6' This permit authorizes the removal of two existing boatlifts and construction of a double boat lift,
boathouse, touchless boat cover system, an 82'xl' catwalk, and 29'x2' walkway, and uses located in

structure, whether floating or stationary, shall become a permanent part of this reconfigured docking
facility without permit modification. No non -water dependent uses of structures shall be conducted
on, in or over Public Trust waters without permit modification.

ADDITIONAL CONDITIONS
;) This permit authorizes a maximum of two (2) formalized boat slips.
The boathouse shall not be completely enclosed or have side coverage more than one half the height of
the side, from the roof waterward. Footprint of the boathouse shall not exceed the dimensions on the
authorized workplan drawings.
The authorized boathouse shall be single story, and shall not be designed to allow for second story use.
The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structures in order to make it more visible during hours of darkness or
inclement weather.
No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
General
The permittee and/or his or her contractor shall meet with a representative of the Division prior to
Project initiation.
No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
The U.S. Army Corps of Engineers authorized the proposed project and assigned SAW 2016-
01414, which was issued 9/12/16.
The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 3900 and assigned the project DWR project No. 20160684.

LOTS 27 & 28 — SECTION A
TOWN OF SOUTHERN SHORES —DARE COUNTY
The applicant currently has an uncovered boat lift on the north side of the existing 24' x 25' tee head at the
end of the 97' x 4' pier. The applicant is requesting to remove the uncovered boat lift and pilings and to
construct a 24' x 30' covered boathouse on the south side of the tee head to store his two +/- 22-25 foot
long boats.
The applicant owns property which abuts the Currituck Sound and a lagoon resulting in approximately 466
feet of shoreline. Within the lagoon is a 10.5' x 10.5' deck over water accessed by a 4' x 12' pier. The
proposed new boathouse will not extend waterward of the existing deck nor into a channel and a
considerable distance less than the width of the Currituck Sound. The new construction (including
removal of the existing pilings on the north side) will not result in an encroachment into the 15-foot setback
from adjacent property owners' areas of riparian access. The total area allowed for docks and boathouses is
8 feet per linear foot of shoreline. Thus, the total possible is 3,128 square feet. The new boathouse, tee
head, and deck (in the lagoon) will constitute 1,430.25 square feet. Boathouses of greater than 400 square
feet must document the need. The proposed 720 square foot boathouse is necessary to cover the owner's
two �/- 22 to 25 foot long boats. The proposed boathouse will be open sides with a flat top roof to
minimize visual impact of the sound from the owner's house. The boathouse will have two boadifts
installed under the cover. The boathouse will also utilize two boat covers which extend approximately two
feet from the top of the boathouse interior and rest on the walkways (see http://touchlesscover.com).

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -
colored form) is retained by you and it must be available on site when the project is inspected for compliance.
Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B
with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-
2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified
party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must
be carried out in accordance with your application. Modifications, time extensions, and future maintenance
requires additional approval. Please read your permit carefully prior to starting work and review all project
plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that
he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact

8. PROJECT SUMMARY: The applicant proposes to remove two existing boatlifts and
then install a large double lift boathouse with a touchless boat cover system.
Project Setting
The site of the proposed development is located at 251 North Dogwood Trail, Southern Shores,
Dare County, adjacent to the Currituck Sound.
The property is ±37,000 ft2 in size and has an elevation that ranges from V to 10' above normal
water level (NWL). Man-made features within the highground area include a single-family
dwelling, driveway and parking area. According to the USDA's Natural Resources Conservation
Service's Web Soil Survey, the soil on the property is made up of Fripp fine sand (FrD) and is
vegetated with lawn grass, loblolly pines, oaks, various deciduous trees and ornamental
bushes. Based on available information, there appears to be no archaeological sites on this
property or nearby.
The shoreline is ±466' in length and is adjacent to both the Currituck Sound and a pond/lagoon
located along the southern property line that is connected to the Sound. The shoreline adjacent
to the Sound has been stabilized with riprap while the remaining shoreline is unhardened.
Coastal wetlands consisting of black needlerush (Juncus roemerianus) and giant cordgrass
(Spartina cynosuroides) are located waterward of the riprap alignment. A±100'x4' pier extends
westward into the Currituck Sound to a 16'xl6' tee -head platform with lower platforms that
measure 25'x24' overall. A ±13'x12' 4-piling boatlift is located on the north side of the platform
and a davit style boatlift is located on the south side of the platform. A smaller 10.5'x10.5'
platform accessed by a 12'x4' pier/walkway is located within the pond/lagoon.
The adjacent property to the north is similar in use and development with a single-family
dwelling, a bulkhead with riprap landward of coastal wetlands, and a pier/platform for water
access. The adjacent property to the south is undeveloped.
The waters of the Currituck Sound are classified as SC by the Environmental Management
Commission and are not open to shellfish taking. Water depths within project area range from
1.5' to 3' below NWL, the bottom substrate is made up of fine sands and there is ±3.5 miles of
open water to the west of the site. The proposed project area is void of Submerged Aquatic
Vegetation (SAV); however, SAV beds containing widgeon grass (Ruppia maritima) and wild
celery (Vallisneria americana) were observed growing nearshore and along the north side of
the pier.
Development Proposal

