Docking Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2019 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Walters, Jr. ADDITIONAL CONDITIONS Permit No. 66-16 Page 2 of 3 3) In order to ensure compliance with Section 7.02 of Article 7 in Sunset Beach's local regulations, the permittee shall not initiate construction on the authorized docking facility until authorizations are received and construction begins on a primary structure (i.e. residence). Development shall otherwise comply with all local regulations. 4) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 6) This permit authorizes a maximum of 2 formalized boat slips. Docking space on the landward side of the floating dock is not authorized under this permit. In order to ensure compliance with this condition, cleats shall not be installed on the landward side of the floating dock. 7) In order to satisfy concerns of the resource agencies, physical stops shall be placed on the boatlift at a minimum height of 18" above the bottom substrate to prevent the boatlift from disturbing the bottom substrate. The physical stops shall remain in place for the life of the docking facility. 8) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owners' riparian access corridors. 9) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 10) The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. Footprint of the boathouse shall not exceed 400 square feet. 11) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 12) The authorized boathouse and covered platform shall be single story, and shall not be designed to allow for second story use. 13) No attempt shall be made by the permitte to prevent the full and free use by the public of all navigable waters at or adjacent to the aloorized wo lc LU U 0 N T WUl 2 U Z CC� � C U _. ....................0.................................................................................. Therefore, in accordance with TI 5A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. General 15) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 16) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 17) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 18) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: Future development of the permittee's property (including construction of the primary structure referenced in Condition 3 above) may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2016-00939), which was issued on 5/10/16. NOTE: The N.C. Walters, Jr. ("Permittee") authorizing the construction of a 465 foot pier, boat lift, and docks ("Project") at 9197 Schuyler Drive, Calabash, North Carolina ("Property"). A copy of the CAMA Permit is attached as Exhibit A. Based on the following facts and reasons, Petitioners request permission to file an appeal of the CAMA Permit: FACTORS SUPPORTING REOUEST FOR THIRD PARTY HEARING The CAMA Permit Decision is Contrary to Statute or Rule. The decision to issue the CAMA Permit is contrary to CAMA and certain regulations of the Coastal Resources Commission ("CRC") contained in the North Carolina Administrative Code. The CAMA Permit is contrary to: a. CAMA's stated goal of protecting "common-law and statutory public rights in the lands and waters of the coastal area," which includes navigation [N.C. Gen. Stat. § 113A-102(7)]; b. the CRC's stated management objective "to protect public rights for navigation and recreation and to conserve and manage the public trust areas so as to safeguard and perpetuate their biological, economic and aesthetic value" [15A NCAC 7H .0207(c)]; c. the CRC's use standards for public trust areas which states that "any use which jeopardizes the capability of the waters to be used by the public for navigation or other public trust rights which the public may be found to have in these areas shall not be allowed" (emphasis added)[15A NCAC 7H .0207(d)]; d. the CRC's use standards for public trust areas which states that "[p]rojects which would directly or indirectly block or impair existing navigation channels... are considered incompatible with the management policies of public tryst areas" [15A NCAC 7H .0207(d)]; e. the CRC's specific use standard for piers and docking facilities that limits length to not extend "beyond the established pier or docking facility length along the same shoreline for similar use" [I SA NCAC 7H .0208(b)(6)(G)(i)]; and, f. the CRC's specific use standard that requires piers and docking facilities longer than 400 feet to be permitted "only if the proposed length gives access to deeper water at a rate of at least 1 foot each 100 foot increment of length longer than 400 feet" [15A NCAC 7H .0208(b)(6)(H)]. 