This permit, issued on February 11, 2016 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Observation Pier 1) ' This permit authorizes only the pier and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this observation pier without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2019 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Streamline Developers, LLC ADDITIONAL CONDITIONS Permit No. 23-16 Page 2 of 3 3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) This permit does not authorize any formalized boat slips. In order to ensure compliance with this condition handrails shall be placed around the perimeter of the authorized observation platform. 5) No portion of the pier and platform shall exceed one quarter of the width of the water body as depicted on the attached workplan drawings. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) Any portion of the permitted access pier and observation platform built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 8) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 9) To reduce direct impacts to oyster resources, the permittee shall, in consultation with DCM, relocate all oysters falling within the footprint of pilings to an area immediately adjacent to the project area. General 10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 11) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 12) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: -The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2016-00142). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 3883 and assigned the project DWR Project No. 20071367 V6. PROJECT SUMMARY: The proposal is for a pier and platform with no slips for lot 71 of the Mariners Point s/d. Because of the PNA classification, substrate composition and shallow water depths (< -1.3' nlw), the subdivision, major permit (167-07) was conditioned to require each lot to apply for a CAMA major permit if individual docks were requested. cs Field Investigation Report: Streamline Developers lots 71 Mariners Point Page 02 9. Narrative Description: The Streamline Developers project is located at 1821 Olde Farm Road off of Oglesby Rd which is part of the existing Mariners Point subdivision. Mariners Point was permitted through CAMA Major Permit # 167-07 for infrastructure,149 residential lots, and a docking facility. Oglesby Rd. is found by turning right off of N. 20a' St. in Morehead City in the area locally known as Crab Point. Dill Creek borders this site to the northeast. Lot 71 is a partially developed and .379 acres (16,513.06sf) in its entirety and average elevation of 3.1' above NHW. There is a 125' x 200' expanse of coastal wetlands present along the shore adjacent to Dill Creek. This section of coastal wetlands contains Smooth Coordgrass (Spartina alterniflora). The water depths in Dill Creek are shallow but, according to the applicant, reach —1.5' NLW within the channel portion and -1.3' at NLW at the waterward end of the proposed structure. Previous and recent field work confirms the soundings. The substrate in this area is thick organic mud. There are scattered oysters within the vicinity and there was no SAV observed. This section of Dill Creek is a Primary Nursery Area as designated by the Division of Marine Fisheries and the Division of Water Quality classifies it as SA/HQW waters. The area in which the proposed project would take place is closed to the taking of shellfish. The shoreline length is 125' with the water body width at 29' as measured from the edge of marsh to the edge of marsh. Morehead City's Land Use Plan dated 2007 classifies this area as Low Density Residential and Conservation within the AECs. 10. Proiect Description: The applicants are proposing a 6' x 238.64' (8' of this over high ground) residential pier and a 13' x 30.75 L- head platform with no slips. The pier access would cross high ground for 8', and a span of coastal wetlands for another 230.64' before it would intersect the proposed L-head platform. The pier would be elevated to a minimum height of 3' above marsh substrate over coastal wetlands. The platform would be located with 6' over coastal wetlands and 7' over open water. The water depths in the open water area north of the platform are-1.3'at NLW and therefore no slips are proposed due to the sensitive nature of the water classification (PNA). The platform would be located 3' to 5' (depending on location) landward of the edge of the existing channel. Due to the narrow water body width (29'), the platform would not exceed a distance of 7' and would meet the maximum allowable 1/4 distance of 7.25'. The water body width of Dill Creek in this location of the project is approximately 29'. The pier and platform would be positioned approximately 75' from the western riparian access line and the platform would be located a distance of approximately 25' from the eastern riparian access line. Riparian Access Lines were determined through previous permits, aerial photography and are drawn relative to the channel location. All water depths and coastal wetland expanses, have been field verified. ` Field Investigation Report: Streamline Developers Lot 71 Mariners Point s/d Page 03 11. Anticipated Impacts: The proposed pier would incorporate 48 ftz of high ground while shading and incorporating 1,383.84ftz of the coastal wetlands. A total of 215.25 ffz of open water would be shaded and incorporated by the proposed L-head platform. There would be temporary turbidity during piling placement. Due to marsh breaks with the wetland areas, there is a potential to hinder access by smaller