Please find the interim response below. I reiterated today the need to pursue utilization of the existing channel. This
office believes that use of the existing access within public trust waters needs is the best option. I also stated that since
it is public waters, the ability to get a permit for maintenance would exist for Mr. Worsley. Perhaps a meeting will be
needed. I also told both representatives from LMG that preapp/scoping meetings help resolve these issues earlier.
Let me know if you need anything else.

Dear Ms. Stasavich:
This letter acknowledges your email sent on 8/10/16 in which you indicated that you wish to place
the CAMA Major Permit application for Mr. Cecil Worsley in abeyance. Based on this request,
processing of your application will be terminated until such time as a written request is received
in this office requesting a resumption of application processing. As required by NCAC
T15A:07J.0204(d), during the pendency of any termination of processing, the permit processing
period will not run. Upon my receipt of a written request to reinitiate processing, the Division of
Coastal Management will resume processing of the application at the point where it was
terminated. Furthermore, additional time will be also needed for this office to complete the review
and make a decision on your request. Therefore, it is necessary that the standard review time be
extended. An additional 75 days is provided by G.S. 113A-122(c). However, we expect to take
action prior to that time and will do so as soon as possible after the reinitiation of application
processing.

Recommendations for State Permit — Cecil Worsley 6/1412016
This office supports the recommendations of the resource agencies, particularly the NC Division of Marine Fisheries, regarding potential
impacts to shallow bottom and primary nursery area. Should concerns be expressed over potential impacts from any of the resource
agencies, the project could then be found to be inconsistent with NCAC 07H .0208(a)(2), which requires that the location, design and need
be consistent with the management objective of the Estuarine System AEC and the project be sited and designed so as to avoid significant
adverse impacts upon the productivity and biological integrity of spawning and nursery areas.
Based on historical aerial photography, it is the opinion of this office thatthe area for the proposed maintenance excavation is located within an
area of Bradley Creek that has been historically used for docking and navigational purposes. The proposed excavation of the area within the
existing basin appears to be CONSISTENT with15 NCAC 071-1.0208 (b)(1). This office has no objection to the proposed work, provided it is
consistent with all state and federal permitting requirements. Any permit issued should include standard permit conditions for mechanical
excavation and fill.

On June 17, 2016, the Division of Water Resources (Division) received your application
requesting a 401 Water Quality Certification from the Division to excavate a new access
channel and basin within Bradley Creek at the property listed above. The Division has
determined that your application is incomplete and cannot be processed. The application is on -
hold until all of the following information is received:
1. Please provide more details regarding avoidance and minimization of impacts for this
project. [15A NCAC 02H .0506(f) and (g)] You have requested authorization to dredge
5,520 square feet of estuarine waters classified as Secondary Nursery Area (SNA) in
order to create a new access channel within Bradley Creek. These impacts do not
appear to be needed since there appears to be an existing, functional access channel
that can be used. Please revise the plans to avoid or minimize these impacts or provide
additional information describing why they are needed.
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested
information for the proper consideration of the application. If all of the requested information
is not received in writing within 30 calendar days of receipt of this letter, the Division will be
unable to approve the application and it will be returned. The return of this project will
necessitate reapplication to the Division for approval, including a complete application package
and the appropriate fee. Please respond in writing within 30 calendar days of receipt of this
letter by sending three copies of all of the above requested information to the 401 & Buffer
Permitting Branch, 1617 Mail Service Center, Raleigh, NC 27699-1617.

On June 17, 2016, the Wilmington Regional Office of the Division of Energy, Mineral, and Land
Resources received a copy of the CAMA Major Permit Application for the subject project. Staff review
of the plans and specifications on June 21, 2016 has determined that the development activities proposed
at this time will not pose a threat to surface water quality from stormwater runoff. The Director has
determined that projects that are reviewed and approved by the Division as not posing a water quality
threat from stormwater runoff should not be subject to the stormwater management permitting
requirements of 15A NCAC 2H.1000, the stormwater rules. By copy of this letter, we are informing you
that this project will not require a stormwater management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff,
then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater
discharge requirements. You are required to have an NPDES permit for stormwater discharge from
projects meeting these criteria. All temporary built -upon area associated with the construction of the
project must be removed within 30 days of completion of the project, or when it is no longer needed,
whichever occurs first.

