with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Upland Development
1) Unless specifically altered herein, this permit authorizes the land disturbing activities associated with
the development of the above referenced property, including the hotel construction, all as expressly
and specifically set forth in the attached permit application and workplan drawings. Any additional
land disturbing activities and/or construction may require a modification of this permit. Contact a
Division of Coastal Management representative at (910)796-7215 for this determination.

This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the

NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be
filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this
plan to the Department of Environmental Quality, Land Quality Section, 127 Cardinal Drive
Extension, Wilmington, NC 28405.
2)'' Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
` ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).
3) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes.

4) ' The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
5) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.

Any soil/groundwater disturbance at the site should be handled in accordance with the Waste
Management Plan, dated January 16, 2008, as approved by the Department of Environmental
Quality.
This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including, but not limited to, stormwater
approval from the City of Wilmington.
The U.S. Army Corps of Engineers assigned the proposed project Action ID No. SAW-2016-
00287.
Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-72.15 prior to the commencement of any
such activity for this determination.

The Wilmington Convention Hotel, LLC plans to construct a new 191,214 SF, 186 room hotel next to the Wilmington
Convention Center in downtown Wilmington. The daily operations when complete will be standard operations of a normal
hotel and associated social functions.
c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type
of equipment and where it is to be stored.
The Wilmington Convention Hotel, LLC will be constructed using earth moving equipments as well as equipment consistent
with the construction of a mutli-story building. While equipment is not in use the equipment will be stored on -site.
d. List all development activities you propose.
The Wilmington Convention Hotel, LLC will construct a 186 room hotel and all roads, utilities, walkways needed to sggrvice
the hotel. Within the 75' AEC. - The Wilmington Convention Hotel, LLC proposes to construct a wooden boa0alk to
connect to the exsting riverfront boardwalk to the west.

Dear Applicants:
The Wilmington Regional Office received three applications for projects related to the Convention
Center. Both Embassy Suites and the Chamber Foundation were intended to drain offsite to sand filters
permitted under a master permit issued to the Convention Center. The Convention Center permit was
intended to be subdivided to accommodate this arrangement. But there are still unresolved issues with the
Convention Center's permit which will prevent the other two from being issued. All three application
packages are therefore being returned.
1. SW8 071016 & SW8 160112: Per the requirements of Section .1009 (c) of the Stormwater
Management Rules, this Office is hereby returning SW8 071016 and SW8 160112 as incomplete.
The $505.00 application fees have been forfeited and new fees will need to be provided if you
choose to resubmit these applications in the future.

e. Examples of Unresolved Issues:
i. Drainage Area 93: The application shows a total of 85,262sf impervious
area. The supplement and calculations show 84,767sf?
ii. Drainage Area 42:
1. Drainage Area: The application shows a drainage area of 52,538sf, but
also 63,250sf of "future" drainage area? This wasn't on the previous
application. The drainage area should only be one number.
2. Impervious Area: The application shows a total of 57,461sf of
impervious area.
a. This is more than the 52,538sf of drainage area shown.
b. The supplement and calculations show 46,353sf rather than
57,461 sf of impervious.
iii. Deed restrictions:
Greater Wilmington Chamber (# TBD): I received 2 copies of the deed
restriction limiting the site to 6,024sf. It also says that the total future
impervious is 16,736sf? There isn't generally a "future" amount
available in a deed restriction. It should just show a total amount,
16,736, as the maximum that can drain from a development. This needs
to be corrected. Please also submit an original signature with your next
application.
2. Embassy Suites (SW8 160112): I received 2 copies of the deed
restriction for 32,541 sf, which is the correct number. Please submit an
original signature with your next application.
iv. Drainage Area 41: I believe we previously discussed the 9,684sf of "existing"
impervious that is not included in the 123,695sf impervious total on the
application, but I do not recall why that area was excluded from the application's
total? The 2009 impervious area total was 123,695. If there is now "existing" in
2016, then the total increases to 133,384sf? Please clarify how the 9,684sf value
has been resolved, and also why it was not shown in 2009.
v. Other: I have not reviewed the remainder of the package in detail because review
of the technical details is dependent on resolving the items listed above. Please
ensure that the package is fully complete with consistent values throughout in
your next submittal.
2. The Greater Wilmington Chamber Foundation Parking Lot Improvements: A partial application
was received on April 6, 2016. Additional materials were received on July 26, 2016. The
application and check number 007121, in the amount of $505, are being returned to you. I have
not reviewed this application in detail because this permit's approval is dependent on the master
permit which is being returned.

