Expanded Docking Facility This permit authorizes the construction of an expanded pier, finger piers, and tie pilings, and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this expanded docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. No sewage, whether treated or untreated, shall be discharged at any time from any boats using the expanded docking facility. Any sewage discharge at the expanded docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Signature of Permittee Mile Post, LLC Permit No.109-16 t� Page 2 of 3 "ADDITIONAL CONDITIONS This permit authorizes a maximum of nine (9) boat slips. At no time shall more than nine (9) vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. Railings shall be installed along the southern facing portion of the pier to discourage vessel dockage in areas where slips are not authorized. Docking outside of authorized slips may cause a shellfish closure. The construction and/or operation of the authorized facilities shall not directly result in any closure of any waters that are open to the taking of shellfish. Any such closure directly attributable to the expanded docking facility shall require that the permittee undertake remedial actions to remedy the situation. Such actions may include, but are not limited to, a removal of any unauthorized slips or mitigative measures to reduce or eliminate the cause(s) of the closure. The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structures in order to make it more visible during hours of darkness or inclement weather. No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. An application processing fee of $400 was received by DCM for this project. a Miller's Waterfront Restaurant Pier Expansion and Slips 6916 South Croatan Highway, Nags Head, NC CAMA Major- Project Narrative, updated 8/4/2016 Received (S Attu `d "GG DCM-EC Existina Conditions The site is a 1.73 Acres (71,222 sq. ft.) parcel of land located at 6916 South Croatan Highway Nags Head, Dare County, North Carolina. The property is owned by 16 Mile Post, LLC and is the location of Miller's Waterfront Restaurant. The parcel is located along the Roanoke Sound. The current use of the property is a waterfront restaurant open for lunch and dinner. The upland portion of the property is dominantly covered with maintained grasses and asphalt parking and driveways. The restaurant is located on the waterfront of the property with and existing pier and gazebo extending into the Roanoke Sound. The restaurant has received a minor permit for the restaurant upgrades in the recent past and the current owner believes that previous ownership obtained existing pier permits in the past.There is existing rip rap located along the shoreline of the property with a coastal marsh extending from the rip rap into the sound. Coastal wetlands onsite are dominated by Spartina alterniflora (Smooth Cordgrass) Juncus roemerianus (Black Needle Rush) and Scirpus pungens (Common Three -Square). Water depths and notes taken during an SAV Survey are included on the attached CAMA Site Plan. SAV Survey A Submerged Aquatic Vegetation (SAV) Survey was conducted on June 24, 2016. SAV was not found in the sandy substrate waters within the project area. This is likely the result of frequent shifting sands in response to prevailing south and southwest winds and high energy. The SAV survey was conducted during peak SAV season. Water depth contours are shown on the attached CAMA Site Plan. On July 14, 2016 we met with Mr. Shane Staples (fisheries representative of NCDCM) on -site to verify the conditions related to no SAV at the project area. No SAV or indications of rhizomes were identified. Our survey methodology was to perform transects in the vicinity of the project area. Along each transect, water depths; substrate types, and SAV sampling was performed. Sampling included diving, feeling and raking the bottom and below the top of the substrate to analyze for rhizomes. Proposed Work Currently proposed work requiring CAMA permitting includes construction of an addition to the existing pier. The proposed work includes a six (6) feet by one hundred and twelve (112) linear feet pier expansion. This includes a pier extension 96 feet further into the Roanoke Sound and a 16-foot pier extension around the existing gazebo. The new structure is proposed to wrap around the existing gazebo on the northerly side and then extend westerly into the sound. The expansion will dogleg northerly with the boat slips being on the platform. There are 9 new boat slips proposed with 4 finger piers; 8 boat slips will be located on the dog leg and the one remaining slip will be along the north side of the pier as a "side -to" slip. The slips include one 12 x 24' slip, four 13' x 26' slips, three 15' x 26', and one 18' x 40' slip. The four proposed finger piers are to be 3' x 12' and there will be 28 tie pilings. The proposed pier has been designed to reach suitable water depths for the slips proposed. Purpose and Need Miller's is an Outer Banks icon that has been in business since 1982. This pier expansion would help grow Miller's business by offering access to the restaurant from the sound for patrons who wish to come by boat. This will help create new access to the business and give a fresh new way for patrons to enjoy the sound and restaurant. To conserve and manage the important features of estuarine