Any violation of these terms may to tines, imprisonment or civil action; or may cause the permit to be null and void. Expanded Docking Facility 1) This permit authorizes only the dock extension, dolphin cluster, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this expanded docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the expanded docking facility. Any sewage discharge at the expanded docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other cjualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered {, hereunder requires further Division approval. = All work must cease when the permit expires on December 31, 2019 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. t. 4), The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. ! Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structures in order to make it them visible during hours of darkness or inclement weather. S) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 3900 and assigned the project DWR Project No. 16-0250. ,NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The project also includes 1-4 pile dolphin cluster at the end of the 6' x 72' dock expansion. The dolphin cluster is to protect the dock from barge traffic using the adjacent property as well as from commercial trawlers using my dock. The adjacent landowner, Mr. Ben Simmons III has waived the 15' riparian setback for the dolphin cluster and dock. This site provides mooring for commercial fishing vessels selling to my wholesale commercial fishhouse, Williams Seafood, located directly across Far Creek. The project site consists of two adjacent parcels owned by Williams Seafood of Engelhard. One parcel is currently used as a harbor of refuge for commercial fishing vessels with an existing man made basin, bulkhead and a 6' x 80' dock. Commercial fishing vessels moor "side to" the bulkhead and dock. The second parcel adjacent to and west of the aforementioned parcel, was formerly developed as Mount Pleasant Church. This parcel has limited highground around the church building. There is a Coastal Wetland marsh vegetated primarily with black needlerush Quncus roemerianus) between the building and Far Creek. The west side of this parcel is bordered by another basin that extends landward toward Goshen Road to an existing boat ramp. Flooding events from various hurricane events damaged the church to the point that services were discontinued. Williams Seafood purchased the property to expand their ability to moor commercial fishing vessels. The building is used to store commercial fishing equipment. Water depths in Far Creek adjacent to the existing dock are 6' to 7' below the normal water level and deepen as you move offshore. Water depths in the Creek offshore the "church property" are shallow (minus 2' to 3' below the NWL) adjacent to the Coastal Wetland marsh but deepen to 6' to 7' approximately 25' offshore in line with the existing dock to the east and bulkhead corner on the neighboring property to the west. Water depths in the Federal channel offshore range from 12' to 14' below the NWL. The Federal channel offshore is maintained by the Wilmington District US Army Corps of Engineers. The Federal channel setback line is approximately 29' offshore the marsh shoreline. Far Creek is designated as Coastal Waters by the Marine Fisheries Commission and SC HQW by the Environmental Management Commission. The purpose of the dock enlargement is to provide additional "side to" mooring for commercial fishing vessels selling to his wholesale/retail business located directly across Far Creek. Far Creek has a federally maintained navigational channel. The eastern most extent of the proposed dock will be positioned approximately 6' inshore of the ACOE Federal setback line and the western end being immediately adjacent to the setback. The proposed dock is also within the riparian setback on the western side of the project area. The applicant has obtained a waiver from that affected property owner, Mr. Ben Simmons. RECEIVED MAR 11 2016 DCM- MHD CITY 2 Williams Seafood Town of Engelhard Far Creek Hyde County Project Setting The project site is located off SR 1101 at 199 Goshen Back Road in the Town of Engelhard adjacent Far Creek in Hyde County, North Carolina. The project site consists of two adjacent parcels owned by Williams Seafood of Engelhard. One parcel is currently used as a harbor of refuge for commercial fishing vessels with an existing man made basin, bulkhead and a 6' x 80' dock. Commercial fishing vessels moor "side to" the bulkhead and dock. The second parcel adjacent to and west of the aforementioned parcel, was formerly developed as Mount Pleasant Church. This parcel has limited bighground around the church building. There is a Coastal Wetland marsh vegetated primarily with black needlerush (Juncus roemerianusl between the building and Far Creek. The west side of this parcel is bordered by another basin that extends landward toward Goshen Road to an existing boat ramp. Flooding events from various hurricane events damaged the church to the point that services were discontinued. Williams Seafood purchased the property