If you wish to pursue construction of these projects, you must reapply for permits. Your application
packages must include completed and signed application forms, supplement forms, signed O&M
r agreements, application fees, signed, sealed and dated calculations, and 2 sets of signed, sealed and dated
site layout and grading plans with details (per permit).
The construction of any impervious surfaces prior to receipt of the stormwater permit, other than a
construction entrance under an approved Sedimentation Erosion Control Plan, is a violation of NCGS
143-215.1 and is subject to enforcement action pursuant to NCGS 143-215.6A.

the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may
contact Department personnel at any time for assistance. By working in accordance with the permit, you

PROJECT DESCRIPTION:
The project site is located at 9 Estell Lee Place, adjacent to the Wilmington Convention Center and Northeast Cape Fear River
within the City of Wilmington limits, in New Hanover County. To locate the site from the Wilmington Regional Office (WiRO) travel
south on Market Street (U.S. HWY 17) until you reach Martin Luther King, Jr. Parkway (N.C. HWY 74) that will be located on the
right. Turn right and travel west approximately 3.5 miles until you arrive at North 3'" Street in downtown Wilmington. Travel
approximately 0.5 miles south until your reach Hanover Street. Turn right onto Hanover Street and continue until you reach Nutt
Street. Turn left onto Nutt Street and then take the immediate right onto Estell Lee Place and continue until you reach the property
of interest, which will be located on the right.
The vacant parcel is located between the Coastline Convention Center, The Greater Wilmington Chamber of Commerce and the
Wilmington Convention Center. Existing structures adjacent to the project area along the riverhont consists of the Wilmington
Riverwalk, steel sheet pile bulkhead and City's floating docks located waterward of The Greater Wilmington Chamber of
Commerce. The project site is approximately 0.8 acres with an elevation of approximately 7' above Normal High Water (NHW).
Waterward of the bulkhead directly west of the Wilmington Convention Center is an area of coastal wetland vegetation and Section
404 type vegetation, approximately 120' in length by 30' in width, which includes: Giant Cordgrass (Spartina cynocoroides) and
Smooth Cordgrass (Spartina aftemiflora) and Common Reed (Phragmites australis). Upland vegetation consists of ornamental
landscaping, maintained grass and hardwood trees, primarily Oak. Existing upland structures on the project site include an
existing storrmwater infiltration system "Sand Filter BMP", which was authorized under State Permit No.15-02 issued to the City of
Wilmington for the development of the Wilmington Convention Center. State Permit No.15-02 expired on December 31, 2013.
Based on the biological investigation report dated 08/10/2000 for State Permit No.15-02, the pre-existing soil remediation project
was completed and approved at the time by the N.C. Division of Water Quality - Groundwater Section (Permit # SR0800073) (See
Sheets 1 and 2 of 2 and Project Narrative).
Redevelopment during the late 1990's and early 2000's of the Wilmington riverfront went through comprehensive efforts between
the City and several property owners, who through their cooperation with the City staff proposed a revitalization project forthis area
which has incorporated public trust access in accordance with the enacted law predicated by House Bill No. 1059: GS 113A-
120(a)(1) and (a)(2) (Urban Waterfront) and was authorized the City of Wilmington under State Permit No.149-98.
The current City of Wilmington/New Hanover County 2006 CAMA Land Use Update Plan classifies adjacent waters as
Conservation, and the adjacent high ground portion of the project area as Developed. The waters of the Northeast Cape Fear
River are classified SC by the Division of Water Resources. They are designated as a Primary Nursery Area (PNA) by the N.C.
Division of Marine Fisheries and they are CLOSED to the harvest of shellfish.
PROPOSED PROJECT:
The applicant proposes the construction a new multi -story hotel adjacent to the Wilmington Convention Center. The new 186 room
Embassy Suites hotel would consist of eight (8) floors with a total elevation of approximately 135' in height to the highest
associated structure on the roof of the proposed building. Parking for the proposed hotel would be available at the existing
Wilmington Convention Center parking deck, which is accessible from Nutt Street. The application also states a new roadway
extension would be constructed from Estell Lee Place to access the new hotel, along with enhancing the existing parking area at
The Greater Wilmington Chamber of Commerce located at 1 Estell Lee Place. The application states that the proposed work in
this area is located outside the 75' Coastal Shoreline Area of Environmental Concern (AEC) and that the owner and The Greater
Wilmington Chamber of Commerce are in agreement for the proposed improvements to the existing parking area.
The application also states a timber access walkway and grass pavers, measuring approximately 170' in length by 8' in width
would lead from the new hotel to the existing City's public Riverwalk, which would be entirely over highground on the City of
Wilmington's property. The applicant has received authorization from the City of Wilmington for the proposed development within
the 75' Coastal Shoreline AEC on the City of Wilmington's property (See Sheets 2 of 2, A201, A203, A204, C107-Cl09, C111,
City's Authorization Letter and Project Narrative).

10. ANTICIPATED IMPACTS:
The proposed upland re -development would impact approximately 106,722 sq. ft. (2.45 acres), of which only 2.13% would be
within the 75' Coastal Shoreline AEC. The only proposed development within the AEC would be the limits of disturbance for the
site preparation and the construction of the timber walkwalk and grass pavers. The application states that a storrnwater permit
application was submitted on 12/08/2015 and an erosion and sedimentation plan was submitted on 10/14/2015 for the proposed
project.

