This permit, issued on August 30, 2015 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Roadway and Bridt=.e Replacement 1) Unless specifically altered herein, this permit authorizes the land disturbing activities associated with the replacement of the existing bridge and roadway, all as expressly.and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (910)796-7215 for this determination. 2) No vegetated wetlands shall be filled, even temporarily, outside of the areas indicated on the attached workplan drawings. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee BHI Stage II Association NBHI Permit No. 86-15 Page 2 of 3 ADDITIONAL CONDITIONS 3) In order to ensure that the authorized culverts do not significantly impact the hydrological connectivity of upstream wetlands, the permittee shall undertake appropriate maintence activities to ensure that the culverts do not become clogged over time. Retaining Walls 4) The retaining walls shall be constructed prior to any backfrlling activities. 5) The retaining walls shall be structurally tight so as to prevent seepage of backfill materials through the structure. 6) The retaining walls shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles or other suitable materials approved by department personnel. 7) The fill material shall be clean and free of any pollutants except in trace quantities Sedimentation and Erosion Control 8) In order to protect water quality, runoff from the construction shall not visibly increase the amount of suspended sediments in adjacent waters. 9) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). 10) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. Stormwater Management 11) A stormwater management permit from the Division of Energy, Mineral and Land Resources (DEMLR) is required for the proposed project. The permittee shall receive a Stormwater Management Permit, and provide a copy of this permit to DCM, prior to the initiation of any development activities authorized by this permit. Any violation of the permit approved by the DEMLR shall be considered a violation of this CAMA permit. General 12) The temporary placement or double handling of fill materials within vegetated wetlands is not authorized. 13) If the crossing of wetlands with mechanized construction equipment is necessary, temporary construction mats shall in utilized for the areas to be crossed. The temporary mats shall be removed immediately upon completion of construction. ll BHI Stage.II AssociationNBHI Permit No. 86-15 Page 3 of ADDITIONAL CONDITIONS 14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 15) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Nationwide Permit 14 (Action ID No. SAW-2015-01 10 1), which was issued on 6/29/15. NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR- 20150579. NOTE: Future development of the permittee's property may. require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. (SEGi) has been retained by Village of Bald Head Island Stage Two Association (herein referred to as the "Applicant"), in conjunction with The Village of Bald Head Island ("Co-Appllcan6, to submit the attached permit application (Attachment 1) for a Coastal Area Management Act Major Permit, which is necessary to perform work located within The Village of Bald Head Island, Brunswick County, North Carolina The site does not have a physical address. Site Information and History: Bald Head Island was developed in the 1990's as a private, secluded residential subdivision. The NC Division of Water Quality Stormwater Unit (now under the Division of Energy, Minerals, and Land Resources) issued low density stormwater permit SW950216, which serves the Palmetto Cove area of The Village of Bald Head Island. On July 29, 2014, SEGi along with Coastal Land Design met with the agencies to evaluate the site. At that time, the DCM flagged the coastal wetland line, which was surveyed and included on the site plan. SEGi later delineated the Section 404 wetlands and submitted the Rapanos forms to Tyler Crumbley, at the US Army Corps. of Engineers. In speaking with Mr. Crumbley, it was suggested that SEGi submit the CAMA Major Application without a final Jurisdictional Determination being issued. This site is located within the AE flood zone and the Coastal Wetland Area of Environmental Concern (AEC). Normal high water is located approximately 739 linear feet northwest of the project site. Based on the fact that the proposed work will not disturb more than 1 acre, a Sediment and Erosion Control permit is not required. The temporary impact areas are being proposed as a construction buffer, as well as where the existing sewer line will be relocated. Relocating the sewer line will consist of excavating a trench approximately 12" wide and IT' to 16" below existing grade, installing the utility, and returning the area to its original grade and contour. Silt fence will be installed, along the temporary limits of disturbance/construction buffer, to ensure crews do not work outside the permitted