1) Unless specifically altered herein, this permit authorizes the land disturbing activities associated_ with
the development of the above referenced property, including the single family residence and
driveway, all as expressly and specifically set forth.in the attached permit application and,workplan
drawings; Any additional land disturbing activities and/or construction may require a modification of
this permit. Contact a Division of Coastal Management representative at (910)796-7215 for this
determination.

ADDITIONAL CONDITIONS
2) _ No fill material shall be placed at any time in any vegetated wetlands or surrounding waters outside of
the alignment of the fill area indicated on the approved workplan drawing(s).
3). All construction within the Ocean Hazard AEC shall comply with all applicable requirements of the
N.C. Building Code and the local flood damage prevention ordinance as required by the National Flood
Insurance Program. If any provisions of the building code or the flood damage prevention ordinance are
inconsistent with any of the following AEC standards, the more restrictive standard shall apply.
4) All fill material shall be clean and free of any pollutants except in trace quantities.
5) The permittee shall, in coordination with the Division of Coastal Management, determine the static
vegetation line and corresponding structural setback requirements. All authorized development shall be
located landward of the appropriate setback lines. Construction shall begin within sixty days of this
determination or the determinations shall be considered void, and new setback lines shall be re-
established. In the case of a major shoreline change within that period, a new setback determination may
be required before construction begins.
6) No structures shall be located waterward of the vegetation line referenced in Condition No. 5 of this
permit.
7), The foundation pilings, and any other foundation or support structures for buildings, shall be located
entirely landward of the structural setback line referenced in Condition No. 5 of this permit.
8) All buildings in the Ocean Hazard Area of Environmental Concern shall be on pilings not less than 8
inches in diameter if round, or 8 inches to a side if square.
9) All foundations shall be adequately designed to be stable during applicable fluctuations in ground
elevation and wave forces during a 100-year storm.
10) All pilings shall have a tip penetration greater than eight feet below the lowest ground elevation under
the structures.
14)' Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently
` threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled
within two (2) years of the time when it becomes imminently threatened, and in any case, upon its
collapse or subsidence. However, if natural shoreline recovery or beach re -nourishment takes place
within two (2) years of the time the structure becomes imminently threatened, so that the structure is no
longer imminently threatened, then it need not be relocated or dismantled at that time. This condition
shall not affect the permit holder's right to seek authorization of temporary protective measures allowed
under CRC Rules.
Sedimentation and Erosion Control
12). Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).

ADDITIONAL CONDITIONS
13) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes.

14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
5) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.

This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including but not limited to a Stormwater
Permit from the Division of Energy, Minerals and Land Resources.
Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
The N.C. Division of Water Resources has authorized the proposed project under DWR Project
No. 14-1139.
The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. No.
SAW-2014-02174.

The purpose of the project is construct a single family dwelling, with access drive and gravel parking area, on the subject
property.

Heavey machinery, such as backhoes, dump trucks, and bulldozers, will be used to clear and grade the land, in order to
build the residential dwelling.

Clear vegetation, grade and fill approximately 485 SF (0.011 Ac) of USACE Section 404 wetlands, using clean earthen fill,
for the building footprint, yard, and driveway. Please see Appendix E for details.

instruction booklet on how to property prepare the required items below.

This is with reference to your request to modify State Permit #1-15, acting as agent for Geoff
Alexander. The permit was issued on January 5, 2015 and will expire on December 31, 2018.
The action proposed in your submittal, as submitted in your January 26, 2015 request, is to
install a swimming pool with concrete decking.
In reviewing the information provided, the Division of Coastal Management has determined that
the proposed action is consistent with existing State rules and regulations and is in keeping with
the original purpose and intent of the permit. This Letter of Refinement authorizes the
modification of State Permit #1-15, as described in your email dated January 26, 2015 and plan
labeled "Site Plan for Geoff Alexander" dated January 6, 2015 and received by DCM on January
23, 2015. All permit conditions remain in effect.
Please note this refinement does not authorize any work not expressly described above, nor does
it eliminate the need to obtain any other additional state, federal or local permits, approvals or
authorizations that may be required. By copy of this letter we are also notifying the U. S. Army
Corps of Engineers and the NC Division of Energy, Minerals & Land Resources of our action. If