1� The applicant proposes to remove two existing boatlifts and construct a flat roofed 24'x30' (720
U ft2) double lift boathouse on the south side of the existing platform. The individual boatlifts will
N p be 29'x10' and will employ a touchless boat cover system during boat storage. An 82'x1'
catwalk will be installed along three sides of the proposed boathouse and a 29'x2' walkway will
be installed between the lifts, all within the dripline footprint. The proposed boathouse will not
encroach within the 15' setback and meets the 1/4 width rule. Water depths within the project
V area range from ±1.5' to ±3' below NWL and the project area is void of SAV's.

Anticipated Impacts
• The proposed development will result in the additional shading of 720 ft2 of PTA and EW
AEC's. (Total shaded impact excluding the pier will be ±1,430 ftz).
• The proposed development will not result in any additional slips on the docking facility.

The development proposal involves the Public Trust Area & Estuarine Waters Areas of
Environmental Concern (AEC's).
I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this
project and my findings are as follows:
15A NCAC 07H.0203 Management Objective of the Estuarine and Ocean System
It is the objective of the Coastal Resources Commission to conserve and manage estuarine
waters, coastal wetlands, public trust areas, and estuarine and public trust shorelines, as an
interrelated group of AECs, so as to safeguard and perpetuate their biological, social, economic,
and aesthetic values and to ensure that development occurring within these AECs is compatible
with natural characteristics so as to minimize the likelihood of significant loss of private property
and public resources. Furthermore, it is the objective of the Coastal Resources Commission to
protect present common-law and statutory public rights of access to the lands and waters of the
coastal area.
Consistent: The proposed development is consistent with the intent of this rule.

07H.0206 Estuarine Waters
(c) Management Objective. To conserve and manage the important features of estuarine waters
so as to safeguard and perpetuate their biological, social, aesthetic, and economic values; to
coordinate and establish a management system capable of conserving and utilizing estuarine
waters so as to maximize their benefits to man and the estuarine and ocean system.
(d) Use Standards. Suitable land/water uses shall be those consistent with the management
objectives in this Rule. Highest priority of use shall be allocated to the conservation of estuarine
waters and their vital components. Second priority of estuarine waters use shall be given to
those types of development activities that require water access and use which cannot function
elsewhere such as simple access channels; structures to prevent erosion; navigation channels;
boat docks, marinas, piers, wharfs, and mooring pilings. In every instance, the particular
location, use, and design characteristics shall be in accord with the general use standards for
coastal wetlands, estuarine waters, and public trust areas described in Rule 07H.0208.
Consistent: The proposed development is consistent with the intent of this rule.
07H.0207 Public Trust Areas
(c) Management Objective. To protect public rights for navigation and recreation and to
conserve and manage the public trust areas so as to safeguard and perpetuate their biological,
economic and aesthetic value.
(d) Use Standards. Acceptable uses shall be those consistent with the management objectives in
Paragraph (c) of this Rule. In the absence of overriding public benefit, any use which
jeopardizes the capability of the waters to be used by the public for navigation or other public
trust rights which the public may be found to have in these areas shall not be allowed. The
development of navigational channels or drainage ditches, the use of bulkheads to prevent
erosion, and the building of piers, wharfs, or marinas are examples of uses that may be
acceptable within public trust areas, provided that such uses shall not be detrimental to the public
trust rights and the biological and physical functions of the estuary. Projects which would
directly or indirectly block or impair existing navigation channels, increase shoreline erosion,
deposit spoils below normal high water, cause adverse water circulation patterns, violate wate�
quality standards, or cause degradation of shellfish waters are considered incompatible with
management policies of public trust areas. In every instance, the particular location, use, ands

design characteristics shall be in accord with the general use standards for coastal wetlands,

Paragraph (a)(2)(A) states that the location, design, and need for development, as well as the
construction activities involved shall be consistent with the management objective of the
Estuarine and Ocean System AEC and shall be sited and designed to avoid significant adverse
impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds,
submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning
and nursery areas.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(B) states that development shall comply with state and federal water and air
quality standards.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(C) states that development shall not cause irreversible damage to documented
archaeological or historic resources as identified by the N.C. Department of Cultural Resources.

