This permit, issued on July 21, 2016 , is subject to compliance with the application (where consistent with
the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines,

Reconfigured Docking Facility
1) This permit authorizes the construction of the enlargement of an existing platform, relocation of a
floating jet ski platform, and construction of a finger pier around an existing lift, and uses located in
or over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this reconfigured docking
facility without permit modification. No non -water dependent uses of structures shall ba conducted
on, in or over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
reconfigured docking facility. Any sewage discharge at the reconfigured docking facility shall be
considered a violation of this permit for which the permittee is responsible. This prohibition shall be
applied and enforced throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2019
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3); This permit authorizes a maximum of three (3) formalized boat slips.
The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation
within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is
not authorized. This prohibition shall be applied and enforced throughout the entire existence of the
permitted structure.
The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
The reconfigured docking facility and associated structures shall have a minimum setback distance of 15
feet between any parts of the structure and the adjacent property owner's riparian access corridor, which
is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel
line that -intersects with the shore at the point where the upland property line meets the water's edge.
The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structures in order to make it more visible during hours of darkness or
inclement weather.
No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
General
The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.

ADDITIONAL CONDITIONS
The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 3900 and assigned the project DWR Project No. 20160476.
NOTE: The permittee is advised that any development or land disturbing activity that is considered non-
r water dependent is not authorized within 50 feet of the normal water level unless specifically
exempted by Environmental Management Commission (EMC) Tar Pamlico River buffer
regulations in place at the time of such development.
NOTE: An application processing fee of $250 was received by DCM for this project.

Purpose

The platform enlargement is to accommodate the large amount of family and friends that use this
dock. The addition of the walkway around the boat lift for the east of washing of the boat and to allow
the jet skis to used in deeper water. The platform and walkway will be used only for private use only.
The platform and walkway will not extend any further out than the existing pier. The project is located on
wright's creek and will not affect any navigation of any boat traffic. There is enough distance from the
adjacent property owners so that it will not affect their view or interfere with the setback lines.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and
where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The
original (buff -colored form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.

Enclosed is a Major CAMA permit application for the construction of a 15' x 15' platform, a 5' x 40'
finger pier and the relocation of a floating jet ski platform at an existing single family pier/mooring system
onsite the applicants property located at 180 Tate Road adjacent the South Prong of Wrights Creek near
Belhaven in Beaufort County, North Carolina. The proposed 15' x 15' platform will result in a new platform
with a dimension of 27' x 20' which exceeds the maximum size platform allowed on a CAMA General
permit per specific condition 7H.1205(f). Therefore, the applicant is seeking authorization through the Major
CAMA permit process,
Washington staff has reviewed the project per the use standards found in 7H.0208 specifically
7H.0208(6)(A)-(J) and have determined the project proposal to be consistent with the Coastal Resource
Commission's rules. Therefore, staff recommends issuance of the permit with the standard permit
conditions for the proposed development. The $250 permit application fee has been deposited.

Consistency Determination: The request is consistent with/not in conflict the Beaufort County Joint
Land Use Plan 2006 Update certified by the CRC on January 13, 2010,
provided that the project meets the policy requirements outlined for
development located in flood zones (see policy 2.2.3 and 4.4 attached).
Overview: The project site is located at 180 Tate Rd Belhaven, NC 27810; adjacent to Wrights Creek off
the Pungo River in Beaufort County. The proposed project includes the enlargement of an existing
platform to 15' x 15', relocation of a floating drive on jet ski platform and the construction of a 5' x 40'
finger pier around an existing boatlift.
Existing site improvements include the following: a single family residence with a gravel driveway and
parking, bulkhead stabilization of the entire shoreline, a 5' x 52' pier with a 12' x 20' L-shaped covered
platform, floating double jet ski platform, and a 13' x 13' open boat lift. Upland vegetation includes
loblolly pines and maintained lawn grasses.
The project site is located adjacent to Wrights Creek, and has a surface water classifications of SA
(Market Shellfishing, Salt Water), HQW (High Quality Waters), and NSW (Nutrient Sensitive Waters).
This portion of Wrights Creek is designated as Primary Nursery Area, and is closed to the taking of
shellfish. No review of SAV (Submerged Aquatic Vegetation) was provided. The project is located in
flood zone AE, a Special Flood Hazard Area according to the FEMA Flood Insurance Rate Map. A review
of archaeological resources was not provided.
Anticipated impacts resulting from this project are expected to include the shading of 1,090 ft2 of
Wrights Creek bottom. This square footage does not include the 5' x 25' pier to access the enlarged
platform.