9. PROJECT DESCRIPTION
The project site is located at 4302 E. Dolphin Drive, near the Atlantic Ocean, within the Town of
Oak Island, in Brunswick County. To find the project site, travel south on US Highway 17 to NC
Highway 133 South. Travel approximately 22 miles south on NC-133 to Dosher Cutoff SE/ NC-
133.Turn onto Dosher Cutoff and then turn right at Southport -Supply Rd. SE/ NC-133. Travel
approximately 0.8 mile and turn left onto NC-133. Travel on NC-133 to Oak Island and turn ri�ton
East Oak Island Drive. Travel approximately 1.3 miles to SE 43rd Street. Make a left on SE 43
Street and the property will be located at the northeast side of the intersection of E. Dolphin St and
SE 43 s Street (on the left).
The property consists of a single lot with a total area of approximately 6,000 square feet. The site is
heavily wooded with Pine (Pinus spp.), Yaupon (Ilex vomitoria) and Wax Myrtle (Myrica cerifera).
The application shows a pocket of jurisdictional §404 wetlands with an area of 485 square feet. The
application states the wetland line was delineated by SEGI and verified by Emily Hughes on May 8,
2014. However, verification of the wetland boundaries was not submitted with the application
package. Wetland vegetation consists primarily of Common Reed (Phragmites australis). According
to the applicant, the highground portion of the property, located along the street side of the lot to the
west, has a current elevation of approximately 4 feet above mean sea level. The frontal dune is
located approximately 320' oceanward of the southern property line.
The long term erosion rate for this portion of Oak Island is 2 feet per year. The 100-year storm
recession line for this area is 325 feet, creating a total Ocean Erodible AEC of 445 feet. The parcel
falls just outside of the Ocean Erodible Area of Environmental Concern (AEC), but falls entirely
within the High Hazard Flood AEC as indicated by zones V 1-30 on the Flood Insurance Rate Maps
of the Federal Insurance Administration. Setbacks in this portion of Oak Island are measured from a
static or fixed vegetation line, unless the actual first line of stable, natural vegetation is more
restrictive. This static vegetation line represents the first line of stable, natural vegetation that
existed prior the large-scale spoil deposition project. The vegetation line was surveyed by the North
Carolina Geodetic Survey Unit in February and March of 2002. With a 2 feet per year erosion rate,
structures with a total floor area less than 5,000 square feet must be set back a distance of 60 feet
landward from the static line. The 60 foot setback is located approximately 260 feet oceanward of
the southern property line. The actual first line of stable, natural vegetation is located oceanward of
the surveyed static vegetation line.
There are no man-made structures currently on the property other than municipal sewer hook-up.
The waters of the Atlantic Ocean in the vicinity of the project area are classified SB by the North
Carolina Division of Water Quality. The area is not designated as a Primary Nursery area by the
North Carolina Division of Marine Fisheries.

PROPOSED PROJECT:
The applicant is proposing to construct a 2-story pile -supported 2,000 square foot (total floor area)
single-family residence with associated wetland fill and a gravel driveway. The entire lot would be
graded and filled, to include the wetland area on the property. The applicant has not proposed any
compensatory mitigation for the wetland impacts associated with the project.
10. ANTICIPATED IMPACTS:
The project would result in the permanent filling of 485 square feet of §404 wetlands and
approximately 5,515 square feet of high ground disturbance and fill. The residence would result in
1,256 square feet of built -upon area. The proposed development would be located within the High
Hazard Flood AEC, landward of the applicable development setback.

9. PROJECT DESCRIPTION
The project site is located at 4302 E. Dolphin Drive, near the Atlantic Ocean, within the Town of
Oak Island, in Brunswick County. To find the project site, travel south on US Highway 17 to NC
Highway 133 South. Travel approximately 22 miles south on NC-133 to Dosher Cutoff SE/ NC-
133.Turn onto Dosher Cutoff and then turn right at Southport -Supply Rd. SE/ NC-133. Travel
approximately 0.8 mile and turn left onto NC-133. Travel on NC-133 to Oak Island and turn r ph on
East Oak Island Drive. Travel approximately 1.3 miles to SE 43 " Street. Make a left on SE 43
Street and the property will be located at the northeast side of the intersection of E. Dolphin St and
SE 43a Street (on the left).
The property consists of a single lot with a total area of approximately 6,000 square feet. The site is
heavily wooded with Pine (Pines spp.), Yaupon (Ilex vomitoria) and Wax Myrtle (Myrica cerifera).
The application shows a pocket of jurisdictional §404 wetlands with an area of 485 square feet. The
application states the wetland line was delineated by SEGI and verified by Emily Hughes on May 8,
2014. However, verification of the wetland boundaries was not submitted with the application
package. Wetland vegetation consists primarily of Common Reed (Phragmites australis). According
to the applicant, the highground portion of the property, located along the street side of the lot to the
west, has a current elevation of approximately 4 feet above mean sea level. The frontal dune is
located approximately 320' oceanward of the southern property line.
The long term erosion rate for this portion of Oak Island is 2 feet per year. The 100-year storm
recession line for this area is 325 feet, creating a total Ocean Erodible AEC of 445 feet. The parcel
falls just outside of the Ocean Erodible Area of Environmental Concern (AEC), but falls entirely
within the High Hazard Flood AEC as indicated by zones V 1-30 on the Flood Insurance Rate Maps
of the Federat Insurance Administration. Setbacks in this portion of Oak Island are measured from a
static or fixed vegetation line, unless the actual fast line of stable, natural vegetation is more
restrictive. This static vegetation line represents the first line of stable, natural vegetation that
existed prior the large-scale spoil deposition project. The vegetation line was surveyed by the North
Carolina Geodetic Survey Unit in February and March of 2002. With a 2 feet per year erosion rate,
structures with a total floor area less than 5,000 square feet must be set back a distance of 60 feet
landward from the static line. The 60 foot setback is located approximately 260 feet oceanward of
the southern property line. The actual first line of stable, natural vegetation is located oceanward of
the surveyed static vegetation line.
There are no man-made structures currently on the property other than municipal sewer hook-up.
The waters of the Atlantic Ocean in the vicinity of the project area are classified SB by the North
Carolina Division of Water Quality. The area is not designated as a Primary Nursery area by the
North Carolina Division of Marine Fisheries.