Areas of Environmental Concern (AEC's) impacted by the proposal are ES. Waters at
the project site are classified as SC and are not open to the harvesting of shellfish. The

I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover
County CAMA Land Use Plan and offer the following comments.
The general area of the project is classified as Developed, while the AECs impacted by
the work are classified as Conservation.
In general, Wilmington -New Hanover County allows development in conservation
classified AECs, which is consistent with the State's minimum use standards. The 2006
Wilmington -New Hanover County Joint Land Use Plan contains some policies, which
exceed the State's minimum use standards. However, none of these standards appear to
be applicable to this proposal.

Thank you for your submittal of January 29. 2016, regarding the above -referenced undertaking. We have
reviewed the materials submitted and offer the following comments.
There are no known archaeological sites within the proposed project area. Based on our knowledge of the
area, it is unlikely that any archaeological resources that may be eligible for inclusion in the National
Register of Historic Places will be affected by the project. We, therefore, recommend that no
archaeological investigation be conducted in connection with this project.
Although work will occur in close proximity to the Wilmington Railroad Museum Complex (NH1169), a
contributing element within the National Register -listed Wilmington Historic District (NH0003), it is
anticipated the proposed project will not adversely affect the character or diminish the integrity of these
historic properties.
These comments are made in accord with G.S. 121-12(a) and Executive Order XVI. If you have questions

1.0 INTRODUCTION
1.1 PURPOSE OF PLAN
The purpose of this Waste Management Plan (Plan) is to provide a guidance
document for the City of Wilmington (City) and their subcontractors to
construct various structures associated with the proposed City of Wilmington
Convention Center to be located at 525 Nutt Street in Wilmington, North
Carolina. Refer to the attached Figure 1 for a site vicinity location. This Plan
provides guidance for the various contractors that may encounter recovered
water or excavated soil that has been documented within the report entitled
Geotechnical and Groundwater Environmental Investigation Report for Nutt
Street Outfall Design — "Nutt Street Culvert Outfall and Wilmington
Convention Center Parking Deck" (Geotechnical and Groundwater
Investigation Report) dated November 14, 2007 prepared by CATLIN
Engineers and Scientists (CATLIN).
It is our understanding that the Convention Center propertywlll be developed
in various phases with a number of contractors. This documentwill provide a
guidance for handling potentially contaminated soil and/or water that may be
encountered during subsurface construction activities. This document may
either be used directly by the contractors or used to prepare theirown Waste
Management Plan, if deemed necessary by the city.
1.2 BACKGROUND
The future Convention Center property is a Brownfields Property that is a
former industrial site that was most recently used as a petroleum -transfer
facility for CSX Transportation but is currently a vacant property with no
structures present. Per the Notice of Brownfields Property (Brownfields
Agreement), the property is contaminated with metals and petroleum
constituents. Subsequent to the issuance of the Brownfields Agreement,
CSX Transportation was notified that the oversight of the investigation and
cleanup of the future Convention Center property had been transferred from
the North Carolina Department of Environment and Natural Resources
(NCDENR), Division of Water Quality (DWQ), Aquifer Protection Section to
the NCDENR Division of Waste Management (DWM), Inactive Hazardous
Sites Branch (IHSB). CATLIN is not aware of any active remedial measures
or monitoring currently being conducted by CSX Transportation. It should be

noted that the intent of this Plan is to provide guidance to allow the various
contractors to handle potentially contaminated water and soil in accordance
with the Brownfields Agreement and not necessarily in accordance with IHSB
Guidelines. It is our.understanding that CSX Transportation is responsible
for addressing IHSB's requirements. This Plan will be implemented upon
receipt of approval from the Brownfields Program.
1.3 HEALTH AND SAFETY
A site specific Health and Safety Plan (HASP) should be. prepared at the
contractor's discretion to ensure the protection of the general public within
the vicinity of the site and personnel on -site or within the immediate areas of
the site during performance of the on -site work related to the handling of the
potentially contaminated soil and/or water. Each individual is responsible for
following a HASP and is responsible for his or her own health and safety.
CATLIN is only responsible far the health and safety of CATLIN employees.
In addition to this HASP, the City of Wilmington may require additional health
and safety procedures to be implemented during the construction activities.
Additionally, the HASP should conform to all applicable Occupational Safety
and Health Administration (OSHA), Environmental Protection Agency (EPA),
NCDENR and American National Standards Institute (ANSI) regulations.
1.4 PERMITS
All required permits will be obtained by others in accordance with local
regulations. Since all permits have not been obtained or made available as
of the preparation of this Plan, the. contractor should ensure that the
recommendations within this Plan are not less stringent than the
requirements of other Permits. In the event that such discrepancies are
identified, then the contractor should consult with the City prior to proceeding
with such activities.
It is our understanding that a Sedimentation and Erosion Control (SEC) Plan
or Plans will be prepared for this project prior to the start of construction in
accordance with the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4). The SEC plans will be
prepared by others under a separate submittal and should include the
construction activities proposed within this Plan.
It is our assumption that this project will also include the management of
stormwater in accordance with an approved Stormwater Permit. The
recommendations within this Plan have been assumed to be in compliance
with the requirements of the Stormwater Permit. However, the Surface
Water Protection Section should be consulted prior to the start of this project
to ensure compliance or the need for additional record keeping and
monitoring to meet the intent of the Stormwater Permit.

