Authorizing development in Chowan County adjacent to Chowan River, end of SR 1220,
at 125 Dye Plant Rd. as requested in the permittee's letter dated 2/9/18, including the
attached w6rkolan drawing (1). Sheet 1 of 1 dated "Revised 3/6/18".
This permit, issued on April 5, 2018 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to tines, imprisonment or civil action; or may cause the permit to be null and void.
1) Unless specifically altered herein, this Minor Modification authorizes the boat lift, finger pier, and
bulkhead addition, all as expressly and specifically set forth in the attached letter and workplan
drawing. Any additional development activities may require a modification of this permit.
Shoreline Stabilization — Bulkhead Addition
2) The bulkhead alignment shall not exceed the alignment of the toe of rip rap, as authorized in the
Minor Modification issued 6/16/17.
(See attached sheets for additional conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2019
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a
representative of the Division of Coastal. Management within a maximum of 30 days prior to the start of
construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse
weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within
a maximum -of 30 days prior to the new expected start of construction.
4) In consultation with the resource agencies, the bulkhead addition as depicted in attached workplans
dated "Revised 3/6/18" may be constructed within the in -water work moratorium previously conditioned
in the active permit dated 1/28/16. All other authorized development restricted to work outside this
moratorium remains in force unless prior approval of the Division of Coastal 'Management, in
consultation with appropriate agencies, has been granted.
5) The bulkhead shall be constructed prior to any backfilling activities.
6) The bulkhead shall be structurally tight so as to prevent seepage of baekfill materials through the
structure.
7) The fill material shall be clean and free of any pollutants except in trace quantities.
8) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
9) - A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
grading, on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
Barge Landing Facility
10) This modification authorizes a maximum of 1 formalized boat slip. All other docking structures are
associated with the mooring of commercial barges and the barge maintenance facility.
General
11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
initiation of the development activities authorized by this Minor Modification.
12) This Minor Modification shall be attached to the original Permit No. 11-16, which was issued on
1/28/16, and all subsequent modifications and refinements, and copies of all documents must be readily
available on site when Division personnel inspect the project for compliance.
13) All conditions and stipulations of the active permit remain in force unless specifically altered herein.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and
where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The
original (buff -colored form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may
contact Department personnel at any time for assistance. By working in accordance with the permit, you
will be helping to protect our vitally important coastal resources.

The purpose of this correspondence is to request a CAMA Minor Modification to the existing
CAMA Major Permit 11-16 to include the following:
Item 1: A single boat lift near the end of the existing pier. This is proposed to be a 13 ft x 13 ft
lift for a small work boat lift to be located immediately to the east of the existing platform. The
lift/slip will be accessed by a 24 ft x 3 ft wood catwalk dock that will extend off of the existing
platform.
Item 2: A new section (50') of bulkheading along the shoreline near the pier. There is a section
near the existing pier that we have permitted shoreline stabilization rip rap protection Oust to the
north of the main bulkhead and wingwall that is already built). As the contractor has completed
near shore mechanical dredging in this area, it has become evident that a section of additional
bulkhead would be more appropriate since there is a relatively steep dredge slope and loose
sands. This new bulkhead would be a low wall (2-3 ft lower than the existing main wall) and we
would want to reserve that ability to keep rock behind the low wall as already permitted. This is
shown on the plan.
Both of these items are colored in red on the five copies of the plan enclosed, dated 1/26/2018.
Letters have been sent to the adjacent riparian owners (see attached copies) and we have
included the required $100 processing fee check. Once we receive the green card receipts (or
any letters) from the adjacent riparian owners, I will forward those to you.

I had previously thought that our SW exemption letters from DEMLR covered that 401 cert condition since I was not
familiar with NCG190000. Please let me know if this is sufficient for you to recommend authorization of the CAMA
minor modification for bulk -heading and a boat lift at the end of the existing pier.

Would Condition #2. of the permit prevent Simon from being able to install the 50' of bulkhead at this time. The need is
rather urgent. There was a failure in the high bank, and he is concerned that a big storm could cause a catastrophic
failure.

Stevens Towing was issued CAMA Major Permit #11-16 on October 28, 2016, and expires on December
31, 2019. The original permit authorized the development of a barge mooring and maintenance facility that
included the dredging of 8.69 acres of water bottom, the construction of 300' of steel sheet pile bulkheading,
a 40' x 300' concrete loading dock, a gravel drive accessing the loading dock, a 205' x 80' barge ramp, 60'
x 30' of riprap at the south end of the ramp, and nine steel monopile tie pilings adjacent to an existing 800'
pier to tie off barges.
2. The permit received a Minor Modified on June 16, 2017, that included widening the ramp from 80' to 116',
extending the bulkhead an additional 40' to accommodate the modified ramp, the construction of the ramp
bulkhead 12' below normal water level to allow access by barges onto the ramp where they will be pulled
into the maintenance bay, relocation of the maintenance bay further landward, the reconfigure of the barge
maintenance area and vehicular access to the loading dock, the extension of bulkheading 40' in a southerly
direction with a 30' return/wing wall and riprap, the placement of —80' of riprap from the north end of the
bulkhead to an existing derelict pump house, and the construction of two 4' x 8' gangways to access barges
from the existing pier.

3. The current request to modify the permit includes:

a. The addition of a 13' x 13' boat lift for a small work boat to be located near the waterward end of the
existing pier on the east side of an existing platform, and accessed by a proposed 24' x 3' "catwalk"
dock extending from the platform.
b. A 50' section of bulkhead to extend from the north end of the existing bulkhead alignment. The
alignment was approved in the June modification to receive riprap along 80' of shoreline, and extend
to a derelict pumphouse. The request to install a bulkhead is the result of a collapse along -50' of
the shoreline escarpment. The placement of riprap in this area would not be stable. The bulkhead
will be lower than the adjacent bulkhead with a return wall. The remaining shoreline would be
riprapped as previously approved as original approved.
4. 1 conducted a site visit with the applicant on March 5, 2018, and have determined that the request meets
the requirements contained in 15A NCAC 07H .0208 USE STANDARDS.
5. The required fee of $100, was received by the Elizabeth City District Office on March 5, 2018, from Quible
& Associates, P. A., Check No. 4723.
6. It is recommended that the Minor Modification request be granted, provided all Permit Conditions of the
original permit and subsequent modification remain in effect.
A copy of the Minor Modification Request is attached, as well as a work plan drawing showing the proposed
changes dated 03/06/18 and a work plan drawing dated 06/16/17 showing modifications landward of the 75'
AEC authorized by DEMLR's Land Quality Section. Landward changes included the relocation of a large
storage tank, concrete and the construction of a large berm between the barge facility and adjacent
residential properties.