vessels ie. Kayaks, canoes to this area, if the height of the proposed pier is lower than 5' above nhw or 7' above bottom substrate at the marsh break areas. The Division of Land Resources approved the Sedimentation and Erosion control plan (CARTE-2006-440) on 6/19/06 with the DWQ Stormwater permit #SW8060625 issued on 7/12/06 for the existing subdivision. The allowable'/4 width for a 29' wide water body is 7.25' from the edge of marsh. The proposal meets this limitation therefore the structure should not cause a hindrance to navigation due to the limited platform width of a maximum of 7' from the edge of marsh and no formalized docking slips being proposed. The proposed work is consistent with 15A NCAC 7H.0208 therefore the Morehead City District Office recommends the project be authorized as proposed on plats dated received December 7, 2015, contingent upon all applicable general conditions and the following standard conditions: • No slips are authorized. • Due to the narrow waterbody width (29') as measured from the edge of the marsh to the edge of marsh, the pier and platform shall not hinder navigation and shall not exceed a maximum of 7' waterward from the north marsh edge at the time of constructuion. • No more than 6' of the platform shall be over coastal wetlands. • All portions of the pier and platform which are over coastal wetlands shall be a minimum height of 3' above marsh substrate. • Staff would recommend a minimum height of 5' above nhw or 7' above bottom substrate any of the marsh breaks within the coastal wetlands to not impede or obstruct small vessel use. NOTE: The location of the marsh break is approximately 65' to 75' landward (south) of the edge of marsh along the south side of the existing 29' wide waterbody or approximately 130' waterward (north) of the property along the NHW contour. The height for the pier access within the marsh break area should be measured from NHW to the bottom of the joist or stringers. Date: January 19, 2016 Consistency Determination: The request is consistent with/not in conflict with the Town of Morehead City Land Use Plan certified by the CRC on September 28, 2007. Overview: The subject property is partially developed and .379 acre lot (16,513.06 ft2) with approximately 125' feet of shoreline along Dill Creek. There is a 125' x 200' section of Coastal Wetland; containing Smooth Cordgrass (Spartina alterniflora). The property is located within the X and AE Flood Zones. Existing site improvements consist of a residence, roads, and infrastructure. There are no existing shoreline improvements. The waters of Dill Creek are classified as SA/HQW. This area of Dill Creek is designated as a Primary Nursery Area and is close to the taking of shellfish. There are scattered oysters in the area; no Submerged Aquatic Vegetation (SAV) habitat was observed. A review of historic and archaeological resources was not provided. Anticipated impacts resulting from this project are expected to include: the pier would incorporate 48 ft2 of high ground, and shade and incorporate of 1,383.84 ft2 of coastal wetland; the L-head platform would shade and incorporate 215.25 ft2 of open water. Basis for Determination: The Town of Morehead City Future Land Use Map (FLUM) designates the site as "Low Density Residential". The applicant proposes to construct a 6' x 239' pier that will terminate in a 13' x 30.75' L-head with no slips. The project located in Dill Creek, a small tidal creek, will span coastal wetlands, soft mud bottom, and oyster bars. The waters are classified as PNA (Primary Nursery Area) by the DMF (Division of Marine Fisheries); a PNA habitat is an area that has been deemed critical to the larval and juvenile life -stages of fish and shellfish. On 10/14/15 DCM staff made a site visit for other similar projects adjacent to the proposed pier and platform in Dill creek; that visit revealed an extensive oyster resource throughout the waterbody as well as an abundance of shrimp and finfish. The edge of the marsh, mudflat, and oysters are dry at low.tide and drop off rapidly to approximately 1' to 2' at the channel edge. Even though nb boat slip is proposed the proximity to the channel and the availability of water at high tide temporary docking could occur and was observed on a similar pier and platform near the proposed project. Due to the limited depths and the sensitive habitat and resources present in the project area it is recommended that a railing be added to the platform to discourage docking of vessels that could smother or potentially prop -kick the bottom. This modification would alleviate concerns about possible negative impacts of potential vessel use. Additionally, during project construction care should be taken to minimize disturbance to the oyster resource present by leaving oyster beds in place and not smothering oysters with equipment or sediment. However where impacts are unavoidable due to piling placement or the need to get equipment to the project site the oysters should be moved to an area of open bottom adjacent to the project area. Staff review of the plans and specifications on January 28, 2016 Iias determined that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000, the stormwater rules. By copy of this letter, we are informing you that this project will not require a stormwater management permit. Ifthe subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. All temporary built -upon area associated with the construction of the project must be removed within 30 days of completion of the project, or when it is no longer needed, whichever occurs first.
