This permit, issued on September 25, 2015 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may to lines, imprisonment or civil action; or may cause me permit to Lie null and Void. Upland Development 1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the parking lots, fuel tanks, and other associated infrastructure, all as expressly and specifically set forth in the attached permit application and work drawings. Any additional land disturbing activities or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (252) 946-6481. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature ofPermittee Beaufort County Permit No. 105-15 Page 2 of 4 ADDITIONAL CONDITIONS Boat Ramp 2) Unless specifically altered herein, this permit authorizes one, two-lane boat ramp, as indicated on the attached workplan drawings. 3) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. 4) Excavation and ground disturbing activities, associated with the placement of the boat ramp, above and below the normal water line shall be limited to that absolutely necessary to establish adequate ramp slope and provide a ramp no greater in size than specified in the attached permit application and workplan drawings. Dockine Facility 5) This permit authorizes only the reconstructed docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this reconstructed docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 6) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the reconstructed docking facility. Any sewage discharge at the reconstructed docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 7) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 9) This permit authorizes no formalized boat slips. 10) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Shoreline Stabilization 11) The alignment of the permitted bulkhead shall be verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -verified by DCM within a maximum of 30 days prior to the new expected start of construction. Beaufort County Permit No.105-15 Page 3 of 4 ADDITIONAL CONDITIONS 12) The bulkhead shall be constructed prior to any backfilling activities. 13) The temporary placement or double handling of fill materials within water or vegetated wetlands is not authorized. 14) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 15) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 16) No excavation, or other land disturbing activities, is permitted except for that which may be required for the construction of the bulkhead wall. 17) All backfill material shall be clean and free of any pollutants except in trace quantities. 18) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. Sedimentation & Erosion Control NOTE: An Erosion and Sedimentation Control Plan will be required for this project. If this plan has not already been submitted, it must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environmental Quality, Land Quality Section, 943 Washington Square Mall, Washington, NC 27889. 19) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 20) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfrlling activities. General 21) No open water areas shall be excavated or filled, even temporarily, outside of the area as indicated on the attached workplan drawings. 22) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 23) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 24) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. Beaufort County Permit No. 105-15 Page 4 of 4 ADDITIONAL CONDITIONS NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Programmatic General Permit 198000291 (Action ID No. SAW201501708), which was issued on 09/22/15. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 3900 and assigned the project DWR Project No. 10-0435 V2. NOTE: The N.C. Division of Water Resources exempted the proposed project from stormwater requirements under project No. SW7150608. NOTE: The permittee is advised that any development or land disturbing activity that is considered non - water dependent is not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission (EMC) Tar Pamlico River buffer regulations in place at the time of such development. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. The project will re -build the existing ramp as a double lane boat ramp with a floating courtesy dock to allow public access to Wrighfs Creek and the Pungo River. Project will also include a fixed crab dock, 23 trailer parking spaces, and 12 car parking spaces. The boat tamp will be open 24 hours a day, 7 days a week to the public. The crab dock will be used for loading and unloading activities. c.-Describe-the proposed construction methodology; types of construction equipment to -be used during construction, the number of each type of equipment and where it is to be stared. A long reach excavator will be used to excavate the boat ramp area and to place rip rap. A bull dozer and motorgrader will be used to grade the site. Dump trucks will be used to move soil on the site and deliver materials. Equipment will be stored on the site during construction. An excavator will be used to demolish existing docks and bulkheads. Piles nad sheet piling will be driven either with an excavator with a vibratory pile driver or by a drop hammer pile driver. Water jetting maybe required to facilitate sheet pile installation in stiff soils. Boat ramp will be constructed by the push slab method. The below water section of ramp will be cast on an upland area. After curing and grading