Permit Class NEW Permit Number 106-15 STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Vermit for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 X Excavation and/or filling pursuant to NCGS 113-229 Issued to Isabelle Cantrell, 400 Lawson Road, Washington, NC 27889 Authorizing development in Beaufort County at adjacent to the Pamlico River at 233 Robert Cox Road, east of Bath NC, as requested in the permittee's application dated 8/5/15 (MP-1, MP-2), 8/18/15 (MP-4) including attached workplan drawings (1-3), 1-2 dated 2/27/15 and 3 dated 8/17/15. This permit, issued on September 25, 2015 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization 1) The alignment of the permitted bulkhead shall be verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -verified by DCM within a maximum of 30 days prior to the new expected start of construction. 2) The bulkhead shall be constructed prior to any backfilling activities. 3) The temporary placement or double handling of fill materials within water or vegetated wetlands is not authorized. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the qualified persons within twenty (20) days of the issuing date. Chairman of the Coastal Resources Commission. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee e Isabelle Cantrell Permit No.106-15 Page 2 of 4 ADDITIONAL CONDITIONS 4) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 5) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 6) No excavation, or other land disturbing activities, is permitted except for that which may be required for the construction of the bulkhead wall. This permit does not authorize any excavation waterward of the approved alignment. 7) All backfill material shall be clean and free of any pollutants except in trace quantities. 8) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 9) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to prevent its movement from the site by wave or current action. 10) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite or broken concrete. Docking Facility 11) This permit authorizes only the pier, platform, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 12) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 13) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 14) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 15) This permit authorizes a maximum of one formalized boat slip. 16) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Isabelle Cantrell Permit No. 106-15 Page 3 of 4 ADDITIONAL CONDITIONS Sedimentation and Erosion Control 17) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 18) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 19) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 20) No open water areas shall be excavated or filled, even temporarily, outside of the area as indicated on the attached workplan drawing. 21) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written consent of the Division of Coastal Management. 22) No excavation or filling of any vegetated wetlands is authorized by this permit. 23) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID No. 201501935). NOTE: The N.C. Division of Water Resources authorizerd the proposed project by way of General Water Quality Certification 3900 and assigned the project DWR Project No. 15-0880. NOTE: The permittee is advised that any development or land disturbing activity that is considered non - water dependent is not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission (EMC) Tar Pamlico buffer regulations in place at the time of such development. NOTE: The N.C. Division of Water Resources exempted the proposed project from stormwater requirements under Project No. SW7150811. NOTE: Future development of the pemuttee's property may require a modification of this permit. PROJECT SUMMARY: The applicant proposes to construct a 5' tall bulkhead out of wood or vinyl with an average alignment 9' below the normal water level and a sloping (2':1') riprap revetment adjacent/waterward of the proposed bulkhead. Cantrell Pamlico River Beaufort County Project Setting The f0.50 acre project site is a developed single family residential lot located in a residential subdivision off SR 1772 at 233 Robert Cox Road adjacent the Pamlico River east of Bath in Beaufort County, North Carolina. The project site is part of a peninsula of land created by the confluence of St. Clair Creek with the Pamlico River. There is an area of Coastal Wetland marsh that abuts the project site that forms the tip of the peninsula sharing a contiguous shoreline on the Pamlico River into St. Clair Creek. The project site is developed with a brick single story residence. The lot, although adjacent to a coastal wetland marsh, is entirely uplands with an elevation of 6' or higher above the normal water level (NWL). The lot is vegetated with lawn grasses and various hardwood trees including loblolly pine, magnolia, pecan and black walnut