PROPOSED PROJECT:
The applicant is proposing to construct a 2-story pile -supported 2,000 square foot (total floor area)
single-family residence with associated wetland fill and a gravel driveway. The entire lot would be
graded and filled, to include the wetland area on the property. The applicant has not proposed any
compensatory mitigation for the wetland impacts associated with the project.
10. ANTICIPATED IMPACTS:
The project would result in the permanent filling of 485 square feet of §404 wetlands and
approximately 5,515 square feet of high ground disturbance and fill. The residence would result in
1,256 square feet of built -upon area. The proposed development would be located within the High
Hazard Flood AEC, landward of the applicable development setback.

Southern Environmental Group, Inc. (SEGi) has been retained by Mr. Geoff Alexander (herein referred to as
the "Applicant"), to submit the attached Division of Coastal Management (DCM) permit application and
associated appendices (see Attachment 1), in order to obtain a Coastal Area Management Act (CAMA)
Major Permit, which is necessary to perform work at his property, located at 4302 East Dolphin Drive SE,
Brunswick County, North Carolina.
Site Information and History:
The lot was last platted October 20, 2012, under Map Book 6, Page 12A, has been assigned Parcel ID
249DA00101 and is approximately 0.14 acres.
SEGi delineated the wetland line on the subject property. The delineation revealed a 485 square feet
depressional area, which is adjacent to a `non -relatively permanent water" (non-RPW), a significant nexus to
a US Army Corps of Engineers (USACE) navigable water. As requested, Ms. Emily Hughes, USACE
Regulatory Field Officer, verified the wetland line on 8 May 2014. To date, SEGi has not received a Final
Jurisdictional Determination Tear Sheet for this property. However, should the Tear Sheet be received
during the processing of this permit application, a copy will be submitted to the DCM.
This site is located within the VE flood zone, but is not located on a waterbody that has a Coastal Shoreline
Area of Environmental Concern (AEC) associated with it. The lot is undisturbed and vegetated and does not
contain any man-made structures or impervious surface area. An aerial map, confirming this information,
has been included with this correspondence.
Proposed Work:
It is the Applicant's intention to construct a single family, residential dwelling, with attendant features. The
proposed structure and covered porch will cover 1,256 square feet or 21% of the site. Gravel, which is not
considered impervious, will be used in the parking area. A stormwater management plan is being prepared
and will be submitted to the NC Stormwater Division, once it has been completed.
In order to facilitate the construction of the dwelling, approximately 485 square feet (0.011 acre) of Section
404 wetlands will need to be filled. Due to the location of the wetland feature, avoidance is not possible.
Minimization of the impact would not result in the existence of a viable feature, after construction was
complete. Therefore, the entire feature is proposed to be filled. The proposed location of the structure is such

While the wetland feature meets the USACE's three criteria to be considered a jurisdictional wetland, it
provides little biological, chemical, and/or physical functions. Therefore, it is of SEGi's opinion that the
proposed fill will not have significant impact on the functionality and overall health of the water quality in
this area. With that being said, the Applicant is not proposing compensatory mitigation with this project.
SEGi feels that the proposed site plan is the least environmental damaging, practicable alternative.
CAMA Major Permit Process:
As part of the CAMA Major Permit process, the Applicant has notified the adjacent property owners, by US
Postal Service certified mail. The adjacent property owners have been determined to be the Town of Oak
Island, Mr. Giles Lippert, Jr. and Mr. Bobby Davis. Confirmation of the notifications has been attached to
the permit application. Also, a $400.00 filing fee is required, which has been included with this
correspondence as Attachment 2.
It SEGi's hope that the information found within and attached to this letter will be sufficient for the DCM to
consider the application complete and the permit will be processed without delay. However, should you have

