This permit, issued on July 27, 2616 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
re subject to Imes, imprisonment or crow action; or may cause me permit to be unit ana vota.
Bridge
1) The horizontal clearances of the authorized bridge shall be no lower than those shown on the
attached workplan drawings.
2) The bridge shall be constructed using top down construction. Any other construction method
may require additional authorization from the N.C. Division of Coastal Management (DCM).
3) The permittee shall exercise all available precautions during construction of the authorized
facilities to prevent pollutants or other waste materials from entering the adjacent waters and
wetlands.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This pemut must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any in work or project modification not covered
hereunder requires further Division approval.
All work mbst cease when the permit expires on
December 31, 2019
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina, Coastal
Management Program.

4) Turbidity curtains shall be used to isolate all in -water work areas from the adjacent waters of Burnt Mill
Creek, including but not limited to existing bridge and fender system removal, pile installation, and pile
removal. The turbidity curtains shall be of sufficient length and effectiveness to prevent a visible
increase in the amount of suspended sediments in adjacent waters. The turbidity curtains shall encircle
the immediate work area, but, shall not impede navigation. The turbidity curtains shall be properly
maintained and retained in the water until construction is complete and shall only be removed when
turbidity within the curtains reaches ambient levels.
5) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party. ,
6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized bridge. At a minimum, permanent
reflectors shall be attached to the bridge in order to make it more visible during hours of darkness or
inclement weather.
7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
Erosion & Sedimentation Control
NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be
filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this
plan to the N.C. Division of Energy, Mineral & Land Resources, Land Quality Section, 127
Cardinal Drive Extension, Wilmington, NC 28405.
8) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
9) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).
Easement
10) Prior to construction of the bridge under this permit, the permittee shall apply for and receive an Easement
from the Department of Administration's State Property Office as required under N.C.G.S. 146-12(e).

13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
14) Placement of riprap material shall be limited to the areas as depicted on the attached workplan
drawings. The riprap material shall be clean and free from loose dirt or any pollutant except in trace
quantities. The riprap material shall be of a size sufficient to prevent its movement from the approved
alignment by wave or current action. The riprap material shall consist of clean rock or masonry
materials such as but not limited to granite, marl, or broken concrete.
NOTE: If water supply lines will be relocated, plans and specifications shall be submitted to and
approved by the N.C. Division of Water Resources- Public Water Supply Section, at 127
Cardinal Drive Extension, Wilmington, NC 28405, prior to the initiation of construction.
NOTE: Future development may require a modification of this permit. Contact a representative of the
Division at (910) 796-7215 prior to the commencement of any such activity for this
determination. The permittee is fiirther advised that many non -water dependent activities are not
authorized within 30 feet of the normal high water level.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including any required approvals from the City
of Wilmington.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR-
16-0398.
NOTE: An application processing fee of $400 was received by DCM for this project.

LOVE GROVE ADDITIONAL ACCESS
The Love Grove residential neighborhood is located adjacent to the west of Smith Creek in Wilmington,
North Carolina. The internal roadway network of the neighborhood currently consists of three collector
streets running in a northeast -southwest orientation (Corbett, King and Stanley Streets) with four
intersecting cross streets (Railroad, Liverpool, Center and Clarendon Streets and Creekfront Drive). The
only access into or out of the neighborhood is via King Street along the south side of the neighborhood
which crosses a CSXT railroad line and connects to North filth Street.
On January 28, 2013, a railroad car derailment occurred on the CSX line which blocked the King Street
access to the neighborhood. Temporary emergency access was constructed to bypass the derailment
while clean-up of spilled, flammable materials occurred. The derailment illuminated the considerable
public safety hazard associated with having only one point of access into the neighborhood, particularly
considering the potential for railroad blockage.
The City of Wilmington decided to address this issued using funding approved during the 2014
Transportation Bond Referendum and contracted with AECOM for design/build services for a new
roadway to provide additional access to the Love Grove neighborhood.
The proposed project will consist of an extension of One Tree Hill Way in a westerly direction, spanning
across Burnt Mill Creek just south of its confluence with Smith Creek via a 677-foot long, pile -supported
bridge, and connecting to Creekfront Drive in the Love Grove neighborhood. The bridge will be
constructed using top -down methods in order to keep mechanical equipment out of the creek.
Concrete piles will be mechanically driven and connected to the bridge super structure via pile caps.
Pre -cast concrete segments of the bridge will be installed on top of the pile caps using a crane.
Additional impervious surface will be treated by collection of stormwater runoff into existing and new
stormwater BMPs. Specifically, the wet detention pond at the northeast corner of the Love Grove
neighborhood will be reshaped to capture and treat some of the additional runoff and a new wet
detention pond will be constructed in the upland area on the east side of the creek to capture and treat
the remaining additional runoff. AECOM personnel are currently working with City of Wilmington staff
on the stormwater permit application.
Jurisdictional delineation of wetland and streams was performed on September 9, 2015 by AECOM
personnel. Mr. John Policarpo with the US Army Corps of Engineers verified the jurisdictional
delineation on November 4, 2015. Also on that day, Mr. Robb Mairs of NC Division of Coastal
Management visited the site for the purpose of delineating CAMA features (coastal wetland and normal
high water line).
No impacts to jurisdictional waters of the US are proposed. The project will include excavation of an
existing upland peninsula that has coastal wetlands on both sides. This is being proposed in order to
alleviate potential rise in flood elevations due to the bridge installation. The peninsula will be excavated
down to an elevation that approximately matches that of the adjacent wetland. A wetland seed mix will
be used for temporary stabilization following excavation with natural recruitment of native plants
species from the adjacent wetland for permanent stabilization. Wetland mitigation credit will not be