trees. There is a 12' wide concrete boat ramp ' that straddles the property line (Cantrell/Newman) on the east side adjacent the Pamlico River shoreline that once was shared by the applicant and the adjacent property owner Newman. The boat ramp has been undermined by erosion causing the concrete to buckle and break. The failure of the boat ramp was brought on by the complete failure, over time, of the bulkhead and riprap revetment that once stabilized the project site. Remnant boards and scattered riprap are all that remains to discern the previous bulkhead/revetment alignment. Most likely the bulkhead/revetment was damaged during the hurricanes in the late 90's and early 2000. This high energy shoreline is subject to a fetch of t5 miles when the wind blows from the southwest and has eroded the bank to within 30' of the existing residence. The shoreline has taken a half moon shape. The erosion of the shoreline has been most severe in front of the existing residence. There is a 6' tall vertical erosion escarpment that starts of the east side of the property adjacent the boat ramp and extends west down the shoreline across the front of the house. The west side of the property has ,experienced less erosion possibly due to presence of more riprap in this area. The escarpment tapers to a flatter slope with a sandy beach and more consolidated riprap revetment. The erosion has left a shelf landward of the previous existing bulkhead. Water depths are less than a foot on this shelf. Water depths deepen quickly to 3' below the NWL waterward of the destroyed bulkhead alignment. The Pamlico River in this location is designated as Coastal Waters by the Marine Fisheries Commission. The Environmental Management Commission has classified the Pamlico River as SB NSW in this location and this area of the Pamlico River is closed to shellfishing. Project Description RECENED The applicant proposes to reestablish part of the eroded shoreline by constructing a bulkhead with an alignment that will start from the existing bulkhead comer on the NewmanSEP 0 9 2015 Isabelle W. From this point the proposed alignment continues in a straight line above the NWL for another 28' before turning landward 90 degrees with the shoreline remaining above the NWL for another 24' where it will end. This proposed bulkhead will average f9' below the NWL with the fiuthest point below the NWL at 21'. The bulkhead will be constructed either out of wood or vinyl and will be 5' tall. The applicant proposes to place a riprap revetment waterward of the bulkhead on a 2':P slope with the riprap toe 10' waterward of the proposed bulkhead. The applicant also proposes to construct a 6' x 80' pier with a 16'x 16' L-head platform and a 13' x 13' boatlift. The boatlift is to be constructed at the offshore end of the proposed pier on the east side. Project Impacts The proposed alignment of the bulkhead will result in the filling of 1,710 ftz of Pamlico River bottom with earthen backfill and 1,900 ft2 of Pamlico River bottom with granite rip rap. The earthen backfill and bulkhead tie back installation will disturb 1,800 ft' of uplands. The pier and platform will shade 256 ftz of Pamlico. River bottom. Staff has reviewed the proposed bulkhead alignment and feels an argument can be made in support of the proposed alignment based on 7H.O2O8(b)(7)(D)(ii) in that the alignment prevents a 90 degree corner were the new bulkhead would adjoin the adjacent property owner's existing bulkhead and would allow for a bulkhead to be constructed in a straight line making it stronger and less app to fail. The proposed riprap will further armor the bulkhead and significantly reduce the risk of failure on this high energy shoreline. Also, the proposed bulkhead alignment would reduce/eliminate the threat to the existing residence from erosion that has encroached to within 30'. The proposed pier, platform and open boatlift are consistent with the specific use standards found in 7H.O2O8(b)(6). Therefore staff recommends issuance of the permit for the aforementioned development activities with the standard permit conditions for bulkhead and pier construction. Overview: The subject property is a .5 acre site with approximately 190 linear feet of shoreline along the Pamlico River. The site is elevated 6 feet above Normal Water Level (NWL) and is vegetated with lawn grasses and hardwood trees. The property is located within the AE Floodzone. Existing site improvements consist of a single-family residence. Existing shoreline improvements include a failing 12 foot wide boat ramp that straddles the eastern property line, a destroyed bulkhead and scattered riprap. The high energy shoreline is subject to a fetch of 5 miles. Severe erosion has occurred along the shoreline. A 6 foot tall vertical erosion escarpment extends west from the boat ramp along the shoreline and in front of the residence then tapers to a flatter slope with a sandy beach and more consolidated