This letter is with reference to your application, acting as agent for R.B. Jennings, for a Coastal
Area Management. Act Major Development permit to undertake construction of a reconfigured
docking facility at 32 Saltmeadow Rd., adjacent to Banks Channel, on Figure Eight Island, in
Wilmington, New Hanover County.
Although processing of the application is nearing completion, additional time is needed for this
office to complete the review and make a decision on your request. Therefore, it is necessary that
the standard review time be extended. An additional 75 days is provided by G.S. 113A-122(c)
which would make December 12, 2016, the new deadline for reaching a decision on your request.
However, we expect to take action prior to that time and will do so as soon as possible. In the

On August 3, 2016, the Wilmington Regional Office of the Division of Energy, Mineral, and Land
Resources received a copy of the CAMA Major Permit Application for the subject project. Staff review
of the plans and specifications on August 8, 2016 has determined that the development activities proposed
at this time will not pose a threat to surface water quality from stormwater runoff. The Director has
determined that projects that are reviewed and approved by the Division as not posing a water quality
threat from stormwater runoff should not be subject to the stormwater management permitting
requirements of 15A NCAC 2H.1000, the stormwater rules. By copy of this letter, we are informing you
that this project will not require a stormwater management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff,
then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater
discharge requirements. You are required to have an NPDES permit for stormwater discharge from
projects meeting these criteria. All temporary built -upon area associated with the construction of the
project must be removed within 30 days of completion of the project, or when it is no longer needed,
whichever occurs first.

The total square footage of the platform and floating dock was calculated as follows:
Shoreline length = 209' x 8 sq. ft. =1,672 sq. ft. allowable.
Ex. Fixed platform = 20' x 16' = 320 sq. ft.
Proposed new floating dock= 40' x 8' = 320 sq. ft.
Total = 640 sq. ft.
It is the staffs recommendation that the reconfiguration of the existing docking facility appears to be consistent with the use standards
set forth in NCAC 07H .0208(b)(6), including the eight square foot rule and the pier width rule and the proposed structures would be
located entirely over open water; however, under strict application of current NCAC 07H .0208(b)(6)(iii), the proposal appears to be
inconsistent with the Y. width rule. The existing docking facility was authorized and consistent prior to this rule change in 1998. The
proposed new configuration would reduce the distance into the waterbody by approximately 11' and it appears the main channel of at
this location favors the other side of the waterbody and would not hinder the established navigation. To meet strict application of NCAC
07H .0208(b)(6)(iii), it would require removal of approximately 10' of the existing fixed platform. It is the opinion of this office that the
applicant's proposal is trying to meet the spirit and intent of NCAC 07H .0208(b)(6). If the project is determined to be consistent with
NCAC 07H .0208(b)(6), this office has no objection to the proposed work, provided it is consistent with all other state and federal
permitting requirements. Any permit issued should include standard conditions for private docking facilities.

This project is consistent and not i&conflict with the 2006 Wilmington -New kanove
County Joint Land Use Plan Update.
The applicant is proposing to reconfigure an existing private docking facility at 32
Saltmeadow Road, adjacent to Banks Channel on Figure Eight Island in New Hanover
County.
Areas of Environmental Concern (AFC's) impacted by the proposal are EW and PT.
Waters at the project site are classified as SA-ORW and are open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover
County Joint Land Use Plan and offer the following comments.
The general area of the project is classified as Residential, Conservation.
In general, Wilmington -New Hanover County allows development in Residential and
Conservation classified AECs, which is consistent with the State's minimum use
standards. The 2006 Wilmington -New Hanover County Joint Land Use Plan contains
some policies, which exceed the State's minimum use standards, including those policies
related to new dredging activities and private docking facilities. However, none of these
more restrictive standards appear to be applicable to this proposal.
This project is consistent with the 2006 Wilmington -New Hanover County Joint Land
Use Plan.

learned of your request to reconfigure an existing docking facility located at 32 Saltmeadow
Road along Banks Channel and Middle Sound in Wilmington, New Hanover County, North
Carolina. Coordinates are: 34.2554 N,-77.7625 W.
On January 1, 2011, we renewed general permit No. 197800056, (copy enclosed), that
authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and
boat shelters, mooring piles, dolphins, jetties and breakwater structures in navigable waters of the
United States in the State of North Carolina pursuant to Section 10 of the Rivers and Harbors Act
of 1899.
Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the enclosed general conditions, and the following special conditions:
1. All work authorized by this permit must be performed in strict compliance with the
submitted plans and the revised plans received on 8 August 2016, which are a part of this permit.

Ed to see if his client wanted to seek a variance from the CRC or if there were any design modifications that could bring
the structure back to the ''/< width. He submitted the attached plan. Would this design still work for your purposes or do
you have any objections or concerns about this change? If it still works, I'll have him submit a new side view drawing and
a revised MP-4 to include the ramp landing dimensions. Let me know if you have any questions or if you need anything
else.