The purpose of the project will be to provide additional roadway access to the Love Grove neighborhood. Currently one only
roadway (King Street) provides access to the neighborhood and that road crosses a railroad line which can restrict access.

Concrete piles will be mechanically driven. A large crane will be used to place the pile caps and bridge span sections on top
of the piles. Excavation will be performed using a backhoe and hand tools. Grading will be performed using typical grading
equipment (bulldozer, graders, rollers, etc.)

construction of a public road / bridge in compliance with the provisions of 15A NCAC 2H
.1000 (hereafter referred to as the "stormwaterrules') and the approved stormwater
management plans and specifications, and other supporting data as attached and on file with
and approved by the Division of Energy, Mineral and Land Resources (hereafter referred to
as the Division or DEMLR) and considered a part of this permit.
The Permit shall be effective from the date of issuance until rescinded and shall be subject to
the following specific conditions and limitations:
I. DESIGN STANDARDS
The runoff from the impervious surfaces has been directed away from surface waters
as much as possible.
2. The amount of built -upon area has been minimized as much as possible.
3. Best Management Practices are employed, including a grassed swale and sheet flow
through vegetated areas, which minimize water quality impacts.
4. Approved plans and specifications for pro'ects covered by this permit are incorporated

II. SCHEDULE OF COMPLIANCE

1. The permittee shall at all times provide adequate erosion controQt%esu in
conformance with the approved Erosion Control Plan.
The permittee shall at all times provide the operation and maintenance necessary to
assure that all components of the permitted Best Management Practices function at
design condition. The approved Operation and Maintenance Agreement is
incorporated by reference into this permit and must be followed in its entirety and
maintenance must occur at the scheduled intervals.
3. The facilities shall be constructed in accordance with the conditions of this permit, the
approved plans and specifications, and other supporting data.

4. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in the
notice, the permittee shall submit a written time schedule to the Director for modifying
the site to meet minimum requirements. The permittee shall provide copies of revised
plans and certification in writing to the Director that the changes have been made.
5. The permittee shall submit all information requested by the Director or his
representative within the time frame specified in the written information request.
6. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction for the following items:
a. Major revisions to the approved plans, such as road realignment, deletion of
any proposed BMP, changes to the drainage area or scope of the project, etc.
b. Project name change.
C. Redesign of, addition to, or deletion of the approved amount of built -upon area,
regardless of size.
d. Alteration of the proposed drainage.
7. The Director may determine that other revisions to the project should require a
modification to the permit.
III. GENERAL CONDITIONS
Failure to abide by the conditions and limitations contained in this permit may subject
the Permittee to an enforcement action by the Division, in accordance with North
Carolina General Statutes 143-215.6A to 143-215.6C.
2. The permit issued shall continue in force and effect until revoked or terminated. The
permit may be modified, revoked and reissued or terminated for cause. The filing of a
request for a permit modification, revocation and reissuance, or termination does not
stay any permit condition.
3. The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit as
allowed by the laws, rules, and regulations contained in Title 15A of the North Carolina
Administrative Code, Subchapter 2H.1000; and North Carolina General Statute 143-
215.1 et. al.
4. This permit is not transferable to any person or entity except after notice to and
approval by the Director. The permittee shall submit a completed and signed
Name/Ownership Change Form, accompanied by the supporting documentation as
listed on the form, to the Division of Energy, Mineral and Land Resources at least 60
days prior to any one or more of the following events:
a. An ownership change including the sale or conveyance of the project area in
whole or in part, except in the case of an individual lot sale that is made subject to
the recorded deed restrictions;
b. The sale or conveyance of the common areas to a Homeowner's or Property
Owner's Association, subject to the requirements of Session Law 2011-256;
c. Bankruptcy;
d. Foreclosure, subject to the requirements of Session Law 2013-121;
e. Dissolution of the partnership or corporate entity, subject to NCGS 57D-2-01(e)