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the
subject permit application for proposed actions that impactfsh and fish habitats. The applicant proposes
to excavate a new access channel and basin within.Bradley Creek. The surrounding waters are classified as
secondary nursery area.(SNA), salt water and secondary recreation (SC) and are closed to shellfish harvest.
The docking facility is currently located within an existing dredged footprint, authorized under permit
#131-12 to the applicant's riparian neighbor. The dredge limit authorized in #131-12 is located at the.
western.edge of Mr: Worsley's floating dock, with the normalized footprint encompassing Mr. Worsley's
docking facility. The waters are classified as SNA, which are estuarine waters commonly used as a
developmental transitional zone, where later juvenile development takes place. Species within
this area are mixture of juveniles that have migrated front the, primary nursery areas upstream, .
sub=adults and adults. Shallow habitat, such as this, with coastal:wetlands and' oyster reefs, .
provide vulnerable juvenile species with protection from.predators, an abundahce.of.food, and.
water temperatures preferable to juvenile flinfish and shellfish species. On a case specific basis,
when prudent, avoidance and minimization measures can be utilized in order to protect sensitive
fisheries habitat. In this specific case, the applicant is within an existing and.maintained dredge
footprint, that has minimal-distance.of travel, (approximately 425ft) to the main channel of
Bradley Creek and the AIWW. Authorization of anew channel would not satisfy avoidance and
minimization measures and result in needless significant adverse impact to the SNA habitat
Therefore, I: object to the proposed action. It is suggested that alternative means.to guarantee
access to Bradley Creek be investigated which gives the applicant approval to. maintain the
existing dredge footprint authorized.in permit #131-12.

Thanks for talking with me on the phone. To memorialize our conversation regarding the Worsley proposal to dredge at
407 Bradley Creek Pt. Rd:
This office has concerns about the purpose and need for the requested action. There appears to be a fully functional
access channel to Bradley Creek that the Applicant can currently utilize. The dredging around the existing dock may be
warranted, but the new access channel does not appear to be necessary. With regard to the upkeep and maintenance
of that existing channel, your client could apply for a permit to maintain the existing channel rather than cut a new
channel. The documents that you provided as evidence of an historic channel have been received, but this office
believes that the historic channel has naturalized sufficiently that we would consider this proposal to be new work and
not maintenance of an existing channel.
If your client can provide sufficient evidence that the proposed impacts are unavoidable, this office will be willing to
consider that. Otherwise we ask that you look into only applying for the necessary dredging around the docking facility.