area. Work will be performed in the dry. Details of the proposed work are illustrated within Appendix I, of the CAMA Major Permit Application. In an effort to minimiimpacts to the wetlands, the Applicant has chosen to incorporate retaining walls into the development plan. The proposed retaining walls are approximately 105' long, including wing walls, 5' high, measured from existing existing grade, and will extend approximately 12" below existing grade. While the Applicant has not determined the type of wall to be installed (i.e. sheet pile, concrete, wood, etc.), some excavation will be necessary but will be performed within the 5' construction buffer. In conjunction with the Applicant's willingness to expend additional funds to reduce impacts to the greatest extent possible, that the impact to wetlands is minimal (i.e. less than 1/10'" acre), as well as the fact that the impact area is shaded by the existing bridge, thus the loss of chemical, physical, and biological processes is anticipated to be insignificant. With that being said, the Applicant is not proposing mitigation for the impacts. SEGi feels that the proposed site plan is the least environmental damaging, practicable alternative. Highest priority of use is allocated to the conservation of existing coastal wetlands. Second priority of coastal wetland use is given to those types of development activities that require water access and cannot function elsewhere. Examples of unacceptable land uses include restaurants, businesses, residences, apartments, motels, hotels, trailer parks, parking lots, private roads, highways and factories. Examples of acceptable land uses include utility easements, fishing piers, docks, wildlife habitat management activities, and agricultural uses such as farming and forestry drainage as permitted under North Carolina's Dredge and Fill Law or other applicable laws." In the absence of any concerns from the commenting agencies, it is recommended that a permit be issued subject to the following conditions: 1. No wetland shall be excavated or filled, even temporarily, outside of the areas indicated on the attached workplan drawing. 2. The temporary placement or double handling within waters or vegetated wetlands is not authorized. 3. In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 4. A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. 5. The retaining wall shall be structurally tight so as to prevent seepage of backfill materials through the structure. 6. If the crossing of wetlands is necessary, temporary construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed immediately upon completion of construction. 7. The retaining wall shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles or other suitable materials approved by Division personnel. 8. The applicant proposes to replace an existing bridge with a roadway and three 30" culverts. The culverts are to maintain hydrologic connectivity to upstream wetlands. The replacement of the bridge with roadway will fill 307 fl of coastal wetlands and 107 f of Section 404 wetlands. Bald Head Creek is classified SA by the Environmental Management Commission and is designated a primary nursery area (PNA) by the NC Division of Marine Fisheries. The NCWRC has reviewed the permit application and does not believe the roadway will cause significant impacts to the downstream functions of the PNA. We do believe, however, that the culvert size should be enlarged since once the culverts are buried 20% the openings will be significantly smaller and may easily clog. To minimize elevated turbidity downstream, appropriate sedimentation and erosion control methods should be implemented during construction. DATE: 7/13/2015 Donald R. van der Vaart Secretary A North Carolina Division of Coastal Management (DCM), Fisheries Resource Specialist has reviewed the subject permit application for proposed actions that impact fish and fish habitats. The applicant proposes to remove an existing wooden bridge and replace with roadway and culverts. The applicant reasons that the current wooden bridge cannot support EMS and fire vehicles. Alternate EMS and fire access is available at the other end of Palmetto Cove Ct. The proposed roadway would measure 16ft. wide and would be stabilized with two 105ft. long wooden retaining walls. The retaining walls would stand 5ft. above grade and extend approximately 12ft. below grade. Three 30in. in diameter by 16ft. long culverts are proposed to connect the wetlands and buried 6in. below grade. Along the south side of the roadway a 4in, sewer line will be installed using open trenching (12in. wide x 12-16in. deep). The adjacent habitats are classified as Coastal Wetlands (CW), Primary Nursery Area (PNA), supporting shellfish harvest (SA) and is closed to shellfishing by the Division of Marine Fisheries Shellfish Sanitation Section. The.application identifies approximately 307ft2 of coastal wetlands and 152ft2 of §404 wetlands. In addition the application states a 5ft. temporary impacts