9. PROJECT DESCRIPTION
The project site is located at 4302 E. Dolphin Drive, near the Atlantic Ocean, within the Town of
Oak Island, in Brunswick County. To find the project site, travel south on US Highway 17 to NC
Highway 133 South. Travel approximately 22 miles south on NC-133 to Dosher Cutoff SE/ NC-
133.Turn onto Dosher Cutoff and then turn right at Southport -Supply Rd. SE/ NC-133. Travel
approximately 0.8 mile and turn left onto NC-133. Travel on NC-133 to Oak Island and turn ri ht on
East Oak Island Drive. Travel approximately 1.3 miles to SE 43rd Street. Make a left on SE 43
Street and the property will be located at the northeast side of the intersection of E. Dolphin St and
SE 43`s Street (on the left).
The property consists of a single lot with a total area of approximately 6,000 square feet. The site is
heavily wooded with Pine (Pinus spp.), Yaupon (Ilex vomitoria) and Wax Myrtle (Myrica cerifera).
The application shows a pocket of jurisdictional §404 wetlands with an area of 485 square feet. The
application states the wetland line was delineated by SEGI and verified by Emily Hughes on May 8,
2014. However, verification of the wetland boundaries was not submitted with the application
package. Wetland vegetation consists primarily of Common Reed (Phragmites australis). According
to the applicant, the highground portion of the property, located along the street side of the lot to the
west, has a current elevation of approximately 4 feet above mean sea level. The frontal dune is
located approximately 320' oceanward of the southern property line.
The long term erosion rate for this portion of Oak Island is 2 feet per year. The 100-year storm
recession line for this area is 325 feet, creating a total Ocean Erodible AEC of 445 feet. The parcel
falls just outside of the Ocean Erodible Area of Environmental Concern (AEC), but falls entirely
within the High Hazard Flood AEC as indicated by zones V 1-30 on the Flood Insurance Rate Maps
of the Federal Insurance Administration. Setbacks in this portion of Oak Island are measured from a
static or fixed vegetation line, unless the actual first line of stable, natural vegetation is more
restrictive. This static vegetation line represents the first line of stable, natural vegetation that
existed prior the large-scale spoil deposition project. The vegetation line was surveyed by the North
Carolina Geodetic Survey Unit in February and March of 2002. With a 2 feet per year erosion rate,
structures with a total floor area less than 5,000 square feet must be set back a distance of 60 feet
landward from the static line. The 60 foot setback is located approximately 260 feet oceanward of
the southern property line. The actual first line of stable, natural vegetation is located oceanward of
the surveyed static vegetation line.
There are no man-made structures currently on the property other than municipal sewer hook-up.
The waters of the Atlantic Ocean in the vicinity of the project area are classified SB by the North
Carolina Division of Water Quality. The area is not designated as a Primary Nursery area by the
North Carolina Division of Marine Fisheries.

PROPOSED PROJECT:
The applicant is proposing to construct a 2-story pile -supported 2,000 square foot (total floor area)
single-family residence with associated wetland fill and a gravel driveway. The entire lot would be
graded and filled, to include the wetland area on the property. The applicant has not proposed any
compensatory mitigation for the wetland impacts associated with the project.
10. ANTICIPATED IMPACTS:
The project would result in the permanent filling of 485 square feet of §404 wetlands and
approximately 5,515 square feet of high ground disturbance and fill. The residence would result in
1,256 square feet of built -upon area. The proposed development would be located within the High
Hazard Flood AEC, landward of the applicable development setback.

Southern Environmental Group, hic. (SEGi) has been retained by Mr. Geoff Alexander (herein referred to as
the "Applicant', to submit the attached Division of Coastal Management (DCM) permit application and
associated appendices (see Attachment 1), in order to obtain a Coastal Area Management Act (CAMA)
Major Permit, which is necessary to perform work at his property, located at 4302 East Dolphin Drive SE,
Brunswick County, North Carolina.
Site Information and History:
The lot was last platted October 20, 2012, under Map Book 6, Page 12A, has been assigned Parcel ID
249DA00101 and is approximately 0.14 acres.
SEGi delineated the wetland line on the subject property. The delineation revealed a 485 square feet
depressional area, which is adjacent to a "non -relatively permanent water" (non-RPW), a significant nexus to
a US Army Corps of Engineers (USACE) navigable water. As requested, Ms. Emily Hughes, USACE
Regulatory Field Officer, verified the wetland line on 8 May 2014. To date, SEGi has not received a Final
Jurisdictional Determination Tear Sheet for this property. However, should the Tear Sheet be received
during the processing of this permit application, a copy will be submitted to the DCM.
This site is located within the VE flood zone, but is not located on a waterbody that has a Coastal Shoreline
Area of Environmental Concern (AEC) associated with it. The lot is undisturbed and vegetated and does not
contain any man-made structures or impervious surface area. An aerial map, confirming this information,
has been included with this correspondence.
Proposed Work:
It is the Applicant's intention to construct a single family, residential dwelling, with attendant features. The
proposed structure and covered porch will cover 1,256 square feet or 21% of the site. Gravel, which is not
considered impervious, will be used in the parking area. A stormwater management plan is being prepared
and will be submitted to the NC Stormwater Division, once it has been completed.
In order to facilitate the construction of the dwelling, approximately 485 square feet (0.011 acre) of Section
404 wetlands will need to be filled. Due to the location of the wetland feature, avoidance is not possible.
Minimization of the impact would not result in the existence of a viable feature, after construction was
complete. Therefore, the entire feature is proposed to be filled. The proposed location of the structure is such

