This permit, issued on June 6, 2016 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) Unless specifically altered herein, this Minor Modification authorizes the filling and grading of a
70'x90' (6,300 total sf area) area in a non -coastal wetland area on the northeast corner of the lower
pond north of the Presbyterian church and west of Yaupon Drive, all as expressly and specifically set
forth in the attached letter and workplan drawing. Any additional land disturbing activities and/or
construction may require a modification of this permit.
2) This Minor Modification shall be attached to the original Permit No. 64-15, which was issued on
6/1/15, and copies of both documents must be readily available on site when Division personnel
inspect the project for compliance.
3) All conditions and stipulations of the active permit remain in force under this Minor Modification,
unless specifically altered herein.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
g This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on

Please find correspondence enclosed dated 04/18/2016 from Kris Bass, requesting a permit modification.
State Permit No. 64-15 was issued on 06/01/2015 for the construction of an infiltration wetland and a salt
marsh wetland from two on-line ponds contiguous with Deer Creek and Bogue Sound, Carteret County.
The permit expires on December 31, 2018.
The applicant is requesting to fill and grade a 70' x 90' (6,300 total sf area) with approximately 50' x 70'
(3,500 sf) impact to a non -coastal wetland area on the northeast comer of the lower pond. This area is in
the eastern pond north of the Presbyterian Church and west of Yaupon Drive, immediately south of the NC
Hwy 24 DOT Rights -of -way.
A check (#1597), received on 05/05/2016, in the amount of $100 has been received in order to process the
request.

Cape Carteret Stormwater Ponds Retrofit
Request for Modificaton
Dear Mr. Brownlow,
Thank you for meeting with us on -site and assisting us as we work to complete this innovative
restoration project. As discussed, we are proposing an adjustment to the grading of the marsh
restoration in the lower pond (at the Presbyterian Church). We would like to fill a small area of
the pond that is quite close to Highway 24. This area has a very steep slope leading down to the
pond, and now that we have begun grading activities, the instability of the slope is apparent. We
are proposing to soften the slope away from the road and sidewalk, and match the existing
elevations on both sides. The grading change will help improve the safety of the sidewalk and
improve access around the site for maintenance equipment. The revised grading will require a
small wetland impact that was not in our original proposal. Because our project is a restoration,
we will attempt to minimize the total by adjusting the slopes to provide the most marsh possible
on the site. The maximum amount of wetland impact will be 3,500 square feet.
I am including a revised grading plan and a profile of a proposed modification of the site plan for
your review and circulation. Please let me know if there are any questions.

Andy,
I spoke to Anthony Scarbraugh about this project early last week and he did confirm that DWR will still have to produce
a Use Attainability Analysis with our new/current plan. It was conveyed to me that it is a statutory requirement for DWR
for any new marina. Based on the age of the nearby marinas (Bailey and Umphlett), DWR either was not required to
produce a copy of past UAAs or they do not have that information available. Do you have the ability to search available
databases going back to 1975 in relation to shellfish resources in this location? It is my understanding that DWR would
produce the UAA, but I would contact you or others to assist with gathering the relevant data.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and
where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The
original (buff -colored form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may
contact Department personnel at any time for assistance. By working in accordance with the permit, you
will be helping to protect our vitally important coastal resources.