9. PROJECT DESCRIPTION
The project site is located at 32 Saltmeadow Road on Figure Eight Island, adjacent to Banks Channel and Middle Sound, in New
Hanover County. The island is accessed from the mainland at the end of Edgewater Club Road (SR 1402), by private bridge over the
Atlantic Intracoastal Waterway (AIWW) and an earthen causeway, which traverses Middle Sound. Heading east on the causeway, turn
right on Beach Road South and travel approximately 1.2 miles south until you reach Saltmeadow Road. Turn right onto Saltmeadow
Road and continue until you reach the property of interest located at the end of the cul-de-sac.
The project site is approximately 0.714 acres in size and has an average elevation of approximately 6' above Normal High Water
(NHW) and is vegetated with maintained lawn grass an ornamental landscaping. The project site has approximately 209 linear feet of
shoreline frontage along Banks Channel, which is currently stabilized by a timber bulkhead. Located waterward of the timber bulkhead
is an approximately 8' in width band of coastal wetlands consisting primarily of Smooth Cordgrass (Spartina altemiflora), which is
evident that NHW meets the existing bulkhead.
Extending in a westerly direction from the timber bulkhead towards Banks Channel is an existing private docking facility, which consists
of an access pier (70' x 6'), uncovered "T-head" fixed platform (20' x 16') and floating dock (20' x 8'), which extends perpendicular to
the shoreline and Banks Channel. There is an existing boatlift (13' x 13') located on the northern side of the floating dock. The
application states the existing docking facility currently accommodates up to two (2) vessels in water depth of approximately -6' @
Normal Low Water (NLW). The previous property owner (Matthews) obtained CAMA General Permit No. 13366-D for the existing
docking floating facility on 1/10/95. Another previous owner (Baggett) obtained CAMA General Permits No. 38952-D and 45840-D to
allow for replacement of the floating dock and installation of a boatlift on 8/17/04 and 7/7/06. The docking facility currently extends
approximately 125' into a waterbody currently measuring approximately 400' across.
The Wilmington -New Hanover County 2006 Land Use Plan classifies adjacent waters and high ground portion of the property as
Conservation. The waters of Banks Channel and Middle Sound are classified SA-ORW by the Division of Water Resources. They are
NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of
shellfish.
PROPOSED PROJECT
The applicant proposes to reconfigure an existing private docking facility. The application states the existing floating dock and boatlift
would be removed and replaced with a new floating dock, measuring approximately 40' in length by Tin width, which would run parallel
to the shoreline and channel. The new boatlift, measuring approximately 12' in length by 14' in width to be installed on the landward
side of the floating dock. The new docking configuration would provide docking space for up to three (3) vessels at this location within
water depth of approximately -6' @ NLW. The new configuration would extend approximately 114' into a waterbody measuring
approximately 400' across, which is a reduction of 11' from its current configuration.
10. ANTICIPATED IMPACTS
The structures would incorporate approximately 488 sq. ft. of Estuarine Waters and Public Trust Area. The proposed structures would
extend approximately 114' into a waterbody, which measures approximately 400' across. This distance would not conform to the %
width distance rule; however, it appears not to exceed the established pier length along this shoreline of Banks Channel and would not
exceed the 1/3 width distance. The proposed structures would allow the existing docking facility to accommodate up to three (3)
vessels in water depth of approximately -6' @ NLW. Based on the application, the proposed structures would not encroach into the
adjacent 15' riparian corridor setback requirements. Minor increases in turbidity should be expected during the construction.

The enclosed CAMA Major Permit application for Mr. R.9 Jennings, 32
Saltmeadow Road, Wilmington, N.C. 28411, is to relocate the existing
boatlift and floating dock and add an additional section of floating dock.
The proposed relocation involves rotating the dock and lift 90 degrees so
that access to the lift and dock is in line with the current flow.
Because of the high velocity of the current during rising and falling tide, it
is very difficult for the owner and his family to use the lift and dock being
broadside to the current.
This relocation will also reduce the distance the dock structure extends out
into the water body.

The Division of Coastal Management hereby acknowledges receipt of your application, acting as agent for Mr. R.B.
Jennings, for the proposed development located at 32 Saltmeadow Road, adjacent to Banks Channel, on Figure "8"
Island, in New Hanover County. It was received as complete on July 15, 2016, and appears to be adequate for
processing at this time. The projected deadline for making a decision is September 28, 2016. An, additional 75-day
review period is provided by law when such time is necessary to complete the review. If you have not been notified
of a final action by the initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional, letter will be
provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from July 15, 2016, you may request a meeting with
the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and federal review
agencies for their comments. If additional information is required based on this review, the agencies may contact you
directly.

DEVELOPMENT PERMIT
The Department of Environmental Quality hereby gives public notice as required by
NCGS 113A-119(b) that the following applications were submitted for a development permits
in Areas of Environmental Concern as designated under the CAMA to reconfigure existing
docking facilities adjacent to Banks Channel and Middle Sound, on Figure Eight Island, in
Wilmington, New Hanover County. On July 13, 2016 by Jimmy Creech, at 17 Beach Road
South (Modification of State Permit No. 57-14); and on July 15, 2016 by R.B. Jennings at
32 Saltmeadow Road Copies of the applications can be examined or copied at the office of
Robb Mairs (NH Co.), N.C. Dept. of Environmental Quality, Division of Coastal Management,
127 Cardinal Drive Ext., Wilmington, NC 28405, (910-796-7423) during normal business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400
Commerce Avenue, Morehead City, NC 28557-3421, prior to August 26, 2016 will be
considered in making the permit decision. Later comments will be accepted and considered up
to the time of permit decision. Project modification may occur based on review and comment
by the public and state and federal agencies. Notice of the permit decision in these matters will
be provided upon written request.
