This permit, issued on March 14, 2016 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may )e subject to tines, imprisonment or ctvu action; or may cause the permit to oe nuu ana vota. Docking Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2019 In issuing this permit, the State of North Carolina agrees that your project is .consistent with the North Carolina Coastal Management Program. Signature of Permittee Supply Group, Inc: Louie Lewis ADDITIONAL CONDITIONS Permit No. 36 16 Page 2 of 4 3) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 4) In accordance with commitment made by the permittee, and in order to satisfy concerns of the Division of Marine Fisheries, a piling shall be placed within each of the seven (7) boat slips as shown on the workplan drawings to prevent docking in shallow water adjacent to the bulkhead and to prevent disturbance of the shallow bottom substrate in this area. The pilings shall remain in place for the life of the docking facility. 5) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 7) This permit authorizes 7 formalized boat slips. 8) The authorized structures shall not encroach into the federal channel setback. 9) Should the adjacent property to the south be sold prior to the initiation of construction of the docking facility, the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15 foot riparian corridor. 10) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 11) The authorized structure and associated activity shall not cause an unacceptable interference with navigation. Bulkhead 12) The bulkhead shall be replaced within its existing footprint. 13) The bulkhead shall be constructed prior to any backfrlling activities. 14) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. i }, ruppily Group, Inc: Louie Lewis Permit No. 36-16 Page 3 of 4 j p ADDITIONAL CONDITIONS 15) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other {. suitable materials approved by department personnel. No excavation is permitted except for that which ' - may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. :16) All fill material shall be clean and free of any pollutants except in trace quantities. l7) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. ,�l 18). No backfill material is to be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 19) All fill material to be placed below normal water high level shall be confined behind the permitted bulkhead. '• 20) - No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. '22). 23) ;24) 25) Upland Develonment The wooden walkway located immediately landward of the bulkhead shall be limited to no more than 6' in width, and shall be slatted and elevated. Sedimentation and Erosion Control In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence). A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of bulkhead & wooden walkway construction. U.S. Army Corps of Engineers Conditions The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. Issuance of this permit should not be construed as relieving the permittee of taking proper steps to ensure the structure and moored boats will not be damaged by wave wash. 27)° ` The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work will, without expense to the United States and in such time and manner as the ` Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre- h.' project condition. g 28) 'In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements within. General 29) ;' The permittee and/or his or her contractor shall meet with a representative of the Division prior to r project initiation. NOTE:. This permit does not eliminate the need to obtain any additional state, federal or local permits, € approvals or authorizations that may be required. Division of Water Resources assigned the proposed project DWR Project No. DWR- 15-0968. Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. The property has approximately 140.65 feet of shoreline, with an existing timber bulkhead stabilizing the uplands. An existing fish house, with pier and docking facility, bulkhead, and parking areas are in place. The waters of the Lockwood Folly River adjacent to the project are classified as SA by the North Carolina Division of Water Quality. The project area is designated as Primary Nursery by the Division of Marine Fisheries. The applicant does not propose a modification or alternate use of the existing site building, but does wish to modify the pier/dock arrangement to be more suitable for docking vessels. The existing bulkhead is damaged and replacement within the current alignment and footprint is proposed as part of this project scope. The owner also proposes to remove approximately 112 feet of the existing pier on the southern side of the covered deck, add a floating dock system, and construct a walkway behind the bulkhead that will enable access to three finger piers. A portion of the existing pilings will be reused as tie pilings and floating dock support. No modifications are proposed to the existing fish house, covered deck, and wooden pier on the north and east sides of the covered deck. The existing number of boat slips for the facility is approximated at 4, based on the standard length of current intended use. The proposed number of slips to be available once proposed modifications are complete is 7, thus adding 3 additional slips. During the initial planning stages of this project, a Scoping Meeting was held in NCDENR's Wilmington Office. A roster of attendees was attached to the original project submittal for reference. Compass Pointe Engineering worked with the US Army Corps of Engineers to establish the navigation channel and setbacks depicted on plan sheets. The project is located at 68 Champion Drive SW, adjacent to the Lockwood Folly River