Reconfiguired Docking Facili 6' This permit authorizes the removal of two existing boatlifts and construction of a double boat lift, boathouse, touchless boat cover system, an 82'xl' catwalk, and 29'x2' walkway, and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this reconfigured docking facility without permit modification. The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. Footprint of the boathouse shall not exceed the dimensions on the authorized workplan drawings. The authorized boathouse shall be single story, and shall not be designed to allow for second story use. The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structures in order to make it more visible during hours of darkness or inclement weather. No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General The permittee and/or his or her contractor shall meet with a representative of the Division prior to Project initiation. No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. The U.S. Army Corps of Engineers authorized the proposed project and assigned SAW 2016- 01414, which was issued 9/12/16. The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 3900 and assigned the project DWR project No. 20160684. Received (; 1U14 15 2016 PROJECT NARRATIVE DCM-EC DAVID ANDREW & LISA bL WRIGHT LOTS 27 & 28 — SECTION A TOWN OF SOUTHERN SHORES —DARE COUNTY The applicant currently has an uncovered boat lift on the north side of the existing 24' x 25' tee head at the end of the 97' x 4' pier. The applicant is requesting to remove the uncovered boat lift and pilings and to construct a 24' x 30' covered boathouse on the south side of the tee head to store his two +/- 22-25 foot long boats. The applicant owns property which abuts the Currituck Sound and a lagoon resulting in approximately 466 feet of shoreline. Within the lagoon is a 10.5' x 10.5' deck over water accessed by a 4' x 12' pier. The proposed new boathouse will not extend waterward of the existing deck nor into a channel and a considerable distance less than the width of the Currituck Sound. The new construction (including removal of the existing pilings on the north side) will not result in an encroachment into the 15-foot setback from adjacent property owners' areas of riparian access. The total area allowed for docks and boathouses is 8 feet per linear foot of shoreline. Thus, the total possible is 3,128 square feet. The new boathouse, tee head, and deck (in the lagoon) will constitute 1,430.25 square feet. Boathouses of greater than 400 square feet must document the need. The proposed 720 square foot boathouse is necessary to cover the owner's two �/- 22 to 25 foot long boats. The proposed boathouse will be open sides with a flat top roof to minimize visual impact of the sound from the owner's house. The boathouse will have two boadifts installed under the cover. PROJECT SUMMARY: The applicant proposes to remove two existing boatlifts and then install a large double lift boathouse with a touchless boat cover system. Project Setting The site of the proposed development is located at 251 North Dogwood Trail, Southern Shores, Dare County, adjacent to the Currituck Sound. The property is ±37,000 ft2 in size and has an elevation that ranges from V to 10' above normal water level (NWL). Man-made features within the highground area include a single-family dwelling, driveway and parking area. According to the USDA's Natural Resources Conservation Service's Web Soil Survey, the soil on the property is made up of Fripp fine sand (FrD) and is vegetated with lawn grass, loblolly pines, oaks, various deciduous trees and ornamental bushes. Based on available information, there appears to be no archaeological sites on this property or nearby. The shoreline is ±466' in length and is adjacent to both the Currituck Sound and a pond/lagoon located along the southern property line that is connected to the Sound. The shoreline adjacent to the Sound has been stabilized with riprap while the remaining shoreline is unhardened. Coastal wetlands consisting of black needlerush (Juncus roemerianus) and giant cordgrass (Spartina cynosuroides) are located waterward of the riprap alignment. A±100'x4' pier extends westward into the Currituck Sound to a 16'xl6' tee -head platform with lower platforms that measure 25'x24' overall. A ±13'x12' 4-piling boatlift is located on the north side of the platform and a davit style boatlift is located on the south side of the platform. A smaller 10.5'x10.5' platform accessed by a 12'x4' pier/walkway is located within the pond/lagoon. The adjacent property to the north is similar in use and development with a single-family dwelling, a bulkhead with riprap landward of coastal wetlands, and a pier/platform for water access. The adjacent property to the south is undeveloped. The waters of the Currituck Sound are classified as SC by the Environmental Management Commission and are not open to shellfish taking. Water depths within project area range from 1.5' to 3' below NWL, the bottom substrate is made up of fine sands and there is ±3.5 miles of open water to the west of the site. The proposed project area is void of Submerged Aquatic Vegetation (SAV); however, SAV beds containing widgeon grass (Ruppia maritima) and wild celery (Vallisneria americana) were observed growing nearshore and along the north side of the pier. Development Proposal r 1� The applicant proposes to remove two existing boatlifts and construct a flat roofed 24'x30' (720 