Paragraph (a)(2)(D) states that development shall not increase siltation.

Paragraph (a)(2)(G) states that development shall not jeopardize the use of the waters for
navigation or for other public trust rights in public trust areas including estuarine waters.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (b) addresses Specific Use Standards. Of these, subparagraph (6) Piers and Docking
Facilities pertain to this project, and those subparagraphs not listed are not applicable to this
project.
Subparagraph (6)(B) states that the total square footage of shaded impact for docks and mooring
facilities (excluding the pier) allowed shall be 8 square feet per linear foot of shoreline with a
maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips
shall not be counted in the total. Projects requiring dimensions greater than those stated in this

Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve
public access, or to support a water dependent use that cannot otherwise occur. Size restrictions
do not apply to marinas.
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (6)(D) states that a boathouse shall not exceed 400 square feet except to
accommodate a documented need for a larger boathouse and shall have sides extending no
farther than one-half the height of the walls and covering only the top half of the walls.
Measurements of square footage shall be taken of the greatest exterior dimensions. Boathouses
shall not be allowed on lots with less than 75 linear feet of shoreline. Size restrictions do not
apply to marinas.
Consistent: The proposed boathouse exceeds the 400 ftz limitation; however, the applicant
has two existing boatlifts and the proposed boathouse design will accommodate two
boatlifts in one structure rather than constructing two separate roofed structures.
Subparagraph (6)(E) states that the total area enclosed by an individual boat lift shall not exceed
400 square feet except to accommodate a documented need for a larger boat lift.
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (6)(F) states that piers and docking facilities shall be single story. They may be
roofed but shall not be designed to allow second story use.
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (6)(G) states that pier and docking facility length shall be limited by:
(i) not extending beyond the established pier or docking facility length along the same shoreline
for similar use; (This restriction does not apply to piers 100 feet or less in length unless
necessary to avoid unreasonable interference with navigation or other uses of the waters.$,) the
public);

Consistent: The proposed development is consistent with the intent of this rule. _
(ii) not extending into the channel portion of the water body;
Consistent: The proposed development is consistent with the intent of this rule.
(iii) not extending more than one-fourth the width of a natural water body, or human -made canal
or basin. Measurements to determine widths of the water body, canals or basins shall be made
from the waterward edge of any coastal wetland vegetation that borders the water body. The
one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or
a local government in consultation with the Corps of Engineers, has established an official
pier -head line. The one-fourth length limitation does not apply when the proposed pier is located
between longer piers or docking facilities within 200 feet of the applicant's property. However,

the proposed pier or docking facility shall not be longer than the pier head line established by the
adjacent piers or docking facilities, nor longer than one-third the width of the water body.
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (6)(I) states that piers and docking facilities shall not interfere with the access to
any riparian property and shall have a minimum setback of 15 feet between any part of the pier
or docking facility and the adjacent property owners areas of riparian access.
Consistent: The proposed development is consistent with the intent of this rule.
15A NCAC O7H.O6O1 No Violation of Any Rule
No development shall be allowed in any AEC which would result in a contravention or violation
of any rules, regulations, or laws of the State of North Carolina or of local government in which
the development takes place.
Consistent: The proposed development is consistent with the intent of this rule.
15A NCAC O7KO6O2 Pollution of Waters
No development shall be allowed in any AEC which would have a substantial likelihood of
causing pollution of the waters of the state in which shellfishing is an existing use to the extent
that such waters would be officially closed to the taking of shellfish. This rule shall also apply to
development adjacent to or within closed shellfish waters when a use attainability study of those
waters documents the presence of a significant shellfish resource in an area that could be
expected to be opened for shellfishing given reasonable efforts to control the existing sources of
pollution.
Consistent: The proposed development is consistent with the intent of this rule.
Based on my review of the applicable subsections of the North Carolina Administrative Code,
the permit application and plans, I recommend a Major Permit be issued to Andrew & Lisa
Wright.

