Docldng )Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee. is responsible. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Signature of Permittee Carl Spears, Jr. ADDITIONAL CONDITIONS Permit No. 97-16 Page 2 of 4 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee.is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through: regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 2 formalized boat slips with boat lifts, 6) In order to satisfy concerns of the resource agencies, physical stops shall be placed on the boat lifts at a minimum height of 18" above the bottom substrate to prevent the lifts from disturbing the bottom substrate. The physical stops and lifts shall remain in place for the life of the docking facility. 7) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owners' riparian access corridors. 8) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 9) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 10) The authorized covered platform shall be single story, and shall not be designed to allow for second story use. 11) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 12) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the en� xis (60of the permitted structure. Bulkhead SEp ®� 2016 13) The bulkhead shall be constructed in the same alignment as depicted on tb6 4*Rlan%drawing. 14) The alignment of the authorized bulkhead shall be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. Carl Spears, Jr. Permit No. 97-16 Page 3 of 4 ADDITIONAL. CONDITIONS . 15) The bulkhead shall be constructed prior to any backfilling activities. 16). The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 17) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation is permitted except for that which may be required for the construction of the bulkhead wall, deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment. 18) The fill material shall be clean and free of any pollutants except.in trace quantities. Metal products, organic materials, or unsightly debris shall not be used. 19) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. Erosion & Sedimentation Control 20) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 21) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). At a minimum, a silt fence shall be propeily installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. 22) A ground cover sufficient to restrain erosion shall be provided within 30 calen Aay�q ti n of any phase of grading on cut or filled slopes. General SEP 0 Zt116 o 23) The permittee r tocffyuttee and/or his or her contractor shall meet with a representative of azgi project initiation. 24) Prior to the initiation of any development authorized by this permit, the purchase agreement submitted with the application package shall be finalized, and a copy of a new deed showing ownership by the permittee shall be submitted to the Division. 25) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 26) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 27) No excavated or fill material shall be placed at any time in any vegetated wetlands or surrounding waters outside of the alignment of the fill area indicated on the workplan drawing(s). Carl Spears, Jr. Permit No. 97-16 Page 4 of 4 ADDITIONAL CONDITIONS 28) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The'permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers is authorizing the proposed project by way of General Permit 197800056 and Nationwide Permit 18 (Action ID No. SAW-2015-01682). NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR- 2016-0661. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. The applicant is proposing to install a culvert and bulkhead, raise the elevation of the property by placing fill material throughout the site and install a docking facility. The property is located at 285 Grandview Drive, adjacent to the AIWW, in Sneads Ferry, Onslow County. Areas of Environmental Concern (AEC's) impacted by the proposal are EW, ES, CW and PTA. Waters at the project site are classified as SA and are open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the Onslow County Comprehensive Land Use Plan and offer the following comments. The general area of the project is classified as Developed/Conservation/Resource Protection. In general, Onslow County allows development in Conservation classified AECs which is consistent with the State's minimum use standards. The Onslow County Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these more restrictive policies appear to be applicable to this project. This project appears to be consistent with the Onslow County Land Use Plan Update. Cc: File Recommendations for State Permit — Carl The applicant's proposal to fill Coastal Wetlands is INCONSISTENT with the Rules of 15 NCAC 071-1.0205 (d) Use Standards for Coastal Wetlands and the Rules of 15 NCAC 71-1.0208 (b)(7)(B) Use Standards for Public Trust Areas. It is the staff s position that the proposal to fill Coastal Wetlands is INCONSISTENT with the Rules of 15 NCAC 71-1.0205 (d) Use Standards for Coastal Wetlands which states "suitable land uses shall be those consistent with the management objective in this Rule. Highest priority of use shall be allocated to the conservation of existing coastal wetlands. Second priority