This permit, issued on March 29, 2022 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein, this Minor Modification authorizes the additional 12 tie pilings, 42 linear feet of bulkhead and rip rap located adjacent to the existing pump house and steel groin, all as expressly and specifically set forth in the attached letter and workplan drawings. Any additional development activities may require a modification of this permit. (See attached sheet for additional conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Stevens Towing ADDITIONAL CONDITIONS General Permit No. 11-16 Page 2 of 2 2) All debris associated with the removal or construction of the permitted docking facility shall be contained within the authorized project area and removed to an appropriate upland location. 3) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 4) This Minor Modification shall be attached to the original Permit No. 11-16, which was issued to the permittee on 1/28/16, as well as all subsequent modifications, refinements, and renewals, and copies of all documents must be readily available on site when Division personnel inspect the project for compliance. 5) All conditions and stipulations of the active permit remain in force unless specifically altered herein. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers assigned the project Action ID SAW-2015-02613. NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 2015-1280. These are the items we reviewed in the field and subsequently discussed through emails. Item 1 (shown in red on the plan) Addition of twelve (12) new guide piles. Eleven (11) of the additional guide piles are in the same alignment/row as the existing ones along the northern side of the barge berthing area. The intent with these new guide piles is to further protect the existing pier while barges are maneuvering into place. The last guide pile would be along the south side of the existing ramp. This will be helpful for launching and retrieval of barges, especially when there are strong currents. Item 2 (shown in red on the plan) Addition of a 42 LF bulkhead between the two existing jetties and tying into land on the south side of the existing pump house. Item 3 (shown in red on the plan) Addition of rip rap protection around the pump house that would tie into existing rip rap on either side, and rip rap protection around the southern existing steel jetty. Ouible & Associates, P.C. has requested a Minor Modification to Major Permit #11-16, which was issued on January 28, 2016 and expires on December 31, 2023. The original major permit authorized construction of a barge ramp, excavation, bulkhead installation and riprap, office buildings, and large tie pilings. 2. Ouible & Associates, P.C. has requested to modify Major Permit #11-16 to allow for 12 new tie pilings to use as guides, an additional 42 feet of bulkheading and rip -rap around the pump house and existing steel groin. I conducted a site visit on November 10, 2021 to review the Minor Modification request pursuant to the provisions of reference (a) and have determined that the request meets the requirements contained in 15A NCAC 07H .0208 USE STANDARDS. Specifically, the request to add additional bulkhead 07H.0208(b)(7) and groins 07H.0205(b)(9). 4. The required fee of $100, paid by Check #6947, was received by the Elizabeth City District Office on January 28 2022. 5. It is recommended that the Minor Modification request be granted, provided all the Permit Conditions of the original permit issued on January 28, 2016 remain in effect. 6. Notifications and signed green cards have been received.
