Minor mod distribution
Morning all,
FYI, I sent out a minor mod for re -circulation today for Robert Webb and Gail Plucker (CAMA #88-16,
SAW#2016-01474). You might remember this project back in May for a bulkhead and rip rap wing walls, filling 404. Due
to concerns from the Town of Duck they have reconfigured the project to what is being distributed today. Narrative,
oversized plans and a mitigation letter is provided in the packet. With the Holidays near I would ask that you provide
comments by January 5". If you need additional time just let me know.
Thanks everyone for the assistance,
Gregg

Hey Greg,
If the impacts are less and still have an approved mitigation option we are good to go as long as they satisfy their
mitigation requirement. I have attached another copy of the mitigation transfer form. Once the applicant has paid
GDSRB, just shoot me the confirmation so we can make note of the different amount in the file. Let me know if you
have any questions. Thanks!

Morning Josh,
Sorry to keep bothering you but I've been getting regular calls from the agent about this one. It's a minor mod
in Duck for a bulkhead that was pulled back significantly due to issues with the Town. The fill has been reduced to
approx. 166.5ft2 of 404 fill, but there is mitigation though Great Dismal Swamp so I wanted to make sure you all had
time to comment. Let me know if there is anything I can do.

Attn: Mr. Gregg Bodnar

Morehead City, NC 28557
Dear Mr. Bodnar,
This letter is with reference to CAMA Major Development Permit #88-16, Robert Webb and Gail Plucker.
Please find attached a revised plat dated November 17, 2017 to reflect the modification to realign the
approved bulkhead alignment to an average of two feet waterward of the existing bulkhead (no more than
five feet at any point), realign the north and south return walls so that rock rip -rap can be placed and remain
within the previously authorized fill alignment and relocation of the house to the east. This request is made,
in part, due to the urging of the Town of Duck Town Council to address their concerns regarding potential
impacts to the adjacent riparian property owners. I have also enclosed the approval letter from the Four
Seasons Architect Control Committee authorizing the consent to relocate the single-family residence at Lot
127 — Four Seasons Duck. The resulting fill in Section 404 Wetlands will be reduced from +/- 1,210 s.f. to
+/- 116.5 s.f. Please find attached the commitment letter from The Great Dismal Swamp Restoration Bank,
LLC to provide mitigation credits for this unavoidable loss.
Thank you for your expeditious consideration of this request for a minor modification to CAMA Major
Development Permit #88-16.
Sincerely,

NARRATIVE
Robert Webb and Gail Plucker purchased Lot 127, Four Seasons in Duck, April of 2015. This property
located at 1166 Duck Road in Duck, North Carolina was improved in 2002 as a six bedroom single-family
residence. This lot with elevations of approximately 16 feet above the normal water level was bulkheaded
and backfilled before 2002. A 5.5 foot high by 35.5 foot long retaining wall adjacent to the bulkhead
retains fill associated with the swimming pool.
Series of storms and the age of the bulkhead (now exceeding 14 years) have resulted in failure of the
shoreline stabilization and retaining wall in part due to the tremendous burden of the house, pool, and
appurtenant structures. This application is to promote a replacement location for the new vinyl bulkhead
which will stabilize the site and withstand the tremendous forces exerted upon it, relocate the house 13 feet
to the east to allow adequate room for deadman installation, and repair the retaining wall.
The applicant requested establishment of the normal water line by the NCDCM and Section 404 wetlands
by the U.S. Army Corps of Engineers which is depicted on the plat. An engineer was employed to design
the bulkhead and advise on the alignment for construction based on these physical features and sound
engineering practices.
These efforts have resulted in the proposed bulkhead alignment which will average 2 feet waterward of the
normal water line and in +/- 7 cubic yards of sand to be placed below normal water level (approximately
1 foot deep). The area to be filled below NWL does not support SAVs. The maximum distance of the
bulkhead alignment waterward of NWL is 5 feet. Rock rip -rap will be placed at the north and south ends of
the bulkhead to avoid impacts to adjoining bulkheads.
This alignment is justified by sound engineering practices to provide a stable shoreline erosion control
measure which can withstand the onslaught of wave energy and support the burden (surcharged) from the
single-family structure and appurtenant structures. This new alignment requires the relocation of the
structure 13 feet to the east so that adequate tiebacks can be installed.
The alignment will result in fill being placed in +/- 116.50 s.f. of Section 404 wetlands which are proposed
to be mitigated by purchase of wetland credits from the Great Dismal Swamp Restoration Bank at a 2:1
ratio (see attached).
The resulting area between the old dilapidated bulkhead and the new will be filled with clean material and
landscaped.