Basis for Determination:
The project is subject to the Beaufort County Joint Land Use Plan 2006 Update. The counties Future
Land Use Map (FLUM) classifies the site as:
Conservation II Overlay: "The Conservation II classification is as an overlay that applies policies to guide
development in all of the non -conservation land classes. The classification helps local governments in
the planning area to mitigate risks to life and property associated with storm and flood hazards. The
overlay includes the coastal shoreline AECs with rules that protect stream margins and water quality.
And, the classification offers a higher level of protection for functional but less essential non -coastal
wetlands. The Conservation II Classification is an overlay that places additional limitations on the
compatible uses and activities of the underlying land classifications. The Conservation II Classification
overlays approximately 175,000 acres in the Agriculture -Forestry -Rural Housing, Transition, and Towns
and Community Centers classifications" (pg III-39).
Agriculture -Forestry -Rural -Housing: "The Agriculture -Forestry -Rural Housing classification provides for
the preservation of the planning area's farming and forestry and its rural housing and hamlets, and it
provides a reserve area for more intensive uses in the future. These areas are key to preserving the
planning area's farming and forestry that remain a major part of Beaufort County's economic base and
to preservation of its rural landscape that is essential to the lifestyle of the planning area. The
classification also anticipates continuation of extractive activities centered in the Aurora area. Public
sewer service will not be provided in this land classification during the planning period unless it
addresses a public health problem or it supports a job creating opportunity" (pg III-43).

shoreline AEC and the public trust shoreline AEC (15A NCAC 07H .0209(d)) is allowed.
2.2.3, page III-13: Development in any flood hazard zone delineated on a Beaufort County FIRM or in
an area that is subject to storm inundation as illustrated on Beaufort County storm surge maps must
meet the location and construction requirements of the Beaufort County Flood Damage Prevention
Ordinance.
4.0 Policies for Natural Hazard Areas
4.4, page III-26: The local governments allow development within special flood hazard areas and
redevelopment following a disaster that is consistent with requirements of the National Flood
Insurance Program, CAMA minimum use III-27 standards, the North Carolina Building Code, and local
Floodplain Regulations. Special flood hazard areas are those areas shown on the Flood Insurance Rate
Maps (FIRM) as having a one- percent chance of flooding in any year.

On May 10,_2016, the Washington Regional Office of the Division of Energy, ,Mineral, and Land
Resources received a copy ofyour CAMA Major application for a pier/deck project located at 180 Tate
Road in the Pamlico Beach community near Belhaven, NC. Staff review of the plans and specifications
has determined that the project, as proposed, consists of activities that will not pose surface water
quality threats from.stormwater runoff since no new impervious area is proposed.
The Director has determined that projects that are reviewed and approved by the Division as not posing
water quality threats from stormwater runoff should not be subject to the stormwater management
permitting requirements of iSA NCAC 21-1.1000. For this reason,, we are informing you byway of this
letter that your project will not require a State Stormwater management permit at this time,
The stormwater rules require the Division to permit the common plan of development, therefore, any
future development on the property, regardless of whether a SEC plan or CAMA Major permit is also
required, will requirela Stormwater Management Permit application and permit issuance from the
Division of Energy, Mineral, and Land Resources prior to any construction. Any construction on the.
subject site, prior to receipt of the required permit, will constitute a violation of 1SA NCAC 21-1.1000
and may result in appropriate enforcement actions by this Office.

SUBJECT: CAMA Dredge/Fill Permit Application for Mark Weitzel, Beaufort County,
North Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located at 180 Tate
Road adjacent to Wrights Creek near Pamlico Beach, NC. Our comments are provided in accordance with
provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended,
Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act
(48 Stat 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to enlarge an existing platform by constructing a 15' by 15' addition adjacent and
inshore the existing 12' by 20' L-shaped cover platform, relocating a floating drive on jet -ski platform,
and constructing a 5' wide access pier around an existing boatlift. Waterdepths near the expanded
platform area are -5' NWL and lower. The South Prong of Wrights Creek is classified SA HWQ NSW by
the Environmental Management Commission and is designated a primary nursery area (PNA) by the NC
Wildlife Resources Commission.
The NCWRC has reviewed the permit application and requests the size of the expanded platform be
minimized from its current proposal The expanded design would shade 1,090 ftZ of creek bottom, not
including the area shaded by the 5' by 25' access pier. This area is known to have submerged aquatic
vegetation SAV) and shading of the area would limit the ability of the vegetation to flourish. SAV
provides important foraging and habitat opportunities as well as improves water quality, especially in
PNA systems: "We do not object to the relocation of the floating jet -ski platform or the 5' wide access pier
around the boatlifts, but believe reduction in the 15' by 15' platform would minimize shading impacts,
and therefore minimize impacts to SAV and the PNA.

