This permit, issued on October 5, 2016 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

Docldna Facility
1) This permit authorizes only the reconfigured dock, pier, and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this reconfigured docking
facility without permit modification. No non -water dependent uses of structures shall be conducted
on, in or over Public Trust waters without permit modification
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
reconfigured docking facility. Any sewage discharge at the reconfigured docking facility shall be
considered a violation of this permit for which the permittee is responsible. This prohibition shall be
applied and enforced throughout the entire existence of the permitted structure.

19ris permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2019
in issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third parry.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of 5 formalized boat slips.
6) The pier and all associated structures shall have a minimum setback distance of 15 feet between any
parts of the structure and the adjacent property owners' riparian access corridors.
7) No portion of the authorized docking facility shall extend past the adjacent pier line, as depicted on the
attached workplan drawings.
8) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.
9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
General
10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
12) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
NOTE: Future development of the permittee's property may require a modification of this permit.

such activity for this determination.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or locermits, }

This letter is in response to your application request under the Coastal Area Management Act
(CAMA) to construct a private docking facility at 914 Santa Maria Ave., in Wilmington, New
Hanover County. On February 16, 2016, processing of your application was placed on hold
pending a request for additional information required by the U.S. Army Corps of Engineers.
This office received notice today 2016 from the U.S. Army Corps of Engineers that their request
has been satisfied. Therefore, processing of your permit application has officially resumed as of
today's date. The revised projected deadline for making a decision is December 10, 2016.

Recommendations for State Permit— Larry Warshaw 12/15/2015
The total area of existing floating dock and platform was calculated as follows:
Shoreline length = 150' x 8 sq. ft. = 1,200 sq. ft. allowable.
Proposed uncovered Platform = 12' x 14' = 168 sq. ft.
Proposed floating dock = 12' x 60' = 720 sq. ft.
Total = 888 sq. ft.
It appears that the project is consistent with the use standards set forth in NCAC 07H .0208(b)(6),
including the '% width rule, the eight square foot rule and the pier width rule. The proposed floating dock
would be located entirely over open water. This office has no objection to the proposed work, provided
it is consistent with all other state and federal permitting requirements. If the project is determined to be
consistent with NCAC 07H .0208(b)(6), it is recommended that any permit issued should include
standard conditions for private docking facilities.

This project is consistent and not in conflict with the 2006 Wilmington -New Hanover
County Joint Land Use Plan Update.
The applicant proposes to replace an existing docking facility within Pages Creek. The
project is located at 914 Santa Maria Avenue in Wilmington, New Hanover County.
Areas of Environmental Concern (AEC's) impacted by the proposal are CW, EW and
PTA. Waters at the project site are classified as SA and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover
County Joint Land Use Plan and offer the following comments.
The general area of the project is classified as Residential/Conservation.
In general, Wilmington -New Hanover County allows development in Conservation
classified AECs, which is consistent with the State's minimum use standards. The 2006
Wilmington -New Hanover County Joint Land Use Plan contains some policies, which
exceed the State's minimum use standards. However, none of these standards appear to
be applicable to this proposal.
This project is consistent with the 2006 Wilmington -New Hanover County Joint Land
Use Plan.

TO MAINTAIN, REPAIR, CONSTRUCT AND INSTALL PIERS, DOCKS,
BOATHOUSES AND BOAT SHELTERS, MOORING PILES, DOLPHINS, JETTIES,
GROINS AND BREAKWATER STRUCTURES IN NAVIGABLE WATERS OF THE
UNITED STATES IN THE STATE OF NORTH CAROLINA,
Projects must be constructed in conformance with following standards in order to be authorized
by this RGP.
1. All piers, docks, boathouses and boat shelters will be pile -supported or floating
structures.
2. Mooring piles, dolphins, jetties and breakwater structures maybe constructed of
wood, metal, or pre -cast concrete. Groins may be constructed of wood, pre -cast concrete, or rock
riprap.
3.. Breakwater structures will be designed to provide for adequate water circulation
landward of the structures.