in Vamumtown, Brunswick County. Areas of Environmental Concern (AFC's) impacted by the proposal are ES, PT and EW. Waters at the project site are classified as SA-HQW and are not open to the harvesting of shellfish. The area is a Primary Nursery Area. I have reviewed this proposal for consistency with the Vamumtown CAMA Workbook Plan and offer the following comments. The general area of the project is classified as Waterfront District and Conservation. In general, Vamumtown allows development within Conservation classified AECs, which is consistent with the State's minimum use standards. This project appears to be consistent with the Var umtown CAMA Workbook Plan. VEZ_ Recommendations for State Permit -Lewis The total area for the docking facility was calculated as follows: Shoreline length = 141 ft. x 8 sq. ft. = 1,128 sq. ft. allowable. Existing roof covered platform = 28 feet wide x 28 feet long = 784 square feet Existing fixed pier = 40 feet long by 6 feet wide = 240 square feet Proposed finger piers (3) = 2.75 feet x 12 feet = 99 square feet Proposed shore side docks = not calculated Total = 1,123 square feet It is the staffs recommendation that the proposal to replace the existing bulkhead, excavate a boat basin and reconfigure the existing docking facility to provide mooring for seven (7) vessels is CONSISTENT with the Rules of 15A NCAC 7H.0206 (d) Use Standards for Estuarine Waters, Rules of 15A NCAC 7H.0207 (d) Use Standards for Public Trust Areas and The Rules of 15A NCAC 07H.0600 Development Standards Applicable to all AECS.. It is staffs recommendation that the proposal to maintenance excavate a boat basin is CONSISTENT with the Rules of 15A NCAC 7H .0208 (b) (1) Specific Use Standards for Navigation channels, canals and boat basins. Specifically (1) states "Maintenance excavation in canals, channels and boat basins within primary nursery areas and areas of submerged aquatic vegetation as defined by the MFC shall be avoided. However, when essential to maintain a traditional and established use, maintenance excavation may be approved if the applicant meets all of the following criteria: (i) The applicant demonstrates and documents that a water -dependent need exists for the excavation; (ii) There exists a previously permitted channel that was constructed or maintained under permits issued bythe State or Federal government. If a natural channel was in use, or if a human -made channel was constructed before permitting was necessary, there shall be evidence that the channel was continuously used for a specific purpose; (iii) Excavated material can be removed and placed in a disposal area in accordance with Part (b)(1)(B) of this Rule without impacting adjacent nursery areas and submerged aquatic vegetation as defined by the MFC; and (iv) The original depth and width of a human -made or natural channel shall not be increased to allow a new or expanded use of the channel" Based on the permit record it appears that a boat basin was authorized adjacent to the fish house in 1985 (CAMA General Permit #D236), although the dimensions of the basin were not included in the record. The location of the ACOE federal channel is approximately 25-35 feet from the existing bulkhead. Therefore, it is highly likely that the previously authorized boat basin would have been located in close proximity to or within the footprint of the proposed boat basin and could be considered maintenance under the provisions of this Rule. If commenting resource agencies determine this proposed activity to be maintenance, it could then be found to be CONSISTENT with the Rules of 15A NCAC 7H .0208 (b) (1) (1) Specific Use Standards for Navigation channels, canals and boat basins. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 69 Champion Drive SW, adjacent the Lockwood Folly River in Varnamtown, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. I I3A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to replace the existing bulkhead, excavate a boat basin, and reconfigure the existing dock facility to provide mooring for seven vessels. Final project depth would be -3.4' at NLW. The Lockwood Folly River at this location is classified SA-HQW by the Environmental Management Commission is designated a primary nursery area (PNA) by the NC Division of Marine Fisheries. The NCWRC has reviewed the project proposal and has concern with the impacts to productive PNA resources from the increase of vessel mooring and proposed dredging. We support measures to minimize impacts to these resources as prescribed by the representative for the NC Division of Marine Fisheries. This prohibition applies to all borrow and fill activities connected with this project. 12. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. PROJECT SUMMARY: The applicant proposes to replace the existing bulkhead, excavate a boat basin and reconfigure the existing docking facility to provide mooring for seven (7) vessels. KV Louie Lewis — Supply Group, Inc. Page Two 9. PROJECT DESCRIPTION The applicant's project is located at 68 Champion Drive SW, adjacent to the Lockwood Folly River, in Varnamtown, Brunswick County. The project site can be accessed from NC Highway 17 South in Brunswick County at the intersection of Hwy 211. At the intersection, turn left and travel south approximately 0.30 miles to Stone Chimney Road. Turn right and proceed south on Stone Chimney for approximately 6.5 miles to Sabbath Home Road SW. Turn left onto Sabbath Home Road SW and proceed east approximately 1.3 miles to Varnamtown Road SW. Turn right onto Varnamtown Road SW and proceed east approximately 1.1 miles to the end of the road. The project site will be located at the end of Varnamtown Road SW, where it intersects with Champion Drive SW. The project site