Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization '_3 )� . Permit No. 30-16 t Page 2 of 3 ADDITIONAL CONDITIONS The temporary placement or double handling of fill materials within water or vegetated wetlands is not authorized. 6)r The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 'No excavation, or other land disturbing activities, is permitted except for that which may be required for 'the construction of the bulkhead wall. This permit does not authorize any excavation waterward of the approved alignment. Sedimentation and Erosion Control In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of ".grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General -No open water areas or vegetated wetlands shall be excavated or filled, even temporarily, outside of the area as indicated on the attached workplan drawing. This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written consent of the Division of Coastal Management. The pemrittee and/or his or her contractor shall meet with a representative of the Division prior to `project initiation. ATE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. The U.S. Army Corps of Engineers authorized the proposed project by way of Programmatic General Permit 198000291 and assigned the project Action ID No. SAW-2016-00319. Miguel Velasco SR. Division of Water Resources authorized the project by way of General Water Quality Certification 3900 and assigned the DWR Project No. 06-1917 V4, which was issued on 2/5/16. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. �y Received PROJECT NARRATIVE JAN 11 2016 CAMA MAJOR PERMIT — Lots 42 & 43 Pelican Pointe Elizabeth City, Pasquotank County DCM-EC January 6, 2016 LOCATION OF PROJECT: The project is located within a mixture of undeveloped and residentially developed properties. The subject property is located adjacent to the Coast Guard Base, located adjacent to the Pasquotank River in Elizabeth City, Pasquotank County, North Carolina. PROJECT DESCRIPTION: The subject properties are comprised of two lots (42 &43) located in the Pelican Pointe subdivision. This CAMA major application is being prepared for the replacement of 1,360 linear feet of a failing bulkhead and the repair of 100 linear feet of an existing groin. The project was previously permitted to Page Development, LLC on July 10, 2007 as Permit # 160-03 and expired on December 31, 2010. The permitted work was never started and property was foreclosed on until it was recently sold to Mr. Velasco. The existing bulkhead has failed in a few locations and approximately 660 square feet concrete rip -rap was placed along the shoreline to help stabilize some of these areas. The existing rip -rap will remain in place and backfill will cover it during the final grading. As a result of the failing bulkhead the shoreline eroded landward which will require 7,200 square feet (290 cubic yards) of backfill to be placed below the normal water level. During the erosion process a small area (-500 sf) of wetlands was created landward of the existing bulkhead and consists of a minor amount of salt meadow hay and common reed. The North Carolina Division of Coastal Management has determined that it is not Coastal Wetlands. There is no upland development or impervious surfaces proposed for this project. The construction and ball of the proposed bulkhead will disturb 42,127 square feet of land on the two lots. The proposed development will include the construction of a new replacement bulkhead a maximum of 34' waterward of NWL. Scalloped/eroded areas landward of the bulkhead along the Pasquotank River are up to 32' deep measured from the old remnant bulkhead. Shallow bottom fill resulting from the construction of a replacement bulkhead along 940' (2' waterward of NWL) will be-1,880sf, the remaining fill will be along a -420' section of severely eroded shoreline. The average alignment along the 420' is 12.6' waterward of NWL with 5,320sf shallow water bottom fill. The subject property is located adjacent to the Coast Guard Base, located adjacent to the Pasquotank River in Elizabeth City, Pasquotank County, North Carolina. PROJECT DESCRIPTION: The subject properties are comprised of two lots (42 &43) located in the Pelican Pointe subdivision. This CAMA major application is being prepared for the replacement of 1,360 linear feet of a failing bulkhead and the repair of 100 linear feet of an existing groin. The project was previously permitted to Page Development, LLC on July 10, 2007 as Permit # 160-03 and expired on December 31, 2010. The permitted work was never started and property was foreclosed on until it was recently sold to Mr. Velasco. The existing bulkhead has failed in a few locations and approximately 660 square feet concrete rip -rap was placed along the shoreline to help stabilize some of these areas. The existing rip -rap will remain in place and backfill will cover it during the final grading. As a result of the failing bulkhead the shoreline eroded landward which will require 7,200 square feet (290 cubic yards) of backfill to be placed below the normal water level. During the erosion process a small area (-500 sf) of wetlands was created landward of the existing bulkhead and consists of a minor amount of salt meadow hay and common reed. The