of coastal wetland use shall be given to those types of development activities that require water access and cannot function elsewhere." The applicant's proposal to fill approximately 439 square feet of Coastal Wetlands does not conform to this standard. The Coastal Wetland fill is not necessary to establish a bulkhead/headwall along the property boundary. It is the staffs position that the proposal to fill Coastal Wetlands is INCONSISTENT with the Rules of 15 NCAC 7H.0208 (b)(7)(B) Use Standards for Bulkheads, which states: "Bulkheads shall be constructed landward of Coastal Wetlands in order to avoid significant adverse impacts to the resources; " Based on these factors, it is recommended that a permit be DENIED which would otherwise authorize the fill of Coastal Wetlands for construction of a bulkhead/headwall. The proposed docking facility would provide docking space for a total of two (2) vessels. The proposed facility would extend approximately 8 P into the waterbody, which measures approximately 420' across, which is CONSISTENT with NCAC 07H .0208 (bx6)(G). The application also appears to be CONSISTENT with the remaining use standards set forth in NCAC 07H .0208(b)(6), including those which dictate the maximum allowable platform area (the 8 square foot rule), the 15' riparian setback and federal channel setback. It appears the project would not impact any visible beds of SAV, and would therefore be CONSISTENT with NCAC 071-1.0208(b)(1). The total area of the existing and proposed structures was calculated as follows: Shoreline length = +/-75 ft. x 8 sq. ft = 600 sq. ft. allowable. Proposed: Proposed finger piers = 5' x 29' =145 sq. ft. & 4' x 28' =112 sq. ft. Proposed platform =12' x 28' = 336 sq. ft. Proposed 13' x 28' boatlift (not included) Total proposed = 593 sq. ft. Any permit issued should include all applicable pier/dock and/or bulkhead conditions. REGAIN Secretary TRACY DAVIS Director On October 14, 2016, the Wilmington Regional Office of the Division of Energy, Mineral, and Land Resources received a copy of the CAMA Major Permit Application for the subject project. Staff review of the plans and specifications on October 19, 2016 has determined that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from Stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000, the stormwater rules. By copy of this letter, we are informing you that this project will not require a stormwater management permit. If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. All temporary built -upon area associated with the construction of the project must be removed within 30 days of completion of the project, or when it is no longer needed, whichever occurs first. VAN DER VAART Environmental Secretary Quality MEMORANDUM: TO: Heather Coats, DCM Assistant Major Permit Coordinator FROM: Gregg Bodnar, DCM Fisheries Resource Specialist SUBJECT: Carl Spears DATE: 7/25/2016 A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the subject permit application for proposed actions that impact fish and fish habitats. The applicant proposes to construct: bulkhead, culvert and docking facility. The surrounding waters are classified as primary nursery area (PNA), able to support shellfish (SA), and are open to shellfish harvest. Coastal wetlands and connected §404 wetlands are also present. There was some discrepancy in the PNA designation for this location. Information requested by the field rep to determine PNA status for the narrative did not indicate the location was designated PNA. Data used by staff does indicate a PNA designation. Inquiries are being made, and an updated'data does indicate the location. is designated PNA. PNAs are estuarine waters where initial post -larval development occurs. Species within this area are early post -larval to juvenile and include finfish, crabs, and shrimp. Species inhabit PNAs because they afford food, protection, and proper environmental conditionsduring vulnerable periods of their life history, thus protection of these areas are imperative. Coastal wetlands are considered among the most productive ecosystems in the world (NCDEQ 2015).' Coastal wetlands are a, productive detritus based system that trap nutrients, toxins and sediment, aid in shoreline erosion control,:dissipate wave and storm action, provides a barrier to flood damage, and provide nursery functions and support fish production. Recent research indicates that even narrow fringes of wetlands are essential factors for fish utilization and erosion control (Whaley and Minello 2002; MacRae and Cowan 2030; Minello et.al. 2011; Gewant and Bollens 2012). An estimated 95%'of commercial finfish and shellfish species in the US are wetland dependent (Feierabend and Zelany 1987). Species common to coastal wetlands include sheepshead; red. drum, flounder, spot, Atlantic croaker, menhaden, oysters and penaeid shrimp; with a myriad of prey species as well. Wetlands can enhance foraging functions of adjacent habitats,.which is why primary (PNA) and secondary (SNA) nursery habitats are closely linked.with coastal wetlands. In addition, these wetlands are important to waterfowl feeding and nesting activities.' A 20OLF bulkhead is proposed to traverse the property located above the normal high water line, with resulting