1.5 NOTIFICATIONS
The Brownfields Program must be notified for various activities documented
within the Brownfields Agreement that are associated with the handling of
potentially contaminated soil and water. It is our understanding that the City
of Wilmington will contract with CATLIN or others to perform these
notifications on their behalf.
Due to anticipated encounters with soil and groundwater contamination
throughout the project, a seven (7) day notification for every occurrence
becomes cumbersome. Therefore, we propose the submittal of a monthly
update report which will include anticipated future activities/schedule and a
summary of the previous months activities. However, the contractors should
ensure that the notifications required by the Brownfields Agreement have
been provided to CATLIN for incorporation in the monthly update report. The
following is a summary of these notifications:
Surface water and underground water at the Brownfields Property may
not be used for any purpose without the prior written approval of
NCDENR.
No activities that encounter, expose, remove or use groundwater (for
example, installation of water supply wells, fountains, ponds, lakes or
swimming pools, or construction or excavation activities that encounter or
expose groundwater) mayoccuron the Brownfields Propertywithout prior
sampling and analysis of groundwater to the satisfaction of NCDENR in
any areas proposed for such activities, and submittal of the analytical
results to NCDENR. Any water pumped from the ground shall be
containerized, sampled and disposed of to NCDENR's satisfaction. If
sampling results disclose to NCDENR contamination in excess of North
Carolina's Groundwater Quality Standards, the proposed activities may
not occur without the prior written approval of NCDENR on such
conditions as NCDENR imposes, including at a minimum legal approval
of plans and procedures to protect public health and the environment
during the proposed activities.
No soil may be excavated or removed from the areas denominated
"Contaminated Soil", on the plat component of the Notice of Brownfields
Property, without a minimum of seven (7) business days advance written
notice to, and the written approval of, NCDENR, unless NCDENR states
otherwise in writing in advance.
No soil may be excavated or removed outside the areas denominated
"Contaminated Soil", on the plat component of the Notice of Brownfields
Property, without a minimum of seven (7) business days advance written
notice to NCDENR. At the time such soil is exposed, NCDENR may
inspect and sample, or require sampling of, the exposed soil for
contaminants. This restriction does not apply to the area denominated
"1999 excavation area" on the plat component of the Notice of
Brownfields Property. If previously unknown soil contamination is

discovered that NCDENR determines would likely contaminate
groundwater even if capped, or that may pose an imminent threat to
public health or the environment if exposed, as much soil as NCDENR
requires shall be removed and disposed of in accordance with applicable
law, and any other actions that NCDENR requires to make the
Brownfields Property suitable for the uses specified in this Agreement
while fully protecting public health and the environment shall betaken. If
soil contamination is discovered that NCDENR determines would not
contaminate groundwater if capped, or pose an imminent threat to public
health or the environment if exposed, as much soil as NCDENR requires
shall be removed and disposed of in accordance with applicable law or
capped.
Soil, landscaping and contours at the Brownfields Property may not be
removed without the prior written approval of NCDENR except for
mowing and pruning of above -ground vegetation or replacement of small
bushes and small trees.
2.0 EXISTING SOIL AND GROUNDWATER CONTAMINATION
It is assumed that all asphalt, trees, shrubs and etc. to be removed as part of the
clearing and grubbing_ activities is not contaminated and can be handled at the
contractor's discretion. However, a qualified environmental professional should
verify and documents contamination is not present during the removal activities.
The Brownfields Agreement identified areas of potential environmental concerns
based on historical soil and groundwater contamination that has been documented
for the property. The Geotechnical and Groundwater Investigation Report is the
most recent known investigation of the subsurface conditions at the Convention
Center project site and was completed after the City executed the Brownfields
Agreement. Therefore, the areas in which soil and groundwater contamination were
documented within the Geotechnical and Groundwater Investigation Report is
considered representative of the existing conditions for the soil and groundwater
contamination. The Geotechnical and Groundwater Investigation Report
recommended that all soil and groundwater encountered on the Convention Center
property be properly managed based on the potential presence of contamination.
Specifically, the recommendations were based on the property being divided into
areas of identified groundwater contamination versus all other areas of the project
site as illustrated on the attached Figure 2. The recommendations within the
Geotechnical and Groundwater Investigation Report were utilized in the
development of this Plan.
Please note that the Brownfields Agreement identifies an area of "Contaminated
Soil". Subsequently, the Geotechnical and Groundwater Investigation Report
documented areas of suspected contamination outside the area identified in the
Brownfields Agreement as "Contaminated Soil". Therefore, we recommend that the
soil be managed across the entire project site per this Plan rather than just the area
identified in the Brownfields Agreement as "Contaminated Soil".