North Carolina Division of Coastal Management has determined that it is not Coastal Wetlands. There is no upland development or impervious surfaces proposed for this project. I have reviewed the rules as they pertain to bulkheads and would like to offer the following: 15A NCAC 07H .0208 USE STANDARDS (a) General Use Standards (3) When the proposed development is in conflict with the general or specific use standards set forth in this Rule, the CRC may approve the development if the applicant can demonstrate that the activity associated with the proposed project will have public benefits as identified in the findings and goals of the Coastal Area Management Act, that the public benefits outweigh the long range adverse effects of the project, that there is no reasonable alternate site available for the project, and that all reasonable means and measures to mitigate adverse impacts of the project have been incorporated into the project design and shall be implemented at the applicant's expense. Approximately 500 sq. ft. of Section 404 Wetlands are located along the river shoreline. The property is located in the AE Floodzone. Existing shoreline improvements include failing wooden bulkhead along the entire length of shoreline, 42 linear feet of broken concrete landward of the bulkhead along the river, and a 100 foot long groin extending into the river. The pilings of the groin appear to be in good shape, but the sheathing is missing. Excessive erosion has occurred along 420 linear feet of shoreline along the river. NWL is a maximum of 32 feet landward of the remnant bulkhead at two (2) sections along the river. Concrete was placed behind a portion of the failing bulkhead along the river prior to 2005 to reduce erosion. Replacement of 1,360 linear feet of bulkhead and installation of sheathing on the existing groin are proposed. Bulkhead will be installed an average of 5.29 feet waterward of NWL and a maximum of 34 feet waterward of NWL. All dirt fill will be brought in from a local commercial source and will be free of pollutants. The waters of the Pasquotank River in this area are classified as SB and are closed to shellfish harvesting. A review of Submerged Aquatic Vegetation (SAV) was not provided. A review of potential historic, cultural and archaeological resources was not provided. The applicant proposes to replace 1,360' of failing bulkhead and to replace the vertical sheathing on an existing 100' wooden groin. The northern shoreline has experience significant erosion due to the failed bulkhead resulting in over 7000 square feet of open water existing behind the original structure. DCM fisheries suggests that the northern portion of the property, where the erosion escarpment exists, would be a great candidate for a living shoreline project, the site conditions are very similar to a living shoreline now. The failed bulkhead offshore breaking water has allowed some wetland vegetation to take hold in the shallow nearshore habitat. Creating a more permanent offshore break and some plantings could provide great protection as well as some habitat value for fish. If the northern section of the property is stabilized by bulkhead it is recommended that the alignment be pulled back to more closely match that of the existing shoreline. This change would significantly reduce the large amount of shallow bottom fill that would occur with the project as proposed. Velasco, Sr. 1 Field Investigation Report r Page 2 Proiect Setting The project site is located at 320 and 322 Harrier Court (lot 42 &43) in Elizabeth City, in Pasquotank County, North Carolina. The site is situated in Pelican Pointe, a low density residential subdivision. Configuration of the properties form a 2.74 acre peninsula bounded on the north and east by the Pasquotank River, on the west by a man-made basin (situated at the mouth of a man-made canal) and on the south side by Harrier Court. The two properties consist of 1,360 linear feet shoreline that currently have failing bulkheads in place. The section of shoreline facing the Pasquotank River has the greatest damage forming a scalloped shoreline landward of a remnant bulkhead. Broken concrete was placed behind 42' of the failing bulkhead prior to 2005 to reduce erosion. Water now flows around the section of riprap. No permit was issued for the placement of the riprap alignment. In 2003, CAMA Major Permit #160-03 was issued to Page Development, Inc. for land disturbance associated with a waterfront residential subdivision, and included an 8' wide boardwalk paralleling and over the adjacent man-made canal. No bulkheading was or riprap was proposed under the original CAMA Major Permit. In 2007, the permit was modified to include a new bulkhead on the applicant's property. Prior to construction the property was seized by First South Bank in foreclosure. During this time First South Bank repaired a section of the bulkhead at the entrance to the basin. Bulkhead damage along the river was considered cost prohibitive and no protective measures were undertaken. Located along the landward side of the eroded section of bulkhead is approximately 500sf of non -coastal wetlands consisting of common reed (Phragmites) with a small amount of salt meadow hay (Spartine patens). Other vegetation found