of the ramp subgrade, a bulldozer will push the slab down the ramp and into location. The remaining ramp above the water line will be cast in place. d. List all development activities you propose. Existing docks will be removed. Existing bulkheads will be removed or demolished to below proposed grade. Existing ramp will be demolished. All existing buildings on the tract will be removed. Existing concrete pavement will be removed. Septic tank and well will be abandonded. New bulkeads will be constructed from the proposed crab dock to the existing rip rap on Wrighfs Creek. Existing rip rap will be connected to the new bulhead installed. Concrete, wood and other debris in the water at the location of bulkhead construction will be removed. Any soil that sloughs off into the ditch during bulkhead demo and construction will be excavated and placed behind the new bulkhead. A new concrete double lane ramp with courtesy dock will be constructed. Parking areas will be created. Lights will be installed in the parking areas. e. Beaufort County has purchased the property on the north..side of the basin that was developed to operate as a commercial fish house. The area is developed with buildings that once were used for an office, retail market, cooler and a freezer. There is an associated gravel drive and parking, area next to the buildings as well as above ground fuel tanks. There was a 15' wide single lane boat ramp into the basin on the west side of the buildings. This boat ramp has been and continues to be used by both recreational and commercial fisherman. Commercial fishing operations upstream of the existing boat ramp use the basin as a harbor of refuge mooring their boats "side to" a dilapidated bulkhead and or small docks. There is a continuous bulkhead that extends along the basin shoreline from the existing riprap revetment along Wrights Creek up the basin to the existing boat ramp. The bulkhead is in various states of disrepair due to differing materials and periods of repair/maintenance. The bulkhead that extends beyond the existing boat ramp has completely failed with varying amounts of erosion landward of the bulkhead. Major CAMA/Dredge and Fill permit no. 88-76 was issued to a previous property owner and authorized the excavation of a 50' wide x 400' long access channel in Wrights Creek to a 70' wide x 490' long upland basin complete with a marine railway at the head/landward end of the basin. It also authorized a pier into Wrights Creek. , All that remains of the pier is scattered pilings. The railway has been removed. The access channel has shoaled in some from the original permitted dimensions but still remains navigable by outboard boats and commercial boats to ±30'. Water depths in the channel and basin range from 3' to 6' below the normal water level (NWL). Major CAMA/Dredge and Fill permit no. 104-10 was issued on 27 September 2010 to the previous landowner and authorized the entire basin shoreline to be stabilized with a bulkhead, maintenance excavation of the basin and channel in Wrights Creek and replacement of the pier in Wrights Creek. None of the work authorized by this permit was ever undertaken. Wrights Creek is classified as SA HQW NSW by the Environmental Management Commission. The Coastat/Inland fishing line establishing the Division of Marine Fisheries or Wildlife Resource Commission jurisdiction is located just upstream of the basin. Wrights Creek is closed to the harvest of shellfish. Project Description RECEIVED JUL 3 0 2015 L Beaufort County Wrights Creek Boating Access Area Page Two The applicant, Beaufort County, has partnered with the North Carolina Wildlife Resource Commission to redevelop the site as a public boating access area. The applicant proposes to demolish and remove all the buildings, fuel tanks and other associated infrastructure on uplands to facilitate the construction of a larger concrete boat ramp and asphalt parking areas. The applicant proposes to construct a two lane boat ramp in the same location of the existing ramp. The lanes will be 15' wide with an 8' wide x 48' long floating launch pier separating the two lanes. The applicant proposes two parking areas, one 12-space parking area for vehicles only on the west side of the new boat ramp and a 23-space parking area for boat trailers on the east side of the new ramp. The boat trailer parking will have 2 spaces designated for the handicap; The vehicle only parking area will have one handicap designated space and two designated spaces for loading and unloading of commercial fishing vessels. A 7' wide x 50' long dock is proposed in the basin just west of the new ramp. This dock will be for temporary use to allow commercial fishing vessels to load and unload. An 8' wide x 55' long concrete walkway will extend from the vehicle parking to the dock. The proposed dock will not extend into the basin beyond '% the width of the basin nor exceed the allowable platform square footage allowed per the Coastal Resource Commission's rules found in NC Administrative Code T15A 7H.0208. The NC WRC mapped the existing impervious surface and determined that the project as proposed would decrease the total impervious coverage from 41.4% to 38.7%. Most of the reduction in impervious cover was from areas closest to the basin creating more vegetative buffer between the parking areas and the basin. The applicant proposes to replace the existing bulkhead for a total of 484' of new bulkhead from the existing riprap