While the wetland feature meets the USACE's three criteria to be considered a jurisdictional wetland, it
provides little biological, chemical, and/or physical functions. Therefore, it is of SEGi's opinion that the
proposed fill will not have significant impact on the functionality and overall health of the water quality in
this area. With that being said, the Applicant is not proposing compensatory mitigation with this project.
SEGi feels that the proposed site plan is the least environmental damaging, practicable alternative.
CAMA Major Permit Process:
As part of the CAMA Major Permit process, the Applicant has notified the adjacent property owners, by US
Postal Service certified mail. The adjacent property owners have been determined to be the Town of Oak
Island, Mr. Giles Lippert, Jr. and Mr. Bobby Davis. Confirmation of the notifications has been attached to
the permit application. Also, a $400.00 filing fee is required, which has been included with this
correspondence as Attachment 2.
It SEGi's hope that the information found within and attached to this letter will be sufficient for the DCM to
consider the application complete and the permit will be processed without delay. However, should you have

Division of Water Resources (DWR) on October 30, 2014. After reviewing your application, we
have decided that the impacts are covered by General Water Quality Certification Number 3890
(GC 3890).
This Certification allows you to use the Nationwide Permit 18 (NW 18) when issued by the U.S.
Army Corps of Engineers and the CAMA permit when issued by the Division of Coastal
Management. In addition, you should obtain or otherwise comply with any other required federal,
state or local permits before you go ahead with your project including (but not limited to) Erosion
and Sediment Control, Non -discharge, and stormwater regulations. Also, this approval to proceed
with your proposed impacts or to conduct impacts to waters as depicted in your application shall

2. Standard Erosion and Sediment Control Practices
Erosion and sediment control practices must be in full compliance with all specifications
governing the proper design, installation and operation and maintenance of such Best
Management Practices:
a. Erosion and sediment control measures for the project must be designed, installed,
operated, and maintained in accordance with the most recent version of the North
Carolina Sediment and Erosion Control Planning and Design Manual.
b. Design, installation, operation, and maintenance of the sediment and erosion control
measures must be such that they equal, or exceed, the requirements specified in the most
recent version of the North Carolina Sediment and Erosion Control Manual. The
devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil)
projects, including contractor -owned or leased borrow pits associated with the project.
c. For borrow pit sites, the erosion and sediment control measures must be designed,
installed, operated, and maintained in accordance with the most recent version of the
North Carolina Surface Mining Manual.
d. Reclamation measures and implementation must comply with the reclamation in
accordance with the requirements of the Sedimentation Pollution Control Act.
e. Sufficient materials required for stabilization and/or repair of erosion control measures
and stormwater routing and treatment shall be on site at all times.
3. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond
the footprint of the impacts depicted in the Pre -Construction Notification and authorized by this
written approval, including incidental impacts. All construction activities, including the design,
installation, operation, and maintenance of sediment and erosion control Best Management
Practices, shall be performed so that no violations of state water quality standards, statutes, or
rules occur.

Sediment and erosion control measures shall not be placed in wetlands or waters without prior
approval by DWR. If placement of sediment and erosion control devices in wetlands and
waters is unavoidable, then design and placement of temporary erosion control measures shall
not be conducted in a manner that may result in dis-equilibrium of wetlands or stream beds or
banks, adjacent to or upstream and downstream of the above structures. All devices shall be
removed and the natural grade restored within two (2) months of the date that the Division of
Energy, Mineral, and Land Resources has released the project.
5. Turbidity
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded as
described in 15 A NCAC 2B .0200. Appropriate sediment and erosion control practices must be
used to meet this standard.
6. The applicant/permittee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from
compliance with §303(d) of the Clean Water Act), and any other appropriate requirements of
State and Federal Law. If the Division determines that such standards or laws are not being met,
including failure to sustain a designated or achieved use, or that State or Federal law is being
violated, or that further conditions are necessary to assure compliance, then the Division may
reevaluate and modify this General Water Quality Certification.
7. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401 Oversight/Express Review Permitting Unit, North Carolina
Division of Water Resources, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
Violations of any condition herein set forth may result in revocation of this Certification and may
result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts
or to conduct impacts to waters as depicted in your application and as authorized by this
Certification shall expire upon expiration of the 404 or CAMA Permits.
You can contest this Certification as provided in Articles 3 and 4 of General Statute 150B by filing
a written petition for an administrative hearing to the Office of Administrative Hearings. You may
obtain a petition form from the Office of Administrative Hearings at http://www.ncoah.com or call
(919) 431-3000 for information. Within sixty (60) calendar days of receipt of this Certification, you
must file the petition with the Office of Administrative Hearings. A petition is considered filed
when the original and one (1) copy is received in the Office of Administrative Hearings during
normal office hours (Monday through Friday between 8:00am and 5:00pm, excluding official state
holidays). The petition may be faxed to the Office of Administrative Hearings at (919) 431-3100,
provided the original and one copy of the petition is received by the Office of Administrative
Hearings within five (5) business days following the faxed transmission.