SUBJECT: Major Permit Request by Andrew and Lisa Wright to construct a flat -roofed 24
foot by 30 foot double -lift boat house with a 1 foot wide by 82 foot long catwalk
and a 2 foot wide by 29 foot walkway on the Currituck Sound; at 251 North
Dogwood Trail, in the Town of Southern Shores.

Consistency Determination: The request is consistent with/not in conflict with the Town of
Southern Shores CAMA Land Use Plan Update certified by the
CRC on August 30, 2012.
Overview: The subject property consists of a .85 acre lot with 266 linear feet of shoreline
along the Currituck Sound to the west and 200 linear feet of shoreline along a pond/lagoon to
the south that connects to the sound. Water depths approximately 80 feet to 120 feet from the
sound shoreline range from 1.5 feet to 3 feet below Normal Water Level (NWL). Coastal
Wetlands are located along the sound shoreline. Site elevations range from 1 foot to 10 feet
above NWL. The subject property is located within the Floodzone AE (EL 7) to the west and
outside of the foodzone to the east.
Existing site improvements include a single-family house, driveway and parking area. Existing
shoreline improvements on the Currituck Sound consist of riprap along the shoreline and a 4
foot wide by 100 foot long pier with a 16 foot by 16 foot terminus platform with lower platforms
bringing the measurement to 25 feet by 24 feet, a 13 foot by 12 foot 4-piling boatlift and a
davit style boat lift attached to the platform. Existing shoreline improvements along the
pond/lagoon consist of a 10.5 foot by 10.5 foot platform accessed by a 4 foot wide by 12 foot
long pier/walkway.
Construction of a flat -roofed 24 foot by 30 foot double -lift boat house with a 1 foot wide by 82
foot long catwalk and a 2 foot wide by 29 foot walkway is proposed. The boat house will be
located on the south side of the existing platform. Individual boat lifts will measure 10 feet by
29 feet. The catwalk will be installed on three (3) sides of the boathouse and the walkway will
be installed between the lifts. The two (2) existing boatlifts will be removed.

The waters of the Currituck Sound are classified as SC in this area and are closed to shellfish
harvesting. The project area is void of Submerged Aquatic Vegetation (SAV); however, SAV
beds were observed growing nearshore and along the north side of the pier. No
archaeological sites are located on or adjacent to this property.
Anticipated impacts resulting from this project are expected to include: the shading of 720 sq.
ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC).
No impacts to Coastal Wetlands are proposed.
Basis for Determination:
The project area is located entirely within the Currituck Sound. As noted on Page 62 of the
Town of Southern Shores land use plan, areas within an AEC are designated as
"Conservation". As indicated on Page 62, "(t) he Conservation category is applied to areas
that should not be developed (i.e., preserved), or if developed (or managed and maintained),
done so in a manner characterized by careful planning and cautious attention to the
conservation of environmental features."

3. Water Quality Certification
The proposed project must comply with all the.conditions of the General Water Quality
Certifications) 3900. [15A NCAC 02B .0507(c)]
Continuing Compliance
4. All mechanized equipment operated near surface waters or wetlands will be regularly
inspected and maintained to prevent contamination of waters and wetlands from fuels,
lubricants,, hydraulic fluids or other potential toxic chemicals. In the event of a
hydrocarbon or chemical spill, the permitee/contractor shall immediately contact the
Division of Water Quality, between the hours of 8'am to 5 pm at the Washington Regional
Office at 252.946.6481 and after hours and on weekends call [phone].
Management ofsuch spills shall comply with provisions of the North Carolina Oil Pollution
and Hazardous Substances Control Act. [15A NCAC 02H .0506 (b)(3) and (c)(3),15A NCAC
02B .0200 (3)(f),'and GS 143 Article 21A]
S. Turbidity. Standard
The Permittee shall adhere specially to 15A NCAC 02B .0222 Tidal Salt Water Quality for
Class SC Waters (3)(g) pH: shall be normal for waters in the area, which generally shall
range between 6.8 and 8.5 except that swamp waters may have a pH as low as 4.3 if it is
the result of natural conditions; (1) Turbidity: the turbidity in the receiving water shall not
exceed 25 NTU; if turbidity exceeds this level due to natural background conditions, the
existing turbidity level'thall not be increased. [15A NCAC 02B .0222]
Other Conditions
A. Re Opener Clause
Mr. Andrew Wright and any authorized agents shall conduct their activities In a manner
consistent with State water quality standards (including any requirements resulting from
compliance with section 303(d)'.of the Clean Water Act) and any other appropriate
requirements of State law and federal law.. Mr. Andrew Wright shall require any
contractors (and/or agents) to comply with all of the terms of this Certificatlon,.and shall
provide each of their contractors (and/or agents) a copy of this Certification. A copy of
this Certification shall be included in the construction contract and available on the job
site at all times. If DWR determines that such standards or laws are not being met
(including the failure to sustain a designated or achieved use) or that State or federal -law
is being violated, or that further conditions are necessaryto assure compliance, DWR may
reevaluate and modify this certification to include condition's appropriate to assure
compliance with such standards and requirements in accordance with 15A NCAC
2H.0507(d). Before modifying the certification, DWR shall notify Mr. Andrew Wright and