2. Petitioners are Directly Affected by the CAMA Permit Decision. Petitioners own a home at 9193 Schuyler Drive, Calabash, Brunswick County, North Carolina, immediately adjacent to and on the east side of the Property. Petitioners have owned their property since May 2009. Petitioners' property has a dock and pier that gives them access to the Atlantic Intracoastal Waterway ("AIW W"). The house was built in 1994, and the pier and docking facility were built shortly thereafter in 1994 or 1995. Petitioners use their second home regularly, sometimes staying two to three months at a time. When they are in residence, Petitioners routinely use their dock and pier for recreation, including boating up and down the AIWW. Petitioners enter and exit their dock from the western side due to an AIWW mile marker on the eastern side of their docking facility which limits their navigation. Petitioners experience boating traffic on the AIWW, which they have seen increase over the last seven years near their docking facility. Weekends and holidays are particularly congested. Over the last two years, commercial and transit traffic has added to the local traffic due to the installation of an upgraded bridge in Sunset Beach. Petitioners have witnessed tugboats pushing and pulling barges in this part of the AIWW, and the wake generated by this traffic can often cover Petitioners' pier at high tide. Recreational traffic travels up and down the AIWW at high speeds. Petitioners count on a clear view on their western side to enter and exit the AIWW safely. Petitioners are directly affected by DCM's decision to issue the CAMA Permit because it allows the Permittee to construct a pier beyond the pier head line established by Petitioners' pier and those on either side of Petitioners. Aerial photographs reflecting the established pier head line is attached as Exhibit B. Piers along this portion of the shoreline are of relatively uniform length which allows for safe ingress and egress for property owners and also keeps the path of the AIWW clear for boating traffic. Petitioners' use of their docking facility will be greatly affected by the construction of the Project on the Property as allowed by the CAMA Permit because it includes a pier that extends further into the AIWW at least 65 feet beyond regulation and beyond the established pier head line. A survey included with the Permittee's application package, a copy of which is attached as Exhibit C, illustrates the proposed location of the Project relative to and beyond Petitioners' pier. Further, the CAMA Permit allows for placing a large, covered boathouse, the roof of which will block Petitioners' line of sight to their west when entering and exiting their own dock and will inhibit their riparian access. Therefore, Petitioners are directly affected by the Project authorized by the CAMA Permit and are entitled to request permission to file a Contested Case. , 3. Petitioners' Request for Contested Case Hearing is Not Frivolous. Petitioners' Third Party Hearing Request is not frivolous because DCM's decision to issue the CAMA Permit is contrary to CAMA's goals and objectives to protect the public trust right of navigation in public trust areas. DCM and the CRC are charged with balancing the public's right to navigate public trust waters with the Permittee's right to develop his Property. DCM focused on the Permittee's ability to access deeper water and elevated that issue over Petitioners' legitimate concerns about navigation when deciding to issue the CAMA Permit. The CAMA Permit allows construction of a docking facility that exceeds the established pier head line of not only the piers immediately adjacent to the Property — including Petitioners'— but also those piers on either side of the immediately adjacent piers. The aerial photographs in Exhibit B illustrate the established pier head line of the four piers surrounding the Property. Petitioners' pier has been in place more than 20 years. The CRC and DCM have no rule or policy for identifying an established pier head line. Although an established pier head line is a subjective standard open to interpretation, DCM has interpreted the pier head line in this case to include piers further down the shoreline in areas that differ from the shoreline in the immediate area of the four piers surrounding the Property. Therefore, the CAMA Permit is contrary to the CRC's specific use standard for piers and docking facilities which dictates that the length of such piers shall be limited to "not extending beyond the established pier or docking facility length along the same shoreline for similar use." 15A NCAC 7H .0208(b)(6)(G)(i). Further, DCM's interpretation of the pier head line is so expansive that it impedes Petitioners' safe navigation from their docking facility immediately adjacent to the Property and will 4 unreasonably interfere with navigation up and down the AIWW by the public. There is no indication that DCM conducted or obtained a depth survey establishing that the additional length beyond 400 feet provided in the CAMA Permit gives the Permittee access to deeper water "at a rate of at least 1 foot each 100 foot increment of length longer than 400 feet," a requirement of the CRC's specific use standards. 