Pursuant to the CAMA-Corps Programmatic Permit process, the North Carolina Division of Coastal Management
(NCDCM) has forwarded to our office a copy of the LAMA permit application, Field Investigation Report and BioReport
for the subject project. The attached notice requests federal agency comments on this project by August 8th, 2016.
The applicant proposes to excavate -612 cubic yards of sediment from 5,520 sq. ft. or shallow bottom habitat around an
existing docking facility and a 20 ft. wide entrance channel to a depth of -SMLW, all within Bradley Creek, Wilmington,
NC. The applicant has proposed to utilize the USACE Disposal Area No. 0248 and dispose of the material on
approximately 13,068 sq. ft. of highground within the DA 0248. The proposed dredging method is mechanical and will
utilize "Bucket to Barge", Clamshell, method. The disposal island is 0.5 miles SE of the project location.
The proposed excavation project is located at 407 Bradley Creek Point Drive around an existing docking facility and into
Bradley Creek, Wilmington, New Hanover County, North Carolina. Coordinates in Decimal Degrees are: 34.20930 N and -
77.82250 W. Additionally, a Google Earth .kmz file is attached for reference.
Please see the attached field investigation report /application for more detailed information concerning the proposed
project.
This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery
Conservation and Management Act. The Corps' initial determination is that the proposed project may affect, but not
likely adversely affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management
Councils or the National Marine Fisheries Service. Impacts are expected to be minimal due to small size of the project
area an temporary nature of sedimentation impacts, but the change in habitat and use of the shallow bottom habitat
will be permanent. No coastal wetlands will be impacted, and the waters within the project area are not designated as
PNA (they are Secondary). SAV is not expected to be present based on aerial imagery of the project location. The
applicant has conducted shellfish surveys within the proposed dredging footprints and has incorporated a loft dredge
offset to protect existing resources from sloughing. (please see attached Project Narrative from the Application).
The Corps has reviewed the project area, examined all information provided by the applicant and consulted the latest
North Carolina Natural Heritage Database. Based on available information, the Corps has determined that the project
will affect, but not likely adversely affect the West Indian Manatee. The project will not affect any other species listed as
threatened or endangered or their critical habitat formally designated pursuant to the Endangered Species Act of 1973
(ESA) within the project area. The use of Manatee Guidelines will be required as a permit condition.
Pursuant to Section 106 of the National Historic Preservation Act (NHPA) of 1966, Appendix C of 33 CFR Part 325, and
the 2005 Revised Interim Guidance for Implementing Appendix C, the District Engineer consulted district files and
records and the latest published version of the National Register of Historic Places and initially determines that no
historic properties, nor properties eligible for inclusion in the National Register, are present within the Corps' permit
area: therefore, there will be no historic properties affected.

NOAA's National Marine Fisheries Service (NMFS) reviewed the public notice for Action ID No. SAW-
2016-01334, dated July 8, 2016. Cecil Worsley, applicant, requests authorization to excavate a new
access channel and to dredge the bottom around an existing docking facility in Bradley Creek, New
Hanover County. The Wilmington District's initial determination is the proposed dredging may affect
essential fish habitat (EFH) or associated fisheries managed by South Atlantic Fishery Management
Council (SAFMC), the Mid -Atlantic Fishery Management Council, or NMFS. As the nation's federal
trustee for the conservation and management of marine, estuarine, and diadromous fishery resources, the
NMFS provides the following comments and recommendations pursuant to the authorities of the Fish and
Wildlife Coordination Act and the Magnuson -Stevens Fishery Conservation and Management Act
(Magnuson -Stevens Act).
Description of the Proposed Project
The applicant proposes excavating an access channel measuring 276 feet in length and 20 feet in width to
improve navigation to an existing dock. The estimated volume of dredging is 612 cubic yards from 5,520
square feet of shallow bottom to establish a controlling depth of -5.0 feet at mean low water. The
applicant proposes to excavate sediment via a bucket -to -barge (clamshell) operation and to transport the
dredged material to an upland disposal site approximately 0.5 miles from the project location. Water
depths within the footprint of the project area average -2.0 feet mean low water. Dredging has never
occurred within the footprint of the proposed access channel; however, aerial photographs from 1981
suggest a natural shallow channel once existed. Over the past 35 years, the area has experienced shoaling
and has become a naturalized shallow bottom habitat. In order to minimize impacts to oyster reefs and
coastal wetlands within the project area and allow for stabilization of the dredge cut, the applicant
proposes a ten -foot dredge offset from the shell bottom, oyster reefs, and salt marsh. Dredging has
occurred previously around the dock.
Impacts to Essential Fish Habitat
The project area is within a state -designated Permanent Secondary Nursery Area. Excavating the access
channel would disturb approximately 5,520 square feet of shallow bottom habitat and potentially impact
neighboring oyster reefs and salt marsh. The SAFMC identifies shallow intertidal and sub -tidal bottom in
estuarine waters as EFH for brown shrimp, pink shrimp, and white shrimp and for estuarine species
within the snapper/grouper complex (e.g., gray snapper and gag). The SAFMC also identifies oysters and
Permanent Secondary Nursery Areas as Habitat Areas of Particular Concern (HAPCs) for shrimp, gag,
and gray snapper. HAPCs are a subset of EFH that are rare, particularly susceptible to human -induced
degradation, especially important ecologically, or located in an environmentally stressed area. The
SAFMC identifies these areas as EFH because fish and shrimp concentrate in these habitats for feeding
and refuge and experience high growth and survival rates when located in these habitats. The SAFMC
provides detailed information on the EFH requirements of federally managed species in amendments to
the fishery management plans and in Fishery Ecosystem Plan of the South Atlantic Region.
The project area clearly functions as nursery habitat for federally managed species as well as other species
of commercial or recreational importance including red drum, Atlantic croaker, spot, Atlantic menhaden,
bay anchovy, striped mullet, weakfish, and blue crab. A number of these species serve as prey for fish
that are managed by the SAFMC (e.g., king mackerel, Spanish mackerel, and cobia) or for highly
migratory fish managed by the NMFS (e.g., billfishes and sharks).
EFH Conservation Recommendations
Section 305(b)(4)(A) of the Magnuson -Stevens Act requires NMFS to provide EFH Conservation
Recommendations for any federal action or permit which may result in adverse impacts to EFH.
Therefore, NMFS recommends the following to ensure the conservation of EFH and associated fishery
resources:
• The permit should not authorize deepening of waters around the existing docking facility beyond
what has been authorized previously.
• The permit should not authorize dredging a new access channel. The applicant clearly has access
to an existing navigable channel with navigation aids located to the southeast of the property
offering direct access to main channel of Bradley Creek. If the applicant continues to pursue the
new access channel, the NMFS recommends development of an EFH Assessment.
Section 305(b)(4)(B) of the Magnuson -Stevens Act and implementing regulation at 50 CFR Section
600.920(k) require the Wilmington District to provide a written response to this letter within 30 days of
its receipt. If it is not possible to provide a substantive response within 30 days, in accordance with the
"findings" with the Wilmington District, an interim response should be provided to the NMFS. A
detailed response then must be provided prior to final approval of the action. The detailed response must
include a description of measures proposed by the Wilmington District to avoid, mitigate, or offset the
adverse impacts of the activity. If the response is inconsistent with the EFH conservation
recommendations, the Wilmington District must provide a substantive discussion justifying the reasons
for not following the recommendations.

