Maguth & Ralph Edaar Trust , authorldng development in Ocean Hazard AEC of 106 S. Shore Drive (Lot #4 and Lot #3-3 as requested in the permiftee's application, dated 4-19-04 . This permit, issued on 1S 4-04 , is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. PFRMff TO ERECT DECKING AND A GAZEBO 1- The structure shall comply withthe NC Building Cade, imludingthe Coastal and Flood Plain Construction Standards, Chapter 4445, 2000 Residential Building Code, and the Local Flood Damage Prevention Ordinance as requited by the National Flood Insurance Program If any provisions of the building code or a flood damage prevention ordinance is inconsistent with any of the following AEC standards, the more restrictive provision shall council. 2- The structure roust set back 60 feet from the fast line of stable natural vegetation. 3- The structure must be located entirely off of the frortal done, and if a primary dune is present, behind the crest of the primary dame. 4- The shructure must be elevated on pilings with a diameter of at least 8 inches and the lowest horizontal structural member must meet the 100-year flood level elevation ofdetema ned for this lot 5- All pilings shall have a tip penetration of 16 feel below existing grade or 5 feet below mean sea level whichever is less. For those structures so located on the primary data or oearer to the ocean, the pilings must extend to five feet below mean sea level. 6- Duce disturbances will be allowed only to the extern necessary for development and if the dune's protective value is not weakened or reduced disturbed areas will be immediately stabilized. 7- This permit may be renewed for one year if requested before the expiration date. 8- The pennihce is required to contact the Local Permit Office shortly before he plane to begin construction to arrange a setback measurement which will be effective for sixty days barring a major shoreline change. Construction must begin within 60 days of the determination or the measurement is void and must be redone. 9- Sand used to strengthen dunes must be brought in from an outside source and must be of the same nature as the sand in the area in which it is to be placed. No sand is to be removed firm the lot. to- Sand held in storage in any dime, other than frontal or primary dunes may be moved laterally in order to strengthen existing primary or f v tat dunes if the work would enhance the protection tolhe proposed development activity and the sand is immediately stabilized It. All development most be consistent with all -applicable, Federal, State, and Local standards. 12- Any structure authorized by this pormit shall be relocated or dismantled when it be.comes urimineaitly threatened by changes in the shoreline configuration, The structure shall be relocated or dismantled within two years of the time when it becomes imminently threatened, and in any case, upon its collapse or subsidence. However, if annual shoreline recovery or beach rc-nourish ment takes place within two years of the time the structure becomes munbenthy threatened, so that the structure is an longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek authorization oftemporary protective measures allowed under CRC Rules. 13- All construction will be landward of the vegetation line. 14- Pursuard to I5A NCAC, Stiubchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise disp.7 o -AiFd-party. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All work must cease when this permit ewes on December 31, 2007 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. This permit may riot be transferred to another party without the written approval of the Division of Coastal Management. AEC HAZARD NOTICE Project Is In An: Ocean Erodible Area_ High Hazard Flood Area Date Lot Was Platted: This notice is intended to make you, the applicant, aware of the special risks and conditions associated with development in this area, which is subject to natural hazards such as storms, erosion and currents. The rules of the Coastal Resources Commission require that you receive an AEC Hazard Notice and acknowledge that notice in writing before a permit for development can be issued. The Commission's rules on building standards, oceanfront setbacks and dune alteration are designed to minimize,but not eliminate, property loss from hazards. By granting permits, the Coastal Resources Commission does not guarantee the safety of the development and assumes no liability for future damage to the development. The best available information, as accepted by the Coastal Resources Commission, indicates that the annual ocean erosion rate for the area where your property is located is feet per year. The rate was established by careful analysis of aerial photographs of the coastline taken over the past 50 years. Studies also indicate that the shoreline could move as much as J 3-4-2 feet landward in a major storm. Theflood waters in amajorstorm arepredicted to be about 141 feet deep in this area. Preferred oceanfront protection measures are beach nourishment and relocation of threatened structures. Hard erosion control structures such as bulkheads, seawalls, revetments, groins, jetties and breakwaters are prohibited. Temporary devices, including sand bags, may be allowed under certain conditions. This structure shall be relocated or dismantled within two years of becoming imminently threatened. The applicant must acknowledge this information and requirements by signing this notice in the below space. Permits issued for development in this area expire on December 31 of the third year following the year in which the permit was issued. Shortly before work begirns on the project site, the Local Permit Officer will detemine the vegetation line and setback distance at your site. If the property has seen little change and the proposed development can still meet the setback requirement, the LPO willinform you that you may begin work. It is impor- tant that you check with the LPO before the permit expires for official approval to continue the work after the permit has expired. Generally, if foundation pilings have been placed and substantial progress is continuing, permit renewal may not be necessary. If substantial progress has not been made, the permit must be renewed and a new setback line established. It is unlawful to continue work after permit expiration without this approval.