to expand their ability to moor commercial fishing vessels. The building is used to store commercial fishing equipment. Water depths in Far Creek adjacent to the existing dock are 6' to 7' below the normal water level and deepen as you move offshore. Water depths in the Creek offshore the "church property" are shallow (minus 2' to 3' below the NWL) adjacent to the Coastal Wetland marsh but deepen to 6' to 7' approximately 25' offshore in line with the existing dock to the east and bulkhead corner on the neighboring property to the west. Water depths in the Federal channel offshore range from 12' to 14' below the NWL. The Federal channel offshore is maintained by the Wilmington District US Army Corps of Engineers. The Federal channel setback line is approximately 29' offshore the marsh shoreline. Far Creek is designated as Coastal Waters by the Marine Fisheries Commission and SC HQW by the Environmental Management Commission. Far Creek is also designated as a Primary Nursery Area by the NC Division of Marine Fisheries and is closed to shellfishing. Project Description The applicant proposes to extend the existing pile supported dock 6' wide x 72' long in a westerly direction across the front of the second parcel with the church building. The dock will align with the existing dock and the bulkhead corner on the neighboring property to the west. A 4-pile dolphin cluster is proposed on the end of the new dock to fend off trawlers during docking activities. The neighboring property owner to the west has also requested the dolphin cluster to assist barge traffic utilizing the neighboring property to the west. The adjacent western property owner has waived the State required 15' setback from the riparian line. The purpose of extending the existing dock is to provide additional "side to" mooring of commercial fishing vessels selling to Williams Seafood located directly across Far Creek from the project site. The proposed dock will be inshore and adjacent to the setback line off the Federal channel. I Williams Seafood Town of Engelhard Far Creek Hyde County Project Setting The project site is located off SR 1101 at 199 Goshen Back Road in the Town of Engelhard adjacent Far Creek in Hyde County, North Carolina. The project site consists of two adjacent parcels owned by Williams Seafood of Engelhard. One parcel is currently used as a harbor of refuge for commercial fishing vessels with an existing man made basin, bulkhead and a 6' x 80' dock. Commercial fishing vessels moor "side to" the bulkhead and dock. The second parcel adjacent to and west of the aforementioned parcel, was formerly developed as Mount Pleasant Church.. This parcel has limited highground around the church building. There is a Coastal Wetland marsh vegetated primarily with black needlerush (Juncus roemerianus) between the building and Far Creek. The west side of this parcel is bordered by another basin that extends landward toward Goshen Road to an existing boat ramp. Flooding events from various hurricane events damaged the church to the point that services were discontinued. Williams Seafood purchased the property to expand their ability to moor commercial fishing vessels. The building is used to store commercial fishing equipment. Water depths in Far Creek adjacent to the existing dock are 6' to 7' below the normal water level and deepen as you move offshore. Water depths in the Creek offshore the "church property" are shallow (minus 2' to 3' below the NWL) adjacent to the Coastal Wetland marsh but deepen to 6' to 7' approximately 25' offshore in line with the existing dock to the east and bulkhead corner on the neighboring property to the west. Water depths in the Federal channel offshore range from 12' to 14' below the NWL. The Federal channel offshore is maintained by the Wilmington District US Army Corps of Engineers. The Federal channel setback line is approximately 29' offshore the marsh shoreline. Far Creek is designated as Coastal Waters by the Marine Fisheries Commission and SC HQW by the Environmental Management Commission. Far Creek is also designated as a Primary Nursery Area by the NC Division of Marine Fisheries and is closed to shellfishing. Project Description The applicant proposes to extend the existing pile supported dock 6' wide x 72' long in a westerly direction across the front of the second parcel with the church building. The dock will align with the existing dock and the bulkhead corner on the neighboring property to the west. A 4-pile dolphin cluster is proposed on the end of the new dock to fend off trawlers during docking activities. The neighboring property owner to the west has also requested the dolphin cluster to assist barge traffic utilizing the neighboring property to the west. The adjacent western property owner has waived the State required 15' setback from the riparian line. The purpose of extending the existing dock is to provide additional "side to" mooring of commercial fishing vessels selling to Williams Seafood located directly across Far Creek from the project site. The proposed dock will be inshore and adjacent to the setback line off the Federal channel.