9. PROJECT DESCRIPTION
The applicant's property is located at 407 Bradley Creek Point Drive, in Wilmington, New Hanover County. To locate the property
from the Wilmington Regional Office (WiRO), take Eastwood Road and travel east towards Wrightsville Beach approximately 2.0
miles. Turn right onto Military Cut -Off Road and travel south approximately 0.5 miles until you reach Aidie Road. Turn left onto
Aidie Road and travel approximately 0.7 miles east until you reach Bradley Creek Point Road. Turn right onto Bradley Creek Point
Road and continue until the road forks. Turn left at the fork and continue until you reach the property of interest, which will be
located on the left. The subject property is bordered by residential properties.
The property is approximately 0.87 acres and is currently developed with a two story single-family residence, which borders the
confluence of the AIWW and the northern side of Bradley Creek, in Greenville Sound. Vegetation on the site consists primarily of
maintained lawn grass and omamental landscaping. The property ranges in elevation from 4'-10' above normal high water (NHW).
There is a narrow section of section "404" type wetlands located on the waterward side of the property, which consists of Wax
Myrtle (Wrica cerifera), Marsh Pennywort (Hydrocotyle umbellate), and Groundsel Bush (Baccharis angustifolia). Coastal Wetland
species located adjacent to the property include, but are not limited to: Black Needle Rush (Juncus roemarianus), Sea Lavender
(Limonium, spp.), Salt Meadow Grass (Spartina patens) and Smooth Cordgrass (Spartina altemiflora) in an area approximately 50'
in width.
The applicant also maintains an existing docking facility, which is currently located within a shared basin area and access channel
that connects to the main stem of Bradley Creek. The existing access pier, measures approximately 56' in length by 6' in width
and spans over the existing wetlands towards Bradley Creek. The pier terminates to a covered platform, measuring approximately
16' in length by 16' in width. An access ramp then leads onto a floating dock, measuring approximately 32' in length by Fin width
which runs parallel to the shoreline. The existing docking facility currently accommodates one to two vessels.
It should also be noted that the adjacent riparian property owner to the west also shares an existing access channel and basin
with three other property owners along this side of Bradley Creek.
The adjacent riparian property owner to the east (Bradley Creek Point Investments, LLC c% Watson Caviness) was issued State
Permit No.131-12, which authorized the excavation of the basin and access channel. Located between this basin and the main
stem of Bradley Creek is a band of Coastal Wetlands, consisting primarily of Smooth Cordgrass (Spartina altemiflora), which
measures approximately 200' in length by 30' in width. Waterward of this area of low marsh along the creek are several areas of
oyster reefs which are visible in the mud flats at low water. Based on site visits at this location and the provided drawings, the
water depth within this basin adjacent to the existing docking facility is approximately -3.5' at normal low water (NLW). The
application states that the water depth outside the basin to the west range from approximately 0.0' to -3.0' at NLW (See Sheet 3 of
9 and Project Narrative).
The waters of Bradley Creek, which are located adjacent to the property, are classified as SC by the Division of Water Resources. This
area is NOT designated as a Primary Nursery Area (PNA) by the Division of Marine Fisheries and according to maps provided by the
Shellfish Sanitation Section, the area is CLOSED to the harvesting of shellfish.
PROPOSED PROJECT:
The applicant proposes to excavate a new access channel and basin within Bradley Creek. The application states a new access
channel, measuring approximately 276' in length by 20' in width to a final project depth of -5' @ NLW, which would be the same
depth as the connecting waters of Bradley Creek. The proposed excavation dimensions also include the basin area which is
located within the adjacent property owner's riparian corridor to the west. The application states that the dredging limits would
maintain a 10' setback from the existing marsh substrate. The material would be excavated mechanically by bucket -to -barge
method, which would result in the removal of approximately 612 cubic yards of material. The excavated material would then be
hauled to a privately owned spoil island located approximately 0.9 miles south of the project site at the confluence of the AIWW
and Molts Channel (US Army Corps of Engineers (USACE) Disposal Site No. DA-0248). RECEIVED