Recommendations for State Permit- Geoff Alexander

It is the opinion of this office that the proposed work is consistent with the Use Standards for Ocean Hazard
Areas, as set forth in NCAC 07H .0306 & .0308. In the absence of any concerns from the commenting
agencies, it is recommended that a permit be issued subject to the following conditions:
1. In order to protect water quality, runoff from the construction must not visibly increase the amount
of suspended sediments in adjacent waters.
2. The structure must set back a minimum of 60 feet from the first line of stable natural vegetation, as
determined by the DCM.
3. The permittee is required to contact the DCM shortly before he plans to begin construction to
arrange a setback measurement that will be effective for sixty (60) days barring a major shoreline
change. Construction must begin within sixty (60) days of the determination or the measurement is
void and must be redone.
4. All construction shall comply with building requirements of the N.C. Building Code, and the local
flood damage prevention ordinance as required by the National Flood Insurance Program. If any
provision of the building code or a flood damage prevention ordinance is inconsistent with any AEC
standards, the more restrictive provision shall apply.
5. All structures authorized by this permit shall be relocated or dismantled when they become
imminently threatened by changes in shoreline configuration. All structure(s) shall be relocated or
dismantled within two (2) years of the time when it becomes imminently threatened, and in any case,
upon its collapse or subsidence. However, if natural shoreline recovery or beach re -nourishment
takes place within two (2) years of the time the structure becomes imminently threatened, so that the
structure is no longer imminently threatened, then it need not be relocated or dismantled at that time.
This condition shall not affect the permittee's right to seek authorization of temporary measures
allowed under CRC Rules.
6. Appropriate sedimentation and erosion control devices, measures or structures must be implemented
to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt
fence, diversion swales or berms, sand fence, etc.).
7. All buildings constructed within the ocean hazard area shall comply with the NC Building Code and
the Local Flood Damage Prevention Ordinance as required by the National Flood Insurance
Program. If any provisions of the building code or a flood damage prevention ordinance are
inconsistent with any of the following AEC standards, the more restrictive provision shall control.
8. All buildings must be elevated on pilings with a diameter of at least 8 inches in diameter if round, or
8 inches to a side if square; and the first floor level of the sills and joists must meet the 100-year
flood level elevation.
9. All pilings shall have a tip penetration greater than eight feet below the lowest ground elevation
under the structure.

Southern Environmental Group, Inc. (SEGi) has been retained by Mr. Geoff Alexander (herein referred to as
the "Applicant"), to submit the attached Division of Coastal Management (DCM) permit application and
associated appendices (see Attachment 1), in order to obtain a Coastal Area Management Act (CAMA)
Major Permit, which is necessary to perform work at his property, located at 4302 East Dolphin Drive SE,
Brunswick County, North Carolina.
Site Information and History:
The lot was last platted October 20, 2012, under Map Book 6, Page 12A, has been assigned Parcel ID
249DAOO101 and is approximately 0.14 acres.
SEGi delineated the wetland line on the subject property. The delineation revealed a 485 square feet
depressional area, which is adjacent to a "non -relatively permanent water" (non-RPW), a significant nexus to
a US Army Corps of Engineers (USACE) navigable water. As requested, Ms. Emily Hughes, USACE
Regulatory Field Officer, verified the wetland line on 8 May 2014. To date, SEGi has not received a Final
Jurisdictional Determination Tear Sheet for this property. However, should the Tear Sheet be received
during the processing of this permit application, a copy will be submitted to the DCM.
This site is located within the VE flood zone, but is not located on a waterbody that has a Coastal Shoreline
Area of Environmental Concern (AEC) associated with it. The lot is undisturbed and vegetated and does not
contain any man-made structures or impervious surface area. An aerial map, confirming this information,
has been included with this correspondence.
Proposed Work:
It is the Applicant's intention to construct a single family, residential dwelling, with attendant features. The
proposed structure and covered porch will cover 1,256 square feet or 2 1 % of the site. Gravel, which is not
considered impervious, will be used in the parking area. A stormwater management plan is being prepared
and will be submitted to the NC Stormwater Division, once it has been completed.
In order to facilitate the construction of the dwelling, approximately 485 square feet (0.011 acre) of Section
404 wetlands will need to be filled. Due to the location of the wetland feature, avoidance is not possible.
Minimization of the impact would not result in the existence of a viable feature, after construction was
complete. Therefore, the entire feature is proposed to be filled. The proposed location of the structure is such

