Bulkhead
The authorized bulkhead shall adhere to the alignment depicted on the attached workplan drawings.
The alignment of the permitted bulkhead shall be staked by a representative of the Division of
Coastal Management within a maximum of 30 days prior to the start of any construction.
The bulkhead shall be constructed prior to any backfilling activities.
The temporary placement or double handling -of fill materials within waters or vegetated wetlands is
not authorized.

ADDITIONAL CONDITIONS
5) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
6) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation landward of the .authorized
alignment is permitted except for that which may be required for the construction of the bulkhead wall
and deadmen cables, etc.
7) All backfill material shall be clean and free of any pollutants except in trace quantities.
Sedimentation and Erosion Control
8) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
9) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
Docking Facility
10) Unless specifically altered herein, this permit authorizes the construction of the docks, piers, boatlifts,
boathouse and other structures and uses that are expressly and specifically set forth in the permit
application. No other structure, whether floating or stationary, shall become a permanent part of this
docking facility without permit modification. No non -water dependent uses of structures shall be
conducted on, in or over public trust waters without permit modification.
11) No sewage, whether treated of untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entireexistence of the permitted structure.
12) The piers and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access corridor.
13) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
14) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
15) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public

General
The pennittee understands and agrees that, if future operations by the United States requires the
;emovai, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free, navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
pemuttee and/or his contractor shall meet with a representative of the Division prior to project
ition in order to discuss the conditions set.forth in this permit.
This.permii shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 9.46.6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
The N.C. Division of Water Resources has authorized the proposed project under DWR Project
No.16-0749.
The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id. No. SAW-
2016-01505.

Dear Mr. Snider.
You have our approval for the impacts listed below for the purpose described in your application dated
July 05, 2016 and received by the Division of Water Resources (Division) on July 22, 2016. These impacts
are covered by the attached Water Quality General Certification Number 3900 and the conditions listed
below. This certification"is associated with the use of CAMA Major Permit and General Permit(s)
198000291 issued by the US Army Corps of Engineers (USACE). This Certification allows you to use the
CAMA Major Permit when the Division of Coastal Management Issues k. Please note that you should
get any other federal, state or local permits before proceeding with your project, including those required
by (but not limited to) Sediment and Erosion Control, Non -Discharge, and Water Supply Watershed
regulations.
This approval requires you to follow the conditions listed in the enclosed certification(s) or general
permit and the following additional conditions:

2. This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Certification. If
you change your project, you must notify the Division and you may be required to submit a
new application package with the appropriate fee. If the property is sold, the new owner
must be given a copy of this approval letter and General Certification and is responsible for
complying with all conditions. [15A NCAC 02B .0507(d)(2)]'
3. Water Quality Certification
The proposed project must comply with all the conditions of the General Water Quality
Certification(s) 3900. [15A NCAC 02B .0507(c)]
Continuine Compliance
4. All mechanized equipment operated near surface waters or wetlands will be regularly
inspected and maintained to prevent contamination of waters and wetlands from fuels,
lubricants, hydraulic fluids or other potential toxic chemicals. In the event .of a
hydrocarbon or chemical spill, the permitee/contractor shall Immediately contact the
Division of Water Quality, between the hours of 8 am to 5 pm at the Washington Regional
Office at 252.946.6481 and after hours and on weekends call (800) 858-0368.
Management of such spills shall comply with provisions of the North Carolina Oil Pollution
and Hazardous Substances Control Act. [15A NCAC 02H .0506 (b)(3) and (c)(3),15A NCAC
02B .0200 (3)(f), and GS 143 Article 21A]
S. Turbiditv Standard
The Permittee shall adhere specially to 15A NCAC 028.0222 Tidal Salt Water Quality for
Class SC Waters (3)(g) pH: shall be normal for waters in the area, which generally shall
range between 6.8 and 8.5 except that swamp waters may have a pH as low as 4.3 if it is
the result of natural conditions; (1) Turbidity: the turbidity in the receiving water shall not
exceed 25 NTU; if turbidity exceeds this level due to natural background conditions, the
existing turbidity level shall not be increased. [15A NCAC 02B .0222]
Other Conditions
6. ReOoenerClause
Mr. Ian Snider and any authorized agents shall conduct their activities .in a manner
consistent with State water quality standards (including any requirements resulting from
compliance with section 303(d) of the Clean Water Act) and any other appropriate
requirements of State law and federal law. Mr. Ian Snider shall require any contractors
(and/or agents) to comply with all of the terms of this Certification, and shall provide each
of their contractors (and/or agents) a copy of this Certification. A copy of this Certification
shall be included in the construction contract and available on the job site at all times. If
DWR determines that such standards or laws are not being met (including the failure to
sustain a designated or achieved use) or that State orfederal law is beingviolated, or that
further conditions are necessary to assure compliance, DWR may reevaluate and modify

