This permit, issued on January 30, 2018 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may De suoJecl to Imes, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization — Bulkhead and Rio Rau 1) Unless specifically altered herein, this Minor Modification authorizes the bulkhead realignment and rip rap placement, all as expressly and specifically set forth in the attached letter and workplan drawings. Any additional development activities may require a modification of this permit. Upland Development 2) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the single-family home realignment, including the retaining wall realignment and other associated infrastructure, all as expressly and specifically set forth in the attached permit application and workplan drawings. (See attached sheet for additional conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2019 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee :rt Webb & Gail Plucker Permit No. 88-16 Page 2 of 2 ADDITIONAL CONDITIONS Mitigation In order to compensate for impacts associated with this permit modification, mitigation was provided in accordance with the provisions as outlined in the attached U.S. Army Corps of Engineers (USACE), Wilmington District Compensatory Mitigation Responsibility Transfer Form dated 8/1/16. The modification documents a reduction in impacts and therefore the permitte shall coordinate with the USACE to document any reduction in required mitigation. It's a minor mod in Duck for a bulkhead that was pulled back significantly due to issues with the Town. The fill has been reduced to approx. 166.5ft2 of 404 fill, but there is mitigation though Great Dismal Swamp so I wanted to make sure you all had time to comment. Please find attached a revised plat dated November 17, 2017 to reflect the modification to realign the approved bulkhead alignment to an average of two feet waterward of the existing bulkhead (no more than five feet at any point), realign the north and south return walls so that rock rip -rap can be placed and remain within the previously authorized fill alignment and relocation of the house to the east. This request is made, in part, due to the urging of the Town of Duck Town Council to address their concerns regarding potential impacts to the adjacent riparian property owners. I have also enclosed the approval letter from the Four Seasons Architect Control Committee authorizing the consent to relocate the single-family residence at Lot 127 — Four Seasons Duck. The resulting fill in Section 404 Wetlands will be reduced from +/- 1,210 s.f. to +/- 116.5 s.f. This lot with elevations of approximately 16 feet above the normal water level was bulkheaded and backfilled before 2002. A 5.5 foot high by 35.5 foot long retaining wall adjacent to the bulkhead retains fill associated with the swimming pool. Series of storms and the age of the bulkhead (now exceeding 14 years) have resulted in failure of the shoreline stabilization and retaining wall in part due to the tremendous burden of the house, pool, and appurtenant structures. This application is to promote a replacement location for the new vinyl bulkhead which will stabilize the site and withstand the tremendous forces exerted upon it, relocate the house 13 feet to the east to allow adequate room for deadman installation, and repair the retaining wall. The applicant requested establishment of the normal water line by the NCDCM and Section 404 wetlands by the U.S. Army Corps of Engineers which is depicted on the plat. An engineer was employed to design the bulkhead and advise on the alignment for construction based on these physical features and sound engineering practices. These efforts have resulted in the proposed bulkhead alignment which will average 2 feet waterward of the normal water line and in +/- 7 cubic yards of sand to be placed below normal water level (approximately 1 foot deep). The area to be filled below NWL does not support SAVs. The maximum distance of the bulkhead alignment waterward of NWL is 5 feet. Rock rip -rap will be placed at the north and south ends of the bulkhead to avoid impacts to adjoining bulkheads. This alignment is justified by sound engineering practices to provide a stable shoreline erosion control measure which can withstand the onslaught of wave energy and support the burden (surcharged) from the single-family structure and appurtenant structures. This new alignment requires the relocation of the structure 13 feet to the east so that adequate tiebacks can be installed. The alignment will result in fill being placed in +/- 116.50 s.f. of Section 404 wetlands which are proposed to be mitigated by purchase of wetland credits from the Great Dismal Swamp Restoration Bank at a 2:1 ratio (see attached). The resulting area between the old dilapidated bulkhead and the new will be filled with clean material and landscaped. When the owners purchased the property in April of 2015 (reference Deed Book 2014, Page 0709), the extent of condition of the structure(s) was not evident. Subsequent analysis of the structure(s) by Mr. Bryan R. Weisbecker, General Contractor, revealed that "the structure is out of level and has a common lean to the west" Mr. Michael O'Steen, P.E. was engaged to determine remedies which included construction of "a bulkhead placed westward of the existing wall(s)." A site plan was developed which proposed the new bulkhead be constructed 20 feet waterward of the existing (failing) bulkhead. CAMA Major Development Permit #88-16 was issued to authorize the alignment. The permitted alignment also required approvals by Special Exception to Town Code 156.128 et. seq. (fill exceeding three feet in height) and a Zoning Variance application from Town Code 156.037(D)(5) (fill in wetlands in the Ocean and Sound Overlay District). The request for the Special Exception was denied February 1, 2017. Since both approvals were necessary, the request for Zoning Variance was tabled. The owners and their representatives began coordination with the Town of Duck staff (staff) to seek a compromise. The owners were advised by the staff that a bulkhead alignment of two feet (average) waterward of the existing bulkhead not exceeding five feet would be approved administratively. in order to construct a bulkhead along this alignment that had adequate tiebacks for the bulkhead would require relocating the existing house 13 feet to the east of its current alignment. During the relocation, the house pilings could be reinstalled vertically, the house renovated to remove damage from the failure of the existing pilings, and construction of a new retaining wall and walkways installed on the east. Essentially, the proposal is to lift the existing structure(s) and place them in the same orientation 13 feet to the east. This realignment would result in removal of no trees as defined in Section I I(a) and remain in reasonable alignment with adjoining residences (See Figure 1).