9. PROJECT DESCRIPTION:
The project is located at the end of One Tree Hill Way on the east side and Creekfront Dr. on the
west side of the project, adjacent to Burnt Mill Creek in Wilmington, New Hanover County. To locate
the site from the Wilmington Regional Office (WiRO) travel south on Market Street (U.S. HWY 17)
until you reach Martin Luther King, Jr. Parkway (N.C. HWY 74) that will be located on the right. Turn
right and travel west approximately 3.5 miles until you reach the exit ramp to Wilmington
International Airport (ILM) onto North 23'" Street. Turn right onto North 23rtl Street and travel south
approximately 0.4 miles until you reach One Tree Hill Way, which will be located on the right. Turn
right onto One Tree Hill Way and continue until the road terminates at the project site. Elevations in
the project area range from 15' to 17' above normal high water (NHW) along the creek. The
predominant land use on the east side is zoned as airport industrial. Existing use on the east side of
the project include an existing Cape Fear Public Utility Authority pump station (COW #10 Northside),
which is located adjacent to the project site to the north and the Screen Gem Film Studios to the
east off of One Tree Hill Way and North 231" Street.
The west side of the project area is the existing Love Grove residential neighborhood. The
application states the internal roadway network of the neighborhood currently consists of three
collector streets (Corbett, King and Stanley Streets) with four intersecting cross streets (Railroad,
Liverpool, Center and Clarenton Streets and Creekfront Drive). The only access into or out of the
neighborhood is through King Street along the south of the neighborhood, which crosses a CSX
railroad line and connects to North 11'h Street.
The application states that due to a railroad car derailment on January 28, 2013 on the CSX line,
access to the Love Grove neighborhood through King Street was blocked off. Temporary emergency
access was constructed to bypass the derailment while clean-up of spilled, flammable materials
occurred. This derailment brought to light the considerable public safety hazard associated with
having only one point of access into the neighborhood. Two scoping meetings were held for this
project prior to the submittal of this permit application.
The project site is located just south of the confluence of Smith Creek and Burnt Mill Creek. The
upland vegetation along the shoreline of the eastern side of the project consists of Pine, Oak,
Magnolia and Maple trees. There is an existing narrow highground peninsula on the eastern side of
the project, which extends towards the west into Burnt Mill Creek. At the waterward end are existing
remnant timber piles which appears to be associated with a previous bridge crossing of the creek.
The vegetation along the shorelines and within the creek of the eastern and western shoreline of
Burnt Mill Creek is primarily Bald Cypress, Narrow Leaf Cat -tail (Typha spp.), Saw Grass (Cladium
spp.), Giant Cordgrass (Spartina cynocoroides) and Bulrush (Scirpus sop.) (See Project Narrative
and Sheet 1 of 5).
Smith and Burnt Mill Creeks are classified C; Sw by the Environmental Management Commission
(EMC) in the area of the proposed construction and is classified by the North Carolina Wildlife
Resources Commission as Inland Waters (NCWRC). The NCWRC has NOT classified Burnt Mill
and Smith Creeks as an Anadromous Fish Spawning Area or as a Primary Nursery Area. The
waters are CLOSED to shellfishing by the Shellfish Sanitation Section of the Division of Marine
Fisheries. Burnet Mill Creek is approximately 1 00'wide and approximately -8' in depth at mean low
water (MLW) in the project location. There were no SAV's observed in the project arq"Urii¢p �he E D