waters so as to safeguard and perpetuate their biological, social, aesthetic, economic values; to coordinate and establish a management system capable of conserving and utilizing estuarine waters so as to maximize their benefits to man and the estuarine and ocean system. (d) Use Standards. Suitable land/water uses shall be those consistent with the management objectives in this Rule. Highest priority of use shall be allocated to the conservation of estuarine waters and their vital components. To protect public rights for navigation and recreation and to conserve and manage the public trust areas so as to safeguard and perpetuate their biological, economic and aesthetic value. (d) Use Standards. Acceptable uses shall be those consistent with the management objectives in Paragraph (c) of this Rule. In the absence of overriding public benefit, any use which jeopardizes the capability of the waters to be used by the public for navigation or other public trust rights which the public may be found to have in this area shall not be allowed. The development of navigational channels or drainage ditches, the use of bulkheads to prevent erosion, and the building of piers, wharfs, or marinas are examples of uses that may be acceptable within public trust areas, provided that such uses shall not be detrimental to the public trust rights and the biological and physical functions of the estuary. Projects which would directly or indirectly block or impair existing navigation channels, increases shoreline erosion, deposit spoils below normal high water, cause adverse water circulation patterns, violate water quality standards, or cause degradation of shellfish waters are considered incompatible with the management policies of public trust areas. In every instance, the particular location, use, and design characteristics shall be in accord with the general use standards for coastal wetlands, estuarine waters, and public trust areas. Consistent: The proposed development of expanding the existing pier meets the intent of this rule. 07H.0208 Use Standards (a) addresses General Use Standards, and subparagraph (1) requires that uses which are not water dependent shall not be permitted in coastal wetlands, estuarine waters, and public trust areas. Restaurants, residences, apartments, motels, hotels, trailer parks, private roads, factories, and parking lots are examples of uses that are not water dependent. Uses that are water dependent include: utility crossings, wind energy facilities, docks, wharves, boat ramps, dredging, bridges and bridge approaches, revetments, bulkheads, culverts, groins, navigational aids, mooring pilings, navigational channels, access channels and drainage ditches. Consistent: The development proposal meets the intent of this rule. (a)(2)(A) requires that the location, design, and need for development, as well as the construction activities involved shall be consistent with the management objective of the Estuarine and Ocean System AEC (Rule .0203 of this subchapter) and shall be sited and designed to avoid significant adverse impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds, submerged aquatic vegetation as defined by the Marine Fisheries Commission, and REtEIVED and nursery areas. (a)(2)(C) requires that the development shall not cause irreversible damage to documented archaeological or historic resources as identified by the N.C. Department of Cultural resources. Consistent: There are no known archaeological or historic resources on the property. (a)(2)(D) requires that the development shall not increase siltation. Consistent: It does not appear that this development will measurably increase siltation. (a)(2)(E) requires that the development shall not create stagnant water bodies. Consistent: It does not appear that the development will create stagnant water bodies. (a)(2)(F) requires that the development shall be timed to avoid significant adverse impacts on life cycles of estuarine and ocean resources. Consistent: Development will have minimum adverse significant effects on life cycles or estuarine resources. (a)(2)(G) requires that the development shall not jeopardize the use of the waters for navigation or for other public trust rights in public trust areas including estuarine waters. Consistent: The development proposal minimal effects on navigation. (b) Specific Use Standards (6) Addresses Piers and Docking Facilities. (b)(6)(A) requires that piers shall not exceed six feet in width. Piers greater than six feet in width shall be permitted only if the greater width is necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Consistent: The development proposal meets the intent of this rule. (b)(6)(B) requires that the total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions shall not apply to marinas. Consistent: The development proposal meets the intent of this rule. They may be roofed but shall not be designed to allow second story use. Consistent: The development proposal meets the intent of this rule. (b)(6)(G) requires that pier and docking facility lengths shall be limited by: (i) not extending beyond the established pier or docking facility length along the same shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length unless necessary to avoid unreasonable interference with navigation or other uses of the waters by the public); (ii) not extending into the channel portion of the water body; and (iii) not extending more than one-fourth the width of a natural water body, or human -made canal or basin. Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier head line. The one-fourth length limitation shall not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall not be longer than the pier head line established by the adjacent piers or docking facilities, nor longer than one-third the width of the water body. Consistent: The development proposal meets the intent of this rule. (b)(6)(1) requires that piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the pier or docking facility and the adjacent property owner's areas of riparian access. The line of division of areas of riparian access shall be established by drawing a line along the channel or deep water in front of the properties, then drawing a line perpendicular to the line of the channel so that it intersects with the shore at the point the upland property line meets the water's edge. The management objective is to ensure that shoreline development is compatible with the dynamic nature of coastal shorelines as well as the values and the management objectives of the estuarine and ocean system. Other objectives are to conserve and manage the important natural features of the estuarine and ocean system so as to safeguard and perpetuate their biological, social, aesthetic, and economic values; to coordinate and establish a management system capable of conserving and utilizing these shorelines so as to maximize their benefits to the estuarine and ocean system and the people of North Carolina. (d) Use Standards. Acceptable uses shall be those consistent with the management objectives in Paragraph (c) of this Rule. These uses shall be limited to those types of development activities that will not be detrimental to the public trust rights and the biological and physical functions of the estuarine and ocean system. Every effort shall be made by the permit applicant to avoid, mitigate or reduce adverse impacts of development to estuarine and coastal systems through the planning and design of the development project. In every instance, the particular location, use, and design characteristics shall comply with the general use and specific use standards for North Carolina Department of Environmental Quality MEMORANDUM 4�3 Division of Coastal Management Page 5 of 5 September 16, 2016 coastal shorelines, and where applicable, the general use and specific use standards for coastal wetlands, estuarine waters, and public trust areas described in Rule .0208 of this Section. Consistent: The development proposal meets the intent of this rule. (d)(4) requires that the development shall not have a significant adverse impact on estuarine and ocean resources. Significant adverse impacts include development that would directly or indirectly impair water quality standards, increase shoreline erosion, alter coastal wetlands or Submerged Aquatic Vegetation (SAV), deposit spoils waterward of normal water level or normal high water, or cause degradation of shellfish beds. Date: October 20, 2016 Consistency Determination: The request is consistent with/not in conflict with the Town of Nags Head 2010 Land Use Plan certified by the CRC on February 24, 2011 as amended through December 12, 2013. Overview: The subject property consists of a 1.63 acre lot with approximately 146 linear feet of shoreline along the Roanoke Sound. The property has an elevation of approximately 5 feet above Normal Water Level (NWL). The site is vegetated with lawn grasses. A Coastal Wetland fringe is located along the shoreline. The property is located within the AE (EL10) floodzone to the southwest and AE (EL9) to the northeast. Existing site improvements consist of a single -story structure with elevated deck and associated parking and septic system. The structure houses a restaurant. Existing shoreline improvements consist of riprap and a 60 foot long pier with a 15 foot by 15 foot terminus gazebo. The pier extends from the elevated deck. Installation of a 6 foot wide by 197 foot long pier/dock, four (4) 3 foot wide by 12 foot long finger piers and twenty-eight (28) tie pilings is proposed. The pier will wrap around the north side of the existing gazebo and from there extend 90 feet waterward to a 6 foot wide by 69 foot long terminus pier/dock with extending finger piers and tie pilings. The pier/dock will accommodate eight (8) boat slips. One (1) additional slip will be located at the gazebo. The waters of the Roanoke Sound in this area are classified as SA and High Quality Waters (HQW) and are open to shellfish taking. There were no observed areas of Submerged Aquatic Vegetation (SAV) within the project area. A review of potential historic and/or archaeological resources was not provided. Staff review of the plans and specifications has determined that the project, as proposed, consists of activities that will not pose surface water quality threats from stormwater runoff since no new impervious area is proposed. The Director has determined that projects that are reviewed and approved by the Division as not posing water quality threats from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 211.1000. For this reason, we are informing you byway of this letter that your project will not require a State Stormwater management permit at this time.