this certification to include conditions appropriate to assure compliance with such
standards and requirements in accordance with i5A NCAC 21-1.0507(d). Before.modifying
the certification, DWR shall notify Mr. Ian Snider and the US Army Corps of Engineers,
provide public notice in accordance with 15A NCAC 2H.0503 and provide opportunity for
public hearing in accordance with 15A NCAC 21-1.0504. Any new or revised conditions shall
be provided to DWR in writing, shall be provided to the United States Army Corps of
Engineers for reference in any permit issued pursuant to Section 404 of the Clean Water
Act, and shall also become conditions of the 404 Permit for the project.
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, any subsequent modifications, the applicant is required to return
the attached certificate of completion to the 401 & Buffer Permitting Unit, NC Division of
Water Resources, 1617 Mail Service Center, Raleigh, NC 27699-1650. [15A NCAC 02H
.0507 (c)]
B. The applicant and/or authorized agent shall provide a completed Certificate of
Completion form to the Division within thirty (30) days of project completion (available
at htto://Portal.ncdenr.org/web/wo/swo/cos/401/certsarfdpermits/aoolv/forms). [15A
NCAC 02H .0506(b)(5)]

SUBJECT: Express Major Permit Request by Ian Snider Go Michael York to install 171
linear feet of bulkhead, a 16 foot by 24 foot boat house, four (4) 6 foot wide by
20 foot long finger piers, two (2) 10 foot by 10 foot boatli ts, and a jet -ski lift on
a canal that connects to the Roanoke Sound; on the property located at 111
Seabreeze Court, in the Town of Manteo.
Date: August 2, 2016
Consistency Determination: The request is consistent with/not in conflict with the Town of
Manteo 2007 Land Use Plan certified by the CRC on July 27,
2007, as amended through February 12, 2009.
Overview The subject property is a .23 acre vacant lot with approximately 171 linear feet of
shoreline along a canal that connects to the Roanoke Sound. The canal is approximately 110
feet wide at this location, with water depths ranging from 5 to 6 feet The site is elevated
approximately 7 feet above Normal Water Level (NWL) and is vegetated with lawn grasses. A
1 foot wide Coastal Wetland fringe totaling approximately 30 sq. ft. is located along the
shoreline. The property is located in the AE (EL 9) Floodzone.
Existing site improvements consist of a concrete driveway and pad and a concrete walkway
that transitions to a wooden walkway near the shoreline. Existing shoreline improvements
consist of riprap and a 6 foot wide docking facility with a boat lift. The docking facility extends
along the entire shoreline perimeter of the Peninsula subdivision. The Dare County GIS
indicates that canal bottom extending from the shoreline perimeter of the subdivision and
encompassing the docking facility, in addition to land area with connecting walkways and
roadways, is owned by Peninsula Owners Association, Inc.
Installation of 171 linear feet of bulkhead, a 16 foot by 24 foot boat house, four (4) 6 foot wide
by 20 foot long finger piers, two (2) 10 foot by 10 foot boatlifts, and a jet -ski lift is proposed.
The bulkhead will be located an average of 5 feet and a maximum of 10 feet waterward of
Normal High Water (NHW), landward of the docking facility and tie into existing bulkheads on
adjacent properties. The existing riprap will be covered with fill. The boathouse will be
located between two (2) of the finger piers. The jet -ski lift will be positioned over high ground.
All of the proposed docking improvements will originate from the common docking facility and
have been approved by the homeowners' association. A total of four (4) slips will be provided.

The waters of the canal and Roanoke Sound are classified as SC and are closed to shellfish
taking. The area is a Primary Nursery Area. A review of Submerged Aquatic Vegetation
(SAV) was not provided. A review of archaeological sites was not provided. .
Anticioated impacts resulting from this project are expected to include: the filling 971 sq. ft. of
Public Trust Area/Estuarine Waters. Areas of Environmental Concern (AECs) and 30 sq. ft. of
Coastal Wetlands AEC; the usurpation of 1,064 sq. ft. of Public -Trust Area/Estuadne Waters
AECs, and; the disturbance of 2,330 sq. ft. of high ground within the Estuarine Shoreline AEC.
Basis for Determination:
The project area is designated as "Single Family Residential" on the Town of Manteo Future
Land Use Map.
Definitions of key words are provided on page 94. These words include "Continue",
"Encourage", "Identify", "Implement", "Protect", "Enhance", "Maintain, "Should", and "Support".
The following LUP policies may be applicable to this request:

On July 22, 2016, the Washington Regional Office of the Division of Energy, Mineral, and Land Resources
received a copy of your CAMA Major application for proposed bulkhead, boathouse, 2 boatlifts and 4
piers project, located at 111 Seabreeze Court, Peninsula Subdivision, PUD, Manteo, Dare County, NC.
Staff review of the plans and specifications has determined that the project, as proposed, consists of
activities that will not pose surface water quality threats from stormwater runoff since no new
impervious area is proposed.
The Director has determined that projects that are reviewed and approved by the Division as not posing
water quality threats from stormwater runoff should not be subject to the stormwater management
permitting requirements of 15A NCAC 2H.1000. For this reason, we are informing you by way of this
letter that your project will not require a State stormwater management permit at this time.
The stormwater rules require the Division to permit the common plan of development, therefore, any
future development on the property, regardless of whether a SEC plan or CAMA Major permit is also
required, will require a stormwater Management Permit application and permit issuance from the
Division of. Energy, Mineral, and Land Resources prior to any construction. Any construction on the
subject site, prior to receipt of the required permit, will constitute a violation of 15A NCAC 2H.3000
and may result in appropriate enforcement actions by this office..
Please keep in mind that this determination does not affect your legal obligation to obtain other permits
and approvals, which may be required by Federal, State, or local government agencies, rule or law. If

Mr. Ian Snider and any authorized agents shall conduct their activities in a manner
consistent with State water quality standards (including any requirements resulting from
compliance with section 303(d) of the Clean Water Act) and any other appropriate

9. Narrative Description:
The subject property is located at 111 Seabreeze Court in the Town of Manteo, Dare County. The
project site is found by traveling from Washington towards the OuterBanks on US 64 East. Cross
the Virginia Dare Memorial Bridge and turn left on US 64 West. Travel approximately 100 yards
and turn right on Russell Twiford Road. Travel approximately .3 miles and turn right onto
Seabreeze Court.
The subject property is one vacant parcel totaling approximately .23 acres. The elevation of
the lot is approximately 7' above Normal Water Level (NWL). Highground vegetation on the
site consists of yard grass. There is a manmade canal that leads to the Roanoke Sound on the
northeastern side of the property to which the applicant is the riparian property owner with a
portion of the shoreline presently armored with riprap. The canal is approximately 110' wide
at this location and this parcel has approximately 171' of shoreline. Presently, the subdivision
has a walkway that runs parallel to the shoreline that was constructed by the Home Owners
Association. At this location, there is presently one boatlift. Also on the property is a driveway,
and 6' walkway. The walkway is constructed partially of concrete which then turns to wooden
slatted as it approaches the shoreline. Water depths in the existing canal range from -5' to -6'
NWL.
The Division of Water resources classifies the Roanoke Sound and this canal as SC waters.
This area is a Primary Nursery Area. This area is closed to the taking of shellfish. The
substrate composition at the project site is a sand bottom.
The applicant is proposing to construct a 4 slip docking facility, boathouse, 2 boatlifis and a
bulkhead.
10. Proiect Description:
The applicant is proposing to construct 171' of bulkhead. The bulkhead will be located an
average of 5' waterward of the Normal Water Level(NWL) with a maximum distance of 10'
waterward of NHW. This will fill approximately 970 ft2 open water and approximately 30 ft2
of fringe Black Needlerush Coastal Wetlands. The aforementioned riprap will be covered
with fill as part of this project. The proposed bulkhead will connect to bulkheads on both
adjacent properties. Highground disturbance resulting from installation of the bulkhead will
total approximately 2,330 ft2 resulting in a total disturbance of approximately 3,300 ft2 from
the bulkhead installation
The applicant is also proposing to construct a 4 slip docking facility with a boathouse, 4 finger
piers, 2 boatlifts and a jet -ski lift that will position the jet ski over hghground. All of the
proposed docking facility will originate from the existing walkway, of which the applicant has
obtained Home Owner Association approval. The finger piers will be 6'x20' and usurp a total
of 480 ft2 of Public Trust/Estuarine Waters. The 2 boatlifts will be approximately 10'x10' and
usurp a total of 200 ft2 of Public Trust/Estuarine Waters. The boathouse will be 16'x24' and
will be located between (2) of the proposed finger piers. This will usurp a total of 384 ft2 of
Public Trust/Estuarine Waters. Water depths at the location of the docking facility are -5 to -6
NWL.

