`This permit, issued on April 27, 2016 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
to tines, imprisonment or civil action; or may cause the permit to be null and void.
Expanded Docking Facility
1) This permit authorizes only the dock extension, dolphin cluster, and other structures and uses located
in or over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this expanded docking
facility without permit modification. No non -water dependent uses of structures shall be conducted
on, in or over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
expanded docking facility. Any sewage discharge at the expanded docking facility shall be
considered a violation of this permit for which the permittee is responsible. This prohibition shall be
applied and enforced throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
cjualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
{, hereunder requires further Division approval.
= All work must cease when the permit expires on
December 31, 2019
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

t8 ADDITIONAL CONDITIONS
3) ' The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.

4), The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
! Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structures in order to make it them visible during hours of darkness or
inclement weather.
S) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.

No portion of the authorized structures shall be within the U.S. Army Corps of Engineers channel
setback.
7) , The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.

No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
• 10)-. This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
i which may be caused from existing or future operations undertaken by the United States in the public
interest.

i approvals or authorizations that may be required.

' NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Programmatic
! General Permit 198000291 and assigned SAW 201600543 which was issued 4/26/16.
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 3900 and assigned the project DWR Project No. 16-0250.
,NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
`NOTE: An application processing fee of $400 was received by DCM for this project.

Dear Mr. Trowell:
Enclosed is a Major CAMA permit application for the enlargement of an existing dock on
my property located at 199 Goshen Back road in the Town of Engelhard adjacent Far Creek. The
project also includes 1-4 pile dolphin cluster at the end of the 6' x 72' dock expansion. The dolphin
cluster is to protect the dock from barge traffic using the adjacent property as well as from
commercial trawlers using my dock. The adjacent landowner, Mr. Ben Simmons III has waived
the 15' riparian setback for the dolphin cluster and dock. This site provides mooring for
commercial fishing vessels selling to my wholesale commercial fishhouse, Williams Seafood,
located directly across Far Creek.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and
where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The
original (buff -colored form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Cardjust prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may
contact Department personnel at any time for assistance. By working in accordance with the permit, you
will be helping to protect our vitally important coastal resources.

adjacent Far Creek in Hyde County, North Carolina. The project site consists of two adjacent
parcels owned by Williams Seafood of Engelhard. One parcel is currently used as a harbor of
refuge for commercial fishing vessels with an existing man made basin, bulkhead and a 6' x 80'
dock. Commercial fishing vessels moor "side to" the bulkhead and dock. The second parcel
adjacent to and west of the aforementioned parcel, was formerly developed as Mount Pleasant
Church. This parcel has limited highground around the church building. There is a Coastal
Wetland marsh vegetated primarily with black needlerush Quncus roemerianus) between the
building and Far Creek. The west side of this parcel is bordered by another basin that extends
landward toward Goshen Road to an existing boat ramp. Flooding events from various hurricane
events damaged the church to the point that services were discontinued. Williams Seafood
purchased the property to expand their ability to moor commercial fishing vessels. The building
is used to store commercial fishing equipment.
Water depths in Far Creek adjacent to the existing dock are 6' to 7' below the normal water
level and deepen as you move offshore. Water depths in the Creek offshore the "church property"
are shallow (minus 2' to 3' below the NWL) adjacent to the Coastal Wetland marsh but deepen to
6' to 7' approximately 25' offshore in line with the existing dock to the east and bulkhead corner
on the neighboring property to the west. Water depths in the Federal channel offshore range from
12' to 14' below the NWL. The Federal channel offshore is maintained by the Wilmington District
US Army Corps of Engineers. The Federal channel setback line is approximately 29' offshore the
marsh shoreline. Far Creek is designated as Coastal Waters by the Marine Fisheries Commission
and SC HQW by the Environmental Management Commission. Far Creek is also designated as a
Primary Nursery Area by the NC Division of Marine Fisheries and is closed to shellfishing.
Project Description
The applicant proposes to extend the existing pile supported dock 6' wide x 72' long in a
westerly direction across the front of the second parcel with the church building. The dock will
align with the existing dock and the bulkhead corner on the neighboring property to the west. A
4-pile dolphin cluster is proposed on the end of the new dock to fend off trawlers during docking
activities. The neighboring property owner to the west has also requested the dolphin cluster to
assist barge traffic utilizing the neighboring property to the west. The adjacent western property
owner has waived the State required 15' setback from the riparian line. The purpose of extending
the existing dock is to provide additional "side to" mooring of commercial fishing vessels selling
to Williams Seafood located directly across Far Creek from the project site. The proposed dock
will be inshore and adjacent to the setback line off the Federal channel.

