Town of Belvilk Riverwalk, Brunswick County
Mr. Jeffrey Cappadona, of Cavanaugh & Associates, and acting as agent for the Town of
Belville, is requesting the renewal of State Permit No. 119-15, issued on October 20, 2015, and due to
expire on December 31, 2018. Mr. Cappadona states that in the near future, the town will submit a
request for a Minor Modification to install a floating dock for the Eagle Island Community Rowing Club.
Thus, the renewal is necessary.
This Office has no objection to the renewal of State Permit No.119-15. Mr. Cappadona has
submitted a check (no. 60690) in the fee amount of $100.

Brunswick Riverwalk CAMA Permit (Permit Number 119-15), which is currently set to expire on
December 31, 2018. The Town intends to adhere to all conditions of the permit, as it's currently
written, throughout the life of the permit. It is the Town's understanding that the permit will be
renewed for a period of three (3) years.

In response to your email from the 191, please see below for the correspondence that the Town had
with Brooks Surgan. The Town is in the process of approving the Eagles Island Community Rowing Club
to install a floating dock at the Town's Riverwalk park. Per the email string below, the Club is planning
to submit the floating dock to CAMA at a later date, but since the existing major permit expires on
December 3V, we were working with Brooks to renew the permit so that the Club can plan to submit
their documents as a Minor Modification to the major permit.
Please let me know if you need more information to proceed with the renewal request. Thanks.

Sorry for getting.back to you late, I misplaced the card you had handed me at our meeting but I was able
to find it. The waters off the park are PNA so the proposed float would require at least 18" of depth at
Low Water. I looked in to the major permit for this and it is still active until December 31, 2018. 1 think
your proposal would be a minor modification to the permit but I will need to check with the district
manager to be sure.

River Road in Belville , as requested in the permittee's application dated 5/29/15 (MP-1, MP-4)
and 7/9/15 (MP-3) including attached workplan drawings (10), as referenced in Condition No. 1 on this permit.
This permit, issued on October 20, 2015 . , is subject to compliance with the application (where
consistent -with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
NOTE: In accordance with commitments made by the permittee, and to address cultural resource
concerns, the proposed observation deck indicated in the attached permit application and
workplan drawings is hereby deleted.
1) Unless specifically altered herein, this permit authorizes the construction of a boardwalk/walking trail
system and one pier on the Cape Fear River, within the Brunswick Riverwalk at Belville, all as..
depicted in the attached permit application and workplan drawings: 10 dated 7/9/ 15 C.1.1, C.3.1,
C.4.1, C.4.2, C.4.3, C.4.4, C..4.5, C.4.7, C.5.1, and C.6.1. RECEIVED

This permit action may be appealed by the permittee or other Signed by the authgrity of the Secretary of DEQ and the

Fishing Pier,
2) This permit authorizes only the fishing pier -and uses located in or over the water that are expressly and
specifically set forth. in the permit application: No other structure, whether floating or stationary, shall
become a permanent part of this pier without permit modification. No non -water dependent uses of
structures shall be conducted on, in or over Public Trust waters without permit modification..
3) 'The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abaridons the
permitted activity without having it transferred to a third party.
4) Any portion of the permitted fishing.pier built over Coastal Wetlands shall not exceed six feet in width
and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of
the decking.
5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it. more visible during hours of darkness or
inclement weather.
6) This permit does not authorize any formalized boat slips.
7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
8) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with .
T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation
within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is
not authorized. This. prohibition shall be applied and enforced throughout the entire existence ofthe
permitted structure:
9) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement theti;S. Fish.&'Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

10) The portions of the authorized boardwalk located over Coastal Wetlands shall be no wider than eight
feet and shall be elevated at least three feet above the coastal wetland substrate as measured from the
bottom of the decking.
11) The portions of the authorized boardwalk not located over Coastal Wetlands, but located within 30 feet
of the normal high water level shall be slatted, wooden, and elevated. RECEIVED

Upland Development
12) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the above referenced property,.including the trails, boardwalks, and
walkways, all as expressly and specifically set forth in the attached permit application and work
drawings.
Cultural Resource Protection
13) Prior to the initiation of any land -disturbing activities_ located on high ground authorized by this permit,
the penmittee 'shall, in coordination with the N.C. Department of Natural and Cultural Resources
(NCDNCR), develop and implement an archaeological survey of the proposed project area. Initiation of
permitted land -disturbing activities shall not begin until written approval is obtained from NCDNCR, and
a copy of such approval has been submitted to the Division of Coastal Management.
Stormwater Manaeement
14) The Division of Energy Mineral and Land Resources approval of this project under stormwater
management rules of the Environmental Management Commission is covered by way of StED
Permit No. SW8150718, which was issued on 8/5/15. Any violation of the permit approved by the
DEMLR shall be considered a violation of this CA.MA permit. .. JAN 0 7 2019

Erosion & Sedimentation Control
NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be
filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this
plan to the Department of Environmental Quality, Land Quality Section, 127 Cardinal Drive Ext,
Wilmington, NC 28405.
15) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
16) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of

18) - This permit does not authorize the interference with any existing or proposed Federal project, and; the
permittee shall not be.entitled to compensation for damage to the authorized structure or work, orinjury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
19) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: IE is recommended that the permittee contact the N:C: Department of Transportation NCDOT)
prior to the initiation of development to ensure that all activities are consistent with NCDOT
right of way requirements.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project Action ID No. SAW-2012-
02046.
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 3900 and assigned the project .DWRProject No. 15-0780.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910). 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: An application processing fee of $400 was received by DCM for this project.