U ft2) double lift boathouse on the south side of the existing platform. The individual boatlifts will N p be 29'x10' and will employ a touchless boat cover system during boat storage. An 82'x1' catwalk will be installed along three sides of the proposed boathouse and a 29'x2' walkway will be installed between the lifts, all within the dripline footprint. The proposed boathouse will not encroach within the 15' setback and meets the 1/4 width rule. Water depths within the project V area range from ±1.5' to ±3' below NWL and the project area is void of SAV's. To conserve and manage the important features of estuarine waters so as to safeguard and perpetuate their biological, social, aesthetic, and economic values; to coordinate and establish a management system capable of conserving and utilizing estuarine waters so as to maximize their benefits to man and the estuarine and ocean system. (d) Use Standards. Suitable land/water uses shall be those consistent with the management objectives in this Rule. Highest priority of use shall be allocated to the conservation of estuarine waters and their vital components. Second priority of estuarine waters use shall be given to those types of development activities that require water access and use which cannot function elsewhere such as simple access channels; structures to prevent erosion; navigation channels; boat docks, marinas, piers, wharfs, and mooring pilings. In every instance, the particular location, use, and design characteristics shall be in accord with the general use standards for coastal wetlands, estuarine waters, and public trust areas described in Rule 07H.0208. Consistent: The proposed development is consistent with the intent of this rule. 07H.0207 Public Trust Areas (c) Management Objective. To protect public rights for navigation and recreation and to conserve and manage the public trust areas so as to safeguard and perpetuate their biological, economic and aesthetic value. (d) Use Standards. Acceptable uses shall be those consistent with the management objectives in Paragraph (c) of this Rule. In the absence of overriding public benefit, any use which jeopardizes the capability of the waters to be used by the public for navigation or other public trust rights which the public may be found to have in these areas shall not be allowed. The development of navigational channels or drainage ditches, the use of bulkheads to prevent erosion, and the building of piers, wharfs, or marinas are examples of uses that may be acceptable within public trust areas, provided that such uses shall not be detrimental to the public trust rights and the biological and physical functions of the estuary. Projects which would directly or indirectly block or impair existing navigation channels, increase shoreline erosion, deposit spoils below normal high water, cause adverse water circulation patterns, violate wate� quality standards, or cause degradation of shellfish waters are considered incompatible with management policies of public trust areas. In every instance, the particular location, use, ands o design characteristics shall be in accord with the general use standards for coastal wetlands, estuarine waters, and public trust areas. Of these, subparagraph (6) Piers and Docking Facilities pertain to this project, and those subparagraphs not listed are not applicable to this project. Subparagraph (6)(B) states that the total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be 8 square feet per linear foot of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Subparagraph (6)(D) states that a boathouse shall not exceed 400 square feet except to accommodate a documented need for a larger boathouse and shall have sides extending no farther than one-half the height of the walls and covering only the top half of the walls. Measurements of square footage shall be taken of the greatest exterior dimensions. Boathouses shall not be allowed on lots with less than 75 linear feet of shoreline. Size restrictions do not apply to marinas. Consistent: The proposed boathouse exceeds the 400 ftz limitation; however, the applicant has two existing boatlifts and the proposed boathouse design will accommodate two boatlifts in one structure rather than constructing two separate roofed structures. Subparagraph (6)(E) states that the total area enclosed by an individual boat lift shall not exceed 400 square feet except to accommodate a documented need for a larger boat lift. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6)(F) states that piers and docking facilities shall be single story. They may be roofed but shall not be designed to allow second story use. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6)(G) states that pier and docking facility length shall be limited by: (i) not extending beyond the established pier or docking facility length along the same shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length unless necessary to avoid unreasonable interference with navigation or other uses of the waters.$,) the public); v Consistent: The proposed development is consistent with the intent of this rule. _ (ii) not extending into the channel portion of the water body; Consistent: The proposed development is consistent with the intent of this rule. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier -head line. The one-fourth length limitation does not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. Date: July 18, 2016 Consistency Determination: The request is consistent with/not in conflict with the Town of Southern Shores CAMA Land Use Plan Update certified by the CRC on August 30, 2012. Overview: The subject property consists of a .85 acre lot with 266 linear feet of shoreline along the Currituck Sound to the west and 200 linear feet of shoreline along a pond/lagoon to the south that connects to the sound. Water depths approximately 80 feet to 120 feet from the sound shoreline range from 1.5 feet to 3 feet below Normal Water Level (NWL). Coastal Wetlands are located along the sound shoreline. Site elevations range from 1 foot to 10 feet above NWL. The subject property is located within the Floodzone AE (EL 7) to the west and outside of the foodzone to the east. Existing site improvements include a single-family house, driveway and parking area. Existing shoreline improvements on the Currituck Sound consist of riprap along the shoreline and a 4 foot wide by 100 foot long pier with a 16 foot by 16 foot terminus platform with lower platforms bringing the measurement to 25 feet by 24 feet, a 13 foot by 12 foot 4-piling boatlift and a davit style boat lift attached to the platform. Existing shoreline improvements along the pond/lagoon consist of a 10.5 foot by 10.5 foot platform accessed by a 4 foot wide by 12 foot long pier/walkway. Construction of a flat -roofed 24 foot by 30 foot double -lift boat house with a 1 foot wide by 82 foot long catwalk and a 2 foot wide by 29 foot walkway is proposed. The boat house will be located on the south side of the existing platform. Individual boat lifts will measure 10 feet by 29 feet. The catwalk will be installed on three (3) sides of the boathouse and the walkway will be installed between the lifts. The two (2) existing boatlifts will be removed. Dogwood Trail in Southern Shores, Dare County, NC. Staff review of the plans and specifications has determined that the project, as proposed, consists of activities that will not pose surface water quality threats from stormwater runoff since no new impervious area is proposed. The Director has determined that projects that are reviewed and approved by the Division as not posing water quality threats from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000. For this reason, we are informing you by way of this letter that your project will not require a State Stormwater management permit at this time. The stormwater rules require the Division to permit the common plan of development,.therefore, any future development on the property, regardless of whether a SEC plan or CAMA Major permit is also required, will require a Stormwater Management Permit application and permit issuance from the Division of Energy, Mineral, and Land Resources prior to any construction. The objection is based on the size and the exact location of the deck and boathouse. Because the proposed size will almost certainly have a detrimental visual impact on the sound from our property I would like to suggest that entire project be moved to the south side of the existing walkway to Drew current dock / deck / boat lift. Essentially that there be no decks, boatlifts, platforms or boat house to the north of the existing walkway. I may be that I do not understand the plan as presented but I will be available from Monday 4/25 through Saturday 4/29 if you want to discuss the positioning. An initial screening of the submittal package has been conducted as per 15A NCAC 07J.0204. This revealed certain deficiencies, which must be corrected before the application package can be accepted as complete. To assist you in expediting the permitting process as much as possible, I am notifying you of these deficiencies immediately so that they can be quickly corrected to facilitate my detailed review. Because the deficiencies are easily correctable, I am not returning the original application package. Please make the needed changes, and submit the appropriate documentation. With the retained copy of the application, I can commence the detailed review. Please understand that the subsequent detailed review may reveal additional areas where further information or documentation is required to demonstrate compliance with the rules directly applicable to the proposed development. If this occurs, you will be notified of such issues separately. Our initial screening has identified the following deficiencies: 1. If lifts are proposed, they should be shgwn, This also includes any other structures, such as a touchless boat cover that shows that the V2 wall requirement will be met when lowered. 2. In our June 6, 2016 phone conversation, you indicated that the applicant may be proposing a type of boat cover that lowers down from the lift. If this is accurate, please include a description of this in the narrative and any documentation for this type of system. To expedite our response to your permitting request, we will commence the detailed review of your application for a pennit pending the receipt of the additional information requested above. However, the statutorily provided 75/150 days allowed for review cannot commence until such time as we have received a complete application package. Once your application has been accepted as complete, you will receive a separate notification letter. If it is not possible to render a permit decision within 70 days of the date when your application is received complete, you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant.