While the wetland feature meets the USACE's three criteria to be considered a jurisdictional wetland, it
provides little biological, chemical, and/or physical functions. Therefore, it is of SEGi's opinion that the
proposed fill will not have significant impact on the functionality and overall health of the water quality in
this area. With that being said, the Applicant is not proposing compensatory mitigation with this project.
SEGi feels that the proposed site plan is the least environmental damaging, practicable alternative.
CAMA Major Permit Process:
As part of the CAMA Major Permit process, the Applicant has notified the adjacent property owners, by US
Postal Service certified mail. The adjacent property owners have been determined to be the Town of Oak
Island, Mr. Giles Lippert, Jr. and Mr. Bobby Davis. Confirmation of the notifications has been attached to
the permit application. Also, a $400.00 filing fee is required, which has been included with this
correspondence as Attachment 2.
It SEGi's hope that the information found within and attached to this letter will be sufficient for the DCM to
consider the application complete and the permit will be processed without delay. However, should you have

lot. To facilitate the development, 485 square feet (0.011 acre) of §404 jurisdictional wetlands will be filled. This
action is part of the permitting process and will be reviewed by the US Army Corps of Engineers and NC
Division of Water Resources, to ensure it is in compliance with the Clean Water Act.

With this correspondence, Southern Environmental Group, Inc. (SEGi) is notifying you of the proposed
construction of a residential dwelling, to be located on a parcel adjacent to land owned by you. This was
determined by using the Brunswick County, North Carolina tax information page. SEGi has been retained by the
property owner, Mr. Geoff Alexander, herein referred to as the "Applicant', to notify the adjacent property
owner(s) and to apply for a Coastal Area Management Act (CAMA) Major Permit.
The Applicant intends to construct a single family dwelling, along with associated parking on the 6,000 square
foot lot that is located within the Ocean Hazard Area of Environmental Concern. Heavy machinery, such as a
dump truck and bulldozer will be utilized to bring in clean earthen fill and a bulldozer will be used to grade the
lot. To facilitate the development, 485 square feet (0.011 acre) of §404 jurisdictional wetlands will be filled. This
action is part of the permitting process and will be reviewed by the US Army Corps of Engineers and NC
Division of Water Resources, to ensure it is in compliance with the Clean Water Act.
To assist you in the decision making process of the proposed construction, attached you will find the Permit
Applications and Site Plan. The Applicant and SEGi requests that you sign the enclosed form letter, and return it,
in the self addressed stamped envelope. This will help to expedite the CAMA permit process. If you should
choose not to respond to this letter, the Division of Coastal Management will assume there is no objection to the
proposed activity.

The Division of Coastal Management hereby acknowledges receipt of your application, acting as agent for
Geoff Alexander, for State approval for development of the subject property located at 4302 E. Dolphin Drive, in Oak
Island, Brunswick County. It was received as complete on October 16, 2014 and appears to be adequate for processing
at this time. The projected deadline for making a decision is January 1, 2015. An additional 75-day review period is
provided by law when such time is necessary to complete the review. If you have not been notified of a final action by
the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter
will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th
day.
If this agency does not render a permit decision within 70 days from October 16, 2014, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project.
Such a meeting will be held within five working days from the receipt of your written request and shall include the
property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your
proposed development. You should post this notice at a conspicuous point along your property where it can be
observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the road right-of-way where a private road would lead one
into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to
receive a copy of my field report and/or comments from reviewing agencies.

This notice is intended to make you, the applicant, aware of the
special risks and conditions associated with development in this
area, which is subject to natural hazards such as storms, erosion
and currents. The rules of the Coastal Resources Commission
require that you receive an AEC Hazard Notice and
acknowledge that notice in writing before a permit for
development can be issued.
The Commission's Hiles on building standards, oceanfront
setbacks and dune alterations are designed to minimize, but not
eliminate, property less from hazards. By granting permits, the
Coastal Resources Commission does not guarantee the safety of
the development and assumes no liability for future damage to
the development. Permits issued in the Ocean IIazard Area of
Environmental Concern include the condition that structures be
relocated or dismantled if they become imminently threatened
by changes in shoreline configuration. The structure(s) must be
relocated or dismantled within two (2) years of becoming
imminently threatened, and in any case upon its collapse or
subsidence.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual long-term
average ocean erosion rate for the area where your property is
located is 7 feet per year.
The rate was established by careful analysis of aerial
photographs of the coastline taken over the past 50 years -
Studies also indicate that the shoreline could move as much as
_IL2� feet landward in a major storm.
Thr flood waters in a major storm are predicted to be about
I G— 17 feet deep in this area.
Preferred oceanfront protection measures are beach nourishment
and relocation of threatened structures. Hard erosion control
structures such as bulkheads, seawalls, revetments, groins, jetties
and breakwaters are prohibited. Temporary sand bags may be
authorized under certain conditions.
The applicant must acknowledge this information and
requirements by signing this notice in the space below. Without
the pr"Wsign#ture, the application will not be complete.