Request for Consent to Relocate
Single -Family Residence
Lot 127 — Four Seasons in Duck
In accordance with "First Amendment to Declaration of Covenants, Conditions and Restrictions Four
Seasons in Duck," Section D (adding a new Article Five, Section 1 I(a) entitled, "Vegetation West Side
Highway 12," the applicants and owners of Lot 127, Four Seasons in Duck, Mr. Robert Webb and
Ms. Gail Plucker (owners) request consent to relocate the existing single-family residence 13 feet to the
east.
When the owners purchased the property in April of 2015 (reference Deed Book 2014, Page 0709), the
extent of condition of the structure(s) was not evident. Subsequent analysis of the structure(s) by
Mr. Bryan R. Weisbecker, General Contractor, revealed that "the structure is out of level and has a
common lean to the west" Mr. Michael O'Steen, P.E. was engaged to determine remedies which included
construction of "a bulkhead placed westward of the existing wall(s)." A site plan was developed which
proposed the new bulkhead be constructed 20 feet waterward of the existing (failing) bulkhead. CAMA
Major Development Permit #88-16 was issued to authorize the alignment. The permitted alignment also
required approvals by Special Exception to Town Code 156.128 et. seq. (fill exceeding three feet in height)
and a Zoning Variance application from Town Code 156.037(D)(5) (fill in wetlands in the Ocean and
Sound Overlay District). The request for the Special Exception was denied February 1, 2017. Since both
approvals were necessary, the request for Zoning Variance was tabled.
The owners and their representatives began coordination with the Town of Duck staff (staff) to seek a
compromise. The owners were advised by the staff that a bulkhead alignment of two feet (average)
waterward of the existing bulkhead not exceeding five feet would be approved administratively. in order to
construct a bulkhead along this alignment that had adequate tiebacks for the bulkhead would require
relocating the existing house 13 feet to the east of its current alignment. During the relocation, the house
pilings could be reinstalled vertically, the house renovated to remove damage from the failure of the
existing pilings, and construction of a new retaining wall and walkways installed on the east. Essentially,
the proposal is to lift the existing structure(s) and place them in the same orientation 13 feet to the east.
This realignment would result in removal of no trees as defined in Section I I(a) and remain in reasonable
alignment with adjoining residences (See Figure 1). Attached are the detailed site plans, Sheets S1 — S3
prepared by Michael D. O'Steen, P.E.
The owners respectfully request written approval of the "Request for Consent to Relocate the Single -
Family Residence at Lot 127, Four Seasons in Duck." This approval can then be provided to the Town of
Duck for their approval of the proposed project.

Dear Mr. Webb,
November 7, 2017
It was a pleasure meeting with you and learning firsthand the circumstance you are facing with your home on the
sound side of Four Seasons. The threat of continued erosion is clearly a problem in need of a solution. The Four Seasons
Architectural Control Committee has no problem with your request to relocate your home eastward as a preventative
measure. From our perspective, the home movement aspect of your application is approved. Our only concern has been
that other federal, state and local bodies super cede Four Seasons, our bylaws and our covenants in this particular matter.
Based on our conversation, we understand you have now cleared those hurdles and are free to begin the home moving
process.
At this time, the Architectural Control Committee would like additional time to review the requested renovations, as
those are viewed as a separate portion of the application. We anticipate a fifteen day review period. We appreciate your
patience during this process.
Sincerely,
Robert L. Christianson