This ROP does not authorize excavation or the discharge of excavated or fill material within
Waters of the US, except for the placement of rip -rap material for groin construction. This ROP
does not authorize any work on Atlantic Ocean beaches.
The following definitions should be used for purposes of this regional general permit (ROP):
a. Mean high water mark (MHM: The line on the shore, in tidal water, reached by the
plane of the mean (average) high water. The precise determination of the actual location of the
line can be established by survey with the reference to the available tidal datum, preferably
averaged over a period of 18.6 years. A less precise method, such as observation of the apparent
shoreline, which is determined by reference to physical markings, lines of vegetation, may be
used for the purpose of this permit.
b. Ordinary High Water Mark (OHWM): The line on the shore, in non -tidal waters,
established by the fluctuations of water indicated by physical characteristics such as clear,
natural line impressed on the bank; shelving changes in the soil; destruction of terrestrial
vegetation; the presence of litter and debris; or other appropriate means that consider the
characteristics of the surrounding areas.
Special Conditions
a. Authorized structures located on or adjacent to Federally authorized waterways will be
constructed in accordance with the Commander's Policy on Setbacks Along Federally
Authorized Channels. You may review a copy of the policy at

b. This general permit does not authorize construction across or into any natural or
manmade channel or water body in any warmer that may adversely affect navigation by the
general public.
c. Piers, docks, boathouses, Boat shelters and mooring piles authorized by this general
permit may be extended or be located up to 400 feet waterward of the mean high water
(MHWM) elevation contour (tidal areas) or the Ordinary High Water Mark (OHWM) elevation
contour (non -tidal areas) or one-third (1 /3) the width of a natural water body, whichever is closer
to the shoreline, except as otherwise governed by the presence of a Federally maintained
channel.
d. The width of any pier will not exceed six (6) feet, unless the Corps determines, in
writing, that a greater width is necessary for safe use, to improve public access, or to support a
water dependent use that cannot otherwise occur.
e. The total square footage of shaded impact for docks and mooring facilities (excluding the
pier) allowed shall be 8 square feet per linear foot of shoreline with a maximum of 800 square
feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the
total. The maximum size of any individual component of the docking facility authorized by this p` J�

General Permit shall not exceed 400 square feet unless the Corps determines, in writing, that a
greater width is necessary for safe use, to improve public access, or to support a water dependent
use that cannot otherwise occur.
f. Boathouses and boat shelters will not be enclosed and will not exceed 400 square feet.
Boatlifts will be open and will not exceed 400 square feet.
g. Boathouses, boatlifts, boat shelters and floating piers will not be constructed over
Federally jurisdictional wetlands.
h. Docks and piers extending over wetlands will be elevated sufficiently (minimum of 3
feet) above the wetland substrate to prevent total shading of vegetation, substrate, or other
elements of the aquatic environment.
i. Piers, docks, boat houses, and boat shelters shall not be constructed in seagrasses and
other submerged aquatic vegetation.
j. Wooden jetties will not extend farther than 100 feet waterward of the MHWM (tidal
areas) or the OHWM elevation contours.
k. This general permit does not authorize the installation of fueling facilities on authorized
structures.
1. Mprap groins shall not exceed abase width of 10 feet or extend more than 25 feet
waterward of the mean high water or normal water level elevation contour,
m. Riprap groins must be constructed of clean rock or masonry material and be of sufficient
size to prevent displacement by wave or current action.
n. Riprap groins shall not be located within primary nursery areas, submerged aquatic
vegetation, or areas identified as essential fish habitat.
o. Floating structures will be supported by material that will not become waterlogged or
sink when punctured, will be installed to provide for fluctuations of water elevation, will be
designed so that the structure will not rest on the bottom at any time and will be secured in such
manner as to not break away.
p. Breakwater structures will be no longer than 500 feet. They will have a minimum of one -
inch openings between standard width (6 to 12-inch) sheathing boards and at least one, five-foot
wide opening for each 100 linear feet of structure.
q. Breakwater structures may not be constructed so as to prohibit access to estuarine waters
or public trust areas.