fill.. Though the bulkhead would tie into existing bulkheads, the location would result in fill of. 439ft' of coastal wetlands and 1,408ft' of connected §404 wetlands: §404 wetlands physically connected to coastal wetlands provide the same ecological function for coastal fisheries resources. Without additional justification as to the need of the wetland fill, the combined 1,847ftz of wetland impact seems excessive and unnecessary. To reduce impacts to both wetland types, it is recommended that the bulkhead be moved landward to.a location that avoids wetland impacts. The applicant.proposes to construct a 24in x 132ft culvert within an existing' drainage ditch that runs the length of the. property frorn the road through the proposed bulkhead and 'into the coastal wetlands.. No information in provided to the justification for the need of this culvert over.the existing ditch. Replacing an existing vegetated ditch with culvert will remove the natural filtration provided by the vegetation and the open ditch; and allow untreated storm water to enter the PNA system at higher velocities than existing. This could result in.reduced water quality within the SA and PNA designations, and potentially cause loss of coastal wetlands and productive PNA bottom through concentrated runoff.'High ground storm water BMPs should be investigated to provide a better solution. Finally, the applicant proposes to construct a docking facility,.boatlift and tie pilings, resulting in 2 slips. .The waters within the boatlift footprint range from approximately 1ft to -8ft at normal low water (Mft . It is recommended that permanent stops be installed on the boatlift to reduce the potential for direct vessel impacts to PNA bottom: Depths within the tie piling footprint range from Oft to -8ft at NLW. The use of tie pilings indicates that the slip can be used for more permanent dockage than just loading and unloading. Formalized slips in shallow water can allow vessels to repeatedly contact the bottom, resulting in; aquatic:vegetation or shellfish bed loss, anoxia in the sediment which can kill benthic invertebrates and reduction of shallow bottom habitat and direct vessel impact during low tide. In addition, vessels moving to and from these shallow water docks can cause "prop kicking" or propeller disturbance impacts to the PNA. 1t is recommended that the tie pilings be removed to reduce the potential for a vessel to be docked for long periods of time over low tides with exposed PNA bottom. PROJECT DESCRIPTION: The project site is located at 285 Grandview Drive, adjacent to the AIW W, in Sneads Ferry, Onslow County. To get to the site from the Wilmington Regional Office, take US Hwy 17 N to Old Folkstone Road in Holly Ridge (approximately 30 miles) and turn right. Continue approximately 6 miles along Old Folkstone Road (crossing through at the intersection of Old Folkstone and NC Hwy 210) and turn right onto Chadwick Acres Road. Travel approximately 1.6 miles and turn right onto Carrol Street. Continue to the end of Carol Street and turn left onto Grandview Drive. The subject property will be located along the right hand side of the road directly across the street from 282 Grandview Drive. The lot is approximately 10,598 sq. ft. and unimproved. The high ground portion is elevated approximately 2-4 feet above Normal High Water (NHW). Vegetation on the tract consists of lawn grasses, shrubs, Coastal and "404" type wetlands. The applicant has approximately 75.8' linear feet of shoreline along the AIW W. The waters of Stump Sound, adjacent to the project site, are classified as SA by the North Carolina Division of Water Quality. They ARE NOT designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries, and they are OPEN to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to install a culvert and bulkhead, raise the elevation of the property by placing fill material throughout the site (a portion of which would be placed within Coastal and "404" type wetlands) and install a docking facility. According to the permit application package provided, the applicant is seeking authorization to develop the subject property for private residential use. In doing so, the applicant proposes to install a 24" diameter x 132' long HDPE culvert along the western property boundary, within the belly of an existing "ditch". The proposed culvert would originate along the property boundary bordering Grandview Drive and would extend south, through the proposed bulkhead or "headwall" as referred to in the application package. The applicant indicates that a portion of the "ditch" would need to be excavated for pipe/culvert installation. Specifically, a 1' deep x 3' wide x 116' long cut would be made for placement of the pipe/culvert. As stated in the application package, approximately 28 sq. ft. of Coastal Wetlands and 263 sq. ft. of "404" type wetlands would be impacted as a result of this phase of the project. Once graded and laid, the pipe/culvert would be covered with clean fill material. In succession with the culvert installation, the applicant proposes to install a bulkhead or "headwall", as it is referred to in the application package, along both the southern (shoreline side) and eastern side of the property. In total, approximately 200 linear feet of