This permit, issued on June 16, 2017 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

1) Unless specifically altered herein, this Minor Modification authorizes the ramp modification, barge
maintenance area reconfiguration, bulkhead/wing wall extension, rip rap extensions and new gangways
(2), all as expressly and specifically set forth in the attached letter and workplan drawing. Any
additional development activities may require a modification of this permit.
2) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
(See attached sheet for additional conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2019
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
An Erosion and Sedimentation Control Plan may be required for this project. Contact the
Department of Energy, Mineral, and Land Resources, Land Quality Section at 943 Washington
Square Mall, Washington, NC 27889 prior to the commencement of any such activity for this
determination.
This Minor Modification shall be attached to. the original Permit No. 11-16, which was issued on
1/28/16, as well as all subsequent renewals, refinements, and modifications, and copies of all documents
must be readily available on site when Division personnel inspect the project for compliance.
All conditions and stipulations of the active permit remain in force unless specifically altered herein.
A minor modification application processing fee of $100 was received by DCM for this project.

02613.

Minor Modification to Major Permit
Stevens Towing has requested a Minor Modification to Major Permit #11-16 which was issued on October
28, 2016, and expires on December 31, 2019. The original permit authorized,the development of a barge
mooring and maintenance facility that included the dredging of 8.69 acres of water bottom, 300' of steel
sheet pile bulkhead, a 40' x 300' concrete loading dock landward of normal water level, a gravel drive
accessing the loading dock, a 60' x 205' barge ramp, 30' x 60' of riprap at the south end of the ramp, and
nine steel monopile tie pilings adjacent to an existing 800' pier to tie off barges.
2. Stevens Towing would like to make the following modifications to CAMA Major Permit #11-16:
a. Ramp modification to include the removal of all work waterward of the approved bulkhead alignment,
widening the ramp from 66OL49 80' to 116', and extending the bulkhead an additional 40' to
accommodate the modified ramp. The bulkhead along the W 116' section of ramp would be
constructed 12' below normal water level to allow access by barges onto the ramp where they will
be pulled in the maintenance bay. This will include moving the maintenance bay landward.
b. Reconfigure barge maintenance area and vehicular access to the loading dock resulting an increase
of 3,719square feet of impervious cover, or 27.6% impervious lot cover within the 75' AEC.
c. As noted in a. above the widening of the ramp width on the landward side will result in the extension
of bulkhead 40' south and a 30' retumlwing wall. The applicant proposes placing riprap on the south

side of the bulkhead and extending riprap from the north end of the bulkhead —80' to an existing
derelict pump house.
d. The final aspect of the modification includes the construction of two 4' x 8' gangways to access
barges from the existing pier.
3. 1 conducted a site visit with the applicant on April 11, 2017, and have determined that the request meets the
requirements contained in 15A NCAC 07H .0208 USE STANDARDS.
4. The required fee of $100, was received by the Elizabeth City District Office on April 28, 2017, Check No.
4254.
5. It is recommended that the Minor Modification request be granted, provided all the Permit Conditions of the
original permit remain in effect.
6. A copy of the Minor Modification Request and work plan drawing(s) are enclosed.

The purpose of this correspondence is to request a CAMA Minor Modification to the existing
CAMA Major Permit 11-16 to include the following:
Item 1- Ramp Modification
Based on consultation with other barge ramp facility managers, owners and operators, Stevens
Towing has learned that the ramp does not have to extend 200 + ft out into the River and it is
actually a better scenario to start the ramp at or near NWL. The CAMA plan attached shows
this in plan view and updated cross-section. In this currently proposed scenario, the ramp
would shorten, widen and the slope would increase. The ramp would widen from 80 ft to 116 ft
and would shorten from 555 ft (total slope per permitted plan) to 304 ft. This would alleviate
having a coffer dam and dewatering scenario in the River. Instead, a coffer dam across the
NWL shoreline can be left in place during ramp construction. This simplifies construction and
would likely decrease potential adverse environmental impacts. The entire area in the already
permitted ramp location in the River was permitted to be dredged to -12 ft due to undercutting
needed for the permitted ramp alignment. With this current proposal, this will still be excavated
to -12 ft, but no engineered ramp fill will be placed in the River. Some of the dredging took
place in the 2016-2017 dredge season, but was not completed. As previously permitted and
shown on the current plan, there would be two guide piles in the River to assist with barge
maneuvering.
Currently, the barge maintenance area is proposed to be on a flat surface instead of on the
slope of the ramp as previously permitted with the longer ramp. This plan continues to include
an infiltration basin to collect wash down water, but it is now proposed further landward. We
believe this is an environmentally preferred situation and it is certainly better logistically to be
working from a flat surface. In addition, there is a need to provide a better access to the
waterfront working platform which is shown on the plan. Since this plan proposes additional
coverage, there is more demolition/removal of existing coverage around the site. The idea is to
remain well under a net site impervious coverage increase of 10,000 sq.ft. This plan requests a
net increase of 3,719 sq.ft. The total % site impervious cover would be 22.8%.. T�ot�all iimmmpe�rvfiogS

would be 27.6%9. These figures are provided in the notes section of the current plan.