r. If the display of lights and signals on the authorized structure is not otherwise provided
for by law, such lights and signals as may be prescribed by the U.S. Coast Guard will be installed
and maintained by and at the expense of the perrnittee.
s. It is possible that the authorized structure may be damaged by wavewash from passing
vessels. The issuance of this permit does not relieve the pemmittee from taking all proper steps to
ensure the integrity of the permitted structure and the safety of moored boats. The pemrittee will
not hold the United States liable for any such damage.
t. This general permit does not authorize habitable structures or any structure or associated
facility for nonwater elated use,
u. Structures and their attendant utilities, authorized by this general pernnit, located on lands
subject to an easement in favor of the United States for the operation, maintenance,
improvement, and enlargement of the Atlantic Intracoastal Waterway (AIW W), will be removed
at the expense of the pernittee, in the event that, in the judgment of the U.S. Army Corps of
Engineers (USACE) acting on behalf of the United States, the lands are needed at any time for
any purpose within the scope of the easement. Permanent buildings will not be constructed
within the easement.
v. This general permit does not apply to structures within existing or proposed marinas as
defined by North Carolina Administrative Code, Title 15, Subchapter 7H.0208(b)(5).
w. Should all or part of a proposed development activity be located in an Area of
Environmental Concern (AEC) as designated by the North Carolina Coastal Resources
Commission, a Coastal Area Management Act (CAMA) permit is required from the North
Carolina Division of Coastal Management before the onset of the proposed activity. Should a
Federal activity within any one of North Carolina's twenty coastal counties or which could affect
a coastal use or resource in any one of North Carolina's twenty coastal counties be proposed by a
Federal agency, a consistency determination pursuant to Subpart "C" of 15 CFR 930 must be
prepared and submitted by that Federal agency to the North Carolina Division of Coastal
Management before the onset of the proposed activity.
General Conditions.
a. Except as authorized by this general permit or any USACE approved modification to this
general permit, no excavation, fill or mechanized land -clearing activities shall take place within
waters or wetlands, at any time in the construction or maintenance of this project. This permit
does not authorize temporary placement or double handling of excavated or fill material within
waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill
activities connected with this project.
b. Authorization under this general permit does not obviate the need to obtain other federal,
state, or local authorizations. % o

c. All work authorized by this general permit must comply with the terms and conditions of
the applicable Clean Water Act Section 401 Water Quality Certification for this general permit
issued by the North Carolina Division of Water Quality.
d. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
e. The activities authorized by this general permit must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for a reason other than safety.
f. The permittee understands and agrees that, if future operations by the United States require
the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall
cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be
required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural
work or obstructions caused thereby, without expense to the United States. No claim shall be
made against the United States on account of any such removal or alteration.
g. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration
before completion of the work will without expense to the United States and in such time and
manner as the Secretary of the Afmy or his authorized representative may direct, restore the
affected water of the United States to its former conditions,
I The permittee will allow the Wilmington District Engineer or his representative to inspect
the authorized activity at any time deemed necessary to assure that the activity is being
performed or maintained in strict accordance with the Special and General Conditions of this
permit.
L This general permit does not grant any property rights or exclusive privileges.
j. This permit does not authorize any injury to the property or rights of others.
k. This general permit does not authorize the interference with any existing or proposed
federal project.
1. 1n issuing this permit, the Federal Goverment does not assume any liability for the
following:
(1) Damages to the permitted project or uses thereof as a result of other permitted

(2) Damages to the permitted project or uses thereof as a result of current or
future activities undertaken by or on behalf of the United States in the public interest.
(3) Damages to persons, property, or to other permitted or unpernutted activities
or structures caused by the activity authorized by this permit.
(4) Design or construction deficiencies associated with the permitted work
(5) Damage claims associated with any future modification, suspension, or
revocation of this permit. ,
in. Authorization provided by this general permit may be modified, suspended or revoked in
whole or in part if the Wilmington District Engineer, acting for the Secretary of the Army,
determines that such action would be in the best public interest. The term of this general permit
shall be five (5) years unless subject to modification, suspension or revocation. Any
modification, suspension or'revocation of this authorization will not be the basis for any claim
for damages against the United States Government.
n. This general permit does not authorize any activity which the District Engineer
determines, after any necessary investigations, would adversely affect:
(1) Rivers named in Section 3 of the Wild and Scenic Rivers Act (15 U.S.C.
1273), those proposed for inclusion as provided by Sections 4 and 5 of the Act and wild, scenic
and recreational rivers established by state and local entities.
(2) Historic, cultural or archeological sites listed in or eligible for inclusion in the
National Register of Historic Places as defined in the National Historic Preservation Act of 1966
and its codified regulations, the National Historic Preservation Amendment Acts of 1980 and
1992, the Abandoned Shipwreck Act of 1987 and the Native American Graves Protection and
Repatriation Act.
(3) Sites included in or determined eligible for listing in the National Registry of
Natural Landmarks.
o, This general permit does not authorize any activity which will adversely affect any
threatened or endangered species or a species proposed for such designation, or their designated
critical habitat as identified under the Federal Endangered Species Act (16 U.S.C.1531).