Enclosed is a Major CAMA permit application for the enlargement of an existing dock on
my property located at 199 Goshen Back road in the Town of Engelhard adjacent Far Creek. The
project also includes 1-4 pile dolphin cluster at the end of the 6' x 72' dock expansion. The dolphin
cluster is to protect the dock from barge traffic using the adjacent property as well as from
commercial trawlers using my dock. The adjacent landowner, Mr. Ben Simmons III has waived
the 15' riparian setback for the dolphin cluster and dock. This site provides mooring for
commercial fishing vessels selling to my wholesale commercial fishhouse, Williams Seafood,
located directly across Far Creek.

Enclosed is a Major CAMA permit application submitted by Mr. Sammie Williams of
Williams Seafood located in the Town of Engelhard off SR 1101 at 199 Goshen Back road adj acent
Far Creek in Hyde County, North Carolina. Mr. Williams is proposing to extend an existing dock
6' x 72' and construct a 4-pile dolphin cluster at the end of the dock. The purpose of the dock
enlargement is to provide additional "side to" mooring for commercial fishing vessels selling to
his wholesale/retail business located directly across Far Creek.
Far Creek has a federally maintained navigational channel. The eastern most extent of the
proposed dock will be positioned approximately 6' inshore of the ACOE Federal setback line and
the western end being immediately adjacent to the setback. The proposed dock is also within the
riparian setback on the western side of the project area. The applicant has obtained a waiver from
that affected property owner, Mr. Ben Simmons. Water depths adjacent the dock range from 6' to
7' suitable for wooden and small fiberglass trawlers, however they are not suitable for steel hull

Staff has reviewed the general and specific use standards for Estuarine Waters and Public
Trust Area specifically the use standards for pier and dock construction including
7H.0208(b)(6)(A)-(J) have determined that the proposal is consistent therefore Staff recommends
that the permit be issued. The $400 application fee has been deposited.

Hyde County, North Carolina.
Date: March 18, 2016
Consistency Determination: The request is consistent with/not in conflict with the Hyde
County CAMA Core Land Use Plan certified by the CRC on
March 28, 2008.
Overview: The subject property is a .54 acre lot with approximately 400 feet of shoreline
along Far Creek. Existing site improvements consist of former church building and driveway.
Existing shoreline improvements consists of a dock and bulkhead. The property has Coastal
Wetland marsh, vegetated primarily with black needle thrush (iuncus roemerianus) located
between the existing building and the creek.
The waters of Far Creek are classified as HOW/SC. This area of Far Creek is designated as a
Primary Nursery Area and is closed to the taking of shellfish. A review of Submerged Aquatic
Vegetation (SAV) and historic and archaeological resources was not provided.
Anticipated impacts resulting from this project are expected to include: the shading of 432 ftz
non -vegetated wetlands.
Basis for Determination:
The Hyde County Land Use Map (FLUM) designates the site as "Office and Institutional".
Preferred uses for this land use include "public and private office and institutional uses,
churches, meeting facilities, governmental facilities" (p 235). Non -preferred uses include
"residential uses, commercial operations, for profit service and office uses, uses that will have
adverse impacts on adjacent residential areas" (p 235).