15A NCAC 7H .0208(b)(6)(H). Therefore, the additional length allowed by the CAMA Permit is not supported and does not justify unreasonable interference with navigation. The docking facility authorized by the CAMA Permit causes an unreasonable interference with Petitioners' and the public's navigation of the AIW W and exceeds the established pier head line. What constitutes an unreasonable interference with navigation is a subjective question, as is what constitutes the established pier length along the shoreline. Both issues are open to interpretation and are precisely the type of issue ripe for the presentation of evidence before an Administrative Law Judge. Petitioners have articulate facts and made legal arguments entirely appropriate for adjudication in the Office of Administrative Hearings. Therefore, Petitioners' request for a Contested Case to challenge the CAMA Permit is not frivolous. The decision to issue the CAMA Permit is contrary to CAMA and the CRC's regulations and it directly affects the Petitioners. Further, Petitioners' request to challenge DCM's decision to issue the CAMA Permit is not frivolous. Therefore, Petitioners' request to file an appeal of the CAMA Permit under N.C. Gen. The physical stops shall remain in place for the life of the docking facility. 8) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owners' riparian access corridors. 9) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 10) The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. Turn right onto Sunset Blvd N/NC -179 Bus and travel approximately 1.86 miles. Turn right onto Shoreline Dr. W/NC-179 Bus. And travel approximately 1.84 miles. Turn left onto Bonaparte landing Rd. The project site is an undeveloped tract of land adjacent to the AIWW that measures approximately 3.3 acres of which approximately 0.73 acres is upland and approximately 2.5 acres appears to be platted beyond mean high water (MHW) encompassing portions of salt marsh. The property has approximately 195 feet of shoreline frontage along the eastern side and southern rear of the property and is stabilized with natural vegetation. The elevation of the high ground area of the lot measures approximately 8 feet above normal high water (NHW). High ground vegetation consists mainly of hardwoods including live oaks, pines, and red cedar as well as natural shrubs and herbaceous vegetation. Section "404" wetlands ranging from approximately 10 feet to 15 feet in width exist between the high ground and the MHW line. Coastal wetlands consisting primarily of Smooth Cord Grass (Spartina alterniflora) extend waterward approximately 325' beyond the Section "404" wetlands. The mean low water (MLW) contour is located approximately 60 feet waterward of the edge of marsh. The waters of the AIWW are classified SA by the Division of Water Quality and ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are OPEN to the harvest of shellfish. 10. PROPOSED PROJECT: The applicant proposes to construct a private pier with a partially covered "t-head", boathouse, and floating dock to provide docking space for two (2) vessels. The proposed project would consist of a pier measuring approximately 465' in length by 6' in width of which 445' would extend waterward beyond the MHW boundary and approximately 120' would extend waterward of the edge of marsh. The pier would terminate at a fixed "t-head" measuring approximately 12' in width by 24' in length, of which approximately 12' in width by 12' in length would be covered. A boathouse measuring approximately 15' in width by 26' in length would be attached to the eastern edge of the proposed 1-head". A ramp measuring approximately 4' in width by 18' in length is proposed to be attached to the western edge of the proposed "t-head" and lead to a proposed floating dock measuring approximately 8' in width by 16' in length, extending parallel to the federal channel. The proposed docking facility would terminate approximately 20' landward of the 80' federal channel setback. The proposed docking facility would exceed the pier -head line of the immediately adjacent piers, however, prior to submittal of the application, DCM staff discussed establishing a pier head line between adjacent properties located at 9285 Peakwood Dr. and 9131 Schuyler Dr. These private docking facilities maintain similar use and reside approximately 775' WNW and 1,250' ESE of the proposed project location. The proposed configuration would allow for docking of up to three (3) vessels, however the application only indicates two (2). 