This permit, issued on December 9, 2015 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
oe subject to Dries, imprisonment or civii acnon; or may cause LOU Pcrinu w uc uuu auu V VIU.
Docking Facility
1) This permit authorizes only the reconstructed docks, piers, and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this reconstructed docking
facility without permit modification. No non -water dependent uses of structures shall be conducted
on, in or over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
reconstructed docking facility. Any sewage discharge at the reconstructed docking facility shall be
considered a violation of this permit for which the permittee is responsible. This prohibition shall be
applied and enforced throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
. Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2018
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third parry.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of 3 formalized boat slips.
6) The reconstructed pier and associated structures shall have a minimum setback distance of 15 feet
between any parts of the structure and the adjacent property owner's riparian access corridor to the west. .
7) Should the adjacent property to the east be sold prior to the initiation of construction, the permittee shall
be required to obtain a signed riparian corridor waiver from the new property owner prior to the
placement of any structures within the 15 foot riparian corridor.
8) The authorized structures and associated activity shall not exceed the established Wrightsville Beach pier
head line.
9) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct
view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee
walls are permitted. Lattice is specifically excluded from being used under this authorization.
10) The roof of the covered platform shall not be designed for second story use and shall be located entirely
over open water.
11) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
General
12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
. project initiation.
13) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
14) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.

ADDITIONAL CONDITIONS
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit
197800056 (Action ID No. SAW-2015-02152), which was issued on 10/14/15.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWQ-
15-0970.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

The enclosed CAMA Major Permit application for Ed Bartlett, 44 Pelican Drive, Wrightsville Beach, NC
28480, is to tear down and replace the existing pier and floating dock. The new fixed structure will be a
16' x 18' deck at the bulkhead with a 6' x 30' pier leading to the floating dock. The floating dock will be a
6' x 26' with a 6' x 13' L-shape at the end. There will also be 2 boat lifts. This will make a total of 3 boat
slips. This dock will be private and for family use only.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is retained by
you and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy
and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your
right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or
113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of
this decision on your permit. You should also be aware that another qualified party may submit an objection to the issuance
of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried
out in accordance with your application. Modifications, time extensions, and future maintenance requires additional
approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are
having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance.

9. PROJECT DESCRIPTION:
The project site is located at 44 Pelican Drive; adjacent to Lee's Cut, adjacent to Greenville Sound in the Town of
Wrightsville Beach, New Hanover County. To locate the property from the Wilmington Regional Office (WiRO) travel
east on Eastwood Road approximately 3 miles towards Wrightsville Beach. From the AIW W drawbridge, continue to
travel east on West Salisbury Street (US HWY 74) for approximately one mile. Turn left onto Pelican Drive and travel
east. The property of interest will be located on the left.
The property is approximately 0.2 acres with an elevation of approximately 6' above normal high water (NHW). There
is approximately 60' of shoreline frontage along Lee's Cut, which is currently stabilized by an existing timber bulkhead
The applicant currently maintains a two-story single family residence on the property. Upland vegetation consists of
maintained lawn grass and ornamental landscaping. There is an area of Coastal Wetlands waterward of the timber
bulkhead on the northern end of the property approximately 10' in width, which consists primarily of Smooth
Cordgrass (Spartina alternii fora)..
The applicant currently maintains a private docking facility within Lee's Cut. An existing access pier, measuring
approximately 32' in length by 6' in width extends waterward towards Lee's Cut, which terminates onto a fixed
uncovered platform measuring approximately 10' in length by 12' in width creating a "T-head" configuration. An
access ramp leads onto an existing floating dock, measuring approximately 25' in length by 6' in width, which runs
perpendicular to the shoreline and channel. There is one boatlift measuring approximately 13' in length by 13' in width
on the eastern side of the floating dock and two (2) tie pilings on the western side of the floating dock. The application
states the existing docking facility currently accommodates up to two (2) vessels within existing water depths ranging
from approximately 4' to -7' at normal low water (NLW) (See Sheets 3 of 3 and Project Narrative).
The Wrightsville Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion
of the project area as Developed. The waters of Lee's Cut, in Greenville Sound are classified as SB#, by the NC
Division of Water Resources. These waters are NOT designated as Primary Nursery Area (PNA), by the NC Division
of Marine Fisheries and they are CLOSED to the harvest of shellfish. RECEIVED

The applicant proposes to replace an existing docking facility within Lee's Cut. Once the existing docking facility is
completely removed, a new gazebo would be constructed just waterward of the timber bulkhead, measuring
approximately 20' in length by 18' in width, which would be located entirely over open water. An access pier,
measuring approximately 28' in length by 6' in width would extend from the northern end ofthe gazebo towards Lee's
Cut, which would lead onto a new floating dock, measuring approximately 26' in length by 6' in width, which would
run in the same alignment as the access pier. The floating dock would then turn 90' to the west a distance of
approximately 13', creating an "L-shaped" docking configuration. Two (2) boatlifts, each measuring approximately
13' in length by 13' in width would be installed. One would be located inside and one (1) would be on the eastern side
of the "L-shaped" configuration. The application states that the existing water depths at the location of the proposed
and existing structures range from approximately 4' to -T at NLW. The proposed new docking facility configuration
would potentially provide docking space for three (3) vessels at this location (See Sheets 1 through 3 of 3 and Project
Narrative).
10. ANTICIPATED IMPACTS:
The proposed new structures would incorporate an additional 1,100 sq. ft. of Public Trust Area and Estuarine Waters,
which is essentially usurped by the existing docking facility. The structures would not encroach into the 15' riparian
corridor setback requirement of the adjacent riparian properties. The proposed structures would extend approximately
80' into a waterbody, which measures approximately 470' across. This distance appears to conform to the 1/4 width
rule and would not exceed the established Town of Wrightsville Beach pier head line. The proposed structures would
accommodate up to three (3) vessels at this location within current water depths ranging from approximately 4' to -T
@ NLW. Minor increases in turbidity should be expected during the construction phase of the project; however,
turbidity levels should return to normal once the project is complete.

