This permit, issued on January 27 2015 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to lines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) Unless specifically altered herein, this permit authorizes the removal of the existing slips/boatlifts creating only observation piers and the construction of a new docking facility, as well as the associated uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 2) The portion of the authorized pier spanning over the existing canal shall be elevated a minimum of 5 feet above the normal high water level with a minimum piling span of 10 feet. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit # 12-15 Page 2 of 2 ADDITIONAL CONDITIONS 3) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 4) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 5) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 7) This permit authorizes a maximum of six formalized boat slips at the authorized facility. General 8) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 9) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation in order to discuss the conditions set forth in this permit. 10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division of Coastal Management at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. Project Summary: The proposed project is for the construction of a shared 6-slip docking facility which includes all associated infrastructure (pier, platforms, finger piers and boatlifts) along the Taylors Creek portion of the property. The pier would remain within an easement area Field Investigation Report 2001 Front Street Dock Association, Inc. 2001 Front St, Beaufort, Carteret County Page 2 of 3 (Clara Wade property) that would range from 25.5' to 32.81' in width depending on location. A portion of the dock access would also bridge over a navigable channel within the existing unnamed natural tributary that connects to Taylors Creek. The 2001 Front Street Dock Association, Inc. non-profit corporation was formed on 8/25/14 in order to serve the proposed shared docking facility. 9. Narrative Description: The 2001 Front Street Dock Association, Inc. project is located at 2001 Front St., is adjacent to Taylors Creek and within the Town of Beaufort's ETJ. The site is found by turning right off of Cedar Street onto Live Oak Street. Follow Live Oak St. until you reach the stop sign and turn left onto Front St. Follow this road for approximately 1.21 miles (6,401 feet). The site will be located on the right (north side of Taylors Creek). It is not located within the Beaufort Historic District or the National Historic District. The residential property is 1.41 acres (61,421sf) in its entirety and 6.8' above nhw. Taylors Creek runs along the south side of the property with an unnamed natural tributary along the north side of Taylors Creek. The upland vegetation mainly consists of lawn grasses, shrubs and oak trees. There is a 22' x 110'section of coastal wetlands along the 110' of shoreline along the canal portion and 22' x 110' along the Taylors Creek portion of the tree hammock consisting of Distichlis spicata (Salt Grass), Spartina patens (Salt Meadow Cordgrass) Spartina altemiflora (Smooth Cordgrass) and Juncus roemerianus (Black Needlerush). The waters of Taylors Creek have an approximate -3' lunar tidal amplitude. The Division of Water Quality classifies this area as SC Waters. Taylors Creek is not designated as a Primary Nursery Area and is closed to the taking of shellfish. The Town of Beaufort's Land Use Plan classifies this area as Residential with Conservation within the AECs. There are no shellfish resources in the area. The Federal Channel Setback within this area of Taylors Creek is 61'. Water depths within this project location are -8' nlw/mlw, with connecting water depths of -10' plus nlw/mlw. The bottom substrate is silty sand with shell. Taylors Creek is approximately 400' wide at this location. 10) Proposed Development: The applicant proposes to add a shared 6-slip private residential docking facility with platforms, finger piers and boatlifts to the Taylors Creek portion of the property. There are existing docking facilities along the canal portion of the property; however, due to the shallow water depths and frequent maintenance dredging, the applicant is asking for a shared docking facility along Taylors Creek that would serve 1915,1919,2001,2005 and 2011 Front St. The existing docks located within the canal would remain for observation type use (with no slips) and the existing slips including boatlifts, would be removed. The canal would be allowed to silt in and naturalize with no further maintenance excavation performed. A 25' to 32' wide easement and non-profit dock association have been created in order to accommodate the shared pier for the residents at 1915,1919,2001,2005 and 2011 Front Street. Riparian signatures with waivers were obtained from the adjacent neighbors, Mr. Fredrick Stanley, Mr. Bradford Piner and Mrs. Margaret Risser. Field Investigation Report 2001 Front Street Dock Association, Inc. 2001 Front St, Beaufort, Carteret County Page 3 of 3 The applicant is proposing to construct a 6' wide pier that extends from the high ground portion that abuts coastal wetlands, along the Front Street shoreline. It would extend over a total of 32' of coastal wetlands [(Distichlis spicata (Salt Grass), Spartina patens (Salt Meadow Cordgrass), Spartina alterniflora (Smooth Cordgrass) and Juncus roemerianus (Black Needlerush)] and would then bridge over the canal portion (open water) for approximately 79'. The bridge portion would be 6' wide, a minimum of 5' above nhw and would have a minimum pilings span of 10 wide in order to allow small john boats, canoes etc access and navigation to this area. The pier would then continue over a second section of coastal wetlands (Spartina alterniflora (Smooth Cordgrass)) for 111' and finally over open water within Taylors Creek for the remaining 22'. The total length of the pier would be 244' from the high ground escarpment and 234' from the normal high water contour of the property along Front Street. The pier would then intersect a fixed 10' x 10' platform. A 3' x15' gangway would extend from the fixed platform and would intersect a 6' x 70' floating platform. There would be three 4' x 27' finger piers extending south from the floating platform that would delineate the proposed 6 slip areas. There would be six 13' x 13' boatlifts within each of the 6 proposed slips. All portions of the docking facility within Taylors Creek would not exceed a maximum distance of 79' waterward of the edge of marsh or 96' from the normal high water contour that borders the small tree hammock along the north side of Taylors Creek. All parts of the docking facility would be landward of the USACOE channel setback (approximately 17'), a distance of 5.38' from the eastern riparian access line and 6.35' from the western riparian access line. There would be a total of six slips. 11. Anticipated Impacts: The proposed dock additions would shade a total of 798ft2 of coastal wetlands. The 6-slip docking facility would also shade 958 ftz as well as incorporate 2,862 ft2 of open water Public Trust Area. The existing water depths are sufficient for this use (-8' nlw). The setting of pilings has the potential to cause a temporary increase in turbidity during construction activities. The location of the proposed docking facility would not be a hindrance to navigation due to the fact all portions would be located 17' landward of the 'USACOE channel setback. The bridge portion over the unnamed tributary would also not be a hindrance to navigation due to the minimum height of 5' above NHW and a piling span of 10' in width. The proposed naturalization of the unnamed tributary has the potential to restrict the use of Public Trust Waters to canoes and kayaks, which due to the shallow water depths, would be the only vessels that could reasonably navigate that portion. However, this area, through naturalization, has the potential to create additional habitat area. Per the applicant(s), the homeowners at 1915, 1919 and 2001 Front St have historically maintained the docks within this area. Access to the existing docks was from an entrance located to the west of the canal and has been difficult to maintain, which has required frequent dredging. Per the applicant due to the shallow water depths and frequent maintenance excavation they are proposing the construction of a shared "community" pier for 1915, 1919, 2001 and 2011 Front Street. Per the appl�ant the existing docks within the canal would remain for observation uses but no further dredging would ba conducted and this area would be allowed to silt in and convert back to wetlands. The proposed pier would extend from 2001 Front St approximately 9' west of the existing dock, would span the canal (following USACOE height and width specifications) then cross a high ground tree hammock and extend within Taylors Creek. The proposed docking facility (includes pier, platforms and boatlifts) would extend a maximum of 77' waterward of normal high/ mean high water and approximately 19' landward of the USACOE channel setback. The development conforms to the guidelines set forth under 15A NCAC 07H .0208. The number of Directors may be increased by action of the members and the Board of Directors.