11. ANTICIPATED IMPACTS The proposed pier system would incorporate approximately 1,526 sq. ft. of Estuarine and Public Trust Area and would shade approximately 1,950 sq. ft. of Coastal Wetlands, consisting primarily of Smooth Cord Grass. The proposed access pier would result in the shading of approximately 72 square feet of Section "404" wetland. Water depths in the vicinity of the proposed slips measures approximately -1.5 feet at MLW. As proposed, there could be potential for bottom disturbance and displacement of the substrate "kicking" by vessel propellers to access the docking facility at periods of low water. Minor increases in turbidity should be expected during construction. The proposed docking facility would extend a total distance of approximately 465' into the water body as measured from the mean high water boundary of which approximately 120 feet would extend into open water within a water body which measures approximately 564 feet in width. This distance would conform to the width rule. The proposed new docking facility would meet an established pier -head line for piers that have similar use but would exceed past the directly adjacent piers to east and west to achieve sufficient water depths for the proposed slips. The structure, as proposed, would not encroach into either of the adjacent 15' riparian corridor setbacks or the 80 foot federal channel setback. The construction of the pier, "t-head", floating dock, and boathouse would provide docking space for three (3) vessels. It is staffs recommendation that the proposal to construct a private docking facility with a "t-head", floating dock and boathouse is CONSISTENT with the rule in 15A NCAC 071-1.0208 (b) (6) (G) (i) which states "Pier and docking facility length shall be limited by: not extending beyond the established pier or docking facility length along the same shoreline for similar use." It is also staffs recommendation that the proposal to construct a private docking facility with a "t-head", floating dock and boathouse is CONSISTENT with the rule in 15A NCAC 071-1.0208 (b) (6) (H) which states "Piers or docking facilities longer than 400 feet shall be permitted only if the proposed length gives access to deeper water at a rate of at least 1 foot each 100 foot increment of length longer than 400 feet, or, if the additional length is necessary to span some obstruction to navigation. Measurements to determine lengths shall be made from the waterward edge of any coastal wetland vegetation that borders the waterbody." Due to the limited amount of water, approximately -1.5 feet at MLW located adjacent to the proposed docking facility as shown in the attached drawings, there could be potential for bottom disturbance and displacement of the substrate "kicking" by vessel propellers to access the docking facility at periods of low water. This office supports the recommendations of the resource agencies, particularly the NC Division of Marine Fisheries, regarding potential impacts to shallow bottom within primary nursery areas. Should concerns be expressed over potential impacts from any of the resource agencies, the project could then be found to be inconsistent with NCAC 07H .0208(a)(2), which requires that the location, design and need be consistent with the management objective of the Estuarine System AEC and the project be sited and designed so as to avoid significant adverse impacts upon the productivity and biological integrity of spawning and nursery areas. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of the structure without permit modification. No non -water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 3. The authorized structure and associated activity must not cause an unacceptable interference with navigation and shall not exceed the established pier head line. 4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. 5. The pier/boathouse and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 6. This permit does not authorize the interference with any existing or proposed Federal project, and, the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without having the permit transferred to a third -party. 8. This permit authorizes a maximum of three (3) boat slips. At no time shall more than three (3) vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. VAN DER VAART &'rNloq BRAXTON DAVIS nrmaor A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the subject permit application for proposed actions that impact fish and fish habitats. The applicant proposes to construct a private docking facility. The surrounding waters are classified as primary nursery area (PNA), able to support shellfish (SA), and are open to shellfish harvest. PNAs are estuarine waters where initial post -larval development occurs. Species within this area are early post -larval to juvenile and include finfish, crabs, and shrimp. Species inhabit PNAs because they afford food, protection, and proper environmental conditions during vulnerable periods of their life history, thus protection of these areas are imperative. Formalized slips in shallow water can allow vessels to repeatedly contact the bottom, resulting in; aquatic vegetation or shellfish bed loss, anoxia in the sediment which can kill benthic invertebrates and reduction of shallow bottom habitat during low tide. In addition, vessels moving to and from these shallow water docks can cause propeller disturbance