The application states that the material would be off loaded and placed outside the USACE Easement Boundary on the eastern
portion of the island. The proposed spoil site is commonly used as a disposal site by local marine contractors. The applicant also
proposes to install eight (8) channel markers within the access channel from the mouth of the creek to the basin area. The two
most waterward markers would be located at the mouth of the channel and would not be located any farther than the existing
channel markers (Green Buoy #3 and Red Marker #4) within Bradley Creek (See Sheets 1 through 9 of 9 and Project Narrative).
10. ANTICIPATED IMPACTS
The proposed dredging would disturb approximately 5,520 sq. ft. of shallow bottom area, and would result in the removal of
approximately 612 cy of material from the existing basin and access channel system. The application states that the dredging
limits would maintain a 10' offset from the location of the existing Coastal Wetlands. The disposal of the material would impact
approximately 13,068 sq. ft. of highground, which would be located on an existing spoil island at the confluence of the AIWW and
Motts Channel (USAGE Disposal Site No. 0248), which is commonly used as disposal site by local marine contractors. Minor
increases in turbidity should be expected during the dredging event; however, no long tens adverse impacts are anticipated.
The proposed eight (8) channel markers within the access channel do not appearto impede established navigation within this area
of Bradley Creek. The two most waterward markers would be located at the mouth of the channel and would not be located any
farther than the existing channel markers (Green Buoy #3 and Red Marker #4) within Bradley Creek