revetment on Wrights Creek to f80' upstream of the new boat ramp in the basin. The existing bulkhead remnants will be completely removed. The applicant proposes to replace the existing bulkhead for a total of 484' of new bulkhead from the existing riprap revetment on Wrights Creek to ±80' upstream of the new boat ramp in the basin. The existing bulkhead remnants will be completely removed. Piles nad sheet piling will be driven either with an excavator with a vibratory pile driver or by a drop hammer pile driver. The below water section of ramp will be cast on an upland area. After curing and grading of the ramp subgrade, a bulldozer will push the slab down the ramp and into location. Date: August 5, 2015 Consistency Determination: The request is consistent with/not in conflict with the Beaufort County Land Use Plan certified by the CRC on January 13, 2010. Overview: The subject property is a 3.11 acre site with approximately 720 linear feet of shoreline along a manmade canal and approximately 85 linear feet of shoreline along Wrights Creek, near its confluence with the Pungo River. The property is located within the AE Floodzone. Existing site improvements consist of two (2) buildings with associated septic system, above ground fuel tanks, and gravel driveway with asphalt and concrete parking areas. Existing shoreline improvements include riprap revetment along Wrights Creek and bulkhead, docks and a 15 foot wide boat ramp along the manmade canal. A 400 foot long access channel approximately 30 feet in width with water depths ranging from 3 to 6 feet below Normal Water Level (NWL) extends from the canal into Wrights Creek. A commercial fish house operated on the site before the buildings and infrastructure suffered substantial damage from Hurricane Irene in August 2011. The bulkhead is in various states of disrepair due to differing materials and periods of repair/maintenance. Shoreline erosion has occurred landward of some failed bulkhead sections. The boat ramp continues to be used by both recreational and commercial fisherman. Commercial fishermen upstream of the ramp use the manmade canal as a harbor of refuge, mooring their boats "side to" the bulkhead or docks. The facility will be open 24 hours a day 7 days a week to the public. Installation of shoreline improvements to include two (2) 15 foot wide boat ramps separated by an 8 foot wide by 48 foot floating launch pier, a 7 foot wide by 50 foot long dock, and 484 linear feet of bulkhead, and site improvements to include two (2) parking areas with a total of twelve (12) regular parking spaces and twenty-three (23) boat trailer parking spaces, and an 8 foot wide by 55 foot long concrete walkway is proposed. The existing boat ramp will be removed and the new ramp placed in its location. New bulkhead will extend from the existing riprap revetment at Wrights Creek to 80 feet west of the new boat ramp. Existing bulkhead remnants will be removed. Where existing bulkhead is intact, it will be cut 1 foot below grade to allow for installation of tie backs for new bulkhead that will be installed just waterward of the existing bulkhead. Existing buildings, septic system, fuel tanks, concrete pavement and associated upland infrastructure will be removed. Parking will include one (1) handicapped accessible regular space and two (2) handicapped accessible boat trailer parking spaces. The concrete walkway will connect vehicle parking to the dock. The parking area driveway will tie into the turnaround terminus of Wilkins Road. Stormwater will continue to be discharge to a ditch along Wilkins Road, which drains to Wright's Creek and to the existing access ditch on the south side of the site. The project will result in reduced impervious surface area. Most of the reduction occurs closest to the manmade canal, creating more vegetative buffer between the canal and parking areas. The Tar -Pamlico Buffer Rule applies to this location. The waters of the Wrights Creek are classified as SA HQW NSW waters and are closed to shellfish taking. A review of Submerged Aquatic Vegetation (SAV) was not provided. A review of historic and archaeological resources was not provided. Anticipated impacts resulting from this project are expected to include: the filling of 2,173 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC) and 1.7 acres of Uplands, and; the shading of 350 sq. ft. of Public Trust Area/Estuarine Waters AEC. A portion of Upland disturbance will occur within the Public Trust Area/Estuarine Shoreline AEC. In order to determine if this project requires the submission of and Environmental Assessment/Finding of No Significant Impact, or an Environmental Impact Statement, the project has been reviewed against the minimum criteria for construction activities set out in 15A NCAC 01C .408. The project does meet the minimum criteria which exclude the project from requiring environmental documents. The project meets the minimum criteria specifically as follows: • Under 15A NCAC 01 C .408 (1 xa) — The project is located within one of the 20 coastal counties. The project is located within 575 feet of waters classified as High Quality Waters, but the project impacts less than 5 acres located all or in part within 575 feet of High Quality Waters. The project is located outside of any Outstanding Resource Waters watershed. • Under 15A NCAC 01C.408 (2)(e) —The project does not include the construction of a marina. The project does not include excavation of a new channel.
