'Authorizing development in Chowan County adjacent to Chowan River, end of SR 1220,
125 Dye Plant Road as requested in the permittee's letter dated 9/23/16, including the
attached workman drawing dated revised 9/22/16.
This permit, issued on October 28, 2016 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) Unless specifically altered herein, this Minor Modification authorizes the use of mechanical dredging
within 200' of the normal water line, and modifications of the spoil disposal method and area, all as
expressly and specifically set forth in the attached letter and workplan drawings. Any additional
development activities may require a modification of this permit.
'2) This Minor Modification shall be attached to the original Permit No. 11-16, which was issued on
1/28/16, and copies of both documents must be readily available on site when Division personnel
inspect the project for compliance.

Phis permit action may be annealed by the oermittee or other Siened by the authoritv of the Secretary of DEO and the
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any, maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2019

Stevens Towing Company has requested a Minor Modification to Major Permit #11-
16, which was issued on January 28, 2016, and expires on December 31, 2019.
Development authorized by the original major permit includes the hydraulic dredging
of 378,350sf (8.68 acres) of water bottom to a depth of -12', the placement of 9 barge
tie pilings along an existing 837' pier, the construction of 300' of bulkhead adjacent
to a 40' x 300' concrete shore side dock, a large 80' x 205' concrete ramp to remove
barges to a single bay with a rollback roof system for cleaning and repairing barges,
and the construction of an 8.6-acre dredge spoil pond at an upland site on the property
—700' from normal water level. Additional development on the property includes the
resurfacing of existing concreted areas adjacent to the river and the construction of a
new office on the north side of the property —470' landward of normal water level.
2. Stevens Towing Company has requested to modify Major Permit #11-16, to change
the approved method of dredging from hydraulic to mechanical beginning at normal
water level out to a distance of 200' using an excavator with a clamshell bucket.
Where possible the bottom will be dredged from land with direct placement of dredge

spoil into a truck for transport to an onsite spoil retention area. Where needed the
excavator will be placed on a barge, and spoil will be transported to the shoreline by
barge. Approximately 31,000 cubic yards of spoil will be removed mechanically out
of the total estimated spoil of 98,000 cubic yards. The modification will also include
a modification to the approved spoil retention area located -700' landward of normal
water level. The new configuration will use three retention ponds instead of a single
retention pond.
3. I conducted a site visit on September 27, 2016, to review the Minor Modification
request pursuant to the provisions of reference (a) and have determined that the
request meets the requirements contained in 15A NCAC 07H .0208 USE
STANDARDS.
4. The required fee of $100, paid by check # 3962, was received by the Elizabeth City
District Office on September 26, 2016. A copy of this monetary transaction is
attached for your records.
5. It is recommended that the Minor Modification request be granted, provided all the
Permit Conditions of the original permit issued on January 28, 2016, remain in effect.

The purpose of this correspondence is to request a CAMA Minor Modification to the existing
CAMA Major Permit 11-16 to include the following:
Item 1-
A change in methodology of the permitted dredging for the 200 ft closest to shoreline. Instead
of hydraulic dredging for the area closest to shore, that area is now proposed to be excavated
mechanically by an excavator from land and mounted on barge. No new dredge area will be
added. This total proposed mechanical dredge area is 94,000 sq.ft. and constitutes 31,000 cu
yds. of material of the total proposed 98,000 cu yds. Material from the clamshell excavator
bucket will be transferred directly onto a hopper barge or dump truck. The use of a hopper
barge will be required for areas that are not immediately adjacent to shore. In these areas, the
hopper barge will be floated to shore for immediate off-loading. Material will be loaded onto
dump trucks that will transfer the material into what we have labeled on the plan as Spoil Basin
#3. Use of a clamshell bucket minimizes the amount of bottom disturbance, and when the
bucket is fully loaded, the amount of water transferred to the barge is minimal.
Item 2-
A reconfiguration of the dredge spoil retention areas. This has been done to place to the spoil
retention areas in the flattest portions of the property away from the River to minimize grading
efforts and to reduce amount of digging to create containment berms. This includes three
separate containment basins. As mentioned above, Basin #3 is intended to be used for the
mechanically dredged material, but this area could also be utilized for hydraulic dredging when
mechanical dredging is complete (if necessary).

I also meant to follow up on the minor mod to CAMA 11-16 (SAW-2015-02613) issued to Steven's Towing. They are
requesting to modify from hydraulic to mechanical dredging from NWL out 200' using am excavator with clamshell
bucket with direct placement onto a truck for on -site spoil disposal when possible, and placement on a barge with
transport to land when necessary. Approximately 31,000 cy of the estimated 98,000 cy will be removed mechanically.

The enclosed permit constitutes authorization under the Coastal Area Management. Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -
colored form) is retained by you and it must be available on site when the project is inspected for compliance.

the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS

2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified
party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must
be carried out in accordance with your application. Modifications, time extensions, and future maintenance
requires additional approval. Please read your permit carefully prior to starting work and review all project
plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that
he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact
Department personnel at any time for assistance. By working in accordance with the permit, you will be
helping to protect our vitally important coastal resources.
