This permit, issued on September 21, 2016 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Bulkhead
1) The alignment of the authorized bulkhead shall not exceed a distance of two feet waterward of the
existing deteriorated bulkhead.
2) No backfill material shall be placed within 30 feet of the normal high water line, except that which will
be used to backfill the area behind the permitted bulkhead.
3) The temporary placement or double handling of fill materials within waters or vIgetated wetlands is
not authorized. HECE! VE®
4) The bulkhead shall be constructed prior to any backfilling activities. SEP Q $ 2016

This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the
qualified persons within twenty (20) days of the issuing date. Chairman of the Coastal Resources Commission.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2019
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program

ADDITIONAL CONDITIONS
5) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure.
6) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or
other suitable materials approved by Division personnel.
7) All backfill material shall be clean and free of any pollutants except in trace quantities.
Sedimentation and Erosion Control
8) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
9) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed
immediately landward of the bulkhead cap immediately following completion of backfilling activities.
General
10) No vegetated wetlands shall be excavated or filled, even temporarily, outside of the approved bulkhead
alignment.
11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the
written approval of the Division of Coastal Management.
12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The penmittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The N.C. Division of Water Resources has assigned this project DWR Project No. 2016-0732.
NOTE: The U.S. Army Corps of Engineers has assigned this project Action ID No. SAW-2016-01710.

It is the staffs recommendation that the applicant's proposal to install approximately 50 linear feet of
bulkhead with a maximum of approximately 100 square feet of coastal wetland fill and connecting to the
existing adjacent bulkhead to the north appears to be CONSISTENT with the Rules of 15 NCAC 7H.0208 (b) (7)
(D)(iii) Use Standards for Bulkheads and Shore Stabilization Measures states "the bulkhead alignment will not
adversely impact public trust rights or the property of adjacent riparian owners." It would seem that removal
of the existing dilapidated bulkhead and construction of the new bulkhead on the landward side of the area of
coastal wetlands would present a greater environmental problem with potential erosion and washout during
the construction process as well as pose a possible threat to the foundation pilings of the house. I
It is the opinion of this office that the proposed bulkhead is CONSISTENT with the Use Standards for Coastal
Wetlands, Estuarine Waters and Public Trust Areas, as set forth in NCAC 07H .0205, .0206 & .0207. In the
absence of any concerns from the commenting agencies, it is recommended that a permit be issued subject to
the standard conditions for bulkheads
It is also staff's recommendation that a permit be issued provided the proposed bulkhead steps out in front of
the existing bulkhead only what is necessary for the driving of the vinyl sheet piles and associated tie back
system, with a 2' maximum distance waterward of the existing bulkhead.

The applicant is proposing to construct approximately 50 linear feet of new vinyl
bulkhead with approximately 100 square feet of coastal wetland fill. The project is
located at 33 Monroe Street, adjacent to a manmade canal off the AIWW in Ocean Isle
Beach, Brunswick County.
Areas of Environmental Concern (AEC's) impacted by the proposal are Estuarine
Waters, Estuarine Shoreline and Coastal Wetlands. Waters at the project site are
classified as SA and are open to the harvesting of shellfish. The area is not a Primary
Nursery Area.
I have reviewed this proposal for consistency with the Ocean Isle Beach Land Use Plan
and offer the following comments.
The general area of the project is classified as Residential.
In general, Ocean Isle Beach allows development in Residential classified AECs, which
is consistent with the State's minimum use standards. The Ocean Isle Beach Land Use
Plan contains some policies, which exceed the State's minimum use standards. However,
none of these standards appear to be applicable to this proposal.
This project appears to be consistent with the Ocean Isle Beach Land Use Plan update.

On July 8, 2016, the Wilmington Regional Office of the Division of Energy, Mineral, and Land
Resources accepted a Notice of Intent for coverage under the General Stormwater Management
Permit for Bulkheads and Boat Ramps for the subject project. Staff review of the plans and
specifications on June 8, 2016 has determined that the development activities proposed at this
time does not create any additional built -upon area and will not pose a threat to surface water
quality from stormwater runoff. The Director has determined that projects that are reviewed and
approved by the Division as not posing a water quality threat from stormwater runoff should not
be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000, the
stormwater rules. By copy of this letter, we are informing you that this project will not require a
stormwater management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater
runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES)
stormwater discharge requirements. You are required to have an NPDES pernut for stormwater
discharge from projects meeting these criteria. All temporary built -upon area associated with the
construction of the project must be removed within 30 days of completion of the project, or when
it is no longer needed, whichever occurs first.