3.0 WASTE MANAGEMENT PLAN IMPLEMENTATION
This section of the Plan has been prepared to address the recommendations of the
previously referenced Geotechnical and Groundwater Investigation Report as
associated with the excavation, backfill and disposal of potentially impacted soils
and water.
3.1 SOIL SCREENING
The following Sections provide an outline to be considered for screening
excavated soil in general accordance with the construction sequence
illustrated on the Flow Chart provided on the following page.

3.1.1 Excavation of Existing Soil
Soils are anticipated to be excavated and temporarily stockpiled using
standard construction equipment such as an excavator, loader,
backhoe or bulldozer. Alternative excavation approaches, if desired,
will be presented within the monthly update reports. During the
excavation process the soils will be field screened using olfactory
observations by a qualified environmental professional. Soils in which
a strong odor or presence of free -phase product are noted will be
excavated and stockpiled on and covered with plastic in general
accordance with the stockpile detail provided on the attached Figure
3. These stockpiles will be no larger than approximately 250 cubic
yards and will be sampled per Section 3.1.2 of this Plan.
All other soils will be stockpiled adjacent to the excavation in order to
allow the soils to be used as backfill in the vicinity in which the soils
were excavated, if backfill is needed. Soils to be used as backfill will
not require covering with plastic or segregation into 250 cubic yard
stockpiles. In the event that backfill is not needed then the soils will
be sampled for potential off -site disposal per Sections 3.1.2 and 3.1.4
of this Plan. In the event that these soils are desired to be used as
backfill within other areas of the project site then samples will be
collected for on -site use per Section 3.1.3 of this Plan.
3.1.2 Sample for Off -Site Disposal
Soil samples should be collected by a qualified environmental
professional representative. Soil samples will be collected for
laboratory analysis per the requirements of the disposal facility in
general accordance with industry standards and the standard
methods presented in Appendix A. In order to prevent construction
delays, quick turn -around time is suggested from the laboratory. The
contractor should generally expect this turn -around time to be
between 24 and 72 hours. An off -site disposal facility has not been
selected as of the preparation of this Plan. The selected off -site
disposal facility along with their testing criteria will be provided within
the monthly update reports.
3.1.3 Sample for On -Site Use
Soil to be used for on -site use purposes should be sampled and
handled by a qualified environmental professional representative
using industry standards and the standard methods presented in
Appendix A. On -site use is an indication that the soils may be used
at the discretion of the contractor and/or City within the Convention
Center property. The following sampling program is to be generally

implemented for the sampling of each stockpile to be used for on -site
use as previously referenced in Section 3.1.1 of this Plan.
o Collect grab samples from two (2) depths at three (3)
locations within each stockpile.
o Composite the grab samples into one (1) composite
sample per stockpile for laboratory analyses.
o Samples are to be analyzed for volatiles Total
Petroleum Hydrocarbons —Diesel Range Organics (TPH
- DRO) per EPA Method 3550/8015.
o Collect and analyze a duplicate sample and equipment
blank sample at a 25% frequency.
o Analyze a trip blank sample per sampling event.
o All sample results will be, compared to the following
criteria:
■ TPH — DRO = 40 ppm
o The sampling results will be provided within the monthly
update reports along with the recommendations for
handling these soils.
3.1.4 Disposal at Permitted Facility
The City will coordinate the submittal of a waste profile along with this
Plan to a permitted off -site disposal facility for approval of disposal of
soils prior to commencement of shipment. All soils to be disposed of
off -site will be loaded into an appropriate transportation vehicle using
standard construction equipment such as an excavator or loader.
Soils will be transported within approved NCDOT containers under
proper manifest paperwork as established by the off -site disposal
facility. As previously stated, an off -site disposal facility has not been
selected as of the preparation of this Plan. The selected off -site
disposal facility along with their testing criteria will be provided within
the monthly; update reports.
3.2 WATER SCREENING
The following Sections provide an outline to be considered for screening
potentially contaminated water in general accordance with the construction
sequence illustrated on the Flow Chart provided on the following page.

