HomeMy WebLinkAboutSC_04-99_Main/Patei Surf City/fender Local Government CAMA MINOR DEVELOPMENT PERMIT as authorized by the State of North Carolina, Department of Environment, Health, and Natural Resources and the Coastal Resources Commission for development in an area of environment concern pursuant to Section 113A-118 of the General Statues, "Coastal Area Management - SC 04/99 Permit Number Issued to Lewis Main 7 Shelia Pots authorizing development in Ocean Hazard AEC at 814 S. Shore Drive as requested in the permiftee's application, dated 5-3-04 . This permit, issued on 5-20-04 , is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. PERMIT TO ERECT 16 x 16 UNCOVERED DECK I- The structure shall comply with the NC Building Code, including the Coastal and Flood Plain Construction Standards, Chapter 4445, 2000 Residential Building Code, and the Local Flood Damage Prevention Ordinance as required by the National Flood Insurance Program. If any provisions of the building code or a flood damage prevention ordinance is inconsistent with any of the following AEC standards, the more restrictive provision shall control. 2- The structure must set back 60 feet from are fast line of stable natural vegetation 3- The structure must be located entirely off of the frontal dune, and if a primary dune is present, behind the crest of the primary done. 4- The structure must be elevated on pilings with a diameter of at least 8 inches and the lowest horizontal structural member rust meet the 100-year flood level elevation of determined for this lot 5- All pilings shall have a tip penetration of 16 feet below wasting grade or 5 feet below meant sea level whichever is less For those structures so located on the primary done or nearer to the ooean, the pilings must extend to five feet below mean sea level. 6- Done disturbances will be allowed only to the mound necessary fro development and if the dune's protective value is not weakened or reduced disturbed areas will be immediately stabilized 7- This pemdt may be renewed for one year if requested before the expiration date. 8- The permittee is required to contact the Local Permit Officer shortly before he plans to begin construction to arrange a setback measurement which win be effective for sioy days barring a major shoreline change. Construction must begin within 60 days of the determination or the measuemem is void and must be redone. 9- Sand used to strengthen duress must be brought in fran an outside source and must be of the same nature as the sand in the area in which it is to be placed. No sand is to be removed from the lot 10- Sand held in storage in any due, other than frontal or primary dunes may be moved laterally in order to strengthen existing primary or frontal domes if the work would enhance the protection to the proposed development activity and the sand is immediately stabilized It- All development must be or n stem with all -applicable, Federal, State, and Local standards. 12- Any structure authorized by this permit shall be relocated or dismantled when it becomes imrmvrently threatened by changes in the shoreline configuration. The structure shall be relocated or dismantled within two years ofthe time when it becomes imminently threatened, and in any case, upon its collapse or subsidence. However, if natural shoreline recovery or beach re-nourishnwm lakes place within two years of the time the structure becomes imminently threatened, so that the structure a no longer irm merdly threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the pernit holder's right to seek authorization of temporary protective measures allowed under CRC Rules. 13- All construction will be landward of the vegetation lice. 14- Pur amot to 15A NCAC, Subchapter 7J.0406(bl this permit may not be assigned, transferred, sold or dherwise disposed of to a tilla This permit action may be appealed by the permittee Or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All wait must cease when this permit expres on December 31, 2007 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. Shore Drive. The application may be inspected at the address below. Public comments received by 5-13-04 will be considered. Later comments will be accepted and considered up to the time of permit decision. Project modifications may occur based on further review and comments.
