Any violation of these terms may be subiect to fines, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization 1) The authorized bulkhead, riprap, and associated access steps shall adhere to the alignment depicted on the attached workplan drawings. 2) The alignment of the permitted bulkhead and riprap shall be staked by the permittee and approved by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of any construction. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Camp Don Lee Permit # 5645 Page 2 of 3 ADDITIONAL CONDITIONS 3) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 4) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation landward of the authorized alignment is permitted except for that which may be required for the construction of the bulkhead wall and deadmen cables, etc. 5) The bulkhead shall be constructed prior to any backfilling activities. 6) All backfill material shall be clean and free of any pollutants except in trace quantities. 7) The riprap material shall be free from loose dirt or any pollutant. It must be of a size sufficient to prevent its movement from the approved alignment by wave or current action. 8) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite, marl, or broken concrete. Sedimentation and Erosion Control 9) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 10) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfrlling activities. General 11) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 12) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation in order to discuss the conditions set forth in this permit. 13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. Field Investigation Report: Camp Don Lee Page 2 Narrative Description: The property is located adjacent'to the Neuse River at 315 Camp Don Lee Road (SR 1303) near Arapahoe, Pamlico County. This 43-acre parcel is developed with the necessary facilities to support a Methodist summer retreat. The adjacent property to the west is similarly developed (Camp Sea Gull) and the adjacent property to the east is developed with a single family dwelling. The elevation of the high ground of the parcel is about 6' above the normal water level (nwl). Vegetation on the tract mainly consists of pine trees and lawn grasses, with a fringe of Coastal Wetlands along the east and west property boundaries. There are no Coastal Wetlands in the vicinity of the project area. This parcel has approximately 2,600' of continuous shoreline along the Neuse River. Immediate offshore water depths adjacent to the parcel range from —1' to —3' NWL. The subaqueous substrate is firm without shell. There is not a cultural resource in the nearby vicinity of the project area. This waterbody is approximately 3 miles across at this location. These waters are not classified as a Primary Nursery Area and there is not any submerged aquatic vegetation present. This area is closed to shellfish harvest and is classified as SA; HQW, Nutrient Sensitive Waters. There is not a defined Federal Channel in the nearby vicinity of this project area. This project area is subject to the Neuse River Riparian Buffer Rules. 10. Proposed Development: The applicant wishes to construct two vinyl bulkheads and riprap adjacent to the Neuse River, near Arapahoe. The proposed development will take.place at 315 Camp Don Lee Road, Pamlico County. There has been significant shoreline erosion over the past few months which has the ability to compromise some of the Camp's structures nearby. This shoreline stabilization project is proposed in two separate phases, or sections. The first phase proposed is to construct a 300' long vinyl bulkhead, along with 460' of rip rap in front of the bulkhead and extending past it to the southwest corner of the property. A set of steps is also being proposed as a means of access to the water's edge. The second phase proposed is a 70' long section of rip rap to the west of the existing dock, and 760' of vinyl bulkhead along the shoreline to the east of the existing dock near the center of the southern property boundary. The rip rap revetments would not exceed 10' waterward of the NWL. The proposed bulkheads will be constructed along the erosion escarpment at the NWL. The proposed bulkheads will be 6' high as measured from the substrate and have 10' tie back rods to the dead men anchors buried in the high ground. All of the proposed work is to be accomplished using typical marine construction techniques from the high ground. Anticipated Impacts: The proposed rip rap revetments will fill 2,500 square feet of shallow bottom in these Estuarine Waters. The proposed vinyl bulkheads will fill 12,840 square feet of high ground along the shoreline. Traditional marine construction methodology will be utilized during the construction of this public docking facility, dredging, and boat ramp. Temporary turbidity impacts are anticipated during construction. A turbidity curtain will be placed across the canal and silt fencing installed to prevent sediment from entering the adjacent waterbody. There is not a cultural resource in the nearby vicinity of the project area. This project area is subject to the Neuse River Riparian Buffer Rules. These waters of the Neuse River are not classified as a Primary Nursery Area and there is no submerged aquatic vegetation present. Management of such spills shall comply with provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act. Turbidity Standard The Permittee shall adhere specially to 15A NCAC 02B .0220 Tidal Salt Water Quality for Class SA Waters (3)(g) pH: shall be normal for waters in the area, which generally shall range between 6.8 and 8.5 except that swamp waters may have a pH as low as 4.3 if it is the result of natural conditions; (1) Turbidity: the turbidity in the receiving water shall not exceed 25 NTU; if turbidity exceeds this level due to natural background conditions, the existing turbidity level shall not be increased. Re Opener Clause The Camp Don Lee and their authorized agents shall conduct their activities in a manner consistent with State water quality standards (including any requirements resulting from compliance with section 303(d) of the Clean Water Act) and any other appropriate requirements of State law and federal law. The Camp' Don Lee shall require their contractors (and/or agents) to comply with all of the terms of this Certification, and shall provide each of their contractors (and/or agents) a copy of this Certification. A copy of this Certification shall be included In the construction contract and available on the job site at all times. If DWR determines that such standards or laws are not being met (including the failure to sustain a designated or achieved use) or that State or federal law is being violated, or that further conditions are necessary to assure compliance, DWR may reevaluate and modify this certification to include conditions appropriate to assure compliance with such standards and requirements in accordance with 15A NCAC 2H.0507(d). All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal, relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910- 3282 at least two weeks prior to beginning work and upon completion of work. 3. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 4. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 6. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the work authorized by this permit and again upon completion of the work authorized by this permit. 8. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 9. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter I I3A Article 4). 10. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 11. We are proposing two phases of vinyl and rip rap bulkheads. The shoreline is eroding in several areas. Some areas of the shoreline are being eroded leaving a vulnerable and steep bank. We are proposing bulkheads in an attempt to stabilize the shoreline and prevent any further loss of shoreline. Phase I will consist of 300' of Vinyl Bulkhead and 460' of Rip Rap along with a set of steps to provide access to the beach area that is along the shoreline. Phase II will consist of 730' of Vinyl Bulkhead and 70' of Rip Rap. The vinyl will begin where the existing dock is located and will run east along the shoreline outlining an existing boat ramp. The Rip Rap will be installed to the west of the dock joining existing rip rap. Interlocking vinyl sheet panels will be driven into the shoreline. Most panels will be 12', 6' driven, 6' exposed. The length of the vinyl panels will follow the natural elevation of the shoreline. The vinyl bulkhead will utilize the Navy anchor system, with pilings driven along the waterward side of the wall. A deadman anchor system will be installed. An excavator with a vibratory head will be used for the installation of the panels from the land. A rip rap, or rock bulkhead will also be installed from the land with an excavator with a bucket.