3.2.1 Temporary Water Storage
The Geotechnical and Groundwater Investigation Report
recommended procedures for handling water that comes in contact
with potentially contaminated subsurface soils. The Convention
Center project site was divided into two areas of groundwater
contamination as identified on the attached Figure 2. In an effort to
reduce the amount of surface water that enters an excavation and
comes in contact with potentially contaminated soils, the contractor
should install best management practices in accordance with an
approved SEC Plan and Stormwater Permit to divert surface water
away from the excavation: All stormwater that enters an excavation
within these areas should be considered contaminated and managed
as such. All water from the project site that may come in contact with
subsurface soils is to be allowed to infiltrate into the subsurface at that
location or pumped to a temporary holding tank for testing and/or
visual observation. Recommendations for screening water are based
on the location in relation to the areas of groundwater contamination
as identified on the attached Figure 2. The contractor should use
standard construction dewatering pumps to transfer water to and from
the temporary holding tanks. All recovered water should be placed in
a holding tank(s) of sufficient size to allow for necessary dewatering
prior to off -site disposal. An off -site disposal facility should be
contracted prior to start of construction activities to allow for ease of
disposal of contaminated water.
3.2.1 Screening Water from Contaminated Area
All recovered water from the Contaminated Area as illustrated on the
attached Figure 2 should be placed in a holding tank to allow for
sampling by a qualified environmental professional. Water samples
will be collected for laboratory analysis per the requirements of the
disposal facility in general accordance with industry standards and the
standard methods presented in Appendix A. In order to prevent
construction delays, quick turn -around time is suggested from the
laboratory. The contractor should generally expect this turn -around
time to be between 24 and 72 hours. An off -site disposal facility has
not been selected as of the preparation of this Plan. The selected off -
site disposal facility along with their testing criteria .will be provided
within the monthly update reports.
3.2.2 Screening Water from Outside the Contaminated Area
All recovered water from Outside the Contaminated Area as illustrated
on the attached Figure 2 should be placed in a holding tank to allow
for visual inspection by a qualified environmental professional. In the
event that the recovered water has any visible or olfactory indications

of contamination then the water should be analyzed as recommended
below. This holding tank should be only for recovered water from
areas outside the areas of identified groundwater contamination. If
deemed necessary, water samples should be analyzed for volatiles
per EPA Method 8260, semi-volatiles per EPA Method 8270 and
selected metals (lead and arsenic) per appropriate EPA Methods and
compared to the applicable 15A NCAC 2L.0202 North Carolina
Groundwater Quality Standard (21- GWQS) and 15A NCAC 2B North
Carolina Surface Water Quality Standard (26 SWQS) prior to
discharge per Section 3.2.5 of this Plan.
3.2.3 Off -Site Disposal
The City will coordinate the submittal of a waste profile along with this
Plan to a permitted off -site disposal facility for approval of disposal of
water prior to commencement of shipment. All water to be disposed
of off -site will be loaded into an appropriate transportation vehicle
using standard construction dewatering pumps. Water will be
transported within approved NCDOT containers under proper

3.2.4 Discharge
All water that is deemed acceptable for discharge described in
Sections 3.2.2 and 3.2.3 of this Plan should be considered for
discharge to the ground surface, drainage conduits, or directly to
receiving waters through appropriate best management practices in
accordance with an approved SEC Plan and Stormwater Permit.

CATLIN STANDARD METHODS OF INVESTIGATION
1.0 DATA COLLECTION
1.1 BACKGROUND DATA
Background data and history information relevant to the site investigation is generated
through numerous sources. These sources may include, but are not limited to, the
following:
• Conversations with the client and regulatory officials involved with the incident.
• Review of pertinent regulatory correspondence.
• Review of previous and existing reports and other technical data.
• Review of available historical records.
1.2 SURVEYS AND POTENTIAL RECEPTOR DATA
Physical survey and potential receptor data are collected in accordance with the
intended level of investigation. In general, the purpose is to collect sufficient
information for site assessment and corrective action planning.
Individual receptors are identified and evaluated in the context of their potential for
contaminant impact. Potential receptors of contamination can include surface water
bodies, groundwater supply wells, wellhead protection areas, and subsurface building
structures.
1.2.1 Horizontal Survey
Horizontal survey data are generated using either accepted general field
surveying techniques, or existing survey maps; or by using a combination of
existing data and field generated information. The survey area generally
extends to a point at least 50 feet beyond suspected plume boundaries. A
receptor scale survey of a larger area surrounding a site will be made if
appropriate and necessary.
1.2.2 Vertical Survey
A vertical survey is conducted at the site typically within an accuracy of 0.01
foot. The datum plane is generally assumed unless otherwise noted. Assumed
temporary benchmarks (TBM) are selected near ground level. The vertical
survey includes such points as top of all well casings, selected ground shots,
important utility inverts, utility fluid levels, important surface water levels, and
other items determined to be significant.

