BRAXTON DAVIS l Irt'HJf Pk 'Cr This letter of refinement is in reference to the 06/08/2017 correspondence and email from the NCCF requesting a modification of Major CAMA Permit No. 64-15 issued to NCCF on 06/01/2015. Permit No. 64-15 authorizes a wetlands restoration project on property located adjacent to Bogue Sound on in Cape Carteret, Carteret County, North Carolina. The request to modify and repair the slope of the project embankments; replace the existing concrete connecting pipe between the two project areas with proposed 24-inch diameter double wall HDPE piping; and restoring the finish grade and stone as shown on drawings prepared by Professional Engineer Bass, dated 06/09/2017, is hereby authorized. Functional sedimentation barriers shall be installed prior to work commencing, including on the project's (west) side of Yaupon Drive to prevent any possible sedimentation, silt or runoff into the contiguous waterbody of Deer Creek and Bogue Sound until the work is completed and the area is effectively stabilized. All permit conditions including the 12/31/2018 expiration date still apply and remain unchanged. Please append this letter to the permit file to document authorization to proceed with the proposal. REGAN seemory BRAXTON DAVIS Director COPY This letter is in reference to the 07/2712017 email correspondence from Lexia Weaver of the NCC, the authorized agent for CAMA Major Permit No. 64-15. Ms. Weaver requests the Division's position specifically on the spillway structure that was installed in the top of the earthen berm between the two ponds. The purpose of this letter is to clarify the Division of Coastal Management's position on the spillway. CAMA Major Permit No. 64-15 authorizes a wetlands creation project on property located adjacent to Deer Creek in Cape Carteret, Carteret County, North Carolina. On 06/08/2017, the NCCF requested a modification of Major CAMA Permit No. 64-15 due to significant erosion occurring within the project. The modification request was to modify and repairthe slope of the project embankments; replace the existing concrete connecting pipe between the two project areas (the ponds) with a 24-inch diameter double wall HDPE piping; and restore the finish grade and stone as shown on drawings prepared by Professional Engineer Bass, dated 06/09/2017. The plans submitted and the scope of the work did not show or provide information about the spillway which was not part of the original scope of work nor the modification request. Therefore, the Division of Coastal Management (DCM) requested verification that the property owners (the Churches) are reasonably aware of the work that was not shown on the original plans which is the spillway constructed on the Cape Carteret Presbyterian Church and the Cape Carteret Baptist Church properties. The DCM requested the NCCF to submit to the DCM signed letters from the churches that they have no objections to the modification done to the top elevation of the earthen bens; or NCCF can restore the finished grade at the top of the earthen berm embankment to its original grade prior to its disturbance. The DCM does not object to the design or the installation of the spillway. Likewise, the DCM did not require the installation of the spillway, therefore the Division does not object to the removal of the spillway. The purpose of the notifications was to ensure the changes made were acknowledged by the property owners since it was not part of the original permit application or modification. The waters within the ponds located to the north of the Cape Carteret Baptist Church are not classified as Outstanding Resource Waters (ORW) nor is it within the ORW Management Areas (575' Area of Environmental Concern). The waters in the pond which is intimately connected to Deer Creek are not considered to be navigable but the area does have tidal Flooded marsh with coastal wetland species. Therefore, that pond may be subject to the Coastal Shoreline rules and subject to CAMA Permits for development within 75' of the normal high water level. The coastal wetlands within the pond (eastern most pond) flooded by Deer Creek are also subject to the CAMA and the Coastal Resources Commission's rules for the Coastal Wetlands Area of Environmental Concern.