the US Army Corps of Engineers, provide public notice in accordance with 15A NCAC
21-1.0503 and provide opportunity for public hearing in accordance with 15A NCAC
2H.0504. Any new or revised conditions shall be provided to DWR in writing, shall be
provided to the United States Army Corps of Engineers for reference in any permit issued
pursuant to Section 404 of the Clean Water Act, and shall also become conditions of the
404 Permit for the project.
Upon completion of all work approved within the 401'Water Quality Certification or
applicable Buffer Rules, any subsequent modifications, the applicant is required to return
the attached certificate of completion to the 401 & Buffer'Permitting Unit, NC Division of
Water Resources, 1617 Mail Service Center, Raleigh, NC 27699-1650. [15A NCAC 02H
.0507 (c)] .
8. The applicant and/or authorized agent shall provide a completed Certificate of
Completion form to the Division within thirty (36) days of project completion (available
at http•//portal ncdenrorg/web/wo/swp/ws/401/certsandoermits/apply/forms). [15A
NCAC 02H .0506(b)(5)]
9. This approval and its conditions are final and binding unless contested. [G.S.143-215.5]
These Certifications can be contested as provided in Articles 3 and 4 of General Statute 150B by filing a
written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as

On July 18, 2016, the Washington Regional Office of the Division of Energy, Mineral, and Land Resources
received a copy of your CAMA Major application for proposed double lift boathouse project, located at
251 N. Dogwood Trail in Southern Shores, Dare County, NC. Staff review of the plans and specifications
has determined that the project, as proposed, consists of activities that will not pose surface water
quality threats from stormwater runoff since no new impervious area is proposed.
The Director has determined that projects that are reviewed and approved by the Division as not posing
water quality threats from stormwater runoff should not be subject to the stormwater management
permitting requirements of 15A NCAC 2H.1000. For this reason, we are informing you by way of this
letter that your project will not require a State Stormwater management permit at this time.
The stormwater rules require the Division to permit the common plan of development,.therefore, any
future development on the property, regardless of whether a SEC plan or CAMA Major permit is also
required, will require a Stormwater Management Permit application and permit issuance from the
Division of Energy, Mineral, and Land Resources prior to any construction. Any construction on the
subject site, prior to receipt of the required permit, will constitute a violation of 15A NCAC 2H.1000
and may result in appropriate enforcement actions by this Office.
Please keep in mind that this determination does not affect your legal obligation to obtain other permits
and approvals, which may be required by Federal, State, or local government agencies, rule or law. If

The NC Division of Coastal Management hereby acknowledges receipt of the

development of their property located in Southern Shores, Dare County. It was
received complete on June 21, 2016, and appears to be adequate for processing at
this time. The projected deadline for making a decision is September 4, 2016. An
additional 75-day review period is provided by law when such time is necessary to
complete the review. If you have not been notified of a final action by the initial
deadline stated above, you should consider the review period extended. Under
those circumstances, this letter will serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from June 21, 2016,
you may request a meeting with the Director of the Division of Coastal Management
and permit staff to discuss the status of your project. Such a meeting will be held
within five working days from the receipt of your written request and shall include
the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location
of the proposed development. Enclosed you will find a "Notice of Permit Filing"
postcard which must be posted at the property of the proposed development. You
should post this notice at a conspicuous point along the property where it can be
observed from a public road. Some examples would be: Nailing the notice card to
a telephone pole or tree along the road right-of-way fronting the property, or at a
point along the road right-of-way where a private road would lead one into the
property. Failure to post this notice could result in an incomplete application.

dated 4/19/16.
This is a follow up to the a mails I sent to Ron Renaldi, Carolina Division of Costal
management and to George Wood, Environmental Professionals Inc. as well as phone
messages left on 4/23/16.
The objection is based on the size and the exact location of the deck and boathouse.
Because the proposed size will almost certainly have a detrimental visual impact on the
sound from our property I would like to suggest that entire project be moved to the south
side of the existing walkway to Drew current dock / deck / boat lift. Essentially that there
be no decks, boatlifts, platforms or boat house to the north of the existing walkway.
I may be that I do not understand the plan as presented but I will be available from
Monday 4/25 through Saturday 4/29 if you want to discuss the positioning.

