Permit Class i NEW } STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 _ Excavation and/or filling pursuant to NCGS 113-229 Permit Number 87-16 Issued to John C. & Patricia S. Woolard, 3434 Slatestone Road, Washington, NC 27889 Authorizing development in Beaufort County at adjacent to Pamlico River, at 85 Edgewater Road, near Washington, as requested in the permittee's application dated 5/31/16, including attached drawings (2), both dated 5/26/16. This.permit, issued on July 29, 2016 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. i, Expanded Docking Facility P- r. i 1) This permit authorizes the construction of an uncovered boat lift and a 20'x5' catwalk, and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this expanded docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the expanded docking facility. Any sewage discharge at the reconfigured docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the qualified persons within twenty (20) days of the issuing date. Signature of Permittee j John & Patricia Woolard Permit No. 87-16 Page 2 of 3 ADDITIONAL CONDITIONS 3) This permit authorizes a maximum of three (3) formalized boat slips. e .; ' 4): Should Cypress Bay HOA property to the northwest be sold prior to the initiation of construction of the r expanded docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the 15-foot riparian corridor setback and submit it to the Division of Coastal Management. t.5) The petmittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the s' permitted activity without having it transferred to a third party. 6).y The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. # - Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structures in order to make it more visible during hours of darkness or inclement weather. h.ri .. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. `10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 11) This permit does not authorize the interference with any existing or proposed Federal project, and the - permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. a NOTE: The U.S. Army Corps of Engineers authorized the proposed project and assigned SAW 2016- ;. 01413. ' NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 3900 and assigned the project DWR Project No. 20160677. I currently have a pier with 2 uncovered boatlifts. I would like to relocate one of the existing boatlifts and add an additional uncovered boatlift with a catwalk separating the two. This will bring my total number of slips to three. Attached, please find the CAMA Major Permit application along with signatures of no objection from the adjacent property owners. Please note that both adjacent property owners have waived the 15' setback from the riparian property line. The adjacent property owner has waived the 15' setback Staff has reviewed the proposed project with regard to rules found in Subchapter 7H concerning development in a Public Trust Area. It is staffs recommendation that the proposed project appears consistent with 15A NCAC 07H .0208 as described below_ This office feels the development is consistent with 15A NCAC 07H .0208(b)(6)(E) which states in part that "The total area enclosed by an individual boat lift shall not exceed 400 square feet except to accommodate a documented need for a larger boat lift". The applicant has proposed an uncovered boatlift which is approximately 169 ftz in size. Staff recommends the following conditions be included if the project is permitted. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 2. This permit authorizes only the structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures may be conducted on, in or over public trust waters without pen -nit modification. 3. This permit authorizes a maximum of three boat slips. DATE: July 6, 2016 BRAXTON DAVIS Di...i Consistency Determination: The request is consistent with/not in conflict the Beaufort County Joint Land Use Plan 2006 Update certified by the CRC on January 13, 2010, provided that the project meets the policy requirements outlined in policy 2.1.5 and 4.4 (attached). Overview: The project site is located at 85 Edgewater Beach Rd; on the Pamlico River in Beaufort County. Existing site improvements include the following: a single family residence, bulkhead stabilization of the entire shoreline, an 80' long pier with a ±16' x ±16' L-head platform, 8' x 5.5' step down and two uncovered boat lifts. Vegetation includes lawn grasses and ornamental shrubs. The project proposes the following changes to the existing pier and uncovered boatlifts: the addition of one uncovered boatlift, and a 20' x 5' catwalk to separate the existing slip and proposed slip. The project site is located on the Pamlico River, and has a surface water classifications of SB (Primary Recreation, Salt Water) and NSW (Nutrient Sensitive Waters), is not designated as Primary Nursery Area, and is not open to the taking of shellfish. No SAV (Submerged Aquatic Vegetation) was observed during the on -site field visit. The project is located in flood zone AE, a Special Flood Hazard Area according to the FEMA Flood Insurance Rate Map. A review of archaeological resources was not provided. Anticipated impacts resulting from this project are expected to include the shading of ±268 ft2 of non - vegetated Wetlands River Bottom and localized turbidity due to installation of uncovered boatlift. Basis for Determination: The project is subject to the Beaufort County Joint Land Use Plan 2006 Update. Staff review of the plans and specifications has determined that the project, as proposed, consists of activities that will not pose surface water quality threats from stormwater runoff since no new impervious area is proposed. The Director has determined that projects that are reviewed and approved by the Division as not posing water quality threats from stormwater runoff should not be, subject to the stormwater