The total area of floating docks and platform was calculated as follows:
Shoreline length = 60' x 8 sq. ft. = 480 sq. ft.
Proposed floating dock = 6' x 26' (not calculated due to alignment)
Proposed floating dock— 6' x 13'= 78 sq. ft.
Proposed covered platform = 20' x 18' = 240 sq. ft. (credit applied through for access)
Total = 318 sq. ft.
It is the staffs recommendation the replacement of the existing docking construction of the additional floating dock at the
existing docking facility would provide docking space for three (3) vessels at this location. It appears that the project is
CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the Y4 width rule, the eight square foot
rule and the pier width rule. The proposed structures would be located entirely over open water. If the project is determined to
be consistent with NCAC 07H .0208(b) and (6), it is recommended that any permit issued should include standard permit
conditions for private docking facilities.

This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and
is thereby responsible for complying with all conditions. If total fills for this project (now or in
the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). This approval requires you to follow the
conditions listed in the attached certification and any additional conditions listed below.

This project appears to be consistent with the 2006 Wrightsville Beach Land Use
Plan Update.
The applicant proposes to replace an existing docking facility within Lee's Cut. The
project is located at 44 Pelican Drive, in Wrightsville Beach, .New Hanover County.
Areas of Environmental Concern (AFC's) impacted by the proposal are PT and EW.
Waters at the project site are classified as SB and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover
County Joint Land Use Plan Update and offer the following comments.
The general area of the project is classified as Developed and Conservation.
In general, Wrightsville Beach allows development in Resource Protection and
Conservation classified AECs, which is consistent with the State's minimum use
standards. The Wrightsville Beach Land Use Plan contains some policies, which exceed
the State's minimum use standards. However none of these policies appear to be
applicable to this project.
Provided all local, state and federal requirements can be met, this project appears to
be consistent with the 2006 Wrightsville Beach Land Use Plan Update.

The Town of Wrightsville Beach has reviewed the CAMA permit application for 44 Pelican
Drive. The Town approves of the project only if the recommended changes are incorporated
and complied with:
1. The replacement of the existing private docking facility must meet the Town's
Pierhead Line requirements, please provide a site plan that indicates the location of
the Pierhead Line in relation to the proposed docking facility.
2. The applicant must provide documentation of the adjacent riparian property owner
statement of no objection due to the encroachment of the proposed boat lift within
the 15' riparian setback.
3. The scope and intent of the project must remain consistent with the Town's 2005
CAMA Land Use Plan.
4. The applicant must take mitigation action to the maximum extent feasible to
decrease adverse impacts on water quality and to limit increases in turbidity.

authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and
boat shelters, mooring piles, dolphins, jetties and breakwater structures in navigable waters of the
United States in the State of North Carolina pursuant to Section 10 of the Rivers and Harbors Act
of 1899.
Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the enclosed general and special conditions.

this Department of the Army regional general permit does not relieve you of the responsibility to

Dear Mr. Pippin:
The Division of Coastal Management hereby acknowledges receipt of your application, acting as agent for Mr. Edwin
Bartlett, for the proposed development located at 44 Pelican Drive, adjacent to Lee's Cut in Wrightsville Beach, New
Hanover County. It was received as complete on August 24, 2015, and appears to be adequate for processing at this time.
The projected deadline for making a decision is November 8, 2015. An additional 75-day review period is provided by
law when such time is necessary to complete the review. If you have not been notified of a final action by the initial
deadline stated above, you should consider the review period extended. Under those circumstances, this letter will serve
as your notice of an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from August 24, 2015, you may request a meeting with the
Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will
be held within five working days from the receipt of your written request and shall include the property owner, developer,
and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from a
public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property; or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and federal review agencies
for their comments. If additional information is required based on this review, the agencies may contact you directly.

The Department of Environment and Natural Resources hereby gives public notice as required by NCGS
113A-119(b) that the following application was submitted for a development permit in an Area of
Environmental Concern as designated under the CAMA. According to said application, On August 24, 2015
Edwin Bartlett proposed to replace an existing docking facility at 44 Pelican Dr., adjacent to Lee's Cut in the
Town of Wrightsville Beach, in New Hanover County. A copy of the application may be examined or copied
at the office of Robb Mairs, N.C. Dept. of Environment & Natural Resources, Div. of Coastal Management, 127
Cardinal Drive Ext., Wilmington, North Carolina 28405, (910-796-7423) during normal business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400 Commerce
Avenue, Morehead City, NC 28557-3421, prior to October 10, 2015 will be considered in making the permit
decision. Later comments will be accepted and considered up to the time of permit decision. Project
modification may occur based on review and comment by the public and state and federal agencies. Notice of
the permit decision in these matters will be provided upon written request.

Management Act Major Development permit to undertake development activities at 44 Pelican Drive, in
Wrightsville Beach, New Hanover County.
Although processing of the application is nearing completion, additional time is needed for this office to complete
the review and make a decision on your request. Therefore, it is necessary that the standard review time be
extended. An additional 75 days is provided by G.S. 113A-122(c) which would make January 21, 2016, the new
deadline for reaching a decision on your request. However, we expect to take action prior to that time and will do