We would not allow any construction with in the Setback of the channel. So as long as all the piles are outside of the
setback navigation would not have a problem with this project. it is hard to tell based on the provided drawing if any
construction is planned for inside the setback but we do not want any within the setback, thanks.

does grant, bargain, sell and convey unto the said parties of the second part, their heirs and
assigns, a certain lot or parcel of land located in the Village of Engelhard in Lake Landing
Township, Hyde County, North Carolina, which is more particularly described as follows:
BEGINNING at an iron stake in the edge of Far Creek, which
stake [narks the northeast corner of the Mount Pilgrim
Disciple Church lot; running thence in an eastward direction,
along the edge of Far Creek,126 feet to a point evidenced by
an iron post in the edge of said creek; running thence in a
southeast direction, 263 feet to the public road leading from
Engelhard to Middletown by way of Goshen; running thence
in a westward direction, with said road to an iron post which
marks the southeast comer of the aforesaid Mount Pilgrim
Church lot; running thence in a northwest direction, with the
line of said church lot, 272 feet to the point of beginning,
containing 0.63 of an acre, more or less.
This is the identical parcel of land described in a deed from Charlotte M. Neal
to Royden S. Neal, Jr., dated July 6, 1990, and of record in the Office of the Register of
Deeds of Hyde County, North Carolina, in Book 137 at page 477, which deed is made a part
hereof for the purpose of description.

privileges and appurtenances thereunto belonging or in anywise thereunto appertaining unto
them, the said parties of the second part, their heirs and assigns, to their only use and behoof
in fee simple absolute forever.
AND THE SAID party of the first part, does for himself and his heirs,
executors and administrators, covenant to and with the said parties of the Nicond part, their
hews and assigns, that h. is seized of said premises in fee and has a right to convey the same
in fee simple; that the same is free and clear from all encumbrances, except as set forth above,
and that he does hereby forever warrant and will forever defend the title to the same against

provided by law when such time is necessary to complete the review. If you have not been

Project Setting
The project site is located off SR 1101 at 199 Goshen Back Road in the Town of Engelhard
adjacent Far Creek in Hyde County, North Carolina. The project site consists of two adjacent
parcels owned by Williams Seafood of Engelhard. One parcel is currently used as a harbor of
refuge for commercial fishing vessels with an existing man made basin, bulkhead and a 6' x 80'
dock. Commercial fishing vessels moor "side to" the bulkhead and dock. The second parcel
adjacent to and west of the aforementioned parcel, was formerly developed as Mount Pleasant
Church. This parcel has limited bighground around the church building. There is a Coastal
Wetland marsh vegetated primarily with black needlerush (Juncus roemerianusl between the
building and Far Creek. The west side of this parcel is bordered by another basin that extends
landward toward Goshen Road to an existing boat ramp. Flooding events from various hurricane
events damaged the church to the point that services were discontinued. Williams Seafood
purchased the property to expand their ability to moor commercial fishing vessels. The building
is used to store commercial fishing equipment.
Water depths in Far Creek adjacent to the existing dock are 6' to 7' below the normal water
level and deepen as you move offshore. Water depths in the Creek offshore the "church property"
are shallow (minus 2' to 3' below the NWL) adjacent to the Coastal Wetland marsh but deepen to
6' to 7' approximately 25' offshore in line with the existing dock to the east and bulkhead corner
on the neighboring property to the west. Water depths in the Federal channel offshore range from
12' to 14' below the NWL. The Federal channel offshore is maintained by the Wilmington District
US Army Corps of Engineers. The Federal channel setback line is approximately 29' offshore the
marsh shoreline. Far Creek is designated as Coastal Waters by the Marine Fisheries Commission
and SC HQW by the Environmental Management Commission. Far Creek is also designated as a
Primary Nursery Area by the NC Division of Marine Fisheries and is closed to shellfishing.
Project Description
The applicant proposes to extend the existing pile supported dock 6' wide x 72' long in a
westerly direction across the front of the second parcel with the church building. The dock will
align with the existing dock and the bulkhead corner on the neighboring property to the west. A
4-pile dolphin cluster is proposed on the end of the new dock to fend off trawlers during docking
activities. The neighboring property owner to the west has also requested the dolphin cluster to
assist barge traffic utilizing the neighboring property to the west. The adjacent western property
owner has waived the State required 15' setback from the riparian line. The purpose of extending
the existing dock is to provide additional "side to" mooring of commercial fishing vessels selling
to Williams Seafood located directly across Far Creek from the project site. The proposed dock
will be inshore and adjacent to the setback line off the Federal channel.