management permitting requirements of 15A NCAC 21-1.1000. For this reason, we are informing you by way of this letter that your project will not require a State Stormwater management permit at this time. Woolard Edgewater Beach Beaufort County Project settine John C. Woolard has submitted a CAMA Major Permit request for development onsite his property. The project site is a single-family residential lot with a bulkhead shoreline located off SR 1316 at 85 Edgewater Beach Road on the Pamlico River near the City of Washington in Beaufort County, North Carolina. The lot is approximately 0,24 acres in size and has approximately 61 linear feet of shoreline. Man-made features on the lot include a single-family residence, 80' long pier with a t16' x t16' L-head platform, 8' x 5.5' step down, two uncovered boatlifts. Water depth at the terminal end of the pier structure range from 4.0' and 4.5' below Normal Water Level (NWL). The existing number of slips is two. Landward of the NWL the elevation gradually slopes upward to an approximate elevation of t4' above the NWL. The lot is mostly vegetated with lawn grasses and ornamental shrubs. The Pamlico river is approximately I mile in width at this location. The upstream is a developed single-family dwelling with a bulkheaded shoreline with a pier and an uncovered boatlift. This dock is approximately 50' from the proposed development. The downstream property are single family townhomes with a natural shoreline. The downstream property has a boat ramp as well as a marina with multiple slips. These docks are approximately 450' from the proposed development. Both the adjacent properties are similarly vegetated with lawn grasses and ornamental shrubs. The Pamlico River is classified as SB NSW by the Environmental Management Commission at the project site. The Pamlico River at this location is designated Coastal Waters, is not open to shell fishing and is not a Primary Nursery Area. No SAV's were observed during the on -site field visit. Proiect description The applicant proposes to add an additional slip with an uncovered boatlift to the existing docking facility. The new slip with boat lift will be located on the downstream side of the existing docking facility and will be positioned landward of the existing boatlift. The applicant also proposes to construct a 20' x 5' catwalk to separate the existing slip and proposed slip. This will bring the total number of slips at this docking facility to three. Anticipated impacts The project will result in localized turbidity due to the installation of the uncovered boatlift. Additionally, the lifts will be located within the 15' riparian setback on the downstream side of the project. The Townhomes on the downstream side have waived the 15' setback requirement. The addition of the 20' x 5' catwalk will bring the total platform square footage to 400 square feet, which is under the maximum 488 square feet allowed for this property. The development will not cause a hazard to navigation and doesn't exceed one quarter width of the waterbody. Woolard Edgewater Beach Beaufort County Project settine John C. Woolard has submitted a CAMA Major Permit request for development onsite his property. The project site is a single-family residential lot with a bulkhead shoreline located off SR 1316 at 85 Edgewater Beach Road on the Pamlico River near the City of Washington in Beaufort County, North Carolina. The lot is approximately 0.24 acres in size and has approximately 61 linear feet of shoreline. Man-made features on the lot include a. single-family residence, 80' long pier with a t 16' x t 16' L-head platform, 8' x 5.5' step down, two uncovered boatlifts. Water depth at the terminal end of the pier structure range from 4.0' and 4.5' below Normal Water Level (NWL). The existing number of slips is two. Landward of the NWL the elevation gradually slopes upward to an approximate elevation of t4' above the NWL. The lot is mostly vegetated with lawn grasses and ornamental shrubs. The Pamlico river is approximately 1 mile in width at this location. The upstream is a developed single-family dwelling with a bulkheaded shoreline with a pier and an uncovered boatlift. This dock is approximately 50' from the proposed development. The downstream property are single family townhomes with a natural shoreline. The downstream property has a boat ramp as well as a marina with multiple slips. These docks are approximately 450' from the proposed development. Both the adjacent properties are similarly vegetated with lawn grasses and ornamental shrubs. The Pamlico River is classified as SB NSW by the Environmental Management Commission at the project site. The Pamlico River at this location is designated Coastal Waters, is not open to shell fishing and is not a Primary Nursery Area. No SAV's were observed during the on -site field visit. Project description The applicant proposes to add an additional slip with an uncovered boatlift to the existing docking facility. The new slip with boat lift will be located on the downstream side of the existing docking facility and will be positioned landward of the existing boatlift. The applicant also proposes to construct a 20' x 5' catwalk to separate the existing slip and proposed slip. This will bring the total number of slips at this docking facility to three. Anticipated imi) The project will result in localized turbidity due to the installation of the uncovered boatlift. Additionally, the lifts will be located within the 15' riparian setback on the downstream side of the project. The Townhomes on the downstream side have waived the 15' setback requirement. The addition of the 20' x 5' catwalk will bring the total platform square footage to 400 square feet, which is under the maximum 488 square feet allowed for this property. The development will not cause a hazard to navigation and doesn't exceed one quarter width of the waterbody.