Item 3- Shoreline Stabilization
A. Bulkhead: Proposed new bulkhead south of the ramp along NWL 40 ft with the 30 ft wing
wall. The permitted plan included rip rap in this location, but the bulkhead will assist with
barge ramp activities.
B. South Side Rip Rap: Rip Rap Protection along NWL to the south of the bulkhead
described in A above, extending 90 ft along the shoreline.
C. North Side Rip Rap: Rip Rap protection from the north side of the working platform to the
existing pump house (80 ft). The permitted plan failed to request and permit shoreline
stabilization in this area.
Item 4- Ganaways for Baroe Access
In order for personnel to access barges 2 and 3 from the existing pier, we are proposing two 4 ft
wide gangways as shown on the plan.

On June 7, 2017, the Washington Regional Office of the Division of Energy, Mineral, and Land
Resources received a stormwater redevelopment exclusion modification request for a proposed
project, located.at 125 Dye Plant Road, on the Chowan River in Chowan County. Staff review of
the plans and supporting documents has determined that the project proposes activities that are
excluded from State Stormwater permitting requirements as set forth in Section 2.(d)(3) of
Session Law 2008-211, effective October 1, 2008, and the stormwater rules under Title 15A
NCAC 2H .1000, as amended.
Therefore, the Division of Energy, Mineral, and Land Resources is hereby providing
confirmation that the subject project is excluded from State Stormwater permitting requirements
under the following conditions: 1) The project must be constructed as shown on the plans
submitted to this Office; 2) The project, proposes no net increase in impervious coverage, and
3) The proposed stormwater control, provides equal or better protection of surface waters then
the existing stormwater control.
Under Section .1003(b) of the stormwater rules, the entire common plan of development must
be permitted. Therefore, any future development or changes to the proposed development,
including but not limited to, the locations of the built -upon area and construction of additional
built -upon area, may require approval or a Stormwater Management permit application and
permit issuance from the Division of Energy, Mineral, and Land Resources prior to any
construction. Any construction on the site prior to receipt of the required approval or permit will
constitute a violation of Title 15A NCAC 2H.1000 and Session Law2008-211, and may result in
the initiation of appropriate enforcement action.
Please keep in mind that this determination does not affect your legal obligation to obtain other
permits and approvals, which may be required by Federal, State, or local government agencies,

On January 20, 2016, the Washington Regional Office of the Division of Energy, Mineral, and Land
Resources received a stormwater redevelopment exclusion request for a proposed project located
at 125 Dye Plant Road, on the Chowan River in Chowan County. Staff review of the plans and
supporting documents determined that the project as proposed would be excluded from State
Stormwater permitting requirements as set forth in Section 2.(d)(3) of Session Law 2008-211,
effective October 1, 2008, and the stormwater rules under Title 15A NCAC 2H .1000, as amended.
However, under Section .1003(b) of the stormwater rules, the entire common plan of development
must be permitted. Therefore, any future development or changes to the proposed development,
including but not limited to, the locations of the built -upon area and construction of additional
built -upon area, may require approval or a Stormwater Management permit application and permit
issuance from the Division of Energy, Mineral, and Land Resources prior to any construction.
On May 31, 2017, the Washington Regional Office received notification from the Division of Coastal
Management that a request to change the original plans as permitted had been received by their
office. The requirements to exclude projects from State Stormwater permitting must meet the
following conditions: 1) The project must be constructed as shown on the plans submitted to this
Office; 2) The project, proposes no net increase in impervious coverage, and 3) The proposed
stormwater control, provides equal or better protection of surface waters than the existing
stormwater control.
Please submit to this office a revised set of plans so that a determination may be made by this office
if the redevelopment exclusion is still valid. Please include in the plans any impervious built upon
area to be removed or that has already been removed (roads, water treatment structures, etc.). The
complete set of plans will be evaluated for its compliance with the redevelopment exclusion
requirements. If you have any questions, or need additional information concerning this matter,

The enclosed permit constitutes authorization under the Coastal Area Management Act, and
where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The
original (buff -colored form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may
contact Department personnel at any time for assistance. By working in accordance with the permit, you
will be helping to protect our vitally important coastal resources.

Our office has reviewed your request for a second extension to the dredge moratorium at Stevens
Towing Company on the Chowan River, in Chowan County. The request to extend the dredge
moratorium was for an additional three weeks to attain an — 80% overall completion of the dredge
portion of the project authorized by CAMA Major Permit #11-16.
In consultation with the NC Wildlife Resources Commission, NC Coastal Management's Fisheries
Resource Specialist, the US Army Corp of Engineers, and NOAA Fisheries we are unable to grant
the requested three-week dredge extension. Due to favorable environmental conditions Fisheries
Biologists are already documenting significant Anadromous fish movement in the Chowan River.
All work must cease on February 28, 2017, as stated in the initial extension granted in February
13, 2017.