1.3 DRILLING AND MONITORING WELL/P/EZOMETER INSTALLATION
Necessary permits are applied for and obtained in accordance with federal, state, and
local requirements prior to drilling or well construction activities. Additionally, the well
locations are scanned for underground utilities priorto conducting intrusive subsurface
activities. Wells are installed under applicable licensing requirements, and are
designed and constructed in accordance with accepted standards and practices. Any
wells purposely installed at off -site locations are permitted through appropriate right -of -
entry agreements with all necessary property owners and/or their agents.
1.3.1 Drilling Methods and Subsurface Data Collection
Drilling is accomplished utilizing one or more of the following methods:
Auger Drilling
Auger drilling is the preferred, most often used method of subsurface
investigation and is accomplished using a vehicle or trailer mounted drill rig.
Continuous flight auger types used vary upon the site and situation; ranging
from the 4-inch outside diameter solid stem to the 12-inch outside diameter
hollow stem. Auger type is selected based upon appropriateness and/or
site -specific requirements.
Hand Augering
Hand augering is utilized when economically and scientifically feasible,
or when no other method is suitable. Hand augers typically produce
three-inch diameter holes and are generally limited to depths of less
than 15 feet.
Direct Push
Direct push methods of subsurface investigation are used generally for
soil screening purposes or collection of groundwater samples where
permanent wells are not viable.
Other Methods
Other drilling methods, such as mud and air rotary, rock coring, cable
tool, and large bucket augering are used when site conditions or
project requirements dictate.
Regardless of the drilling method used, the drill rig(s) and all drilling tools are
thoroughly cleaned between boreholes to prevent cross introduction of
contaminants. Split spoon samples are collected and field -described at
intervals of five feet or less, and cuttings are continuously monitored for organic
vapors. Drill cuttings are containerized for off -site disposal or are spread on the
ground surface in proximity to the well or boring in accordance with North
Carolina Department of Environment and Natural Resources (NCDENR)
requirements.

A geologist or engineer, trained in using visual/manual techniques, is always
present during drilling and is responsible for subsurface contaminant and
geologic data collection. Soils are classified in general agreement with the
Unified Soils Classification System (USCS).
1.3.2 Hydropunch Installation
Hydropunch penetrometers (Hydropunches) are used to delineate the spatial
extent of dissolved and free phase plumes. Soil borings are advanced to the
appropriate depth and then the Hydropunch is advanced through the soil
boring into undisturbed material. Groundwater samples are collected by
pulling back on the body of the Hydropunch and allowing the groundwater to
enter the screened portion of the sample chamber. Samples are retrieved
using a decontaminated Teflon bailer or peristaltic pump.
1.3.3 Well Installation
Wells are typically constructed of threaded PVC casing and screen. No glues
or cements are used in joining PVC components. Well diameter, slot sizes,
and protective covers vary depending upon site -specific conditions or situation -
specific requirements.
1.3.4 Well Development
Wells are developed by over -pumping or surging using appropriate pumps,
blocks, or bailers. Through development, unwanted fine materials are
removed from the natural formation surrounding the well. Well development
will be performed no sooner than 24-hours after grouting is completed for the
Type III wells. Water generated during development is containerized and
properly disposed or is discharged onto the ground in proximity of the well in
accordance with NCDENR requirements.
1.4 HYDROGEOLOGIC DATA COLLECTION
Data used to help characterize hydrogeologic conditions at a site are obtained through
various procedures including, but not necessarily limited to, those described below:
1.4.1 Regional Geology
Information pertaining to the regional geologic framework is compiled from
existing publications, maps, and scientific papers.
1.4.2 Site Geology
Shallow site geology is generally determined from field descriptions and
borehole samples. Interpretations with regard to hydrogeologically important
contacts, zones, fractures, faults, cleavage, and facies changes are made
when possible.

1.4.3 Groundwater Occurrence and Characteristics
Groundwater data is obtained utilizing a number of methods and procedures,
not limited to the general list below:
Well Water Levels
After well development, wells are allowed to stabilize for a minimum of
24 hours prior to measuring. Water level and free product thickness
(where applicable) measurements are performed using an electronic
interface probe or steel tape with water/product finding pastes.
The specific gravity of any accumulated product is determined and
used to calculate true hydraulic grade from measured water levels.
This information is combined with vertical survey data to determine
relative potentiometric surface elevations for all wells.
Aquifer Testing
Various aquifertests may be used to make determinations of hydraulic
conductivity. Slug or pumping tests are often used to characterize site
hydrogeologic conditions and to develop remedial action alternatives
utilizing appropriate pumping technologies.
Other Methods
Other methods may be deemed appropriate for determining various
groundwater characteristics. These other methods may include nested
well configurations and/or clustered piezometer installations; sieve or
pipette analysis; fracture trace analysis; computer modeling; and
geophysical logging.
1.5 PETROLEUM HYDROCARBON DATA COLLECTION
1.5.1 Collection Methods
Petroleum hydrocarbon data is obtained through various methods including,
but not limited to, the following:
Field Analysis
• Direct thickness measurement of phase separated components using
tapes and/or probes.
• Manual vapor analysis using a photoionization detector (PID) or flame
ionization detector (FID).
Detectable odor and visual observation.