on the property includes, but is not limited to, a variety of grasses, loblolly pine (Pinus taeda), bald cypress (Taxodium distichum), sweetgum (Liquidambar styraciflua), greenbrier (Smilax rotundifolia), groundsel tree (Baccharis halimifolia), carolina jasmine (Gelsemium sempervirens), cat brier (Smilax rotundifolia), poison ivy (Toxicodendron radicans), and pennywort (Centella asiatica). The most excessive erosion is along only 420' of the applicant's shoreline facing the Pasquotank River. Normal water level (NWL) is a maximum of 32' landward of the remnant bulkhead along two sections of the eroding shoreline. Bulkheading along the remaining property(s), while old and showing signs of structural fatigue, have not failed. Located on the northern most point of the project site is a 1 00'wooden groin in need of repair. The structural elements, such as the pilings and walers, are solid, with no sheathing. Necessary repairs would require the installation of new vertical sheathing only. The waters of the Pasquotank River along the project site are classified as SB, which are primarily recreational and any use specified by the SC classification applies (including aquatic propagation, fishing, wildlife, secondary recreation and agriculture). Velasco, Sr. requests a CAMA Major Permit to construct a replacement bulkhead along 1,360' of shoreline along the Pasquotank River and a man-made basin. The proposed development will include the construction of a new replacement bulkhead a maximum of 34' waterward of NWL. Scalloped/eroded areas landward of the bulkhead along the Pasquotank River are up to 32' deep measured from the old remnant bulkhead. Shallow bottom fill resulting from the construction of a replacement bulkhead along 940' (2' waterward of NWL) will be—1,88Osf, the remaining fill will be along a —420' section of severely eroded shoreline. The average alignment along the 420' is 12.6' waterward of NWL with 5,32Osf shallow water bottom fill. The proposed bulkhead will require a return wall at each end or that it tie into the existing bulkhead. No work has been requested outside the applicant's property. The total amount of requested shallow water bottom fill is 7,2OOsf. This would equal an average alignment of 5.29' along the entire 1,360' of shoreline, and a maximum of 34' at the deepest eroded pockets. High ground disturbance associated with the construction of the replacement bulkhead will be limited to 30' landward of the existing bulkhead. The estimated amount of high ground fill/disturbance associated with the construction of the replacement bulkhead will be 42,127sf. In addition, the shallow bottom fill and the high ground disturbance, it is estimated that there will be approximately 5OOsf of non -coastal wetland fill. Total impacts: 49,827sf and 1.14 acres (.978 acres of land disturbance) The applicant would like to make repairs to the existing 1 00'wooden groin by installing wooden vertical sheathing. The subject property is located adjacent to the Coast Guard Base, located adjacent to the Pasquotank River in Elizabeth City, Pasquotank County, North Carolina. PROJECT DESCRIPTION: The subject properties are comprised of two lots (42 &43) located in the Pelican Pointe subdivision. This CAMA major application is being prepared for the replacement of 1,360 linear feet of a failing bulkhead and the repair of 100 linear feet of an existing groin. The project was previously permitted to Page Development, LLC on July 10, 2007 as Permit # 160-03 and expired on December 31, 2010. The permitted work was never started and property was foreclosed on until it was recently sold to Mr. Velasco. The existing bulkhead has failed in a few locations and approximately 660 square feet concrete rip -rap was placed along the shoreline to help stabilize some of these areas. The existing rip -rap will remain in place and backfill will cover it during the final grading. As a result of the failing bulkhead the shoreline eroded landward which will require 7,200 square feet (290 cubic yards) of backfill to be placed below the normal water level. During the erosion process a small area (-500 sf) of wetlands was created landward of the existing bulkhead and consists of a minor amount of salt meadow hay and common reed. The North Carolina Division of Coastal Management has determined that it is not Coastal Wetlands. There is no upland development or impervious surfaces proposed for this project. The construction and backfill of the proposed bulkhead will disturb 42,127 square feet of land on the two lots. Please show all riprap and the existing wooden groin (frame). c) Show adjacent land and clarify water bodies to the north as shown on the enclosed plan. d) Give distances to adjacent land along the basin opening and the mouth of the canal. e) Show existing water depths along the bulkhead and within the beaches. On site measurements indicated that the depth along the breaches exceeds three feet in some places, not 30". Please verify and show on the plan view drawing and cross section if needed. f) Show the landward limit of all high ground fill on the property and the limit of associated grading (Per DCM MP-1 FORM under f. — Land disturbance will equal 42,000sf). g) Clarify the area of fill below Normal Water Level.