is approximately 0.71 acres in size and has operated as a commercial fish house. Man-made structures on the high ground of the site include a storage building, well sites, asphalt parking lot, and a fish house adjacent to the shoreline. The high ground of the project site is vegetated with native grasses and shrubs. The applicant states that the elevation of the site is approximately+8.5 feet above Mean Low Water (MLW). The project site has approximately 141 feet of shoreline frontage that has been stabilized with a wooden bulkhead. Water dependent structures on the site include a wooden bulkhead, a covered platform connected to the fish house and a fixed docking facility that provides mooring for four (4) vessels each measuring approximately 24 feet in length. The existing fixed pier is approximately 7 feet in width and 128 feet in length, is located approximately 26 feet water ward of the bulkhead and is oriented parallel to the bulkhead. The northern most section of the fixed pier appears to extend into the adjacent riparian area of the property to the north a distance of approximately 3 feet. A single piling is located approximately 10 feet north of the terminal end of the existing fixed pier and also appears to be located across the riparian line. The fixed pier is accessed from the fish house or from an access pier on the south side of the property measuring approximately 9 feet in width by 31 feet in length. Located on the north side of the property, connected to the existing fish house is a covered platform measuring approximately 28 feet in length by 28 feet in width. The covered platform is utilized in the fish house operations and provides and area for transfer, culling and sorting. The existing facility provides shore side mooring for four (4) vessels each measuring approximately 24 feet in length. However, historically this facility has serviced and provided mooring for vessels more than 40 feet in length. Aerial photos indicate that vessels were moored "side to the dock" and then moored parallel to one another extending outboard from the existing dock and into the federal channel. Mean High Water (MHW) meets the bulkhead and water depths range from -1.0 feet at MLW approximately 10 feet water ward of the bulkhead to -7.2 feet at MLW on the water ward side of the fixed pier within the federally maintained channel. The southern portion of the fixed pier is located within the ACOE federal channel setback of the Lockwood Folly River. The property is bordered to the north by a vacant lot, a residence and Champion Drive SW to the south, residential development to the west and the Lockwood Folly River to the east. CAMA Major Permit #63-84 was issued to Gary Ross Galloway on April 24, 1984 and authorized the construction of a commercial fish house with a covered work/loading area and a shore parallel docking facility. Information gathered from a DCM permit database search located a permit record for a CAMA General Permit #D236, issued to Gary Galloway on January 29, 1985, authorizing the maintenance ext>aSr Wn of a boat basin water ward of the existing bulkhead. However, the permit record does not include V 16 2015 dimensions of the boat basin. u4:0. Uk40 01N Louie Lewis- Supply Group, Inc. Page Three The waters of the Lockwood Folly River are classified as SA-HQW by the North Carolina Division of Water Resources. The waters are closed to the harvest of shellfish and are designated a Primary Nursery Area by the Division of Marine Fisheries. 10. PROPOSED PROJECT The applicant is proposing to excavate a boat basin, replace the existing bulkhead and reconfigure the existing docking facility to provide mooring for seven (7) vessels. The proposed bulkhead replacement would be constructed within the same alignment as the existing bulkhead and would measure approximately 141 feet in length. Existing water depths range from approximately -1.0 feet at MLW near the bulkhead, to -7.2 feet at MLW near the federal channel setback. The dimensions of the proposed boat basin excavation would be approximately 86 feet in length by 19 feet in width (see form DCM MP-2 and Sheet 4 of 5). As proposed, the boat basin excavation would maintain a minimum 5 feet buffer from the existing bulkhead. Excavation of the basin would be accomplished by using a mechanical excavator either stationed on the high ground or mounted on a barge. The proposed excavation would have a maximum box cut depth of -5 feet at MLW and a proposed final project depth of -3.4 feet at MLW is anticipated in the vicinity of the proposed boat slips. Excavated material would be dewatered and then trucked to an approved offsite upland location. The proposed spoil disposal area is located off Hwy 17 near Supply and is owned by the applicant (see Sheet 5 of 5). The proposed docking facility modifications would consist of the construction of a shore side pier, three (3) finger piers and a floating dock adjacent to the existing covered loading platform and fixed pier. The proposed shore side pier would connect to the existing bulkhead and would begin on the south side of the existing loading platform, measuring approximately 6 feet in width by 87 feet in length. Extending outboard of the shore side dock are three (3) proposed finger piers each measuring approximately 3.5 feet in width by 12 feet in length. The finger piers would be oriented perpendicular to the channel and would be spaced to provide mooring for six (6) vessels. The applicant is proposing a total of six (6) tie pilings a maximum of 18 feet water ward of the proposed finger piers. Each finger pier would have two (2) tie pilings water ward of the terminal end of the finger pier (see Sheet 4 of 5). The applicant is proposing a floating dock that would extend from the shore side dock toward the channel on the south side of the existing covered platform. The proposed floating dock would measure approximately 22 feet in length and 6 feet in width. As proposed, a portion of the existing fixed pier located on the water ward side of the covered platform would provide mooring for one (1) vessel. As proposed, the docking facility would provide docking space for seven (7) vessels (see sheet 4 of 5). The Lockwood Folly River in this location measures approximately 200 feet in width. 