The applicant owns property which abuts the Currituck Sound and a lagoon resulting in approximately 466
feet of shoreline. Within the lagoon is a 10.5' x 10.5' deck over water accessed by a 4' x 12' pier. The
proposed new boathouse will not extend waterward of the existing deck nor into a channel and It considerable distance less than /, the width of the Currituck Sound. The new construction (including
removal of the existing pilings on the north Sid
from adjacent Property owners' areas of ripariae) will not result in an encroachment into the I5-foot setback
n access. The total area allowed for docks and boathouses is
8 feet per linear foot of shoreline. Thus, the total possible is 3,728 square feet. The new boathouse, tee
head, and dock (in the lagoon) will constitute 1,358.25 square feet (+/• 642 square feet less than the
maximum allowed). Boathouses of greater than 400 square feet must document the need. The proposed
648 square foot boathouse is necessary to cover the owner's two +/- 22 20 rn foot long boats. The proposed
boathouse will be open sides with a flat top roof to minimize visual impact of the sound from the owner's
house.

Enclosed is our signed objection to this project as described in the permit application
dated 4/19/16.
This is a follow up to the a mails I sent to Ron Renaldi, Carolina Division of Costal
management and to George Wood, Environmental Professionals Inc. as well as phone
messages left on 4/23/16.
The objection is based on the size and the exact location of the deck and boathouse.
Because the proposed size will almost certainly have a detrimental visual impact on the
sound from our property I would like to suggest that entire project be moved to the south
side of the existing walkway to Drew current dock / deck / boat lift. Essentially that there
be no decks, boatlifts, platforms or boat house to the north of the existing walkway.
I may be that I do not understand the plan as presented but I will be available from
Monday 4/25 through Saturday 4/29 if you want to discuss the positioning.

Dear Mr. Wood:
The NC Division of Coastal Management hereby acknowledges receipt of your application on
May 31, 2016, for State approval for the development of the referenced project. An initial
screening of the submittal package has been conducted as per 15A NCAC 07J.0204. This revealed
certain deficiencies, which must be corrected before the application package can be accepted as
complete. To assist you in expediting the permitting process as much as possible, I am notifying
you of these deficiencies immediately so that they can be quickly corrected to facilitate my detailed
review.
Because the deficiencies are easily correctable, I am not returning the original application package.
Please make the needed changes, and submit the appropriate documentation. With the retained
copy of the application, I can commence the detailed review. Please understand that the subsequent
detailed review may reveal additional areas where further information or documentation is
required to demonstrate compliance with the rules directly applicable to the proposed
development. If this occurs, you will be notified of such issues separately.
Our initial screening has identified the following deficiencies:
1. Not all questions on the application have been answered, or indicated as "not applicable."
Please address the following items:
Form DCM-MP-4:
Number l(d), the submitted cross-section drawing shows a 3' walkway
within the boathouse, please include all proposed walkway dimensions in
application and describe in project narrative.
Number 1(f), the application lists that two boatlifts are to be included;
however, the dimensions listed are 30'x24'. Please indicate the correct lift
dimensions.

A Cross -Section Drawing must be submitted that:
- Accurately depicts the proposed development. If lifts are proposed, they
should be shgwn, This also includes any other structures, such as a
touchless boat cover that shows that the V2 wall requirement will be met
when lowered.
2. In our June 6, 2016 phone conversation, you indicated that the applicant may be proposing
a type of boat cover that lowers down from the lift. If this is accurate, please include a
description of this in the narrative and any documentation for this type of system.
To expedite our response to your permitting request, we will commence the detailed review of
your application for a pennit pending the receipt of the additional information requested above.
However, the statutorily provided 75/150 days allowed for review cannot commence until such
time as we have received a complete application package. Once your application has been accepted
as complete, you will receive a separate notification letter.
If it is not possible to render a permit decision within 70 days of the date when your application is
received complete, you may request a meeting with the Director of the Division of Coastal
Management and permit staff to discuss the status of your project. Such a meeting will be held
within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