The bridge would measure approximately 667' in length by 39' in width and would be pile -supported,
span across the creek and connect to Creekfront Drive in the Love Grove neighborhood. The
application states the bridge would be constructed using top -down methods in order to keep
mechanical equipment out of the creek. Concrete piles would be mechanically driven and connected
to the bridge super structure via pile caps. Pre -cast concrete segments of the bridge would be
installed on top of the pile caps utilizing a crane. The bridge approach on each side of the creek
would be stabilized by steel sheet piles, Class II rip -rap and an earthen berm entirely over
highground. The most southern end of the earthen berm would encroach into the 30' buffer from
NHW. The application states the new impervious areas associated with the new bridge would be
treated by collection of stormwater runoff into existing and proposed stormwater Best Management
Practices (BMPs) within the northeast corner of the Love Grove neighborhood. The existing wet
detention pond would be reshaped to capture and treat some of the additional surface runoff. The
application also states that a proposed infiltration basin consisting of Class A rip rap would be
constructed within the highground area adjacent to the south side of One Tree Hill Way.
The new bridge has been designed to allow a vertical clearance of 13' to 15' above mean high water
(MHW) from the channel of Burnt Mill Creek underneath the bridge. The new bridge would have two
travel lanes with a multi -use path on the southern side of the bridge. The applicate also proposes to
excavate a portion of the remnant highground peninsula in an area measuring approximately 220' in
length and ranging from approximately 10' to 30' in width down to adjacent wetland elevations. The
application states this would result in the removal of approximately 850 cubic yards (CY) of upland
material, which would be transported to either the County landfill or utilized on -site for the project
(See Project Narrative and Sheets 1 through 5 of 6).
ANTICIPATED IMPACTS:
The proposed bridge would permanently shade approximately 2,340 sq. ft. of the Public Trust Area
of Burnt Mill Creek. No permanent impacts to any Section 404 or Coastal Wetlands are anticipated
with the project; however, the proposed bridge would shade approximately 12,000 sq. ft. of Section
404 and Coastal Wetlands. It is anticipated that the proposed removal of the high ground peninsula
would impact approximately 4,400 sq. ft. of upland area excavation. The projectwould also require
75,794 sq. ft. of high ground disturbance for the grading and paving of the new approaches to the
bridge and riprap. The navigable clearance under the bridge would be 13' to 15' above MHW of the
creek. A localized increase in turbidity can be expected during the in -water portions of the project
for the construction of the supporting structures for the new bridge.

It is the opinion of this office that the proposed project appears to be consistent with the Use
Standards for Coastal Wetlands in 07H.0205, the Use Standards for Public Trust Areas in 07H
.0207 & 07H .0208, the Use Standards for Coastal Shorelines in 07H.0209.
In the absence of any concerns from the commenting agencies, it is recommended that a permit
be issued including standard conditions for bridges, as well as the following notes:

This project is consistent and not in conflict with the 2006 Wilmington -New Hanover
County Joint Land Use Plan Update.
The applicant proposes to construct a new public bridge and associated infrastructure
over Burnt Mill Creek to provide additional access to the Love Grove Community in
Wilmington, New Hanover County.
Areas of Environmental Concern (AEC's) impacted by the proposal are PTA, PTS and
CW. Waters at the project site are classified as C; Sw and are not open to the harvesting
of shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover
County Joint Land Use Plan and offer the following comments.
The general area of the project is classified as Conservation.
In general, Wilmington -New Hanover County allows development in Conservation
classified AECs, which is consistent with the State's minimum use standards. The 2006
Wilmington -New Hanover County Joint Land Use Plan contains some policies, which
exceed the State's minimum use standards, including dredging policy. However, none of
these standards appear to be applicable to this proposal.
This project is consistent with the 2006 Wilmington -New Hanover County Joint Land

Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located at the end of
One Tree Hill Way and Creekfront Drive over Burnt Mill Creek in Wilmington, NC. Our comments are
provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through
113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and
Wildlife Coordination Act (48 Stat 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to construct a new public bridge and associated infrastructure in the Love Grove
community. The area impacted by the project is approximately 2.17 acres, 12,000 ft2 of which will be
shading of wetlands. Stormwater from the bridge would be treated within the existing stormwater
practices within the northeast corner of the community. Clearance under the proposed bridge will be 13'
to 15' above mean high water. Burnt Mill Creek is classified C Sw by the Environmental Management
Commission.
The NCWRC has reviewed the permit application and does not object to permit issuance. To minimize
impacts to aquatic resources that utilize the area, we request a turbidity curtain be installed during pile
installation.