Laboratory Analysis
• Laboratory analysis of phase -separated products.
• Laboratory vapor, soil, and groundwater analysis using appropriate
EPA Methods.
1.5.2 Field Sampling
Field sampling procedures are performed in accordance with recommended
protocol, accepted industry standards, and under appropriate chain -of -custody
procedures. Generally, sampling procedures are as follows:
Product Samples
Product samples are obtained using clean equipment and containers.
Each is shipped to the analytical laboratory in protective containers.
Vapor Samples
PID/FID readings are measured from soil sample headspace using
containerized samples that have been brought to ambient
temperature. Carbon tubes are utilized in conjunction with a
laboratory -calibrated vacuum pump to obtain vapor samples. The
carbon tubes are sealed and refrigerated for shipment to the
analytical laboratory (This method is known as the Carbon
Adsorption Method).
Soil Samples
Soil samples are immediately packed into clean containers, and
refrigerated for shipment to the analytical laboratory.
Groundwater Samples
Groundwater samples are collected in accordance with the following
procedures:
■ Creeks/Lakes/Etc.
Grab samples are obtained.
Domestic Wells
Wells are pumped for a time sufficient to completely
purge the well and any pressure or holding tanks prior
to sampling.
• Monitoring Wells
Water level measurements are made and well volumes
calculated for each well.

Three well volumes are removed from each well using
a thoroughly cleaned Teflon bailer or appropriate
purging pump. If it is not possible to remove three
volumes, due to very low yields, a minimum of one
volume is removed prior to obtaining a sample.
Where analysis for metals is required, wells are
typically sampled utilizing low flow techniques, which
reduce turbidity and the potential for matrix
interference.
Samples are collected and containerized in a manner that minimizes agitation
and contact with the air.
Sampling records are field prepared.
Samples are labeled and proper chain of custody documents are maintained.
Samples are promptly protectively packed, refrigerated, and shipped to the
analytical laboratory for analysis.
2.0 DATA EVALUATION
Data obtained as a result of the site investigation is compiled and evaluated and a report is
prepared for client review and distribution to the appropriate agencies. Generally, specific data
are evaluated as follows:
• Background data are evaluated in context with the suspected or confirmed problem.
• Survey data are utilized to develop site maps and to evaluate contaminant receptors.
• Well construction records are compiled and presented as part of the report. As -built
information is used in combination with other data to evaluate subsurface conditions
and monitoring well screen settings as they relate to the investigation.
• Subsurface drilling logs are used to develop geologic cross -sections, fence diagrams,
isopaths, structure contours, or other constructions: Regional geologic data are used
to obtain an overall framework.
• Hydrogeologic data are used to develop contour maps, flow nets and other
constructions. The data is also used to calculate various hydrogeologic parameters
that describe aquifer characteristics.
• Hydrocarbon data are utilized to develop various plume geometry and
isoconcentration maps.
• All data are compiled and utilized for making specific recommendations with regard to
remedial action alternatives.

enclosed plans illustrate the hotel layout. This hotel was part of the Major Development in an Area
of Environmental Concern Permit No. 15-02 that was for the construction of the Wilmington
Convention Center. That permit has since expired, which is the reasoning behind requesting a new
permit versus a modification to Permit No. 15-02. The current plans are keeping with the original
purpose and intent of the original Permit No.15-02.

property at 9 Estelle Lee Place in Wilmington, NC. As part of the improvements,
they are constructing 186 room hotel that will require work on the adjacent City
of Wilmington vacant 2.84 acre property to the west.

The Division of Coastal Management hereby acknowledges receipt of your application for the proposed development
located at 9 Estell Lee Place, adjacent to the Northeast Cape Fear River, in Wilmington, New Hanover County. It
was received as complete on January 22, 2016, and appears to be adequate for processing at this time. The
projected deadline for making a decision is April 6, 2016. An additional 75-day review period is provided by law when
such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline
stated above, you should consider the review period extended. Under those circumstances, this letter will serve as
your notice of an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from January 22, 2016, you may' request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and federal review
agencies for their comments. If additional information is required based on this review, the agencies may contact you
directly.

DEVELOPMENT PERMIT
The Department of Environmental Quality hereby gives public notice as required by
NCGS 113A-119(b) that the following application was submitted for a development permit in an
Area of Environmental Concern as designated under the CAMA: On January 22, 2016,
Wilmington Convention Hotel, LLC proposed to construct a multi -story hotel at 9 Estell Lee
Place, adjacent to the NE Cape Fear River, in downtown Wilmington, New Hanover County.
A copy of the application can be examined or copied at the office of Robb Mairs, N.C. Dept. of
Environmental Quality, Division of Coastal Management, 127 Cardinal Drive Ext., Wilmington,
NC 28405, (910-796-7423) during normal business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400
Commerce Avenue, Morehead City, NC 28557-3421, prior to February 22, 2016 will be
considered in making the permit decision. Later comments will be accepted and considered up
to the time of permit decision. Project modification may occur based on review and comment by
the public and state and federal agencies. Notice of the permit decision in these matters will be
provided upon written request.
