Columbia St., Wriahtsville Beach , as requested in the permittee's application dated 2/16/16 (MP-1 & MP-2), and Rev. 4/26/16 (MP4), incl. attchd workplan drawings (3), 1 dated Rcd DCM Wilm 5/9/16, 1 dated 4/25/16, and 1 dated 2/15/16. This permit, issued on June 23, 2016 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may ie subject to tines, imprisonment or civil action; or may cause the Dockine Facility to be null and void. 1) This permit authorizes only the reconstructed docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this reconstructed docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the reconstructed docking facility. Any sewage discharge at the reconstructed docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Signature of Perm ittee Jeff & Paige Sweyer/Hugh & Marion Bryan Permit No. 73-16 Page 2 of 3 ADDITIONAL, CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 4 formalized boat slips. 6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owners' riparian access corridors. 7) This permit does not authorize any tie piles on the south side of the dock associated with Slips 3 & 4. 8) The authorized structures and associated activity shall not cause an unacceptable interference with navigation, and shall not exceed the established Wrightsville Beach pier head line. 9) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 10) The authorized covered platform shall be single story, and shall not be designed to allow for second story use. 11) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Bulkhead 12) The alignment of the authorized bulkhead shall not exceed a distance of two feet waterward of the existing deteriorated bulkhead. 13) No backfill material shall be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 14) The temporary placement or double handling of fill materials within ¢¢ waters or vegetated w,�tland8-is noiJ authorized. _ 15) The bulkhead shall be constructed prior to any backfilling activities. w W 16) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the struct. 17) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. General 19) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 20) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2016-00550), which was issued on 3/28/16. NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR- 16-0299. NOTE: An application processing fee of $250 was received by DCM for this project. If a boat is docked at the end of the dock, under this scenario, a boat docked further in will have to cross my extended property line to dock at the proposed dock. Were my pier built to the northern set back line and a boat docked at the end - No boats would be able to get by. Surely, this scenario is not what you could possibly allow. The nature of a floating pier allows any number of boats on its length. There could be numerous small boats on this proposed 80' pier. There could be 1, 80' boat on this pier's south side. There is no limit to the width of these potential boats. It is however clear that each boat on the south side is 100% outside the riparian corridor of 20' as shown on the survey. The 80' proposed floating pier is much larger than any other floating piers that I can find in our neighborhood. It could end up being very nice but it could also dock a flotilla of sea doo's or ski boats. It is difficult to imagine a homeowner owning this many boats. Floating piers of this long length can only lead to chaos. 2) SAFETY IN STORMS AND HURRICANES The survey shows four (4) pilings supporting the 80' floating pier. May I just express my concern that if these pilings fail, the whole pier and any boats tied to it become a very potentially dangerous battering ram. 3) APPLICATION FOR MAJOR DEVELOPMENT PERMIT 4i, states that the proposed project is consistent with applicable zoning which is inconsistent with the narrative stating that both the current and proposed structures are non conforming. Any boats tied to the south side are therefore totally over the southern set back line and not at all within the Riparian corridor. If a boat is docked at the end of the dock, under this scenario, a boat docked further in will have to cross my extended property line to dock at the proposed dock. Were my pier built to the northern set back line and a boat docked at the end — No boats would be able to get by. Surely, this scenario is not what you could possibly allow. The nature of a floating pier allows any number of boats on its length. There could be numerous small boats on this proposed 80' pier. There could be 1, 80' boat on this pier's south side. There is no limit to the width of these potential boats. It is however clear that each boat on the south side is 100% outside the riparian corridor of 20' as shown on the survey. The 80' proposed floating pier is much larger than any other floating piers that I can find in our neighborhood. It could end up being very nice but it could also dock a flotilla of sea doo's or ski boats. It is difficult to imagine a homeowner owning this many boats. Floating piers of this long length can only lead to chaos. 2) SAFETY IN STORMS AND HURRICANES The survey shows four (4) pilings supporting the 80' floating pier. May I just express my concern that if these pilings fail, the whole pier and any boats tied to it become a very potentially dangerous battering ram. The applicant proposes to remove an existing non -conforming structure, replace an existing bulkhead and install a docking facility. The surrounding waters are classified as SB and are closed to shellfish harvest. Depths along the proposed floating dock range from 1ft 4 in to 9ft 6in at normal low water (NLW). The proposed facility consists of a 20ft x 20ft covered platform, an 80ft x 6ft floating dock that runs perpendicular to shore, and two boat lifts; totaling 6 slips. The landward side of the floating dock is located in 1ft 4 in at NLW. Given the length of the structure (80ft) and the depth, there is potential for the floating dock to rest on the bottom at low tide, which would cause direct impact to the soft bottom and has the potential to cause stress on the floating.dock when one end is resting on the bottom and the other end is afloat. In addition; one boat lift, located in slip 6, is In water less than 2ft at NLW. This lift has the potential to cause direct impact through prop kicking if the lift is used during inadequate water depths. Shallow soft bottom is an important foraging habitat for juvenile and adult fish and invertebrates, and aids in storing and cycling of sediment, nutrients, and toxins between the bottom and water column. Soft bottom habitat is used to some extent my most native coastal fish species in North Carolina. The habitat is particularly productive and, by providing refuge from predators, is an important nursery area. Species dependent on shallow soft bottom include clams, crabs, flounder, spot, Atlantic croaker, sea mullet, and rays. Many benthic predators are highly associated with the shallow soft bottom habitat, including flounders, weakfish, red drum, sturgeon and coastal sharks, although almost all fish will forage on microalgae, infauna, or epifauna on the soft bottom. Though the location can request dredging to alleviate these concerns, it is suggested that the