SPECIAL NOTE: This hazard notice is required for
development in areas subject to sudden and massive storms and
erosion. Permits issued for development in this area expire on
December 31 of the third year following the year in which the
permit was issued. Shortly before work begins on the project
site, the Local Permit Officer must be contacted to determine the
vegetation line and setback distance at your site. If the property
has seen little change since the time of permit issuance, and the
proposed development can still meet the setback requirement,
the LPO will inform you that you may begin work. Substantial
progress on the project must be made within 60 days of this
setback determination, or the setback must be remeasmed. Also,
the occurrence of a major shoreline change as the result of a
stony within the 60-day period will necessitate remeasurement
of the setback. It is important that you check with the LPO
before the permit expires for official approval to continue the
work after the permit has expired. Generally, if foundation
pilings have been placed and substantial progress is continuing,
permit renewal can be authorized. It is unlawful to continue
work after permit expiration.

This letter serves a response to the Division of Coastlal Managements request for additional information,
necessary to complete the CAMA Major Permit Application, for Geoff Alexander's property, at 4302 East
Beach Drive, in Oak Island, North Carolina.
In order to complete the application, the following was requested (italicized text) followed by SEGi's
response (bold text):
Form MP-1, Section 5(d) states retaining walls are proposed as part of the project. However, the
narrative and plans do not show retaining walls- nor are they discussed on Forms MP-2 and/or
MP-3. Please correct this discrepancy. Additionally, Section 509 of this form gives the total
disturbed land area as 2,787 square feet, while the MP-3 gives a graded/filled/disturbed area of
—6,000 square feet and the plans appear to show the entire lot being disturbed. Field 5.g states the
proposed project will encroach on a public easement or accessway- please establish whether this is
just for the proposed driveway or whether there are any other encroachments.
Please see the revised Form MP-1 (Attachment 1). The mention of retaining walls in this form
was a mistake. Additionally, the square footage of the total disturbed area has been revised to
reflect 6,000 square feet, and the encroachment on a public easement or accessway is only
associated with the driveway access through the 60' East Dolphin Drive right of way.
2. Field 4a Form MP-2 states that —486 square feet of fill is proposed, yet the plans appear to show
fill the entire length of the lot. Please confirm the total area to be filled.
Please see revised MP-2, which reflects a total fill area of 6,000 square feet (Attachment 2).
3. Please complete Field i. of Form MP-3 and ensure Field f. is consistent with the plans. Field f.
describes a gravel parking pad and concrete drive, yet plans show a gravel drive and concrete pad.
Please be aware that due to a recent law change, I believe gravel is again considered to be an
impervious surface. Please contact DEMLR at 910.796 7215 for further clarification and

Form MP-3 has been revised to be consistent with the site plan. According to the the "Update
on Gravel Legislation", the project was submitted for review to the DCM, while the
temporary rule was still in effect. Thus, this project has two options:
A. demonstrate how the proposed gravel design will meet the temporary rule to be
considered a pervious surface, or
B. count the gravel as completely impervious per SL 2014-120.
The Applicant has chosen option A. In the area denoted as gravel on the proposed site plan,
the Applicant will use a clean or washed, loose, uniformly -graded aggregate of stones, from a
lower limit of 0.08 inches to an upper limit of 3.0 inches in size, and < 5% fines. Once the
gravel becomes compact, to the point where water no longer infiltrates through to the subsoil,
the rock will be scarified. New rock will be added as necessary.
4. Please ensure your site plans (both plan view and x-section drawing) are to scale, using a standard
engineer's scale. Please ensure the following features are included on your plans, as required in
NCAC 07J.0203. All proposed work including the limits of disturbance and fill and retaining walls,
if proposed. Please ensure the cross-section plan accurately depicts the proposed work relative to
existing ground level (proposed buildings are required to be pile supported), and include first floor
elevations relative to mean sea level for the proposed residence. Please note the 60' setback is also
inaccurately depicted on the plan. The setback is located approximately 10' oceanward (south) of
the edge of pavement at E. Beach Drive. The static vegetation line is therefore located
approximately 70'south of the edge ofpavement.
The site plan has been revised to accurately reflect all of the required features and is to scale.
As you will see, the site plan has been broken down into two sheets, which can be printed at
11" z 17". See Attachment 4.
5. Please also submit disclose the total floor area of the house either in the narrative or on the plans
to verify that the 60'setback is the applicable measurement line.
The site plan has been revised to denote 2,000 square feet of heated space (see Attachment 4).