buffer that would result in an additional 203ft2 of coastal -wetlands and 107ft2of §404 wetlands. The southern buffer zone is Aere the 4in. sewer pipe would be located. A scoping meeting and site visit were conducted with no major concerns identified at the time. PNA's are estuarine waters where initial post -larval development occurs. Species within this area are early post -larval and juvenile and include finfish, crabs, and shrimp. Species inhabit PNA's because they afford food and protection during vulnerable periods of their life history. Coastal wetlands are a productive detritus based system that trap nutrients and sediment, aid in shoreline erosion control, dissipate wave and storm action, and provide a barrier to flood damage. In addition coastal wetlands are important to waterfowl feeding and nesting activities, and numerous estuarine dependent species such as shrimp, flounder, oysters, crabs, and menhaden. I would recommend a note be added encouraging the culvert pipe is countersunk as deep as possible to allow for the unimpeded flow of water and reduce the potential for "Perching" of water atthe _ downstream edge of the pipe. (SEGi) has been retained by Village of Bald Head Island Stage Two Association (herein referred to as the "Applicant"), in conjunction with The Village of Bald Head Island ("Co -Applicant"), to submit the attached permit application (Attachment 1) for a Coastal Area Management Act Major Permit, which is necessary to perform work located within The Village of Bald Head Island, Brunswick County, North Carolina. The site does not have a physical address. Site Information and History: Bald Head Island was developed in the 1990's as a private, secluded residential subdivision. The NC Division of Water Quality Stormwater Unit (now under the Division of Energy, Minerals, and Land Resources) issued low density stormwater permit SW950216, which serves the Palmetto Cove area of The Village of Bald Head Island. On July 29, 2014, SEGi along with Coastal Land Design met with the agencies to evaluate the site. At that time, the DCM flagged the coastal wetland line, which was surveyed and included on the site plan. SEGi later delineated the Section 404 wetlands and submitted the Rapanos forms to Tyler Crumbley, at the US Army Corps of Engineers. In speaking with Mr. Crumbley, it was suggested that SEGi submit the CAMA Major Application without a final Jurisdictional Determination being issued. This site is located within the AE flood zone and the Coastal Wetland Area of Environmental Concern (AEC). Normal high water is located approximately 739 linear feet northwest of the project site. Based on the fact that the proposed work will not disturb more than 1 acre, a Sediment and Erosion Control permit is not required. This structure is not sufficient to support fire and EMS vehicle loads. In order to complete the construction of the causeway, approximately 152 square feet (0.003 acre) of Section 404 wetlands and 307 square feet (0.007 acre) of coastal wetlands will need to be permanently filled. The temporary impact areas are being proposed as a construction buffer, as well as where the existing sewer line will be relocated. Relocating the sewer line will consist of excavating a trench approximately 12" wide and 12" to 16" below existing grade, installing the utility, and returning the area to its original grade and contour. Silt fence will be installed, along the temporary limits of disturbance/construction buffer, to ensure crews do not work outside the permitted area. Work will be performed in the dry. In an effort to minimize impacts to the wetlands, the Applicant has chosen to incorporate retaining walls into the development plan. The proposed retaining walls are approximately 105' long, including wing walls, 5' high, measured from existing existing grade, and will extend approximately 12" below existing grade. While the Applicant has not determined the type of wall to be installed (i.e. sheet pile, concrete, wood, etc.), some excavation will be necessary but will be performed within the 5' construction buffer. In conjunction with the Applicant's willingness to expend additional funds to reduce impacts to the greatest extent possible, that the impact to wetlands is minimal (i.e. less than 1/10te acre), as well as the fact that the impact area is shaded by the existing bridge, thus the loss of chemical, physical, and biological processes is anticipated to be insignificant. With that being said, the Applicant is not proposing mitigation for the impacts. SEGi feels that the proposed site plan is the least environmental damaging, practicable alternative. CAMA Major Permit Process: As part of the CAMA Major Permit process, the Applicant has notified the adjacent riparian property owners, by US Postal Service certified mail. This information has been included as part of the permit application and accompanying appendices. Also, a $400.00 filing fee is required, which has been included with this correspondence as Attachment 2.