Project Setting DCpq_ MHD CITY
The 0.72 acre project site is located off SR 1729 at 180 Tate Road adjacent the South Prong
of Wrights Creek near Belhaven in Beaufort County, North Carolina. The private properties along
the Tate road are developed as single family residential. The project site is developed with a single
family residence and associated gravel driveway and parking. The developed uplands are f3'
above the normal water level (NWL). The uplands are vegetated with loblolly pines and
maintained lawn grasses. The entire shoreline on this lot is stabilized with a bulkhead. There is a
5' wide x 52' pier with a 12' x 20' L-shaped covered platform and a 13' x 13' open boatlift that
was authorized by CAMA General permit no. 53538-B issued on 22 May 2009. There is also a
two stall floating jet ski dock/platform that was allowed to remain as part of the resolution of a
compliance action by this Division in 2011.
The water depths in the project area range from minus 2.5' at the bulkhead to minus 6.0'
below the NWL at the end of the existing pier. The South Prong of Wrights Creek is designated
as Inland Waters and Primary Nursery Area by the Wildlife Resources Commission and SA HQW
NSW by the Environmental Management Commission. Wrights Creek is closed to shellfishing.
Project Description
The applicant proposes to enlarge the existing platform by constructing a 15' x 15' addition
adjacent and inshore the existing 12' x 20' L-shaped covered platform and the 5' wide access pier.
This configuration will result in a total platform size 27' x 20'. The applicant proposes to construct
a 5' x 40' finger pier from the new platform across the inshore opening to the existing open boatlift
and then up the west side. The existing floating jet ski dock/platform will be relocated adjacent
the west side of the new finger pier.
Anticipated Impacts
The additional 15' x 15' platform and 5' x 40' finger pier will combine with the other
existing pier/mooring facilities to shade 1,090 ftz of Wrights Creek bottom. This square footage
does not include the 5' x 25' pier to access the enlarged platform.

construct a platform, walkway, and moving of jet ski platform. The pier is located on
180 Tate Road (Mark Weitzel) property. The property is located at 180 Tate Road. The

you may request a meeting with the Director of the Division of Coastal Management and permit

project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property, or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.

The 0.72 acre project site is located off SR 1729 at 180 Tate Road adjacent the South Prong
of Wrights Creek near Belhaven in Beaufort County, North Carolina. The private properties along
the Tate road are developed as single family residential. The project site is developed with a single
family residence and associated gravel driveway and parking. The developed uplands are t3'
above the normal water level (NWL). The uplands are vegetated with loblolly pines and
maintained lawn grasses. The entire shoreline on this lot is stabilized with a bulkhead. There is a
5' wide x 52' pier with a 12' x 20' L-shaped covered platform and a 13' x 13' open boatlift that
was authorized by CAMA General permit no. 53538-B issued on 22 May 2009. There is also a
two stall floating jet ski dock/platform that was allowed to remain as part of the resolution of a
compliance action by this Division in 2011.
The water depths in the project area range from minus 2.5' at the bulkhead to minus 6.0'
below the NWL at the end of the existing pier. The South Prong of Wrights Creek is designated
as Inland Waters and Primary Nursery Area by the Wildlife Resources Commission and SA HQW
NSW by the Environmental Management Commission. Wrights Creek is closed to shellfishing.
Project Description
The applicant proposes to enlarge the existing platform by constructing a 15' x 15' addition
adjacent and inshore the existing 12' x 20' L-shaped covered platform and the 5' wide access pier.
This configuration will result in a total platform size 27' x 20'. The applicant proposes to construct
a 5' x 40' finger pier from the new platform across the inshore opening to the existing open boatlift
and then up the west side. The existing floating jet ski dock/platform will be relocated adjacent
the west side of the new finger pier.
Anticipated Impacts
The additional 15' x 15' platform and 5' x 40' finger pier will combine with the other
existing pier/mooring facilities to shade 1,090 ft2 of Wrights Creek bottom. This square footage
does not include the 5' x 25' pier to access the enlarged platform.

The platform enlargement is to accommodate the large amount of famiPy friends that use this
dock. The addition of the walkway around the boat lift for the east of washing of the boat and to allow
the jet skis to used in deeper water. The platform and walkway will be used only for private use only.
The platform and walkway will not extend any further out than the existing pier. The project is located on
wright's creek and will not affect any navigation of any boat traffic. There is enough distance from the
adjacent property owners so that it will not affect their view or interfere with the setback lines.

To the adjacent property owner, I John A. Johnston & Son, is planning to
construct a platform, walkway, and moving of jet ski platform. The pier is located on
180 Tate Road (Mark Weitzel) property. The property is located at 180 Tate Road. The
platform size is 15' wide by 20' long. This platform will be located on the north side
(facing the water) of his property in the wrights creek. This construction of this platform,
walkway and Jet Ski relocation will have no effect on boat travel on the creek. If you