with all of the rights and responsibilities enumerated herein. The permittee must inform any

s. At his. sole discretion, any time during the processing cycle, the Wilmington District
Engineer may determine that this general permit will not be applicable to a specific proposal. In
such case, the procedures for processing an individual permit in accordance with 33 CFR 325
will be available.
t. Except as authorized by this general permit or any USACE approved modification to this
general perrnit, all fill material placed in waters or wetlands shall be generated from an upland
source and will be clean and free of any pollutants except in trace quantities. Metal products,
organic materials (including debris from land clearing activities), or unsightly debris will not be
used.
u. Except as authorized by this general permit or any USACE approved modification to this
general permit, all excavated material will be disposed of in approved upland disposal areas.
v. Activities which have commenced (i.e., are under construction) or are under contract to
commence in reliance upon this general permit will remain authorized provided the activity is
completed within twelve months of the date of the general permit's expiration, modification, or

Thanks for your help yesterday with our dock project at 914 Santa Maria. Having worked in government myself
for many years, I know that there is always more work to do than time, and your special attention to our project
is much appreciated.
As you may be aware, our project was on hold for several months because we were not sure we were going to
be staying in Wilmington. Now that we know we are staying (thankfully, because we love id), we would like to
go ahead and wrap up the application.
With your assistance, I was able to connect with Tyler Crumbley yesterday. You will see in the email
exchange below that he was also very helpful explaining to me why it was a good idea to stay within the ACE
`general permit' guidelines.
Now that we are clear on the requirements, I wanted to let you know our plan going forward in the event you
have any additional suggestions:
Step 1: Trip Pippin and I are going to work over the next week or so to create a revised design that we think will
meet the `general permit' guidelines of the ACE.
Step 2: Once we have the revised design, Tyler Crumbley told me I could email it to him so that he can have a
quick look to make sure we got it right.
Step 3: After we have Mr. Crumbley's approval, we will resubmit to CAMA for final approval. I
suspect that your guidelines will require you to also send it to Mr. Crumbley and get his sign -off yourself, but
hopefully if we have run it by him first, it will make it easy.
My hope is that this plan is exactly the approach you would want us to take to wrap up this permit, but if for any
reason you want us to handle it differently, let me know and we will change our plan accordingly.

ongoing. However, it has been determined that additional information will be required prior to the
Division taking final action on your application. These required items are summarized below:
1) The U.S. Army Corps of Engineers has requested additional information or project
revision by way of the attached email that is needed to meet their permit processing
requirements; which is a prerequisite for the.CAMA permit to be issued. Therefore, it is
necessary that processing of your permit application be placed in abeyance until such time
as you have satisfied the requirements of the U.S. Army Corps of Engineers, and the Army
Corps of Engineers notifies the Division in writing that no further actions are necessary on

date of this letter, DCM staff will continue processing of the application and the processing clock will not
be suspended. If the required information is not received in this office within the specified timeframe,
processing of the application will be suspended in accordance with 15A NCAC 07J.0204(d) until such