11. ANTICIPATED IMPACTS: The proposed boat basin excavation would result in the disturbance of approximately 1,634 square feet of shallow bottom. The proposed bulkhead replacement, within the existing alignment should not result in the filing of shallow bottom habitat. Approximately 141 feet of Estuarine Shoreline Area of Environmental Concern would be impacted as a result of the proposed bulkhead replacement. Approximately 85 cubic yards of spoils material would be excavated from below MLW. The final project depth would be -3.4 feet at MLW and would connect to the existing depths of the federal channel. The spoil disposal area would result in RECEIVED approximately 10,300 square feet of high ground fill at an approved offsite high ground location. The SEP 16 2015 excavation of the basin by mechanical means may create steep side slopes and subsequent sloughing, Louie Lewis- Supply Group, Inc. Page Four potentially increasing the top width dimensions of the proposed project. As proposed, the applicant would maintain a 5 foot buffer from the existing bulkhead to prevent disturbance to the area resulting from sloughing. The proposed docking facility would incorporate approximately 1,123 square feet of Estuarine and Public Trust Waters Areas of Environmental Concern (AEC). As proposed, a portion of the shore side pier and southernmost finger pier would be located within the 15 foot adjacent riparian corridor setback of the property to the south. The applicant has submitted a signed and initialed adjacent riparian property owner waiver form from the property owner to the south, Kenneth B. Hewett. The applicant is proposing to remove a portion of the existing fixed pier located within the adjacent riparian property owner's corridor to the north. No new development is proposed within the 15 foot adjacent riparian corridor setback of the property to the north, however, a portion of the existing pier will remain inside the setback (see Sheet 3 of 5). The Lockwood Folly River in this location measures approximately 200 feet in width and as proposed the docking facility modifications would not exceed the Y. width limitation. The proposed docking facility modifications would extend a maximum of 38 feet water ward of the bulkhead. As proposed, all fixed structures would be located landward of the ACOE federal channel setback in this location. As proposed, the docking facility would provide mooring for seven (7) vessels. Short term increases in turbidity can be expected during dredging and construction activity. Submitted by: Holley Snider Date: September 11, 2015 Office: Wilmington RECEIVED SEP 16103 Lewis Dock Project Narrative: The Lewis Dock Project is located on a 0.71 acre tract at 68 Champion Drive, in Brunswick County, and adjacent to the Lockwood Folly River in Vamamtown. The property has approximately 140.65 feet of shoreline, with an existing timber bulkhead stabilizing the uplands. An existing fish house, with pier and docking facility, bulkhead, and parking areas are in place. The waters of the Lockwood Folly River adjacent to the project are classified as SA by the North Carolina Division of Water Quality. The project area is designated as Primary Nursery by the Division of Marine Fisheries. The applicant does not propose a modification or alternate use of the existing site building, but does wish to modify the pier/dock arrangement to be more suitable for docking vessels. The existing bulkhead is damaged and replacement within the current alignment and footprint is proposed as part of this project scope. Additionally, the applicant proposes to remove approximately 85 cubic yards of sediment from the waterward side of the bulkhead, with disposal of this material on an off -site uplands location. The owner also proposes to remove approximately 112 feet of the existing pier on the southern side of the covered deck and 6 feet of existing pier on the north side of this deck, add a floating dock system, and construct a walkway adjacent to the bulkhead that will enable access to three 12 foot finger piers. A portion of the existing pilings will be reused as tie pilings and floating dock support. No modifications are proposed to the existing fish house, covered deck, and wooden pier on the north and east sides of the covered deck. A mini -excavator is to be used for sediment removal, with the spoils dewatered during removal with a perforated bucket and as needed when placed in a lined truck bed, prior to removal from site. The existing bulkhead will be replaced in its current alignment. A small floating barge platform, with pile hammer, will be used to assist in pier/piling/bulkhead removal/repairs, as well as new construction. The barge will remain affixed to subject property dock when not in use. The mini -excavator will be stored on the property during construction activities. The existing number of boat slips for the facility is approximated at 4, based on the standard length of current intended use. The proposed number of slips to be available once proposed modifications are complete is 7, thus adding 3 additional slips. During the initial planning stages of this project, a Scoping Meeting was held in NCDENR's Wilmington Office. A roster of attendees is attached for reference.