with 44 CFR 60.3.d.3.
• Any new (or substantially improved) structures in the SFHA should be built according to code

• According to NCDPS e-mail dated 5/21/15, this area is shown outside of the floodway (Coastal

classified as fresh water, secondary recreation (C) and swamp (SW); and are closed to shellfish harvest.
It is recommended that turbidity curtain be placed around the all in -water bents during installation, and
do not significantly limit water flow ornavigation. The excavation of an upland peninsula to below MHW
should utilize an earthen berm during regrading to limit turbidity from entering the.system.

Please find attached the Corps' comments regarding the City of Wilmington's proposed Love Grove additional access
bridge. Based on the forwarded application package, the applicant does not need a permit under Section 404 of the
Clean Water Act; there are no tidal or non -tidal wetland impacts proposed other than piling placement. Generally, the
placement of pilings for bridge construction do not require a permit under Section 404 of the Clean Water Act.
The Corps is in receipt of a permit authorized under Section 9 of the Rivers and Harbors Act of 1899 (attached), issued by
the U.S. Coast Guard. Under a Memorandum of Agreement between the U.S. Coast Guard (USCG) and the Army Corps
of Engineers, the USCG has been delegated the authority to issue permits for bridges, or portions of bridges, that cross
navigable waters of the U.S. Because the proposed bridge crosses tidal Burnt Mill Creek, the USCG has jurisdiction to
issue the permit.
Because there are no proposed fill impacts in tidal or non -tidal wetlands, no further authorization from the Corps is
necessary. The Corps does not recommend any additional special conditions for the CAMA permit. If you have any

Coast Guard review of the proposed project as provided in an email dated January 29, 2016 from
Mr. Charles Benton withABCOM-North Caroline, on behalf of the City of Wilmington, is
complete. Based on the documentation provided it is determined that a formal Coast Guam
bridge permit will not be required for the proposed bridge across Northeast Cape Fear River, at
the =nth of Smith Creek, in New Hanover County, Wilmington, NC.
The project will be placed in our Advance Approval category as per Title 33 Code of Federal
Regulations Part 115.70. This Advance Approval determination is for the location and proposed
bridge across Northeast Cape Fear River and Is valid for five years, from the date of this letter.
If the construction project does not commence within this time ponied, you most contact this
office for reaffirmation of this authorization. Future bridge projects along the same waterway
will have to be independently evaluated before they may be considered for placement in the
Advance Approval category.
The fact that a Coast Guam bridge permit is not required does net relieve you of the
responsibility for compliance with the requirements of any other Federal, State, or local agency
who may have jurisdiction over any aspect of the project. Although the project will not require a
bridge permit, other areas of Coast Guard jurisdiction apply. The following must be met:
a. You or your contractor must notify this office at least 30 days in advance of the steal of
construction and any other work which may be an obstruction to navigmom, so we may
issue and update the information in our Local Notice to Mariners and monitor the project
b. At no time during the project will the waterway be closed to navigation without the prior
notification and approval of the Coast Guard.
c. The lowest portion of the superstructure of the bridge across the waterway should clear
the 100-yea flood height elevation, if feasible.
d. In addition, the requirement to display navigational lighting at the aforementioned bridge
is hereby waived, as per Title 33 Code of Federal Regulations, Part 118.40Cb). This
waiver may be rescinded at anytime in the future should nighttime navigation through the
proposed bridge he increased to a level determined by the District Commander to warrant
lighting.

property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could
result in an incomplete application.

Please find the attached permit application for a joint CAMA Major/Section 404 permit for the
construction of the proposed additional access road to the Love Grove residential community in
Wilmington, NC. Delineations of jurisdictional features were performed on November 4, 2015 by
AECOM personnel, with you participating on the latter date to specifically delineate CAMA features
(coastal wetlands and normal high water line). The project will consist of a new road continuing
west of One Tree Hill Road, connecting to Creekfront Street via an approximately 677 linear foot,
pile supported bridge spanning Burnt Mill Creek just south of its confluence with Smith Creek. No
impacts or discharges to jurisdictional waters of the US are proposed. The following documents