The project site is located on Bradley Creek in the City of Wilmington, New Hanover County.
Waters of Bradley Creek are classified as "SC" by the North Carolina Environmental
Management Commission. The NC Division of Marine Fisheries classifies this vicinity of Bradley
Creek as a permanent secondary nursery area.
The applicant, Mr. Cecil Worsley, proposes to excavate approximately 612 cubic yards of sandy
sediment within Bradley Creek to provide navigable access to an existing dock on the property.
The purpose is to provide safe water access to the navigation channel of Bradley Creek and to
secure future docking access. Proposed dredging would re-establish a previously existing
connection to the mainstem of Bradley Creek which has apparently shallowed due to redirected
flow. Aerial photographs from 1956 and 1966, prior to and just after dredging of the navigation
channel, show a natural channel along the property's waterfront. An aerial photograph from
1981 shows the channel and a clear connection to the dredged mainstem of Bradley Creek. All
aerial photographs referenced here are enclosed as Sheets 6-9 of this permit application. The
applicant requests to re-establish this previously existing connection to the mainstem of the
Bradley Creek channel. No upland development within the 75 ft AEC is proposed, and all
existing uses of the property will remain the same.
The applicant proposes to excavate approximately 612 cubic yards of sediment to a final depth
of -5 ft MLW. Proposed excavation includes the area within and around the floating dock as well
as a 20 ft wide entrance channel to the -5 ft MLW contour of the Bradley Creek channel.
Sediment will be excavated via a bucket -to -barge (clamshell) operation and transported to a
dredge deposition site located on an island approximately 0.5 miles southeast of the property.
The deposition site has been historically utilized for dredge projects in this vicinity and is
frequently maintained by contractors. The applicant also proposes a total of eight (8)
navigational aids along the entrance channel. Navigational aids will be timber pilings and will
feature reflectors for visibility at night.
In order to protect fisheries and water quality resources, LMG GPS-located the waterward edge
of marsh along the northern side of the dredge footprint. LMG also conducted a shellfish
resource survey within the proposed dredging footprint. Sampling was conducted on a transect
along which depths are shown on Sheet 3 of 9 (enclosed). A 1 mz area was raked at sampling
points spaced approximately 20 feet apart along the 170 transect. No oysters or clams were
found along the transect. The small intertidal island located south of the proposed dredging
footprint contained dense oysterbeds along its intertidal and shallow subtidal edges. In order to
avoid impact to this resource, LMG GPS-located the limits of shell bottom around island. A ten
foot dredge offset from the shell bottom and coastal marsh was included to allow for
stabilization of the dredge cut and to avoid impact to these resources. Given the large grain size
(sand) it is anticipated that any turbidity from dredging would settle quickly, and impacts to the
water column would be temporary. Opportunistic benthic invertebrates are expected to quickly

to Bradley Creek, in Wilmington, New Hanover County. It was received as complete on May 31, 2016
and appears to be adequate for processing at this time. The projected deadline for making a decision is
August 14, 2016. An additional 75-day review period is provided by law when such time is necessary to
complete the review. If you have not been notified of a final action by the initial deadline stated above,
you should consider the review period extended. Under those circumstances, this letter will serve as your
notice of an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from May 31, 2016 you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of
your project. Such a meeting will be held within five working days from the receipt of your written
request and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could
result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and federal
review agencies for their comments. If additional information is required based on this review, the
agencies may contact you directly.

We could reschedule our site visit today for Friday am and take you to the site with us (via boat). You'd probably still
need hip boots if you wanted to hop out and walk to the actual dock location. We'd probably meet at Masonboro Yacht
Club and leave from there. I don't know how much time you have, but we'd need about 2 hours to collect water depths
also.
Either way is fine with me. There is a chance of thunderstorms Friday (supposedly after it am) which might make the
boat option a little less reliable. I'll meet you at the property Friday morning too. Just thought I'd offer.