11. Anticipated Impacts:
This proposed dock would result in 1,064 ft= of open water incorporated. The proposed
bulkhead would fill 30 ft2 of Black Needlerush Coastal Wetland, disturb 2,330 ft2 of
highground and fill 971 ft2 of open water. A minor increase in turbidity will occur while
setting pilings. There should be no hazard to navigation resulting from this project.

behalf of Ian. Snider for State approval for the construction of a bulkhead, (4) finger piers, (2) boatlifts
and a boathouse. The site is located at 111 Seabreeze Court, Town of Manteo, Dare County. It was
received as complete on July 14, 2016, and appears to be adequate for processing at this time. You
have requested that the application be processed under the Express Review Permitting Program.
Under. this expedited process, the projected deadline for making a decision will be August 12, 2016.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be
posted at. the property of your proposed development. You should post this notice at a conspicuous
point along your property where it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property;
or at apoint along the road right-of-way where a private road would lead one into your property. Failure
to post this notice could result in art incomplete application.

Good Morning Mr. Snider:
I have looked into the adjacent property boatlift and it appears that while the boat does extend into the riparian
corridor while sitting on the cradle, the structure itself does meet the 15' setback requirement.
Unfortunately, am unable to issue a permit to relocate the two finger piers into the adjacent riparian
corridors. 'Condition #12 of the CAMA Major Permit issue to you reinforces the setback requirement, necessitating a
permit modification or "refinement". To refine of modify the permit will have to get waivers from the adjacent property
owners.
I recommend that you contact Jonathan Howell, District Manager for the Washington Regional Office. As you area
aware Mr. Howell is the Express Permit Coordinator of this area and processed your original permit.
You may also choose not to construct only one of the finger piers, thereby removing the issue on one side
altogether. This would not require a permit modification/refinement.

The other point I was trying to. make was that the HOA covenants we sent you stated 4 (and every other homeowner)
had exclusive use of the canal and waterfront starting at each riparian property line and 20' out into the canal.
The neighbors I would need the waiver from live in Oklahoma and have been difficult to get a hold of. Their existing boat
lift and boat are already encroaching into the 15' setback on the south side of the riparian line, so I was wondering if the
HOA covenants referenced above superseded the 15' as stated in the declarations?

Mr. Reeder I would like to speak with you at your earliest convenience regarding the CAMA permitting process and my
experience to date with Frank Jennings and Kelly Russell at the Elizabeth City CAMA office.
I initially contacted Kelly on March 21" regarding the permitprocess of both a new home and bulkheadat the above
captioned location. She had an open slot in her schedule on March 23rd'and we met onsite at 11:00am that morning.
She was undecided an whether the bulkhead could be permitted as a Minor or Major permit due the sea level being
higher than normal that day (both the lots adjacent to mine are already bulkheaded), and stated she would return the
following week when to.re-inspect. Kelly also said she would send me the appropriate forms so I could start the process
once a decision was made on the permit type.
I called her office the following week only to find out Kelly was out that week. In Kelly's absence I spoke with Frank
Jennings to find out the status, and explained to him what Kelly had communicated to me about the permit process.
Frank and I exchanged phone numbers and he agreed to revisit the sitoto make a determination on the permittype that
week, and would get back with me with his findings.
I never heard back from either Kelly or Frank, (either by mail, phone, email, or text) with either a determination on the
permit type, or was I sent the appropriate forms to apply for permits.
I finally called Frank again today only to find out that Kelly said she couldn't contact me because my voicemail was full
apparently?
To date, I still do not have the forms (Frank said he would try to email them out this afternoon), and have only received
a verbal from*Frank that a major permit would be required to install a new bulkhead. Please understand the proposed
bulkhead lines up exactly with the existing adjacent bulkheads on either side of my lot, and there is an existing 6'
boardwalk beyond defining the location of the bulkhead, in a subdivision PUD that was permitted in 1998 with fill/spoil
and manmade canals. (I have attached a PDF of subdivision Plat)
I am being told a major permit is running a minimum of 4 weeks and could be longer.
What is frustrating is that it is 3.5 weeks later, and I am no further in the process of permitting. Additionally, the
construction of my new home will be out of sequence with the construction of the new bulkhead, and I will be incurring
additional mobilization costs from the marine contractor who was going to install the pilings for the new home and
bulkhead at the same time. '
Ultimately lam writing this email because this process is broken, and changes need to be made to better serve both the
public and protect the environment at the same time.
