 16, 2015, and appears to be adequate for processing at this time.
The projected deadline for making a decision is May 30, 2015. An additional 75-day
review period is provided by law when such time is necessary to complete the review.
If you have not been notified of a final action by the initial deadline stated above, you
should consider the review period extended. Under those circumstances, this letter will
serve as your notice of an extended review. However, an additional letter will be
provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from March 16, 2015,
you may request a meeting with the Director of the Division of Coastal Management
and permit staff to discuss the status of your project. Such a meeting will be held
within five working days from the receipt of your written request and shall include the
property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of
the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard
which must be posted at the property of your proposed development. You should post
this notice at a conspicuous point along the property where it can be observed from a
public road. Some examples would be: Nailing the notice card to a telephone pole or
tree along the road right-of-way fronting the property, or at a point along the road
right-of-way where a private road would lead one into the property. Failure to post this
notice could result in an incomplete application.