bulkhead would be installed, all of which would be located above the normal high water (NHW) line. As designed, the proposed headwall would tie into the existing bulkhead located along the western property boundary and would cut across the property's shoreline, which measures approximately 75 linear feet. Installation of the proposed headwall would result in the filling of approximately 439 sq. ft. of Coastal Wetlands (including but not limited to: Smooth Marsh Cordgrass, Glasswort, Sea Lavender and Black Needlerush) and roughly 1,408 sq. ft. of "404" type wetlands. Additional fill (approximately 10,598 sq. ft.) would be spread throughout the site to bring the elevation of the property to a vertical height consistent with the adjoining properties. As designed, the alignment of the proposed wall (that section along the shoreline) would follow an approximation of a line extrapolated between the outer edges of the two adjoining bulkheads. Aside from making a "connection" or straight bulkhead alignment in this area, the applicant has no justification for wetland impacts associated with construction of the proposed bulkhead/headwall. According to the site plan drawings, it appears a portion of the culvert, proposed fill and "headwall" would be located within the US Army Corp of Engineers "AIW W Northern Easement Line". hi addition to the proposed upland development and wetland impacts, the applicant is proposing to install a private docking facility consisting of a 6' x 48' access pier, 5' x 29' finger pier, 4' x 28' finger pier, 12' x 28' platform (partially covered) and a 13' x 28' boatlift. As shown on Sheet 3 of 3 of the applicable site plan drawings dated revised June 6, 2016, a 5' x 130' concrete walkway would be constructed in the center of the lot, and would extend from the edge of Grandview Drive, south to the 30' Coastal Shoreline buffer. At that location, the concrete walkway would terminate and a 5' x 30' wooden walkway would begin, extending to the edge of the proposed headwall. Waterward of the proposed bulkhead, the applicant intends to begin the construction of a 6' x 48' access pier. The pier would extend in a southerly direction and would terminate adjacent to the proposed 5' x 29' finger pier (referred to below as "spine"), which would be installed perpendicular to the proposed access pier. A 4' x 28' finger pier would be located along the eastern end of the spine, and would extend in a southerly direction, into the AIW W. Immediately west of the 4' x 28' finger pier, the applicant proposes to install a 13' x 28' boatlift. A 12' x 28' partially covered platform would abut the proposed boatlift along the western side. The far western alignment of the proposed pier/docking facility would be located just outside of the 15' riparian condor setback and the eastern side would be well outside of the 15' riparian corridor setback. Accordingly, no "waiver" notifications would be required for the proposed project. Water depths in the vicinity of the proposed docking facility range from -1.5' to -8.0', relative to normal low water. The proposed pier/docking facility would terminate just inshore of the US Army Corp of Engineers Federal channel setback, well within'/4 of the width of the waterbody and within the established pier -head alignment. No SAV was observed during either site visit conducted by DCM. 10. This project will consist of several phases for construction. The existing drainage ditch along the western property line will be cleaned and a stable subbase will be provided for the new drainage pipe. Drainage pipe will be installed and clean backfill will be placed over the drain pipe to secure it in place during construction of the new bulkhead around the southern and eastern property line. The existing topsoil will be removed and stockpiled onsite while fill dirt is brought in from an approved barrow site. Through the initial application package, the applicant was seeking authorization to fill an area of Coastal and "404" type wetland, as part of a residential development plan to include grading and filling, bulkhead installation and construction of a docking facility. In response to the proposed impacts to both Coastal and "404" type wetlands, as well as the potential impacts to waters designated as Primary Nursery Areas (PNA) resulting from the project, several resource agencies responded with unfavorable comments and/or concerns. As a result, the applicant modified his development plan by eliminating all of the Coastal Wetland impacts, as well as the majority of the "404" type impacts. The revised plan, dated 8/16/2016, and received by DCM on August 22, 2016, depicts a re -located bulkhead alignment which eliminates any fill within Coastal Wetlands and reduces the amount of "404" type fill by at least half of that originally proposed. According to the revised MP-2 Form, dated 7/25/16 and received by DCM on 7/25/16, approximately 691 sq. ft. of "404" type fill will be impacted as a result of the project, as opposed to 1,408 sq. ft., as initially requested. Although there were concerns raised about the potential for dockage at what was labeled on the site drawings as slip "2", due to the docking facility being located in a PNA, there is no omission of that slip in the revised package.