Anticipated Impacts
The proposed project will increase boat traffic at this location and their associated impacts.
The dock will shade 432 ftz of Far Creek bottom. There will be some localized short-term turbidity
during pile driving activities.

Enclosed is a Major CAMA permit application for the enlargement of an existing dock on
my property located at 199 Goshen Back road in the Town of Engelhard adjacent Far Creek. The
project also includes 1-4 pile dolphin cluster at the end of the 6' x 72' dock expansion. The dolphin
cluster is to protect the dock from barge traffic using the adjacent property as well as from
commercial trawlers using my dock. The adjacent landowner, Mr. Ben Simmons III has waived
the 15' riparian setback for the dolphin cluster and dock. This site provides mooring for
commercial fishing vessels selling to my wholesale commercial fishhouse, Williams Seafood,
located directly across Far Creek.

The project site is located off SR 1101 at 199 Goshen Back Road in the Town of Engelhard
adjacent Far Creek in Hyde County, North Carolina. The project site consists of two adjacent
parcels owned by Williams Seafood of Engelhard. One parcel is currently used as a harbor of
refuge for commercial fishing vessels with an existing man made basin, bulkhead and a 6' x 80'
dock. Commercial fishing vessels moor "side to" the bulkhead and dock. The second parcel
adjacent to and west of the aforementioned parcel, was formerly developed as Mount Pleasant
Church.. This parcel has limited highground around the church building. There is a Coastal
Wetland marsh vegetated primarily with black needlerush (Juncus roemerianus) between the
building and Far Creek. The west side of this parcel is bordered by another basin that extends
landward toward Goshen Road to an existing boat ramp. Flooding events from various hurricane
events damaged the church to the point that services were discontinued. Williams Seafood
purchased the property to expand their ability to moor commercial fishing vessels. The building
is used to store commercial fishing equipment.
Water depths in Far Creek adjacent to the existing dock are 6' to 7' below the normal water
level and deepen as you move offshore. Water depths in the Creek offshore the "church property"
are shallow (minus 2' to 3' below the NWL) adjacent to the Coastal Wetland marsh but deepen to
6' to 7' approximately 25' offshore in line with the existing dock to the east and bulkhead corner
on the neighboring property to the west. Water depths in the Federal channel offshore range from
12' to 14' below the NWL. The Federal channel offshore is maintained by the Wilmington District
US Army Corps of Engineers. The Federal channel setback line is approximately 29' offshore the
marsh shoreline. Far Creek is designated as Coastal Waters by the Marine Fisheries Commission
and SC HQW by the Environmental Management Commission. Far Creek is also designated as a
Primary Nursery Area by the NC Division of Marine Fisheries and is closed to shellfishing.
Project Description
The applicant proposes to extend the existing pile supported dock 6' wide x 72' long in a
westerly direction across the front of the second parcel with the church building. The dock will
align with the existing dock and the bulkhead corner on the neighboring property to the west. A
4-pile dolphin cluster is proposed on the end of the new dock to fend off trawlers during docking
activities. The neighboring property owner to the west has also requested the dolphin cluster to
assist barge traffic utilizing the neighboring property to the west. The adjacent western property
owner has waived the State required 15' setback from the riparian line. The purpose of extending
the existing dock is to provide additional "side to" mooring of commercial fishing vessels selling
to Williams Seafood located directly across Far Creek from the project site. The proposed dock
will be inshore and adjacent to the setback line off the Federal channel. RECEIVED

Enclosed is a Major CAMA permit application for the enlargement of an existing dock on
my property located at 199 Goshen Back road in the Town of Engelhard adjacent Far Creek. The
project also includes 1-4 pile dolphin cluster at the end of the 6' x 72' dock expansion. The dolphin
cluster is to protect the dock from barge traffic using the adjacent property as well as from
commercial trawlers using my dock. The adjacent landowner, Mr. Ben Simmons III has waived
the 15' riparian setback for the dolphin cluster and dock. This site provides mooring for
commercial fishing vessels selling to my wholesale commercial fishhouse, Williams Seafood,
located directly across Far Creek.