impacts to the PNA. The applicant proposes to construct a 465ft x 6ft pier, a 12ft x 24ft partially covered fixed platform, a 15ft x 26ft boathouse, and a 16ft X 8ft floating dock parallel to the Intracoastal Waterway (AIWW). Water depths at the proposed floating dock is approximately -1.5ft at NLW, and in close proximity to the AIW W. It is recommended that 18" stops be installed on the boatlift and floating dock, to reduce the potential for bottom disturbing activities associated with the boat lift and impact by the floating dock through direct contact with the bottom during low tides. The application states only two proposed slips, though there is potential for a third, the landward portion of the floating dock. Though this location is not identified as a slip, there is significant potential for bottom impact during its use. Since the location is not intended to be used, it is recommended that this unidentified slip be conditioned inactive through no tie off options (cleats), pilings or other such conditions. As for the floating dock, especially ones on the AIWW, I'm not big on stops due to potential damage to the floater from passing vessels when it is resting on the,stops. In that case would Mr. Walters consider orientating the floater parallel to the AIWW, like a few floaters along this stretch of the AIWW? The "surveyed drawing depicts a facility that is inconsistent with the current rules and would require a variance. have spoken with Heather and Doug regarding the established pier head line in this area (see google earth image). Based on our discussions the applicant has established the pier head line using the most outboard adjacent piers in order to gain water depth and to possibly alleviate the need to obtain a variance. The preliminary drawing depicts the pier head alignment based on the outboard piers. The docking facility depicted on the survey would be shifted landward to "not exceed the established pier head line". This would place the proposed floating dock and boat house in approximately 18 inches of water at low tide. The applicant is requesting that we provide some guidance moving forward, i.e. and additional required information on the survey, will stops be required on both the lift and floating dock at 18? or 24? inches? Per Division of Coastal Management, CAMA Handbook for Development in Coastal North Carolina: Section 4 Rules for Specific Types of Projects, "All docks and piers must meet general CAMA rules for coastal wetlands, estuarine waters and public trust areas." "Piers extending more than 100 feet past the marsh vegetation or the shoreline must not extend beyond the length of existing piers used for similar purposes along the same shoreline."{emphasis added) Additionally, `Boathouses are not allowed on lots with less than 75 linear feet of shoreline." Per CAMA Handbook Section 4, "Piers must not interfere with access to any riparian property...: ' Furthermore, the Walters lot does not contain 75 feet of shoreline perpendicular to the centerline of the ICW. Also, the proposed plan does not allow for sufficient setback to Milhous Property and/or to allow for any expansion of Milhous pier, T-head, or installation of a floating dock, etc., through an application for either a General or Major Permit if so elected by Milhous in the future. Therefore, approval of Application and `permitting' construction of the proposed pier, et al., would be a safety concern to the public waterways, impede the Milhous Property `access', and further disturb Milhous Property which may lead to a devaluation of Milhous Property. Flood and Stormwater Management Impact The proposed location and length of Walters pier, could affect coastal flood and stormwater management of the area, including the possible impediment of natural tide (ebb and flow) of Coastal Wetlands and related stormwater drainage (identified on Parcel ID 25500024 and 25500229) as part of the Calabash Acres drainage system. The natural drainage systems also are part of and adjacent to the Milhous Property, of which the Southern comer of Milhous Property and its dwelling (parcel ID 25500023) could be subject to increased flooding and erosion. Increased flooding, erosion, etc., will impair the Milhous Property. The Calabash Acres drainage system and related salt march area is also known for wildlife nesting and breeding area. Per Division of Coastal Management, CAMA Handbook for Development in Coastal North Carolina: Section 4 Rules for Specific Types of Projects, states "Docks and piers must not significantly interfere with water flows, which could lead to the accumulation of pollutants along the shoreline or accelerate shoreline erosion." (emphasis added) Therefore, approval of Application and `permitting' construction of proposed pier, et al., would be an environmental concern to the natural drainage systems and wildlife habitat area, and further disturb Millions Property which may lead to a devaluation of Milhous Property.