applicant consider configuration alternatives. Alternatives to consider should allow the facility to be functional and reduce the potential to dredge because of the configuration. Suggestions include relocating the lift in slip 6 to slips 1 or 2, if a setback waiver can be obtained; to provide.better water depths throughout the tidal cycle, If this is not possible then locating the lift in water depths of at least 18 inches is Nothing Compares. It is suggested that the floating dock start in a minimum of 18 inches of water to provide adequate water depth to float the structure without contact with the bottom during average low tides. These suggestions should allow the facility to maintain functionality while reducing the need to dredge because of the configuration. The site is located within the Town of Wrightsville Beach, in New Hanover County. To locate the property travel east on Eastwood Road (N.C. HWY 74)/ Military Cut -Off Road for approximately 1 mile towards Wrightsville Beach. From the drawbridge, continue heading east on Causeway Drive (N.C. HWY 74) approximately 1 mile and proceed to cross the bridge over Banks Channel. Veer left at the light onto N. Lumina and continue to travel north approximately 0.10 miles to W. Columbia St. Turn left on to W. Columbia St. and drive approximately 0.10 miles until you reach the property of interest, which will be on the left hand side. The applicant currently maintains a two-story duplex family residence on the project site. The property is adjacent to a residential property with an existing single family structure and private docking facility to the south and adjacent to a town right of way and public parking lot to the north. Highground vegetation consists of ornamental landscaping. The lot is approximately 0.14 acres in size and has an average elevation of approximately 3' above normal high water (NHW). The project site has approximately 50 linear feet of shoreline frontage stabilized by an existing bulkhead, which is located at the NHW line. The applicant currently maintains an existing nonconforming docking facility within Banks Channel. An access pier, measuring approximately 60' in length by 5' in width, extends in a westerly direction from the existing bulkhead. The landward extent of the pier is encompassed by a partially covered, fixed platform, measuring approximately 30.5' in length by 16' in width. An access ramp leads from the pier on to a floating dock measuring approximately 33' in length by 6' in width which runs in the same alignment as the access pier. Two (2) floating finger piers, each measuring approximately 6' in width by 16' in length extend off the main floating dock parallel to the shoreline. The two (2) boatlifts, each measuring 13' in width by 13' in length are located on the eastern side of each floating finger pier. The existing docking facility encroaches into the 15' Adjacent Riparian Corridor Setback for the property to the north as well as for the property to the south. The existing docking facility exceeds its allowable square footage of 400 sq. feet according to the 8 sq. foot rule and allows for the docking of up to five (5) vessels within water depths ranging from approximately -5' to -8' at NLW. The Town of Wrightsville Beach Land Use Plan classifies adjacent waters and high ground area of project site as Conservation. There are no known archaeological sites located in the project vicinity. The waters of Banks Channel are classified SB by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to install a new bulkhead and replace an existing private docking facility within Banks Channel. The proposed new bulkhead would step out approximately 2' waterward of the existing bulkhead and tie into the adjacent bulkhead to the south, which is 2' waterward of the existing bulkhead. Once the existing docking facility is removed, the fixed platform would be reduced to dimensions measuring approximately 20' in length by 20' in width. The applicant is also proposing to construct a new floating platform to measure approximately 6' in width by 80' in length which would extend westward from the fixed platform and remain within the footprint of the original pier and floating platform. The two (2) new boatlifts each measuring approximately 13' in width by 13' in length would be installed on the north side of the proposed floating dock, one on the waterward end and one on the landward end, measuring approximately 45' apart. As proposed, there would be three (3) side to slips located on the southern side of the proposed floating dock. The application states that the existing water depth in the location of the proposed structure would range from approximately -1.5' to -9.5' at normal low water (NLW). The proposed docking facility would accommodate up to six (6) vessels. (see sheet 2 of 5) 10. ANTICIPATED IMPACTS: The proposed structures would incorporate approximately 1,218 sq. ft. of Estuarine Waters and Public Trust Areas currently usurped by the existing non -conforming structures. The proposed structure would not encroach into the either of the adjacent 15' Riparian Corridor Setback Areas. The proposed structures would extend approximately 112' into a waterbody, which measures approximately 1,000' across. This distance conforms to the 1/4 width rule and the locally established pier head line. Minor increases in turbidity should be expected during construction. CAMA Major Permit Application - AMENDMENT The subject field investigation report was circulated to your agency on March 3, 2016. According to information received by our office during the initial review, the applicant had requested authorization (under a CAMA major development permit application) to construct a new bulkhead approximately 2' waterward of the existing bulkhead, a floating platform measuring approximately 6' in width by 80' in length, a covered fixed platform measuring approximately 20' in width by 20' in length, and two (2) boatlifts measuring approximately 13' in width by 13' in length. The applicant has decided to modify the original proposal and is now proposing a floating platform measuring approximately 6' in width by 56' in length, an access pier measuring approximately 6' in width by 31' in length, a partially covered fixed platform measuring approximately 14' in width by 23' in length, a floating finger pier measuring approximately 6' in width by 12' in length, and the originally proposed boatlifts measuring approximately 13' in width by 13' in length. The most landward boatift would be located approximately 12' waterward of its proposed location in the original application. The applicant is not proposing to modify the location of most waterward boatlift or the bulkhead alignment/dimensions; proposed in the original application. The applicant's agent has submitted revised drawings showing the design layout with the proposed reconfiguration described above. The total square footage of structures not credited for access would measure approximately 394 sq. ft., which is still within the maximum allowable 400 sq. ft. for the property. The proposed modification would allow docking space for a total of 5 vessels, although the application states only 4. At this time, this office has no objection(s) to the proposed changes.