The applicant's property is located at 33 Monroe Street, adjacent ad uu us with
the AIWW in the Town of Ocean Isle Beach, Brunswick County. Directions from"Hig v5 i'17 south of
Shallotte: Turn Left onto Ocean Isle Beach Rd. and travel approximately 3.6 miles and continue straight
onto Causeway Dr./ NC-904 for approximately 1.12 miles. Turn left onto E. 2"d St. and travel
approximately 0.21 miles. Turn left onto Monroe St. and travel approximately 0.7 miles. The project
site will be located on the left side of the street.
The project site is a canal front lot with approximately 50' of shoreline frontage. The elevation of the
high ground area of the lot averages approximately 5' above normal high water (NHW). High ground
vegetation consists primarily of lawn grasses, woody shrubs, and landscape vegetation. The shoreline
of the property has been stabilized with an existing timber bulkhead and the house structure is located
approximately 22'-23' landward of the existing bulkhead. There is also existing raised decking located
approximately 16' landward of the existing bulkhead, the stairs to which are located 12' landward of
the existing bulkhead. Coastal Wetlands are present water ward of the bulkhead, consisting primarily
of Smooth Cord Grass (Spartina alterniflora). The Coastal Wetlands are, on average, 17' in width as
measured from the bulkhead. Mean High Water (MHW) is located along the existing bulkhead for the
property. An existing docking facility extends from the center of the property off of the existing
bulkhead and consists of a fixed platform measuring approximately 5' in width by 8' in length. A ramp
measuring approximately 3' in width by 18' in length extends waterward from the existing fixed
platform to an existing floating platform measuring approximately 8' in width by 16' in length.
The adjacent shorelines have been stabilized with bulkheads. The property to the south stabilized with
an existing bulkhead that is aligned approximately 0.5' landward of the existing bulkhead on the
project site. The adjacent shoreline to the north has been stabilized with a bulkhead that is aligned
approximately 9' feet landward of the existing bulkhead on the project site. The MHW boundary on
the adjacent properties is located along the bulkheads with approximately 15'-20' of Smooth Cord
Grass present waterward of the bulkheads. Both of the adjacent properties to the north and south are
developed with single-family residences and docking facilities. No known archaeological sites are
within the project vicinity.
The Town of Ocean Isle Beach Land Use Plan classifies the adjacent waters as Conservation, and the
adjacent high ground portion of the project area as Residential. The waters of the AIWW are classified
SA by the Division of Water Resources and are NOT designated as a Primary Nursery Area (PNA) by the
N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish.
10. PROPOSED PROJECT:
The applicant proposes to install approximately 50 linear feet of new vinyl bulkhead with
approximately 100 square feet of coastal wetland fill. The bulkhead backfill would consist of
approximately 100 square feet of coastal wetlands, primarily Smooth Cord Grass (Spartina alterniflora).

As proposed, the new vinyl bulkhead would be aligned an average of 2 feet water ward of the existing
bulkhead. As proposed, the bulkhead alignment would be approximately 2.5' waterward of the
adjacent property's bulkhead to the south and approximately 11' waterward of the adjacent properties
bulkhead to the north. The existing timber bulkhead would remain in place and the limits of
disturbance would be located approximately 20 feet landward of the proposed bulkhead alignment.
The applicant is proposing to install the tie -backs thru the existing wall to prevent land disturbance
associated with removal of the old wall. This method of construction would also aim to alleviate
threats to the existing porch and house structure which resides in close proximity relative to the
existing bulkhead wall.
11. ANTICIPATED IMPACTS
The proposed new bulkhead construction with associated backfill and tie back/anchor system would
result in the filling of approximately 100 square feet of Coastal Wetlands and Estuarine Waters Areas of
Environmental Concern. The bulkhead backfill would consist of approximately 100 square feet of
coastal wetlands, primarily Smooth Cord Grass (Sportina olterniflora), located below MHW in shallow
bottom area. The proposed bulkhead construction would result in the disturbance of approximately
1,000 square feet of high ground. Minor turbidity increase can be expected during the construction
process.

