PROJECT SUMMARY: The applicant proposes to construct a bulkhead with backfill and construct a 3-story commercial and residential building on the property with the same general footprint as the existing building. The applicant also proposes a 30 ft. by 6 ft. wooden deck that would serve as a dock for 2 boats with 4 tie pilings. Field Investigation Report Page 2 Proiect Setting The project is located at 706 Riverside Avenue, Elizabeth City, Pasquotank County, and adjacent to Charles Creek near the mouth where the creek joins the Pasquotank River. The property is also located adjacent to the Charles Creek bridge on the north side of Riverside Ave. The property is approximately .15 acres in area with dimensions of approximately 60 ft. wide and 110 ft. long. The property has an existing 3320 sq. ft. two story building that was severely damaged by fire in early 2007. The front portion of the property is covered mostly by a gravel parking area with grass growing through the gravel. The building was previously used as a boat motor and small engine repair business with a residential apartment above. The remnants of a 7 ft. wide and 20 ft. long dock exists along the west side of the property adjacent to the building and was used as the dock for boats that were being repaired. The remains of the dock are claimed by the adjacent riparian landowner. The shoreline located on the west side has gradually eroded underneath the applicant's building. The waters of Charles Creek stand underneath the building and occupy an area approximately 24 ft. by 30 ft. and approximately one foot deep. Pieces of concrete have been placed along the west building side and now litter the bottom. Vegetation on the property consists of yard grass and weeds. The property has an elevation of approximately two feet above normal water level. The adjacent properties consist of an abandoned yacht club building over Charles Creek and a boat storage building. The waters of Charles Creek in this area are joint waters, classified as C Sw by the Division of Environmental Management and are closed to shellfish taking. Development Proposal The applicant proposes to demolish the existing structure and construct a bulkhead to reclaim the eroded shoreline that was underneath the structure. The applicant also proposes to construct a new 3 story commercial and residential structure in the same general footprint as the previous structure howeverthe new structure will be positioned 8.5 ft furtherto the south of the previous footprint. This repositioning is due to the city's denial of the applicant's variance request to waive a local 15 ft rear property line setback requirement. The applicant was granted major permit #112-03 in 2003 for a similar bulkhead alignment however the applicant never initiated the construction and the permit expired in 2006. Since the authorization of the major permit the existing structure suffered fire damage and the applicant now proposes basically the same bulkhead alignment with the exception of the rear corner alignment and to reconstruct a commercial and residential structure on the property. The proposal consists of a treated wooden bulkhead that would begin at the northwest corner property line and run adjacent to the new building footprint approximately 24 ft waterward of normal water level along the west side. The bulkhead would then turn and run adjacent to the new building footprint along the rear of the proposed building to the existing normal water level Field Investigation Report Page 3 and follow the northern property line to the Griffin property approximately 2 ft waterward of normal water level. The bulkhead would total 69.5 ft. The proposal also consists of constructing a 3 story commercial/residential building immediately adjacent to the proposed bulkhead alignment in the same general footprint as the previous structure. The applicant would install pervious concrete for parking and pedestrian use in the remaining area of the property that is now grassed. Along the western side of the proposed building the applicant proposes a 30 ft. by 6 ft. wooden deck that would extend waterward of normal water level and would require the removal of the existing dock remains. The new deck would have 4 tie pilings facilitating 2 boats to dock alongside the building. The second and third stories of the building would also have 30 ft. by 6 ft. wooden decks immediately above the first story deck. Anticipated Impacts The development proposal will result in the filling of approximately 572 sq. ft. of Public Trust Area and Estuarine Waters Area of Environmental Concern (AEC) of Charles Creek and 6600 sq. ft. of Public Trust Shoreline and Estuarine Shoreline Area of Environmental Concern (AEC), 2,574 sq. ft. of which was previously filled by an existing building and 4,026 sq. ft. to be filled by pervious concrete which was covered by existing gravel. The development would also shade 180 sq. ft. of Estuarine Waters Public Trust Area of Environmental Concern. The bulkhead alignment as proposed will encroach upon property that is currently under dispute by the riparian property owner along the south corner and the dock proposed would encroach into estuarine water that is claimed by the adjacent riparian property owner. The.adjacent property owners object to the bulkhead alignment, removal of the dock claimed by.them and construction of a new dock, and to the position of the proposed 3 story building. Approximately 21 cubic yards of fill material will be placed below normal water level for the backfill of the bulkhead. The fill of 516 sq. ft. of EW-PTA consists of already shaded shallow -water that does not exhibit any wetland or submerged aquatic vegetation. I have reviewed the Rules of the Coastal Resources Commission as they pertain to shoreline stabilization, docks and piers, and coastal shorelines in the Estuarine Waters, Estuarine Shoreline and Public Trust Areas of Environmental Concern (AEC). My findings of the applicability of these rules to Alice Redding's major permit application are as follows: Paragraph 15A NCAC 07H .0208: Use Standards -Subparagraph (b) (6) Docks and Piers (D) states that the combined area of all'T"s, finger piers, platforms, and decks must not exceed a combined total area of four square feet per linear foot of shoreline. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, or to support a water dependent use that cannot otherwise occur. INCONSISTENT: The size of the proposed dock is 30' x 6' which is 180 sq. ft. and the linear feet of shoreline is 21.5 ft therefore only 86 sq. ft. of platform area would be allowed. -Subparagraph (b) (6) (L) states that piers shall not interfere with the access to any riparian property and shall have a minimum setback of 15 ft between any part of the pier and the adjacent property owner's areas of riparian access. CONSISTENT: The bulkhead alignment is proposed along the waterward edge of the existing structure, the property has an obvious erosion problem, the alignment is needed to mitigate the erosion problem that happened underneath the existing structure, the alignment should not cause any adverse impacts, and the need for the proposed alignment has been documented in the Field Investigation Report. Paragraph 15A NCAC 07H .0209: Coastal Shorelines -Subparaph (d) (10) (H) states that new development shall be located a distance of 30 ft landward of normal water level with the exception of development over existing impervious surfaces, provided that the existing impervious surface is not increased and the applicant designs the project to comply with the intent of the rules to the maximum extent feasible. CONSISTENT: The proposed 3 story structure is completely within the existing impervious surface footprint and the associated parking area is over existing impervious surface. It is recommended that the development'proposal be approved with standard conditions however the platform square footage should be limited and an official surveyed site plan should be provided with the - proposed building footprint depicted on the survey in response to the objection received by the adjacent riparian property owner. (.15 acre) -subject property is approximately 60_..feet,•wide and 11.0 feet long and contains approximately 50 feet of shoreline along Charles,Creek,near the mouth where it joins the Pasquotank River. The property has an elevation of approximately 2 feet above Normal Water Level (NWL) and is located in the AE Flood Zone. The, property is served by City water and sewer. Existing site improvements include a two-story structure with a 3,320 sq. ft. building footprint and gravel parking. The building was severely damaged by fire in 2007. The building was previously used as a boat motor and small engine repair business with a residential apartment above. Existing shoreline improvements include the remnants of a 7 foot wide and 20 foot long dock along the west side of the property. The dock was used for boats under repair. The shoreline is located under the existing building along a 24 foot by 30 foot area approximately 1 foot deep that has resulted from gradual erosion. Pieces of concrete have been placed along the west building side and litter the water bottom. Redevelopment of the site to include demolition of the existing building and site improvements, removal of the dock remains, installation of a bulkhead and wooden deck, and construction of a three-story structure and associated parking area is proposed. Approximately 69.5 linear feet of bulkhead will be installed 24 linear feet waterward of NWL along the west property line and 2 feet waterward of NWL along the north property line in order to reclaim eroded area currently under the existing building. A 6 foot wide by 30 foot long wooden deck extending waterward of NWL will be located along the western property line. The deck will have four (4) tie pilings to facilitate the docking of two (2) boats. Pervious concrete will be installed on the remaining site area to accommodate parking and stormwater runoff. Specific to building construction, the lowest floor elevation above base flood elevation was not indicated in the submitted materials. The waters of Charles Creek in this area are classified as Joint and C Sw waters and are closed to shellfish harvesting. The shallow water does not exhibit any wetland or submerged aquatic vegetation. Anticipated Impacts resulting from this project are expected to include: the filling of 572 sq. ft. of Public Trust Area/Estuarine Waters Area of Environmental Concern (AEC) and 6,600 sq. ft. of Estuarine Shoreline AEC; and the shading of 180 sq. ft. of Public Trust Area/Estuarine Waters AEC. The bulkhead alignment, as proposed, will encroach upon property that is currently under dispute by the riparian property owner along the southern corner. The proposed dock will encroach into Estuarine Water that is claimed by the adjacent riparian owner. As indicated in the Field Investigation Report, the adjacent property owner objects to the bulkhead alignment, removal of dock remains claimed by them, construction of a new dock, and the position of the three-story building. ,Basis for Determination: The'Eliiabeth, City Land Classification"Map identifies'th'e site area as "Developed".
