The attached sketch depicts the alterations discussed, though the shift in dock/pier would likely not be as much as shown. This version of modification would intend for the following: 1. Remove existing dock & pier 2. Shift Proposed Dock & Pier to northeast slightly 3. Convert dirt/shell ramp area to concrete (requires material removal) '4. Add concrete to northeast edge of existing ramp, where.existing pier would be removed (if feasible to construct) 5. Add retaining wall and/or small piles for marking northeast edge of ramp 6. Add piles to help prevent boats from getting pinned under adjacent pier during ebb tides Another option if better: 1. Remove existing dock & pier 2. Leave Proposed Dock & Pier as previously shown 3. Convert dirt/shell ramp area to concrete (requires material removal) 4. Add retaining wall and/or small piles for marking northeast edge of ramp 5. The entire property consists of two parcels; a 1,517.2 sq. ft. parcel, and a 1,632.5 sq. ft. parcel, for a total parcel area of 3,149.7 sq. ft. Both parcels are deeded to the Town of Varnamtown, located within the planning jurisdiction of Brunswick County. The tracts average approximately 6' above normal water level (NWL). Most of the project site is located on the waterward tract adjacent to the Lockwood Folly River and has approximately 65' of shoreline. The site currently functions as a public boat ramp facility. A concrete public boat ramp and temporary docking facility was authorized through CAMA Major Permit 92-93, issued on August 9, 1993 and expired December 31, 1996. A "Letter of Refinement" was issued on November 3, 1993 approving a modification to Major Permit 92-93 for the relocation of the proposed concrete boat ramp "several feet towards the north side of the site". There are currently two boat ramps located in the center of the shoreline at the site. The northwest ramp is approximately 17' wide by 72' in length and constructed from concrete, and is bounded by an existing 39' bulkhead on the northern side extending from mean low water (MLW) inland. The 39' bulkhead also has an existing 40' in length by 4' in width walkway which continues to a 21' in length by 4' in width fixed pier, 12' in length by 4' in length ramp, and 16' in length and 8' in width float. The existing docking facility provides two (2) temporary boat slips. The southwest boat ramp is 18' wide and constructed from oyster shell. Both ramps are separated by an existing wooden bulkhead measuring approximately 70' in length. All existing structures encroach on the 15' riparian corridor setback, and the existing ramp and float encroach on the Federal Navigation Channel setback. A gravel parking area occupies the high ground portion of the site, with a total impervious area of approximately 1,865 square feet within the 75' Estuarine Shoreline Area of Environmental Concern setback. Coastal wetlands are not present. The parcel is not serviced by water or sewer. The waters of Lockwood Folly River, adjacent to the project site, are classified as SA;HQW by the North Carolina Division of Water Resources. They are designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT The applicant is proposing to remove the existing 70' wooden bulkhead; construct a new 5' in width by 70' in length fixed elevated pier, 5' in width by 12' in length ramp, and 8' in width by 35' in length float. The proposed elevated pier dock and float would provide two (2) additional temporary dockage spaces which would bring the overall temporary docking space for the facility to four (4). The water depth on the landward side of the proposed floating dock is approximately -2.5' at MLW. 10. ANTICIPATED IMPACTS The proposed elevated pier dock and float would contribute to approximately 630 square foot of open water shading over estuarine waters and public trust area. The proposed docking structure would encroach into the adjacent 15' Riparian Corridor Setback Areas, but the applicant has retained waivers from both adjacent property owners. Increased turbidity should be expected with construction. The proposed dock would extend approximately 66' from the shoreline, which COMPLIES the '''A width rule (67.5') and would extend into the Federal Channel Setback portion of the waterbody. An existing public boat ramp, floating dock, and access pier is located at the end of Fisherman Road (SR1123), at the point where the roadway meets the Lockwood Folly River. The existing ramp area consists of two launch bays, one of which has a concrete base and the other of a shell/soil blended surface. Though the public ramp area has been used for many years, the Town entered into a cooperative agreement with the N. C. Wildlife Resources Commission in the early 1990's to complete upgrades to the site. The Town now wishes to modify the existing facility to improve current boat launching conditions. The property has approximately 36.95 feet of shoreline, with an existing pier, floating dock and parking area. The applicant wishes to add an additional pier and floating dock arrangement per the attached plans to increase the capacity of temporary docking of recreational and commercial boats at the public boat ramp. The current configuration limits the ability of vessels to get in and out of the water in a timely manner during peak use. The proposed number of temporary dockage spaces for the facility is approximated at 2, based on the standard length of current intended use. The Town also wishes to maintain the existing shell base ramp area by adding oyster shells for general stability in areas that have softened over the years. Norton 11/14/2016 The total area of floating dock and platform was calculated as follows: Shoreline length = 65 ft. x 8 ft. = 520 sq. ft. Existing floating dock = 8 ft. x 16 ft. =128 sq. ft. Proposed floating dock= 8 ft. x 35 ft. = 280 sq. ft. Total = 408 sq. ft. The construction of the proposed pier dock and float would provide temporary docking space for one (1) vessel. A fixed, wooden pier and float is proposed in the Estuarine Water and Public Trust Area AEC, and appears to be consistent with use standards outlined in 07H .0208(b)(6). The dock also appears to be consistent with the other use standards set forth in 07H.0207(d), including the 8 square foot rule, the %4 width rule, the 15' riparian corridor setback rule (waived). In the absence of any concerns from the commenting agencies, it is recommended that a permit be issued subject to the standard conditions. NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day operation of the facility to prevent facility waste from entering the adjacent waters. REGAN Secretary TRACY DAVIS Director On November 15, 2016, the Wilmington Regional Office of the Division of Energy Mineral, and Land Resources received a copy of the CAMA Major Permit Application for the subject projet Staff review of the plans and specifications on November 14, 2016 has determined that the development activities proposed at this time will not pose a threat to surface water quality from stormwater nmoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of I SA NCAC 2H.1000, the stormwater rules. By copy of this letter, we are informing you that this project will not require a stormwater management permit. If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements.