9. PROJECT DESCRIPTION
The project site is located at 914 Santa Maria Avenue, in Wilmington, New Hanover County. To locate
the property from the Wilmington Regional Office (WiRO), turn right onto Market Street (NC
Highway17) and travel approximately 5 miles north until you reach Porter's Neck Road. Turn right onto
Porter's Neck Road and travel approximately 1 mile east. Turn Right on Edgewater Club Road at the
round -about and continue east for approximately 1 mile until you reach Sea Shell Lane. Turn right onto
Sea Shell Lane and travel approximately 0.2 miles until you reach Arjean Drive. Turn left onto Arjean
Drive and travel east approximately 0.3 miles until it terminates onto Santa Maria Avenue, which is an
unimproved road. Continue down Santa Maria Avenue until you reach the property of interest, which
will be located on the right.
The owner currently maintains a single-family residence on an approximately 1.0 acre parcel with an
elevation of approximately 20 feet above normal high water (NHW). Upland vegetation consists of
maintained lawn grass and hardwood species, primarily oak trees. Waterward of the highground
towards Pages Creek the elevation of the property transitions significantly along the approximately 150
linear feet of shoreline currently maintained by granite rip -rap. Waterward of the rip -rap is an area of
coastal marsh, measuring approximately 30 feet in width consisting primarily of Smooth Cordgrass
(Spartina alterniflora).
There are existing steps down the steep shoreline, which leads onto an existing access pier, measuring
approximately 50 feet in length by 6 feet in width which extends from the highground of the property
towards Pages Creek to the west. An access ramp leads onto a floating dock, measuring
approximately 16 feet in length by 16 feet in width. The existing docking facility currently
accommodates up to two (2) vessels within water depth ranging from -3 feet to -5 feet at normal low
water (NLW). The existing docking facility is located between existing adjacent private docking
facilities.
The Wilmington -New Hanover County CAMA Land Use Plan 2006 Update classifies the area as
Conservation. There are no known archaeological sites located within the immediate vicinity of the
proposed project. The waters of Pages Creek are classified as SA, by the NC Division of Water
Resources. The waters adjacent to the project area are designated as a Secondary Nursery Area by
the NC Division of Marine Fisheries, and they are Conditionally Closed for the harvesting of shellfish.

The applicant proposes to replace an existing docking facility within Pages Creek. Once the existing
docking facility is entirely remove, a new access pier, measuring approximately 43 feet in length by 6
feet in width would be constructed. The pier would tie into an uncovered platform, measuring
approximately 12 feet in length by 14 feet in width, which would be oriented towards the west in an "L-
shaped" configuration. An access ramp would then lead onto a floating dock, measuring approximately
60 feet in length by 12 feet in width, which would run parallel to the channel and shoreline. A boatlift,
measuring 13 feet in length by 13 feet in width would be installed on the most eastern end of the
proposed floating dock. According to the application, water depth in the vicinity of the proposed
docking facility range from approximately -3 feet to -5 feet at NLW. The structure would extend
approximately 48 feet into a waterbody, which measures approximately 600 feet across. As proposed
the new docking facility would accommodate up to five (5) vessels at this facility (See sheets 1 through

11. ANTICIPATED IMPACTS
The new access pier would shade approximately 180 sq. ft. of coastal wetlands consisting primarily of
Smooth Cordgrass (Spartina alternif1ora). The new docking facility would incorporate approximately
1,129 square feet of Public Trust Area and Estuarine Waters at this location, essentially within the
existing footprint of the existing facility. The proposed structure would be located within the applicant's
riparian access area and would not encroach into the adjacent 15' Riparian Corridor Setback
requirement nor the natural channel. According to the application, water depth in the vicinity of the
proposed docking facility range from approximately -3 feet to -5 feet at NLW. The structures would
extend approximately 48 feet into a waterbody, which measures approximately 600 feet across. This
distance conforms to the 1/4 width rule. Minor increases in turbidity should be expected during
construction.

The Department of Environmental Quality hereby gives public notice as required by
NCGS 113A-119(b) that the following applications were submitted for a development permits in
Areas of Environmental Concern as designated under the CAMA in New Hanover County: On
November 24, 2015, Larry Warshaw proposed to replace an existing docking facility at 914
Santa Maria Ave., adjacent to Pages Creek, in Wilmington; on December 1, 2015, Ray Sito
proposed to reconfigure an existing docking facility at 462 Causeway Dr., adjacent to Motts
Channel, in Wrightsville Beach; on December 3, 2015, Funderburk Four, LLC proposed to
construct a new docking facility at 712 Waynick Blvd, adjacent to Banks Channel, in
Wrightsville Beach; and on December 17, 2015, Quinn Ventrues, LLC proposed to construct a

The Division of Coastal Management hereby acknowledges receipt of your application for State approval for
development at your property located at 914 Santa Maria Ave., adjacent to Pages Creek, near Wilmington, in New
Hanover County. It was received as complete on November 24, 2015, and appears to be adequate for processing at
this time. The projected deadline for making a decision is February 9, 2016. An additional 75-day review period is
provided by law when such time is necessary to complete the review. If you have not been notified of a final action
by the initial deadline stated above, you should consider the review period extended. Under those circumstances,
this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about
the 75th day.
If this agency does not render a permit decision within 70 days from November 24, 2015, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and federal review
agencies for their comments. If additional information is required based on this review, the agencies may contact you
directly.