riprap revetment. The shoreline is eroded to within 30 feet of the residence. An erosion shelf is located landward of the destroyed bulkhead. Water depths are less than a foot on the shelf and deepen to 3 feet below NWL waterward of the destroyed bulkhead. Installation of 190 linear feet of bulkhead with riprap revetment and a 6 foot by 80 foot pier with a 16 foot by 16 foot 'L'-head platform and a 13 foot by 13 foot boatlift is proposed. The existing boat ramp will be removed. The bulkhead will be 5 feet in height. The bulkhead will be located an average of 9 feet waterward of NWL with the furthest point being 21 feet waterward of NWL. The riprap revetment will be installed waterward of the bulkhead with a 10 foot toe and a slope of 2:1 feet. Cantrell Pamlico River Beaufort County Project Setting The ±0.5O acre project site is a developed single family residential lot located in a residential subdivision off SR 1772 at 233 Robert Cox Road adjacent the Pamlico River east of Bath in Beaufort County, North Carolina. The project site is part of a peninsula of land created by the confluence of St. Clair Creek with the Pamlico River. There is an area of Coastal Wetland marsh that abuts the project site that forms the tip of the peninsula sharing a contiguous shoreline on the Pamlico River into St. Clair Creek. The project site is developed with a brick single story residence. The lot, although adjacent to a coastal wetland marsh, is entirely uplands with an elevation of 6' or higher above the normal water level (NWL). The lot is vegetated with lawn grasses and various hardwood trees including loblolly pine, magnolia, pecan and black walnut trees. There is a 12' wide concrete boat ramp ' that straddles the property line (Cantrell/Newman) on the east side adjacent the Pamlico River shoreline that once was shared by the applicant and the adjacent property owner Newman. The boat ramp has been undermined by erosion causing the concrete to buckle and break. The failure of the boat ramp was brought on by the complete failure, over time, of the bulkhead and riprap revetment that once stabilized the project site. Remnant boards and scattered riprap are all that remains to discern the previous bulkhead/revetment alignment. Most likely the bulkhead/revetment was damaged during the hurricanes in the late 9O's and early 2000. This high energy shoreline is subject to a fetch of f5 miles when the wind blows from the southwest and has eroded the bank to within 30' of the existing residence. The shoreline has taken a half moon shape. The erosion of the shoreline has been most severe in front of the existing residence. There is a 6' tall vertical erosion escarpment that starts of the east side of the property adjacent the boat ramp and extends west down the shoreline across the front of the house. The west side of the property has experienced less erosion possibly due to presence of more riprap in this area. The escarpment tapers to a flatter slope with a sandy beach and more consolidated riprap revetment. The erosion has left a shelf landward of the previous existing bulkhead. Water depths are less than a foot on this shelf. Water depths deepen quickly to 3' below the NWL waterward of the destroyed bulkhead alignment. The Pamlico River in this location is designated as Coastal Waters by the Marine Fisheries Commission. The Environmental Management Commission has classified the Pamlico River as SB NSW in this location and this area of the Pamlico River is closed to shellfishing. Project Description The applicant proposes to reestablish part of the eroded shoreline by constructing a bulkhead with an alignment that will start from the existing bulkhead comer on the New ivEo SEP 17 2015 Isabelle W. From this point the proposed alignment continues in a straight line above the NWL for another 28' before turning landward 90 degrees with the shoreline remaining above the NWL for another 24' where it will end. This proposed bulkhead will average t9' below the NWL with the furthest point below the NWL at 21'. The bulkhead will be constructed either out of wood or vinyl and will be 5' tall. The applicant proposes to place a riprap revetment waterward of the bulkhead on a 2':1' slope with the riprap toe 10' waterward of the proposed bulkhead. The applicant also proposes to construct a 6' x 80' pier with a 16'x 16' L-head platform and a 13' x 13' boatlift. The boatlift is to be constructed at the offshore end of the proposed pier on the east side. Project Impacts The proposed alignment of the bulkhead will result in the filling of 1,710 ft' of Pamlico River bottom with earthen backfill and 1,900 ft' of Pamlico River bottom with granite rip rap. The earthen backfill and bulkhead tie back installation will disturb 1,800 ft' of uplands. The pier and platform will shade 256 ft' of Pamlico River bottom. There will be some localized short term turbidity during the aforementioned construction activities.