DESIGN NARRATIVE
1. EXISTING CONDITIONS:
The 33 Monroe St. site is a 5860 square foot lot located at Ocean Isle Beach in Brunswick
County. The site is located on a manmade canal stemming from the Atlantic Intracoastal
Waterway. There is existing bulkhead, dock, and single family residence on the lot. The
existing bulkhead is within 12 feet from the closest structure, stairs leading up to a raised
deck, and less than 24 feet from the house envelope. The mean high water line is located
at the bulkhead for the entire property. The bulkhead is approximately 4.5 to 5.5 feet above
the adjacent substrate. Both adjacent property lots are developed as single family
residential. The elevation of the property ranges from 4 feet to 6 feet NAVD88.
The project is located in a VE-17 High Hazard Flood Area.
The existing wooden bulkhead at this location has begun to deteriorate and requires to be
replaced in order to maintain shoreline stabilization.
2. PROPOSED DEVELOPMENT:
The existing shoreline stabilization at 33 Monroe St. is proposed to be replaced waterward
of the existing bulkhead, ranging from 1-2 feet connecting to the two adjacent property
bulkheads. The existing bulkhead will remain, and tie -backs will be installed through this
existing wall. The top of the existing bulkhead may be lowered upon completion of
construction of new wall. Additional fill may be placed on top of existing wall so that the
wall may be vegetated over. Material from the Ike Williamson permitted sand mine on
Hale Swamp Road is expected to be required for fill material in addition to the existing
material. The bulkhead will be constructed structurally tight to keep material on site. The
purpose of the proposed bulkhead is to protect and stabilize the shore, because the existing
bulkhead is no longer stabilizing the embankment. Constructing the proposed bulkhead in
front of the existing bulkhead, is to prevent failure of the existing bulkhead during
construction, and potential contamination of the adjacent wetlands. Constructing the
proposed bulkhead in front of the existing bulkhead, is also to prevent possible threat to
the foundation of the house because of the existing bulkhead's close proximity to the
existing bulkhead.

This notice is intended to make you, the applicant, aware of the
special risks and conditions associated with development in this
area, which is subject to natural hazards such as storms, erosion
and currents. The rules of the Coastal Resources Commission
require that you receive an AEC Hazard Notice and acknowledge
that notice in writing before a permit for development Can be
issued.
The Commission's rules on building standards, oceanfront
setbacks and dune alterations are designed to minimize, but not
eliminate, property loss from hazards. By granting permits, the
Coastal Resources Commission does not guarantee the safety of
the development and assumes no liability for future damage to
the development. Permits issued in the Ocean Hazard Area of
Environmental Concern include the condition that structures be
relocated or dismantled ifthey become imminently threatened by
changes in shoreline configuration. The structure(s) must be
relocated or dismantled within two (2) years of becoming
imminently threatened, and in any case upon its collapse or
subsidence.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual long-term
average ocean erosion rate for the area where your property is
located is feet per year.
The rate was established by careful analysis of aerial photographs
of the coastline taken over the past 50 years.
Studies also indicate that the shoreline could move as much as
feet landward in a major storm.
The flood waters in a major storm are predicted to be about
17 feet deep in this area.
Preferred oceanfront protection measures are beach nourishment
and relocation of threatened structures. Hard erosion control
structures such as bulkheads, seawalls, revetments, groins, jetties
and breakwaters are prohibited. Temporary sand bags may be
authorized under certain conditions.
The applicantmust acknowledge this information and requirements
by signing this notice in the space below. Without the proper
si application will not be complete.

SPECIAL NOTE: This hazard notice is required for development
in areas subject to sudden and massive stoma and erosion. Permits
issued for development in this area expire on December 31 of the
third year following the year in which the permit was issued.
Shortly before work begins on the project site, the Local Permit
Officer must be contacted to determine the vegetation line and
setback distance at your site. Ifthe property has seen little change
since the time ofpermit issuance, and the proposed development
can still meet the setback requirement, the LPO will inform you
that you may begin work. Substantial progress on the project
must be made within 60 days of this setback determination, or
the setback must be remeasured. Also, the occurrence of a major
shoreline change as the result of a storm within the 60-day period
will necessitate remeasurement of the setback. It is important
brat you check with the LPO before the permit expires for official
approval to continue the work after the permit has expired.
Generally, if foundation pilings have been placed and substantial
progress is continuing, permit renewal can be authorized. It is
unlawful to continue work after permit expiration.

The Department of Environmental Quality hereby gives public notice as required
by NCGS 113A-119(b) that the following applications were submitted on July 15, 2015 for
development permits in Areas of Environmental Concern as designated under the CAMA in
Brunswick County: Kevin Dempsey and Frank Ward propose to construct new bulkheads at
31 and 33 Monroe Street, adjacent to the AIWW, in Ocean Isle Beach, Brunswick County. The
applications can be examined or copied at the office of Sean Farrell, N.C. Dept. of
Environmental Quality, Division of Coastal Management, 127 Cardinal Drive Ext., Wilmington,
NC 28405, (910-796-7424) during normal business hours.