WHEREAS, Elizabeth A. Taylor died testate on May 3, 2008; and,
WHEREAS, the Last Will and Testament of Elizabeth A. Taylor (the "Will") was
duly probated and filed in the office of the Clerk of Superior Court of New Hanover County in
Estate File No. 08-E-521; and,
WHEREAS, Victor Grainger Taylor, Jr. qualified as Executor of the Estate of
Elizabeth A. Taylor on May 29, 2008; and,
WHEREAS, at the time of her death, Elizabeth A. Taylor owned a one-half (1/2)
undivided interest in the real property hereinafter described; and,
WHEREAS, the party of the first part acquired a one-half (1/2) undivided interest
in the real property hereinafter described pursuant to the terms of the Will; and,
WHEREAS, Victor Grainger Taylor, Jr., Executor of the Estate of Victor
Grainger Taylor executed a deed describing a transfer of a one-half (1/2) undivided interest in
the real property hereinafter described to Victor Grainger Taylor, Jr., Trustee of the Taylor
Family Trust u/w/d October 28, 1996 said Executor's Deed being recorded in Book _fs" , at
Page ZON I , in the office of the Register of Deeds of New Hanover County; and,
WHEREAS, said Trustee executed and delivered a deed to the party of the first
part for a one-half (1/2) undivided interest in the real property hereinafter described, said
Trustee's Deed being recorded in Bookat Page 2 AZ I , in the office of the Register
of Deeds of New Hanover County.
NOW THEREFORE, the party of the first part in consideration of the sum of Ten
and No/100 Dollars ($10.00) and other good and valuable considerations paid to the party of the
first part by the party of the second part, the receipt and sufficiency of which hereby are
acknowledged, has granted, bargained, sold and conveyed and by these presents does grant,
bargain, sell and convey unto the party of the second part, said party's heirs and assigns, the

All that certain tract or parcel of land lying and being situate in

Reston Taylor, and Victor Grainger Taylor, Jr. covenant that they are seized of said property in
fee and have the right to convey same in fee simple; that the same is free from encumbrances
except any encumbrances or restrictions mentioned above and that they will warrant and defend
the title to the same against the lawful claims of all persons whomsoever.
John P. Andrews and Lori J. Taylor join in the execution of this deed solely for
the purposes of conveying, relinquishing, and waiving, and hereby do convey, relinquish, and
waive any and all marital interest they may have in the aforesaid property as the spouses of
Frances Grainger Taylor Andrews and Victor Grainger Taylor, Jr. and make none of the
warranties contained herein.
Victor Grainger Taylor, Jr., as Executor of the Estate of Elizabeth A. Taylor, joins
in the execution of this deed solely for the purpose of consenting to the transfer of the one-half
(1/2) undivided interest bequeathed to the party of the first part through the Estate of Elizabeth
A. Taylor, consistent and in compliance with N.C. Gen. Stat. § 28A-17-12(a)(2).

DEVELOPMENT PERMIT
The Department of Environmental Quality hereby gives public notice as required by
NCGS 113A-119(b) that the following applications were submitted for development permits in
Areas of Environmental Concern as designated under the CAMA adjacent to the AIWW in
Brunswick County: On June 6, 2016 Mike Molinini proposed to reconfigure an existing
docking facility at 2688 Mariners Way SE, in St. James (Southport); and on June 14, 2016
Randolph & Sylvia Brecheisen proposed to construct a new docking facility at 216 Shoreline
Drive E., in Sunset Beach. On June 6, 2016 Quinn Ventures, LLC proposed, by the
modification of State Permit No. 36-16, to fdl an area of "404" type wetlands and to install a
bulkhead at 916 S. Anderson Blvd, adjacent to Topsail Sound, in Topsail Beach, Pender
County. On May 31, 2016 Cecil Worsley proposed to excavate a new access channel and
basin within Bradley Creek, at 407 Bradley Creek Point Rd, adjacent to the AIWW, in
Wilmington, New Hanover County. The applications can be examined or copied at the office of
Tara MacPherson (Molinini), Sean Farrell (Brecheisen), Jason Dail (Quinn), or Robb Mairs
(Worsley), N.C. Dept. of Environmental Quality, Division of Coastal Management, 127 Cardinal

Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400
